Thanks, that was me! I remember since my seat was upgraded I was waiting for the dinner service, and about 30 seconds after I gave up and went to sleep, the pilot came over the intercom with the bad news. That being said, I think the girl next to me slept the entire time, and overall it wasn't too bad. When we got to Paris, our rental car had been given away since we were 3 hours late, but luckily my dad had the stick shift experience necessary to drive the other car they had available. Other than that, everything went well. I had a nice time with my family overseas and a pleasant flight back with no delays :)

Chillest controller ever. Should have patched them through to the cabin intercom, would have talked the unruly passenger out of whatever their problem was 😅🤙🏻
This reminds me of Brian Schul's comment about how every ATC controller tries to sound like a NASA Houston ground controller. Conversely, every pilot tries to sound like Chuck Yeager, or failing that, at least like John Wayne.

Any passenger who doesn't have a medical emergency and causes a plane to divert, should be charged with a criminal offense and have to pay restitution to each passenger for the cost of their ticket + the airline for the cost of wasted aviation fuel. EDIT: I realize there is room here for nuance, I'm just saying that the impact of one drunken a**hole can have extremely far-reaching consequences for hundreds of people; and they should not go without compensation for their extraordinary inconvenience(s).
It's not uncommon for airlines to toss a civil suit at passengers who force a turnaround/divert for the cost to the airline to comp the other passengers.
Until the last couple years, I'd have agreed with you wholeheartedly. But unfortunately I've seen a few scenarios where airline employees have pretty much baited passengers and instigated arguments with them through everything from nasty sarcasm to outright name-calling. Truly bizarre. Giving these employees the power to get people criminally charged would be an unmitigated disaster - this is better left to civil courts. Fortunately the flights I've been on in the present era have been smooth and the crews excellent, but some of the ways I've seen other people treated utterly shocked me. What we really need is an objective policy that governs the behavior of both airline passengers and how airline employees interact with them.

rickrudd, I'm not 100% sure about this, but I reckon you as a passenger on a flight that had to divert after I assaulted a crew member or another passenger are legally entitled to file a civil suit against me for the diversion. Inconvenience due to diversion causing you to miss a connecting flight, biz mtg., you name it.
Start billing them for the millions of dollars it cost to divert a flight, wear and tear on landing an over weight airplane, and x10 for just being assh*les. 😆 🤣 😂
Atlanta to Paris and they end up in federal custody at JFK. I guess they are taking the bus back to Atlanta, or swimming to France, because they aren't going to be flying anywhere.
Email says it's an A320, I thought that sounded a little crazy for ATL-CDG, then he says he was a "heavy", so I checked, and it is an A330. Going that far in a 320 would be rough, if even possible (fuel)

This seems to be happening a lot recently. Maybe one of the toilets should be convertible to a holding cell so someone can be detained without it affecting the flight.

I never lived in NYC, but as a kid I used to fly TWA a lot and she was the host of the in-flight entertainment pop channel. She had an amazing voice. This guy is just as good.
Does anyone else have issues with LiveATC? Im trying to listen to Wilkes-Barre/Scranton (KAVP) and Allentown (ABE) departure and tower from yesterday but the archive recordings are totally silent. If I pull PHL tho, it plays those recordings. Is it a smaller airport thing? Like I should be able to listen to what was said.

Since this was a dramatic re-route, how difficult will it be for the airline/flight crew to file a new flight plan from JFK to CDG since they are way off course from the original flight? Can someone shed some light on the logistics involved when an airline makes an unscheduled landing? Thanks.
Deltas dispatch would just file a new flight plan using dispatching software. Their old flight plan would be moot. But likely this plan was stuck cus they'd have to check it after an overweight landing
The pilots don't file flight plans, the company has a dispatch department that does all of that.(Dispatchers are also FAA certified and legally liable for safety of the flight planning just as pilots are liable for safety in the air.) Either the plane continues after a short delay or they put the passengers on a new plane and the aircraft is saved for another day. A new plane could be from Delta or a charter, or just buying tickets for passengers on other airlines, really depends on specific business details and contracts and the location of the fleet that day.
I think fines to cover all the missed connections, fuel wasted, extra personnel wages and 30 days in jail would make people think twice about being unruly on airlanes...

