  • The plaintiff is a real estate broker who showed the defendants an apartment that they moved into. He claims the defendants have not paid his commission yet, so he’s suing. The defendants argue they found the apartment online and not through the plaintiff. They don’t think they owe the plaintiff anything.

      This. You don’t do business without getting a signed contract at minimum of 3 or 6 months. Otherwise, why bother showing them anything FOR THIS EXACT REASON.

    Broker is out of luck. He should have had an agency disclosure signed and commission agreement signed. I was a realtor in my for almost 8 years, it’s nasty. And you will encounter a lot of Ali, Mohammed, Singh, Patel, yusef, and etc, and everyone claims to be the owner and a lot of shell companies, companies with post box. People be careful

      Natasha is sort of like the informal version of Natalia. So he’s used to calling her Natasha in their home and around friends, but quickly corrected himself to Natalia out of respect for her and the situation.

    So many of these cases involve people who seem to live on the edge of legitimacy, doing things with word-of-mouth with zero documentation (except some vaguely worded text messages).

    I disagree with the judge on this one I completely believe the defendants when they say that they were told that the property management would pay the fee, I know the plaintiff had the text from the defendant but the way it was worded to me sounded like the defendant was trying to get a clear answer on if there would be a fee.

      Texts are legal written amendments. Once the defendant asked him in text if he had to pay a commission and the plaintiff said “ok” it became apart of their agreement.

    In Massachusetts - there’s something called a disclosure form. It discloses that the client understands that the agent is working on their behalf and will be paid by the client, regardless if there’s a sale or not. It’s the FIRST thing an agent does! I’m surprised that in the state of New York, that it’s not legally required. I don’t think the broker should have won.

    I have always had a contract for EVERYTHING. My son's engine in his car blew up and I had a nice spare car. I said, "I'll sell you this car at a fair price if you'll just sign the contract." He looked at it and said, "Dad it say's $1?" I said, "Sign it or I can get a lot more" LOL
    He did and started crying with appreciation. More of the story he had to have a contract bill of sale for a tag and I make contracts for everything.

    OK WELL AFTER LISTENING TO THE ENTIRE CASE HONESTLY I DO BELIEVE BOTH SIDE THE DEFENDANTS WERE BROUGHT IN UNDER FALSE PRETENSES THEY THOUGHT THEY THEY MIGHT HAVE TO PAY UNTIL MGN "SAID" WE'LL TAKE CARE OF HIM / IT. EITHER WAY I'M W/ THE PLAINTIFF I WOULDN'T CARE WHO PD JUST GIVE ME MY $$$$. I HOPE THAT THE DEFENDANTS SUED & WON TO BE REIMBURSED GOOD CASE

    Before I hear the verdict my answer would be that technically there was no contract since there is no price set. Even if he said I supposed we have to pay you a commission that doesn't mean they agree to pay 5k. Now if he can prove that is what the would have gotten and told the guy it would be 5k then he is on the hook for paying. But I think with no fixed discussion of what the commission would be...There is no contract. What if the guy came in and said it was 50k?
    And what kind of professional...Especially in NY would not have a contract stating the terms of their deal?

    I kind of believe the defendant. If there’s no contract between the broker and the potential tenant, they shouldn’t be able to collect two or three months in advance for a brokers fee once they moved in . Sounds sketchy to me.
