- The plaintiff rented an apartment from the defendant and was electrocuted due to the faulty wiring. The plaintiff is suing for the return of his security deposit. The defendant argues the plaintiff had 15 people living in the apartment, and she kicked him out. She doesn't believe he was actually electrocuted. The defendant is countersuing for rent and eviction costs.

Two things that I have to say 1. Harvey said at the end that you could withhold rent if you didn't have a working oven but yet the judge allowed the defendant to keep the plaintiffs security deposit for the last month's rent when the defendant herself admitted they just gave them a toaster oven and never fixed the oven because they were just going to evict them anyways, so why then would the defendant be entitled to the security deposit for rent if the oven was never fixed and 2. I can almost guarantee you that if Judge Milian was electrocuted because of faulty wiring and had to go without an oven for a month and a half one of those days being Thanksgiving she would value that at a lot more than a measley $200! I completely disagree with the judge on this ruling.
OK Well here is how the Judge made this ruling I would imagine the landlord tenant court would rule very much the same way. I've worked in this industry for over 15 years so I'm familiar with how the laws work.
#1.He never went to the hospital so most likely he doesn't have any evidence to back up his "paramedics said heart rate was high". He also cannot prove that these outlets ware missing the cover plates, or how long these cover plates ware missing. So basically this whole segment of the law suit is all here say evidence which legally cannot be admitted and just has to be ignored.
#2 She cannot just order the return of *ALL the rent even for the months ware the oven was missing/not working, because the rest of the property was still "functional" other plumbing, light fixtures, doors, windows, locks, heating, cooling AC ect..

Yea I agree. Should have gotten a full month and half rent. The fact that they intentionally didn’t replace it and trying to trick the judge with incorrect inspection report. I would have returned him much more

It's a little hard for him to prove he was electrocuted. He didn't go the hospital and other than elevated hr or BP he had nothing to really show. No burn mark pics etc.
I understand at the time he probably felt he was going to be okay and didint want to go to the hospital because it's a hassle , but courts need proof to award money

Ps been zapped plenty of times with II0V, it was the third time getting bite by the 277V that caused me to start turning off the power. and FYI sometimes you are troubleshooting in a building and there are I000s of breakers. No luck turning off power. 200 bucks were plenty. The LL needs a new handyman though.

As soon as she said she gave them a TOASTER OVEN instead of fixing the full size oven that was there, I knew she was a miserable person. The Defendant gave them the toaster for one reason only. She wanted to inconvenience the Plaintiff(and his family) and make sure they would not want to continue livimg there. He should have sued for the electrocution, not the back rent.
I think the plaintiff actually seemed like a nice guy.
He is greedy and looking for a payday to get out of the homeless shelter. He should try working for his money instead.
Yeah it’s really hard out there, he is a good man. He isn’t really greedy just desperate, greed makes you steal for personal gain. This man is trying to take care of his family. Sometimes working 40+ hours still doesn’t cut it.

Ain't that the truth. She literally had no answers for JM. I've had family try to do this to me and let them know I will in no shape or form tarnish my character/image for nobody.

Judge in medication has to follow the state laws of where the case is from. Judge would have loved to given the plaintiff more.
Because it comes out of the shows pocket. To me it kinda makes them bias. They pay the awards so the less they have to give
@@jennylynx1869 The show is a prime time show that makes millions each month. Paying anything is still all profit for them and seen as a tax writeoff. I doubt they are bias for what is essentially pennies for having the show broadcasted.

He deserved more than $200, he should have gotten his entire deposit back for having no oven. Even Harvey said that the landlord breeched the contract by not supplying a working stove! Judge dropped the ball morally and legally.

