    You have an impressive memory of all the events during your K1 visa application process. It's amazing that you managed to gather all the required documents within a week and also prepared for the interview. It must have been a stressful week, but I'm glad it went well for you. Starting today, I am counting down exactly 7 days. By this time next Tuesday, we will know our fate. I hope everything goes smoothly.

      @@Iam_cherono Hi Cherono, my interview was scheduled for 7am, and I arrived at 6:55am, but I wasn't interviewed until 11am. The interview went well, and I answered all the questions, but one issue made the consular change her mind. I had known my fiancée since December 2021 through one of her friends, and we had been communicating online. We first met in September 2022, around 10 months later, when she traveled to Kenya for her father's funeral. She stayed for a week, and we spent three days at the funeral. The remaining four days before she returned to the US, we spent together visiting friends and family and planning how we could apply for the K1 visa and live together in the US.
      She is widowed and needed a partner who was comfortable assisting her in raising her children. We had lengthy discussions and concluded that it would be best if I traveled to the US under the K1 visa so we could officiate our union. The consular couldn't understand why we hadn't met again since her trip for the funeral. I explained that my fiancée has three children under 18 who depend on her, making it difficult for her to travel to Kenya. Additionally, she had exhausted her sick leave and developed a stomach complication that required several surgeries, making her unfit to travel. Finding someone to take care of the kids while she traveled is also a challenging task, as hiring a nanny is very expensive.
      Due to these circumstances, we didn't have the comfort and flexibility that other couples intending to marry have. As a result, the consular concluded that we were not planning to marry each other. It was an unfair judgment, and she declared that my petition had expired. I explained that I had written letters and made several phone calls to the embassy requesting an extension of the visa, but she didn't consider any of that-she had already made her decision.
      It was a sad day for us, considering the financial investment and the long waiting times we had endured, only to be denied because we hadn't met during the application process. The only reason she could use was to declare that my application had expired. Now, our relationship faces an uphill battle and might lead to our separation due to the inability to be together, see each other, and plan together.
      We have one option left: she can come to Kenya, we get married, and then apply for the CR1 visa. However, figuring out who will take care of the children while she is away is still an uphill task. The few savings we had set aside for the application have been depleted, and it feels like our efforts have gone down the drain. We are demoralized, as the pink slip seems like a dead end. I wish they could have given me the yellow paper so that I could submit the hospital bills and details of her illness, which were among the reasons she couldn't travel.

      ​@@lloydshinaali I'm really sorry to hear about your visa denial. I can't imagine what you are going through right now. While I was searching online, I didn't see clearly whether there is the ability to appeal a decision made by the embassy. A potential option could be to marry your partner in Kenya and apply via that route. It seems that actual marriage makes your case more legally difficult to deny. However, given the time and expense involved, this is a difficult decision that both you and your partner will have to think and pray about (especially considering that there may be no guarantees). You will be in my prayers.

      @@Iam_cherono Thank you, Cherono, for your kind words and support. The visa denial has indeed been a challenging experience. We are considering the option of getting married in Kenya and then applying via the CR1 route, as it seems more legally sound. However, as you mentioned, the time and expense involved make it a tough decision. We will definitely think and pray about it. Your prayers mean a lot to us during this time.
      We have also been considering the possibility of me applying for a B1/B2 visa to travel and visit my fiancée before we refile. The consular denied my K1 visa because we had not made any plans to visit each other during the period within which we had filed our application. Currently, she is unable to visit Kenya because of her three children, who are all under 18 and rely on her for everything. Additionally, the recent tornadoes that have hit Iowa have made her more concerned about leaving them. We believe it will be reasonable for me to travel and visit her before and during the K1 visa refiling process.

    How long does it takes for the embassy to contact the beneficiary in k1 visa processing for the interview?

      For Kenyan context, the embassy doesn't contact the beneficiary inviting them for the interview. The beneficiary will have to create an online account. Once logged in, they will follow the instructions in the account in scheduling for the interview on the available interview dates. Usually the dates are not always open and so the beneficiary will have to keep on refreshing until the dates open up. The account opening action happens after the NVC has sent the petition to the embassy and the status reads "ready" on this site >> ceac.state.gov/CEACStatTracker/Status.aspx
      In my experience, the embassy sent an email to my US petitioner confirming receipt of the petition from the NVC. The email had a list of instructions e.g the link for opening the account(ais.usvisa-info.com/en-KE/iv), medical exam etc. He forwarded the email to me and I was able to set up my online account then paid and scheduled for the interview when there was availability.
      My Timelines:
      1. NVC sent petition to embassy - Aug 29 2023
      2. Embassy confirmed receipt of petition - Sep 8 2023
      3. Did my medical exam - Sep 25 2023
      4. Did my interview - Sep 29 2023

      Kenyans schedule for K1 Visa interview appointments online. During my time when application was ready for interview scheduling, we used this site ais.usvisa-info.com/en-ke/iv/users/sign_in.

      Hello. It took about 16 months from initial receipt of 1st petition to the interview date.

      We submitted the first petition (I-129F) on 5th May 2022 and my interview was on 29 September 2023. You get your results immediately after the interview.

    Do the officer ask the applicant about their education and proof of education in marriage based cases

      In my overall research, the officers main area of interest is to ascertain that your relationship is authentic and bonafide. I personally wasn't asked about my education. That being said, if there is such a hug gap or discrepancy between the two partners, then a red alert/ red flag is triggered, which then leads to the officers vetting you even further. At the very least you should be able to have a common language that you communicate in. For example: If your US partner speaks in English and you come from a non-US country where English is not a first language, having gone through an education system that's taught in English is a good way to proof that you have a good wealth in the English language hence you can clearly communicate with your partner.
      My recommendation would be to work with an immigration lawyer if you think you have a unique case and they will guide you through it since they've worked with different cases that needed specific attention.

      Hi@@sharonchepkoech-gx1bs This question would require an expert opinion. As much as there may be a general rule of thumb in the application process, certain nuances may need to given specific attention. I would recommend you do research on a similar case scenario and/ seek a more expert advise. The goal would be to make sure that you present your case in a manner that will not raise any red flags with the interview officers. Sorry I could not be of much help

      - 5th May 2022 - When we petitioned for K1 Visa by submitting I -129 Form to the USCIS (First application of the K1 visa).
      - 29th Sep 2023 - Interview date. You know your results immediately after the interview.
