      The 4th Amendment has no provision for: Detention, Officer Safety, Reasonable Articulable Suspicion, Exigent Circumstances, Pain Compliance, Taser, Deadly Force, Kidnapping, No Knock Warrant, Dogs, Wrong Address, Policing, Investigation, Inspection, Inventory, Immunity, Traffic Stops, Human Trafficking, Fascism, etc. The only practice condoned in the 4A is seizure pursuant to a warrant, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. (The word "upon" means "probable cause" comes before a "warrant", not after the search.) The SCOTUS is a Private Corporation (see D&B).

      Thank you for mentioning the lawyers who press their clients into taking "deals" that amount to guilty pleas even when the evidence proves their innocence. This happened to me and it's a story lackluster covered. Lazy lawyers? Corrupt lawyers? Turns out my lawyers worked for the police! The subject deserves a video all by itself.

      Bubba Has an outer door, looks like a steel grate, to protect his inner door. Could have kept the outer door closed and locked between him and the cop. Then, when he wants to quit talking, which is best done almost immediately, he only has to close the inner door.

      Cops are allowed to lie. It's why I won't talk to them. And I never have to worry about serving on a jury. Whenever I'd be asked, I'd say I don't trust the cops because they're allowed to lie when no one else is. They've personally stolen from me before. And no cop is gonna testify against another, as if it's a criminal organization with lawful immunity.

      Yah' they going break the door down especially if they looking to arrest you I always open my door to them and cooperate and it always turns out ok I provide identification and once they find out I am not the person they looking for they leave this happened 2 times

      Watching videos like this has convinced me to get a doorbell camera. I have never knowingly committed a crime or been arrested in my 58 years on this planet. But life in the Fascist US of A is getting more precarious everyday. Fight the power! ✊

    As a retired Traffic Enforcement supervisor, I can tell you right now that this arrest is stupid. Nobody identified Bubba as the driver of the go-cart. The officer knew that she wasn’t legally allowed to arrest Bubba as she lacked probable cause and that she was violating the 4th Amendment by entering his house. I’m not sure how it’s done in that jurisdiction but, a supervisor (Watch Cmdr.) is suppose to review the reports and BWC footage and do a UOF report due to the deployment of the Taser and the allegations that the individual committed Batter on the officers.
    One thing I can tell you, it is a seeming common practice to load the defendant with multiple serious charges in order to “CYA” for the officer and the Department. Looking at the limited footage that was shown, this arrest should have never occurred. What the officer should have done is to facilitate the exchange of information between Bubba and the other involved party or, impounded the go-cart, taken a Traffic Collision Report and be done with it. This is what happens when officers are poorly trained, poorly supervised and are allowed to run roughshod over the communities they serve. I hope Bubba fights this arrest and seeks legal advice because his rights were clearly violated.

      Exactly. They want to scare their victims into complying so that their own bad behavior goes unnoticed by the courts, as that's one place where they might actually face reprisals for their crimes.

      Interesting comment. I do consider the property damage an issue here, and it looks like the cop is trying her damdest to get a resolution for the victim. Alleging he is responsible for the damage and failure to report an accident is kinda suspect, but he does have some level of liability - but is it criminal? So the victim is identifying the guy as a responsible party, he retrieved the gokart ... but can't/won't supply the requisite information for restitution purposes, i get it he doesn't have to. So the cop is likely gonna pressure him with the arrest/detention, well the LEO has a verifiable victim who can swear to an affadavit and they can "take care of things" on the backend when suspects have already gotten away. Did he leave the scene of a crime? Well he wasn't directly responsible, so no. Could he be civally liable, i think so because it is a motorized thing. If it was just a bike, i doubt it. He had knowledge that it was being used on the road, which is not correct - but isn't one of the crimes listed. I'm sure there is some kinda given that he dngaf as long as his property is returned, hence the notification his sh*t was left unattended. So someone else left the scene allegedly injured, well - he may be civilly liable and there's no indication that he won't let it happen again...hmm. Impounding him imo is coercion... impounding the go-kart would be evidence in the prior crime. He's not cooperating fully, which is fine with me. The victim needs a report for ins. purposes...and then they can go after the go-kart owner. But he is bubba, not bubba lastname ... so it's all cohersion to get that ID. I learned many years ago that you can't get blood out of a stone, so don't bother. This leo went too far. he shoulda left a chain on the door if/when he actually answered the door. Exigency, not so much. i think they filed the wrong charges and he will get off, but it's a long road. In the mean time, the victim has his ID and can take care of their end. So you are completely right, he removed evidence from the scene and should have given up some info. But like always, the LEO doesn't know how to talk to people. The use of a taser is very concerning to me, escalating an encounter like this to that point is unethical. He didn't slam the door in her face and was willing to talk it out. LEO didn't want to do the job, but a job on him. complete BS. not saying he's a good person, once they get a drug charge they are like "see, I was right to be an asshole!" well it doesn't work that way. he might get roped up depending on the judge. And the not so invisible blue line could really fk him over. if she had done things right, she mighta got the same result w/o completely viol./tasering him - no skillz. sry, i type fast. glhf.

      Thank you for your service. I respect the Police. Traffic Police risk their lives every day just by pulling over someone. But they save hundreds of lives by enforcing the law.
      This video is outrageous!! How the 375 pound female (if she identifies as that) passed her physical is beyond me.

