9th schedule - laws under which cannot be challenged in court. This schedule was added in 1st amendment, 1951. It includes (land reforms, abolition of zamindari system, and other laws ) to protect the laws included in it protected from judicial scrutiny on the ground of violation of fundamental rights. However in 2007, SC ruled that the law included in the schedule after April 24, 1973 (keswabhananda case) are now open to judicial review. Latest verdict- January 2017 - no blanket immunity, Judicial review is a basic structure so, cannot be taken away by putting a law under 9th schedule. Two test of any law passed by parliament- 1st: check for violation of FR i.e, Part 3. 2nd: if violate FR, whether the amount of violation goes to violation of basic structure or not. why India didn't have revolution even though there is lot of discrimination ? because the constitution itself is a revolution without any bloodshed. But in ground things didn't change in overnight. Hence , the parliament pass a number of acts including the SC/ST atrocities act. Instead of reduction, atrocities are more day by bay. That is why govt. want to bring the SC/ST act in 9th schedule. But will it reduce the atrocities is still doubtful. The consequence putting in 9th schedule may not change anything to the SC verdict and the law. The rise in the number of cases is not in proportion to the number of instances reported. And data shows lot of misuse of the act was happened. SC judgement is primarily based on the liberty of individual and try to balance between the protection and the abuse. ( both are in FR, art 13 and art 17). There is need to introduce safeguard for both FR. Speedy justice is the need of the hour.

The police station in my area registered a FIR( SC/st act) AFTER TAKINg Rs. 6000 .....And again demanding 5000 to take action on it ....We fullfil both the demand because of fear ......And still we are waiting for any action ......Law and order is really not working in my area .....The way I experienced ......Then we approach to the S. P. He is not doing anything ......This is the fact .... And if the situations is maintained like this by police station only then naxel comes in the picture of society .....And then government playing politics on it and put energy to kill these innocent people and feeling pride ......What the hell is going I can't able to understand ........ If this is the situation people may think about taking law and order in his hand....

Well Quoted. But efforts to citing this balance creates imbalance. According to me, we should take a broader view as to whether the law is successful. Many people still suffer the atrocities. We can talk on data when we achieve 100% reporting and we are free from witness/complainant intimidation.

I suspect any law can protect sc/st...somehow these discriminations keep happening and we don't find ourselves in that position where we can prove the atrocity forget about lodging a complaint. ..it can be in any form...what can be done by the Govt, other than making laws,is to invest in the human development and bring them in organised sector because most of the people belonging to this category are labourers, small landholders...if financial security is insured people will invest in education and as they become aware and empowered these discrimination will automatically erase....then there will be no necessity of some special provision like sc/st act....
Acquittal and withdrawal of the cases under the Act doesn't mean that the Act is being misused, according to the mentioned data, if we can reflect upon the nature of acquittal of these cases. If the case resulted in acquittal and withdrawal, it only shows that the justice is being denied and not the Act being misused.
There is a golden mean. The original law should be implemented in rural areas, Panchayats and tier 2 and 3 cities where the chances of misuse are almost nil. In tier 1 cities and metropolitans the modified law should be applied. The government should frame the new bill in this way instead of putting it in schedule IX.
TN reservation policy was framed before the keshavanda Bharti case and the case have prospective effect .since it has prospective effect it cannot be challenged it excercise blanket immunity..
Some sc/st people (anysenior professors or any experienced person ) should be present in discussion of sc/st act.. so that they can put some real examples and make discussion more live and ground level discussion will increase..
1. No one is going to change or challenge the Tamilnadu reservation of 69%. 2. There will be no 10% EWS Quota in Tamilnadu. 3. There will be never ever 3 language formula in Tamilnadu. 4. Tamilnadu demand rights as an equal partner doesn't want to be slave to a central Government ruled by any national party. 5. Any changes for above - We are very much ready to leave this Union. Just let us both co-exist peacefully as an Independent Country.
Obviously the JNU Professor is biased in this matter. I could have argued better than him against this Supreme Court judgement - Providing the option of anticipatory bail is fine as far as fundamental rights of the accused is concerned. But why do we need the prior approval of any authority to arrest an accused in a case like this? We have similar provision in Prevention of Corruption Act and we all have seen how often it is misused to protect corrupt officials, even though the provision originally intended to protect the honest ones. There is no doubt that this 'prior approval' thing will be misused to protect people who actually have committed the atrocity.
