- The remission policy drafted by the Yogi Adityanath government in UP allows lifers above 60 to walk free if they have served 16 years in prison and shown ‘good conduct’. Former UP minister Amarmani Tripathi, who killed a young pregnant poet in 2003, has inarguably been one of the big names freed by the policy. But more stories emerge when one scours the list of 691 convicts freed under the policy. In episode 1302 of #CutTheClutter, Editor-in-Chief Shekhar Gupta looks at one such, involving a young IIM alum and IndianOil employee - Manjunath Shanmugam - who cracked down on petrol pump adulteration and was murdered. One of his killers now walks free, more on the way and it raises some questions.

NHAI engineer Satyendra Dubey, the young whistleblower who had exposed corruption in the Golden Quadrilateral highway project in Bihar in 2003. And Shanmugam Manjunath are the two real life heroes who I had learnt about during my journalism studies days. I can never forget the price they paid for their honesty.
S Manjunath was my school senior, Very talented guy. Its a shame how things turned out, May his soul find peace.
His soul can never rest in peace as long as we have these ridiculous laws favouring the criminals!!

Thanks for pointing out that S Manjunath's killer are being released. It's a tragedy. I was a student when this happened. And may the people who let the killer loose face the divine justice. Because our judicial system ain't going to do it.

Very important episode SG sir!... Imagine if things like this fly under the media radar, what to expect of the frail junta memories. Please continue to shine the light on forgotten episodes like this which remind us of the bravado and sacrifice unfortunately our country requires but keeps running short of.. Even one life lost is too many
There is a famous Rabbi Shergil song titled Jinhe Naaz hai hind par wo kaha hai (name inspired from Legendary pyaasa) as a tribute to Satyendra dubey, Manjunath,Navleen Kumar (social activist who took on land mafia and stabbed to death)and Bilkis Bano.
In our college (one of the IIMs) we had done a candlelight March on Manjunath’s death anniversary.

This is such a mockery of justice and so heartbreaking, frustrating and demotivating to the families of these heroes, the right thinking honest officers who want to do the right thing! Where is justice in all this? And who gets to make these ridiculous laws which work only in the favour of the murderers? So disappointing Sir!!!

S Manjunath was senior to me in Engg days. He was a good singer as well. Used to sing in college fest and sometimes anchor the show as well. His voice had a very bass note to it. He used to control a crowd of 2 to 3 thousand just by his sheer voice.
Such extra judicial powers should be snatched from govts.

In Yogi's UP, some gundaas/mafia dons are freed and some are shot in encounters and houses bulldozed. All depends on which party you support and what religion you are. #NayaBharath
It's tragic and true at the same time.
This matter was addressed in the Supreme Court last September and the CJI ordered UP govt to consider premature release of life convicts. It is a reform carried out to improve the correction system. Overcrowded jails & criminal justice system does not deliver anything to the society.
@@TheMemeGuy124Not delivering anything to society is still better than letting criminals walk free. If jails are overcrowded, then start dishing out capital punishment. The people never asked the criminals convicted of murders and other crimes considered highly serious to be imprisoned for life. It is high time laws are also democratized and not just the law makers
70% of encountered criminals are Hindu in UP(Official data) so how is it religion based?
It does require 56 inches of shamelessness to allow convicted killers to walk out of jail...

Justice is only for the rich and affluent. I just can’t understand the forgiving business by politicians. It takes ages to get convicted and then the punishment is truncated. What a nonsense system is this. My sincere prayers to Manjunath’s family for their well being.

They literally released 700 people as a policy, it's obviously not for political purposes.
I remember both cases distinctly... The blogosphere back then exploded with support for these two. I remember one particular blogpost by another IIT guy titled Dubeyji mind mat keejiyega where he said he should have gone to the US for MS like most of his classmates
I am from Karnataka and this manjunath case was big those days. Ravi Belegere had even done an episode on this case in crime diary.
These two young people paid with their lives just for doing their duty.
That's when i realised places like UP, Bihar are fubar and no point going there for anything
This is the type of journalism that we need to keep the nation balanced
Sadly the mafia/politician/businessmen/media nexus will now get even more sophisticated and organized.

this is heartbreaking .this is why capital punishment is needed .how can one be free .in us i read punishment of 90yrs then only justice is delivered .
I guess in Satyendra Dubey's case many big names would have been involved just like Vayapam Ghotala. And to coverup Satyendra Dubey and other two persons were assassinated.
So sad that life was so unjust for Satyendra Dubey both before and after his death.

People who have committed serious crimes like murders, rapes. Should never be released not until they are too old to commit any crimes and their all property should be confiscated to ensure they are not able to gather courage to do it again and setting an example to their neighbours that crime doesn't pay off in this country

I was in school when this happened.Under what provisions a convict serving life sentence can be released? Then whats the point of a court case? Its not minor theft or something? These laws have to be changed? There are consequences to the actions one take the principal of Karma.
Feels so sad to read this. After getting a conviction which itself is difficult, people can now get away in 16 years and in between this time there is parole where they go home.
This does set a dangerous precedent. Under this law, criminals will now start hiring assasins who are in their 50s. Whose "bright" idea was this law?
Ashamed that this is happening in India.

I remember. I was about 17, and I read about this. Sad, its beyond sad. Funny how we all just forget and move on to the next unfortunate event.
Such a tragedy! And, India has never been fair, and protective to whistleblowers. The whistleblower act was passed in 2014 after being pending for a decade. The law is quite weak, and now, such kind of people even cease to exist.

A criteria of 16yrs in jail, more than 60yrs of age etc has been set for release.
But the killers and deep conspirators should be put away for life. NO RELEASE.

Sir, This is one of the very emotional episode - which directly hurts the heart. But, I feel you handles the symptoms. Request you to go to the root cause - the dilemma of the society - should the life sentence be forever, for everyone? or there should be some methods of determining cases fit for release?
It is very natural for us to become emotional and say that no one should be released. They should die in prison only. But, is it the best or fair policy? If it is not, how should the remission be decided? What if, the person was innocent but could not prove it at the time of trial and was jailed? Recently, a couple of such cases of wrong convictions getting reversed after a couple of decades in jail were reported.
So, it will be a great beginning if you do an analysis of all attempts to formalise this remission policies - may be comparison of states, and arguments on this by legal luminaries and activists. Maybe that will lead to a more reasonable policy when such criminals simply walk out because they meet the criteria of remission. To me, the existence of a criterion is good - that way people wouldn’t be able to use discretion for favouring or harming chosen few. But, the quality of the criterion - which should not allow such things to happen is important. Time for a proper process to evolve the criteria for remission.

The age for such remissions should be atleast 75 and no less.