I've listened to bitching and moaning when workplaces made safety shoes, hard hats and other PTE compulsory. Same with smoking in public places (and on planes). They used to say the "N"-word on mainstream network television channels, but not "goddamn". It takes a while to change, but it generally takes. 👍
@@swrennie Looking at the fines levied by the FAA, $15000 was the top fine for an incident that did not involve interfering with or striking cabin crew. That was the bottom fine that involved physical contact with cabin crew or refusing to follow directions like taking a seat or wearing a mask. The FAA has the authority to levy $37000 per incident. My Dad worked with a technician (he was an elec engineer) who refused to stop at stoplights because he refused "to be ordered around by a robot". This was in the early 1960s.

Planes are rated to land at their maximum weight. But in practice landing at maximum weight puts added wear on airframes and landing gear plus a longer roll out.
Wait, did I get everything right? They have to divert due to an unruly passenger. When asked, they want CUSTOMS to meet the airplane. Right? So, does that passenger have to pay taxes or what exactly is the custom's duty? There are so many law enforcement agencies in the US, but I expected them to ask for either police, homeland security, SWAT, TSA or whatever. Customs was the least I expected.

The air marshal thing was brought up in a forum elsewhere. Unless the passenger is endangering the safety of the flight, it's too minor to blow their cover. The crew can usually restrain the passenger without much effort. Definitely agree that the punishment should be more severe though.
It appears that the recording begins part way through the conversation, some conversations aren't captured. The pilots will already have told an ATC about the unruly passenger and the diversion to JFK. The overweight bit refers to the plane itself: it's carrying enough fuel to get to its planned destination. If it lands early it's heavier than it should be, unless it flies around in circles to burn off fuel, or dumps some out in mid-air.

The unruly passenger will have a lawyer. So what you suggest is potentially gonna get very complicated.
Start putting these people on a permanent no-fly list that is actually shared amongst airlines.

It is an excellant idea. Otherwise airlines should have a "special" seat in the very last row that has arm and leg restraints. And sedatives.

There was a Delta flight that diverted from CDG to IAD (orginally destined to ATL) on Friday 1/28. I wonder what happened with that.

The “NW” at the end of the registration number means that aircraft is a leftover from Northwest Airlines.

I wouldn't call it way off course. The shortest route from ATL to CDG is almost directly over JFK. It all depends on weather and the intended route.

According to FlightRadar24 the aircraft, Airbus 330-300, spent 1 hr 26 mins on the ground at JFK before taking off again for CDG.

How do you overload the plane with 65,000lbs over fuel weight
Landing weight is usually lower than take off weight.
That's total fuel, not the fuel amount over the maximum landing weight. That A320 was 160k lb + cargo, max landing weight is 146k lb.
Planes use up the fuel during flight. It follows that they are rated to take off heavier than they are rated to land
This was a flight ATL-CDG. They were certainly overweight stopping at JFK. They hadn't burned nearly enough fuel.
Planes are rated to land at their maximum weight. But in practice landing at maximum weight puts added wear on airframes and landing gear plus a longer roll out.
I fly a lowly archer and would love having ATC ask me what my “ Mach” number is. Wouldn’t have a clue however at that point in time 😂

Wait, did I get everything right? They have to divert due to an unruly passenger. When asked, they want CUSTOMS to meet the airplane. Right? So, does that passenger have to pay taxes or what exactly is the custom's duty? There are so many law enforcement agencies in the US, but I expected them to ask for either police, homeland security, SWAT, TSA or whatever. Customs was the least I expected.

I don't care what the thumbnail says, that's not the actual radio message.
The captain reads "we need acustoms" what appears to be a typo because 'acustoms' does not make sence.

Or attempted smuggling of some kind? 🤔 (Customs dept here deals with import/export & controlled items, but I think in the States their function is more like Border Patrol, so not sure how that might work...?)

Seems it’s popular to do this on airplanes . The punishment has to be more severe , and maybe use Air Marshals to keep the peace .
The air marshal thing was brought up in a forum elsewhere. Unless the passenger is endangering the safety of the flight, it's too minor to blow their cover. The crew can usually restrain the passenger without much effort.
Definitely agree that the punishment should be more severe though.
Wait until the guy gets the bill for the landing fees at JFK.

@@Karlsmarten The FAA can fine them, the airline can sue for the cost of diverting and they end up on the no fly list.

It appears that the recording begins part way through the conversation, some conversations aren't captured. The pilots will already have told an ATC about the unruly passenger and the diversion to JFK. The overweight bit refers to the plane itself: it's carrying enough fuel to get to its planned destination. If it lands early it's heavier than it should be, unless it flies around in circles to burn off fuel, or dumps some out in mid-air.