It’s illegal in most states including the largest ( California, NY, Florida etc) And very importantly, if it is legal in your state, you cannot use deadly force or weapons- only the amount of force REASONABLY NECESSARY to avoid the false arrest. And guess who gets to decide the amount of force that is reasonable? Anyway, we agree that the chances of you ending up in the marble orchard are very high.

    The problem isn't the cop, the problem is that the system now charges Bubba with a crime and until it's resolved, he has no options for recourse. We need to stop retaliatory charges; if a cop arrests someone without a warrant illegally, charges against that person should HAVE to be dropped.

      If you’re indicating that he can’t file Title 42 section 1983 (federal civil rights) claims against the police officer until his criminal case is resolved that is not accurate. While there may be strategic reasons why an attorney would wait until the criminal matter is resolved there is no bar unless the person has already been convicted and then after being convicted he/she files a claim which would impugn the validity of a conviction. That’s known as a _Heck_ bar.
      Some people have mistakenly thought that their claims didn’t begin to toll until after they resolved the criminal matter in their favor. Some people have been time barred from perusing their claims because of this misconception.
      A good civil rights attorney is going to track when claims begin to toll and to keep an eye on the latest filing date.

      Soon as they arrest you, damages begin to accrue. They are taking your time.
      They are keeping you from work.
      Many cases they tow and impound your car.
      All of this puts you under financial loss.
      If you miss work you may lose you job.
      Getting arrested my cause you to lose your job until you prove your innocence.
      Even if you are arrested and out on bail you may lose your job due to having unresolved charges.

      he also withheld the information about who crashed the cart, u cant tell me they took it without asking and then told him, and still think he doesnt know them.That childs parents are liable, and maybe even bubba depending if he lets them use it often.her trying to arrest him in his house is wrong but so is withholding information about a crime.

    Looks like a home invasion to me. Armed criminals forcing their way into a person's home, attempting to kidnap that person. False imprisonment, too.
    I'm honestly surprised the pigs didn't shoot the dog...

    Home Invasion - the crime of entering a dwelling and committing or with intent to commit a crime (as assault) while armed and while another is lawfully present.
    Kidnapping - a crime at common law consisting of an unlawful restraining of a person's liberty by force or show of force.
    False Imprisonment - the confinement of a person without the consent of such person or without legal authority.
    Did the pigs enter a dwelling? Yes.
    Did the pigs commit a crime? Yes (kidnapping).
    Looks like both criteria for 'Home Invasion' were met.
    False imprisonment appears to have followed.

      I got a case dismissed many years ago saying the almost the same thing. I offered not to file charges if the case of my friend was dropped. They got back to me in less then 3 days.

    You are exactly correct about defense attorneys. My girlfriend worked at Walgreens and they accused her of stealing something which was bulshit the defense attorney didn't even look at the evidence just told her to plead guilty to disorderly conduct. Defense attorneys in the Da's are in cahoots

      People through aloud the word sue like its free. Truth is, you need time, resources, and money to sue. That's what makes the criminal justice system inherently unfair to the working-class and people without means.

      That's because if you were better informed, you would know civil attorney's use what is called a "contingency fee agreement," which means the attorney representing him will get paid either 33.3% or 41% directly out of the settlement amount achieved in the law suit. Plus, the same agreement discloses how all of the law firms expenses will be covered, any upfront out of pocket expenses paid to handle his case also are paid from the settlement awarded . The same way a personal attorney handles cases. So Bubba don't need money from anyone here.

    Whatever training these cops are getting... is the wrong training. They seem to think they can do whatever they want. They also seem emboldened to take whatever measures they wish. It is time for them to fear some repercussions! Perhaps they'll then get serious about learning the law, rather than doing whatever they wish, knowing that it won't be them that pays the price.

    That cop showed up to arrest someone and she didn’t care who or for what. Amazingly, she could find no reason to arrest anyone so you’ll never guess… obstruction!! Imagine my shock. Attorneys need to start just assuming a constitutional violation occurred anytime the work obstruction is uttered.

    Many plaintiff are too poor to hire a quality lawyer, and as a poor defendant they rely on the public defender who works under and share the same DA Office. Public defender wheel-and deal with the DA , sometimes to the detriment of the defendant and the law professional. The cliche has more truth than most people realize: You want justice ? How much can you afford?

    I saw a similar situation on On Patrol Live where the cops received a complaint about a man answering his door naked. Cops came and when the man refused to step out, they (the Chief was on the scene took the lead) stepped in and put him in cuffs inside his door. They later released him after the chief lectured and berated him in an emotional rant. I messaged the police department, and they replied saying it was perfectly legal based on Terry v Ohio. I’m no attorney, but the interaction seemed questionable to me. Unfortunately, there aren’t many people who are willing to stand up for these things.

    This Kansas and State vs Shively 1999 would be the standing case law in which deadly force was use against the police officer. She could have obtained a search warrant from her smartphone.. her actions are totally unjustified.

    I have a question about judges who refuse to watch the body cam footage or other video evidence. What are we supposed to do when the judge claims he does not have time to watch them? I have seen this happen more than once and I was shocked. He took the word of the cop and did not want to see the proof of innocence.

    Fail to report damage? They didn't even have a chance to! They were recovering their stolen vehicle! Besides, their own vehicle was damaged. Where I live, police will not even show up. They tell you to call your insurance company and not the police.

    They apparently aren't teaching cops about trespassing laws, public v private property, or ID laws. Why would they teach them about the 4th Amendment?