He doesn't have ANY evidence. It's all here say. The paramedics "told him" his heart rate, "he says" he saw burned wood, "he says" the plates ware missing. Legally all that cannot be admitted into evidence. pretty much the whole ENTIRE electrocution segment cannot be admitted into evidence and has to be ignored.
I bought a brand new oven. Turns out the wires weren't secured properly and an exposed wire started burning a piece of plastic next to it. My dad, electrician, came over and looked at it. Said there was exposed wire loose and if it had touched the metal frame I would've been electrocuted. He fixed it all up and I notified the manufacturer, but it can happen just that easy.
I think I'd return it for a full refund. Unless it was too inconvenient. You got unlucky and lucky.

I think it would have, but he didn’t sue for anything pertaining to that. He didn’t have any medical bills and didn’t sue for pain and suffering. He probably wouldn’t have gotten any since he didn’t even go to the doctor or hospital, but I wish he would have known to at least try instead of suing for rent he already paid due to not having an oven later. Didn’t make much sense. But he probably doesn’t binge watch PC like I do.🥴🤣

The message here is that if you rent and your oven breaks, Landlords know it's only a hit of about 100 per month. And if landlords leave electrical plates off plugs and have faulty wiring and electrocute people to the point where they call the EMT, no problem! This judge found no need for a penalty here either. Unreal decision.

Isn't this show produced in the US? They keep calling a stove an "oven" like they do in Canada. It is a stove and the oven is the baking compartment of the stove.

The defendants are something else. He should’ve gotten more than $200. He was electrocuted and they never gave him a new stove. JM is soo cheap sometimes.
I hate when people bring God/Christianity into their mess. He sued because he was greedy not because he was trying to be a good Christian 🙄🙄 And she wasn't any better - because they were previously homeless she decided they could just give them any old thing and they had to take it. 👎👎

I really appreciate Judge’s line of questioning on the decision of Landlord to opt to not replace oven and let tenant live ANY amount of time without a stove. To withhold a basic need because of monetary discrepancies is EVIL. Do not choose money over your Humanity, cmon now

What he SHOULD have done was eat the cost to hire an electrician to put on paper there’s a severe electrical issue. Then he could’ve forced her to 1: fix it and 2: pay for their hotel in the meantime. But he didn’t. So unfortunately there’s only so much the judge can do

That landlord is a slumlord 🤨 He should definitely get all his deposit & punitive damages, the judge’s decision on this is 💩
And to educate all of you, slumlords do not put out money to get wiring corrected and never have it inspected till someone is hurt or there is a electrical fire. And the defendant put the blame on her father to decide to have the Plaintiff to use a toaster oven, instead of getting the poor wiring redone. Slum lord put the blame on her father for everything. She is the Slumlord. And then she blames her sister for the decision. Slumlord blames everyone in her family. Slumlord. And she did not grab the inspection results for she only did not see it, she decided to grab the inspection results of two other units and thought the judge would not read the documents. SLUMLORD! And the defendant owes the defendant. It was a good judgement.

notice we're given and he was there November December and a week in January ,so she should have awarded him for,, compensation for the fact that it was not an oven.. More at the and convenience and that it should have been in oven to use.. Because the place came with a oven..
The refrigerator stopped working and the tenant couldn't even think to check the outlet and plug it in someplace else? Maybe the oven didn't work because the fuse tripped.

I lived with my family and next door was the slum lord, for he had faulty wiring and a few years after we had an issue with the faulty wiring, the place caught fire and burnt down.
He lost me at "trying to be a good christian" ..what a farce
Seems like a bad resolution for the plaintiff. He had faulty oven that wasn't replace, faulty fridge and got electrocuted in a place with no inspection. To me, had a right to not pay rent in December or January, and to break the lease and not owe for February either.
How the hell does a homeless person have money to pay rent for 8 years?!!!

I always wondered what the circumstances are surrounding a person’s “homelessness.” He mentioned a daughter several times. I wonder what bridges him and his wife burned to not be able to stay with their daughter in her home? Or what mistakes they made as a couple that brought them to this unfortunate situation of not being able to have a home of their own.
