- The plaintiff says she attended the defendant’s New Year’s Eve party and checked her designer coat, but it was gone at the end of the night. She’s suing for the cost of the coat and the party tickets. The defendant says things got out of hand at coat check when the night ended, and people were just grabbing things. He claims he bears no responsibility because the coat check was free.

defendant made a good point though , he said his defense was that she never proved she had her jacket in coat check . and why would a person put a one thousand dollar jacket in a coat check when everyone knows that someone would want to steal a jacket of that high cost . i just think that bigger price tags require bigger proof and this plaintiff never showed a photo of her jacket being given over to coat check . if they found her BF jacket then most likely hers would have been there too if she really had it in coat check . sometimes this judge just gets it wrong .

Exactly, Completely lacked accountability. Sometimes unforeseen things, go wrong when doing business, which in this case was his responsibility. He does, need to, take note of how to plan better next time, but he doesn’t see that.

He’s definitely liable. It’s his event, he offered a promise of safety for their coats and failed to provide it. Her story seems reasonable - it makes sense she’d wear her expensive coat to a big NYE event. His coatcheck fell apart, he failed to provide safety, and even got people’s things stolen. He’s liable. She got the full price because it’s a fairly new coat, it’s a unique and rare designer coat, and that rarity & lack of availability makes her able to get near the value of it. He needs to get insurance, to have cameras, and to have coat check in a more secure location.

I work at a luxury event venue and this is why we don’t offer to hold anything or let anyone store any items anywhere. We refuse to be liable for missing items. A lady put her purse in a random cupboard to not carry it around then was going crazy when it was missing at the end of the night. Way to much liability involved
So true! I was an event coordinator for 6 years & the only things people would lose would be their phones. I can’t imagine if someone would’ve lost their whole purse. But, seriously, who does that if you’re not either VIP or work for the place in some way? She was TRIPPING!! 💯😂😂😂

A lot of event centers, hotels and venues have actually gotten away from the coat check / hold area. It's kind of an old school thing that people no longer want to be liable for. So now they basically say to everyone it's your own responsibility to hold on to your own coats, purses, and bags.

This is clear cut case of negligence. Guy throws a party, charges people for access, takes their coat, fails to secure guests property, loses guests properly, and then is surprised to find he is responsible for missing property??! 😝😂

The plaintiff is a beautiful woman and I’d bet she had on that coat. She’s a woman who appreciates fashion obviously. I learned never to wear expensive outerwear that needs checked.
It kills that everyone wants to be an entrepreneur but do not do their due diligence. Either get insurance to protect yourself or don’t offer services that may get you sued for other people’s personal property. It’s not that hard to have a bit of self preservation.
This defendant had no defense here. He didn't provide adequate security at his party.

For people confused on why she got the amount of money she did...I'm an Adjuster, the way it works is you get the amount of what it would cost to replace the item NOW in present day (not what you paid for it) and then you take that amount and subtract for depreciation. The coat was almost brand new so there was not really much depreciation to take out and she only paid 800 because she got a discount... the coat costs over a grand. We do not take into account what you paid for an item... think of it this way, imagine this was for a TV and the TV was sold to you by your best friend for only $20 because they did you a solid when the TV actually costs $500. We would never only give you $20 because that's what you paid, we would give you the full 500 (then add depreciation) because that is how much you WILL have to pay to replace the TV now. We don't penalize you because you got a good deal, we have to make you whole again and able to re purchase the item.

A little business advice: If you required a coat check, then you assumed responsibility. If a coat check was voluntary, then you need to post at the coat check location and on the coat check ticket "not responsible for items lost or stolen"

Defendant is liable for the missing coat, for he is to make sure of the safety of his coat check system. She was lucky she still had the receipt and brought it to court. He was crazy to think he was not responsible for the safety of his guests' coats.
The fact that he was lost to why he had to pay for her coat … after taking the $1,000 coat into coat check telling them the coat would be safe giving them a ticket but let people bust in the coat check and take it … don’t provide a coat check if you don’t want to get sued or have insurance if your going to not have control over the events end coat check looks like a attic

She had just bought it in November, max 2 mo. prior to the incident so it was considered still new.
The coat was only a month ish old so little or no depreciation taken out, also the depreciation is taken out of what it costs to replace the item in present day, not what you paid for it.

He provided 2 services that failed which were included in the price of entry: security and a coat check. How does he not understand that it makes him liable? He can say "coat check was free" but that just means that it was a cost he assumed with the entry fee and it isn't an additional cost on top of the entry fee.

I'm glad the Plaintiff won, but I'm surprised she was awarded more than she paid for the coat. Even if she received it at a discount, your award is typically capped at what you paid for an item. She got super lucky, and I think it was because that guy was trying so hard to shirk his responsibilities that the Judge just let it slip by her.

It was purchase right before it was stolen and the price difference was because when she purchases the next she will not be getting the 20% discount that the company graciously gave her on her original one so she will have to pay full price, so that is the price he is responsible for paying

Preventing theft is literally the reason why you have a coat check. It's a safe place to keep your coat while at an event. If you don't want to be responsible for someone's coat, don't offer a coat check.

They could careless About “preventing theft “. They just don’t want a bunch of coats lying around , and also a bunch of people complaining about no where to put their coats . I have been to many places (presidents list events ) in which I’ve had to check my coat and believe me , it had nothing to do with them trying to prevent anything . Next time leave the coat in your vehicle - or risk it being stolen .
And the only reason why the plaintiff won is because of the extra circumstances that happened such as them #1 not having a disclaimer . #2 them dropping the coats off of the hangers which was their reasonable duty . And #3 them not having security preventing the mayhem of everyone stealing coats . Otherwise she would’ve been hard pressed to collect any money . And btw I’m on her side .
