      No, because it (the lower) started as a rifle, it has to remain a rifle and keep a 16" barrel or it is considered a short barreled rifle....an NFA item.
      You can put a 16" barrel (or longer) on a pistol lower and keep the brace on. You cannot put a stock on an AR lower that started as a pistol.

      @@theunofficialresults231you can convert a pistol lower to a rifle by putting an upper on it with a barrel length of 16" or longer, allowing you to add a stock. As long as it was originally a pistol, it can be disassembled and converted back to a pistol, per the ATF's website.

    Just be careful using short barrels. Putting a brace on it doesn't keep you from running afoul of the NFA. Just Google: "weapon made from a rifle" to make sure you have your bases covered. You can go the other direction and make a rifle out of a pistol though. Go figure.

    All the UA-cam experts are leaving out one key fact.....
    A lower purchased as just a lower. Not a pistol or a rifle. This is the best way to purchase them as you can literally do anything with it (build a rifle or a pistol, tear it down and go the pther way with it.)and stay inside the guidelines.
    Obviously a short barrel with a stock still needs the extra paperwork.

      Correct, the lower is what matters. If it started as a rifle, it has to stay a rifle even if you put a brace on it, it has to have a 16" barrel.

So she didn’t need this anymore. I bought a new stripped lower and put it together for this upper after I removed the flash hider. It has never been on a gun with a stock since I’ve owned it. The 5.56 can I have is direct thread. I could see how it could be misconstrued, but stayed within the guidelines. Even the foregrip is angled, not a straight 90. That’s a gray area, but still legal.

      It is a felony if that lower is registered as a rifle lower and not as a pistol lower. As others said a pistol lower can have a rifle upper on it but a rifle lower can not have a pistol upper on it.
      Maybe I did not hear it but seems like that is a rifle lower (i.e. the pin and weld to make 16” legal rifle), putting a brace on does not change what the lower is registered as (pistol or rifle). So unless he pin and welded that suppressor on that barrel it would be a unregistered SBR. Dumb laws but still laws. People should be made aware so they don’t blindly break a law with serious consequences.

    Was the lower purchased as part of a complete rifle or part of a complete pistol? If it was purchased as a complete rifle, it cannot be converted to a pistol lower, per the ATF, but if purchased as a complete pistol, it can be converted to a rifle, then back to a pistol, once disassembled. If the lower was purchased separately as an "other", you can use it as a rifle or pistol lower, but once the lower has been used as a rifle, it cannot be used as a pistol lower, legally. Atf can't prove this with an "other" lower unless you admit it by some means. Even inadvertantly. Stupid, confusing laws. You may want to rethink keeping this video up. ATF has been on a bender lately.

    • @airborneivan
      @airborneivan 2 місяці тому

      Off the ATF website: "Assuming that the firearm was originally a pistol, the resulting firearm, with an attached shoulder stock, is not an NFA firearm if it has a barrel of 16 inches or more in length.
      Pursuant to ATF Ruling 2011-4, such rifle may later be unassembled and again configured as a pistol. Such configuration would not be considered a “weapon made from a rifle” as defined by 26 U.S.C. § 5845(a)(4).

      I bought the lower stripped. Was not designated rifle or pistol. The upper had been sitting and not on a lower for a little bit, so I busted the pin and weld and then assembled a lower for it. It had been on my wife’s lower with a pistol brace prior. She likes the soft SBM4 brace and its short length of pull. That’s what I had meant by running it as a rifle.
