So many talking about fraud for payment of a couple hundred dollars under the table. There are literally millions of Americans who cheat on their taxes and thousands of businesses that claims losses that never happened and those are for a lot more than a couple of hundred dollars, yet we don't go after them and here we are talking about a small not for profit that actually helps the poor.

Accepting under the table pay isn't the problem, but not reporting it is. At least here in Canada anyway. Several years ago my then husband was on a disability pension and I got a job that I later found out was paying me under the table. I reported every penny I got to his disability worker and on my taxes. But then my employer didn't pay minimum wage or holiday pay (it's illegal not to pay holiday pay here) so I went to the Labour Board. My employer decided to retaliate by reporting my pay to my husband's disability worker and was very disappointed when I told her that I had been reporting the income all along anyway. The income that I reported paired with my time sheets that I had snapped pictures of before submitting them ended up being the only evidence I had that I wasn't paid properly and I won my case. Being paid under the table was perfectly legal because I was reporting the income anyway

I didn't realize breakfast and lunch were considered incidentals. I wonder if those who donated would be happy to know their money was going for employee meals?(the defendant claimed she told him to put any donation received into petty cash) Shouldn't that money be going towards the victims their organization was supposed to help? Or does her "non-profit" only use the government grants for that purpose?

Attorney here and ALJ for the Department of Labor (21 years). I love Judge Milian. However, she botched this case. The plaintiff came into the court with "unclean hands" so he deserved nothing! He is a fraudster. By giving him a $400 judgment, the judge has allowed him to defraud a federal government agency (DOL). The claimant admitted he is a worker not a volunteer and he expected to be paid yet he was collecting unemployment benefits which is money set aside by the DOL for those who are NOT working.
A 'non profit' is not supposed to make money. And taking donation money and putting it in the petty cash is not how you take, nor use, donations but he was stealing the donations. But the best part is, he is working under the table yet still claiming benefits, and he dares bring this to court. They both need to be investigated by the IRS...
