Modi govt’s criminal law ‘reform’: Sedition/treason/hate crime/lynch mobs, crime against women, kids

  • The Modi government Friday moved three bills to overhaul India’s colonial-era criminal law. The Bharatiya Nyaya Sanhita Bill, Bharatiya Nagarik Suraksha Sanhita Bill, and Bharatiya Sakshya Bill seek to replace the Indian Penal Code (IPC), 1860, Criminal Procedure Code (CrPC), 1898, and the Indian Evidence Act, 1872, respectively. While all three bills will now be scrutinised by a standing committee, their proposals are out in the public domain. In episode 1289 of #CutTheClutter, Editor-in-Chief Shekhar Gupta looks at the some of the important reforms proposed for the IPC - the more complex charge that takes sedition’s place in the books, the definitions introduced for terrorism and organised crime, and what the bill means for failed suicide attempts, sex on the premise of marriage, and mob lynchings.

    These laws are transformational, they will reform Police & Judiciary. The objective of the laws are.
    -Zero FIR filing
    -Enquiry with clinical evidence to be completed within 90 days
    - Justice to be delivered in 3 years or before
    - Digital diary & complete computer/digitization of all courts in India
    I hope we deliver the justice within time frame, it is imperative for foreign investors' confidence (speedy justice)

      These laws also increased the detention of suspects for up to 90 days from 60 days making innocent people more susceptible to false confessions.

      @@user-yk5vc8kx6f how do you mean 5-8%. It applies to all cases like burglary, robbery, physical assault, attempted murder and murder. They can take people into custody for 90 days now in almost all cases.

      The same way farm laws was repealed, these laws will too not see the lime light
      Before bringing UCC, Hope they bring back the farm laws (which will benefit lakhs of small farmers, remove middle men and bring down the horrible Mandi system which is the root cause for inflation- creating artificial demand by hoarding/storing goods illegally. This not only impacts farmers but also middle class)
      People in opposition unnecessarily creating issue by bringing names like adani Ambani and scaring farmers by telling they will be robbed of their lands.
      Govt had no spine to go ahead with their farm laws and had to withdraw because of the backlash
      I believe more than UCC/CAA/NRC, farm laws will truly benefit ppl (economically)

      Devil's in the details, don't be happy too soon. The entire politics of this country stands on flaky criminal laws which give impunity to politicians.
      I don't see drastic change, there may just be cosmetic reframing of same codes instead of making laws foolproof and bringing speedy justice

    Hope we will see Common Civil laws too in parliament in 2024
    irrespective of Gender,Religion & Caste. With Equality for both Men & Women.
    Govt. should take serious steps towards Uniform Civil Code.

      The draft is almost Ready now !!
      Gujarat has also made a commitee under Retd.supreme court & High court Judges.
      & Under CAA Afganistan Sikhs Were brought in India gave them refugee status.
      & last year in Gujarat central Govt. Gave citizenship to Hindu refugees from pakistan.
      Its a Long process it is not Like Article 370 & 35A to Remove eveything in just one speech.
      through presidential Order.

      Passing UCC is more tougher than anything u can imagine even NRC.
      In CAA & NRC u face resistance from Muslims but in UCC, U face from Muslims, Christians, Sikhs, Especially ST's.

    Lot of paperwork will be done, lots of PILs will be filed and lot of noise will be made by specifically the lawyer community. But in time, this day and these Bills will be celebrated. The aura of Modi & Shah will be part of folklore and soon will be turned to demi-gods.
    Good or bad, history is being written everyday by this duo. Some others are - NITI Aayog, GST, IBC, A370, Parliament, Ayodhya, CDS, etc.

    The proposed reform is really promising. But this won't pass in the current term though. Jan Vishwas Bill took roughly 3 years of work before it was passed by both houses. I anticipate this will take roughly the same amount of time.
    Under the new laws, Sedition now specifically target Anti-nationals (calling for division of India) rather than folks who express displeasure towards Govt policy. Arresting people because they called a progeny of a Politician Penguin is no longer sedition. This is a step in the right direction.
    The new laws completely removed references to "unnatural carnal desires" aka gay sex completely. Also a step in the right direction
    Mandatory chargesheets notification and publications!!
    Time limits for chargesheets with automatic bail!
    This is a huge step in the right direction.
    One has to wonder, why so called "liberal, progressives" did not bother to pass such comprehensive reforms? Instead we get essays that extols the beauty and genius of IPC.
    Edit: So "Liberal, Porgressives" are calling these reforms as a work of an Autocratic regime and quoting Nazi concentration camp survivor Hannah Ardent (Hai Bhagwan!). Long overdue reforms occur because Mudiji is fuscist. Hot take ke bhi haad hoti hai.

    Mr Shekhar Gupta lets it slide while quoting Sharjeel Imam that "somebody" may say that it is just a irresponsible statement ...afterall what wherewithall he had to acheive that objective.
    This man overlooks the fact that this was found to be an act of treason by the SC whose independent views his ilk celebrates. Just imagine that this guy and his kind set the narrative in India for decades.. .

    When a government actually puts in the work to make these changes to better tackle a country is indeed commendable. I can’t imagine anyone from any other party doing that. If opposition wants power, they need to work hard.

    You can bring any number of reforms in overtly legislated and under enforced country, Unless the conduct of street level bureaucrats change on the ground, it will not make any difference to the life of a common man.
    Dealing with Govt departments, police, bureaucrats is still rather worse than how it used to be earlier.
    I personally experienced it recently at a post office, went there for some work related to my father’s old account .
    While visiting 3 days in a row to get it closed. Asking for own money back felt like begging or asking for a loan 😀 The Experience was anything but frustrating. I also witnessed How some people were being shoed away and treated. Like a peace of sh..t ..Was wandering why these frontline Clerks are being called public servants, they should be called kings 👑 and we as commoners. 😊

      Have u read the old and new law ? I m a lawyer. I can say these laws r not new. 99% of content of old law has been retained just the numbering of sections have been modified and rearranged.
      IPC has seen some cosmetic changes.
      Crpc and Evidence Act r ditto as they were with change in name and change in sequencing only.
      To say that british era has been done away with is untrue.
      Changes in IPC r the only material changes. But those could have been done simply with an Amendment Act jnstead of renaming the law.
      If british era was to be done away with then power procedure of police investigation should have been changed in CrPC. But no such change has been made.
      Similarly in Evidence the manner of proof and admissibility of evidence which is british designed should have been changed. But no such changed has been done.
      Changing name of a city doesn't change the lives of its people.
      Same is true for these so called new laws.

      @@offred6013 Simplification in itself is a great achievement. Since they have reduced number of sections by 30 percent, it is unlikely that it is 99% the same. Also, provisions to improve justice system and reduce delays is amazing.

    some laws are on point but some still leave a lot of room for misuse.
    The terrorism one will be misused.
    There are degree of hateful acts that should not be swept under the common blanket of terrorism.
    Such acts should be treated corresponding to the degree of the severity of the act.

      And also some laws have consequences greater than the others and therefore should be worded even more carefully.

      the modi government has totally failed in Manipur (both state and central government) and that's a fact. It's because of them that the violence spread so quickly and it's still continuing. They have still not imposed president's rule in Manipur which can stop the violence. And the PM has still not accepted that they have failed to maintain peace. They only took action after the video went viral but they knew about that incident and many such incidents like that for more than 2 months.

However concerns remain of misuse, but we could always do with simplification and clarity of offences and punishment. Hope this bill gets further scrutinised and gets passed eventually, IPCs from colonial era has to expire at least now.

    This reform is very positive. In fact the section 4 quote can probably also be used against the "sar tan se judah" mobs. This is why I will vote for Modi. The only issue I see is of proportionality. While a terrorist act should be punished with life imprisonment or death, what Sharjeel Imam did needs to have a more proportionate punishment. Maybe this thought is already there in the reform.

      that is for the courts to decide. Laws don't have doctrine of proportionality, judgements should have that - that is why there are always ranges of minimum and maximum punishment.

    High poverty states in India are also states with least English penetration.
    Bihar, Jharkhand, Uttar Pradesh, Madhya Pradesh, Assam, Chattisgarh, Odisha, Rajasthan, West Bengal, Gujarat.

    You have not covered the multiple provisions that ensure faster and easier delivery of justice:
    Filing zero FIR anywhere in India,
    zero FIR must have section number,
    video conference hearing (no need to travel to the HCs/SC)
    video and other electronic evidence to be admitted in courts,
    all cases to be disposed within 3 years (no endless adjournments),
    full digitization of court data,
    extension of court case to be justified in writing, etc.

    In addition to my earlier comment applauding the reforms presented here, another thought comes to my mind. Democracies outside of India have not had the kind of diversity of population that India has. Now, with mass immigration and movement of people, other countries are facing the challenges of managing multi ethnicity, multi religious and even multi-patriotic sensibilities among their populations.. resulting in challenges/situations of a unique kind. India can light the path in how to effectively and responsibly address these situations. We borrow, adopt and adapt in technology, entrepreneurship, scientific arenas from the world; this can be a very valuable’giving back’ :)

    We need much strong laws against the crimes committed by women. Change dowry case that if proved false the lady gets mandatory minimum of 15 years.

    Why unpronounceable Hindi names for every central scheme, proposal, law, etc.? This further alienates those who don't speak or understand Hindi. At least, have a parallel English names for all these.

      When original name were in english they were translated into hindi and other indian languages. Same will happen here.
      And in my opinion these will be known as NEW ipc, crpc & evidence act in popular imagination rather then these hindi names.

    This govt has been doing some tremendous work and genuinely trying hard to take India forward. However, there is a fundamental attitude problem with most Indians. They dont respect the law and order and are more of a mobocracy. The less said about law enforcement agencies, the better. Hope this mentality changes in the next 2-3 generations as India develops more and more.
