- Well, you asked for it, so we delivered: a video on the Financial Trading Commission (FTC) and the Children's Online Privacy Protection Act (COPPA).

This video might upset a lot of people because we're not actively panicking about the future. A lot of noise is being made about this issue, and people are rightly very worried. At the same time, we'd recommend exercising caution and adopting a wait-and-see approach until we find out just how bad things are going to get.
UA-cam seems to fall apart every other week. What is with this place?

Kids under 13 can't even post videos on UA-cam themselves, because they agreed that they're over 13 by the time they created the account or are supervised by their parents, which means that their parents did uploaded the videos and gave the permission. That's the whole point here which actually everyone misses.

This law was NEVER well intended, praetoriancorps. It was from the beginning a reaction to the Supreme Court saying "No, you cannot make 'obscene' artwork illegal!" when they threw out COPA (one P).

The FTC / Coppa is so out of touch with pretty much everything and as such do not need to make law's about an issue they know nothing about.
Coppa has destroyed my UA-cam Kids toy channel WD Toys. Revenue is down more than 50% from Last Year. This is my full time job and I support my 6 kids ages 3-12 with my channel. Now I don't know how I am going to pay my bills.
Will file a lawsuit against UA-cam for their abuse of power and you will likely win because that's unjust if I was the judge I would make you pay back all the revenue they took from you and also other content creators 10 times over that means they will be paying for the rest of their lives!

But if the FTC uses out-of-touch adults to look at the videos they'll say it's for kids because it's Pokemon, and a machine could make the same claim because of the use of bright colors for all we know.
These guys just don't know what kids consume vs teens, young adults, or even adults just a bit younger than themselves. And now they're wanting to make career ending decisions they're neither equipped or knowledgeable enough to make.

No, the issue is that people will abuse children if it makes them profits. That’s the issue.
In order to violate COPPA, one must be an operator of a website.
According to the definitions put forth by the FTC, an "operator" would be one who "collects or maintains personal information..." or "on whose behalf such information is collected or maintained".
Content creators on UA-cam do not operate, have any access or control over the website's software that gathers and stores personal data of it's users. Secondly, UA-cam does not collect or maintain user data on behalf of content creators. With or without content creators, the data would continue to be amassed.
UA-cam collects and maintains user information on behalf of UA-cam and UA-cam alone, for its own targeted marketing purposes.
By the FTC's own definition, content creators are not and cannot be defined as "operators" and as such, COPPA should not be applied to them.
Regardless, while they are mercilessly thrown under the COPPA bus, it's business as usual and UA-cam happily continues accumulating user data for their benefit. Let's be real here, we all know its not as if kids under 13 are going to stop lying about their age to make online accounts and watching videos that were not intended for children whether on UA-cam or elsewhere. So really, all this is helping who?

I too am a youtube animator with the same dreams as you. I opened up this channel when I was 13 years old and had so much ambition for my own content. Now that the FTC is enforcing its scumbag rules upon us, it just isnt fair. I could lose both my videos and all my favorite animators in one night. Someone needs to stop these assholes. But those things aside, I think you should continue doing what you love. : ) I hope you become like your favorites.

COPPA - Don't "collect" data of children, CREATORS - incapable of collecting data. Is there a disconnect here??
I like to think that it would only apply to content creators that are monetized, because the targeted ads are what they're trying to stop, so I doubt they would be able to fine someone who makes no money off of the videos

They could have just stopped running a system that collects the data of under 13s and everything would be back to normal.
Instead they chose to throw us under the bus.
If this is going to backfire on anyone it should backfire on UA-cam.
A misunderstanding ....which may or may-not have fully grasped ...yet. UA-cam is forcing the reclassification of a channel or individual video because they don't want to be financially penalized. Even though the FTC stated creators can be fined, UA-cam will also be fined in addition to the creator. So they reclassify the video in order to prevent themselves from paying a the penalty. UA-cam doesn't care if the creator is penalized by the FTC, UA-cam only cares if they may be penalized and will adjust content accordingly. UA-cam is now fundamentally changed! Creators will need to find other venues (video hosting sites) to attempt something similar to the golden days of UA-cam. UA-cam deliberately violated the law due to greed and now everyone must deal with the consequences.
Hmmm. I think we found a loop hole big enough to sue the FTC and get our money back, thank you!

Think of it this way: there are two city’s right next to each other. Adult vill and Kids vill. Kids vill is all happy and colour full while adult vill is sad and gray. You can either build something boring in adult vill and make money or you can build something colourful but make little money in kids vill. If something two colourful and happy gets built in adults vill, it will be torn down and destroyed. They would destroy it with the thought that kids from Kids vill will come over because of the colourful-ness and then be saddened by the rest of adult vill.

@@variamente6855 The required categorization of videos is just a byproduct of YT's settlement in which they admitted to illegally collecting data from kids 12 and under. The only reason why you have to categorize your videos now, is so that YT can keep their data collection process turned on site-wide.
The law was probably written by washed up 60 something year olds because according to FTC, if you say words like "Yeah" and "duh" it mean you are targeting your videos towards children. I use those words often enough in my day to interactions with the world at large... and I am 26. The FTC is filled with out of touch jerks that want to line their pockets. Remember that this the same agency that hired Ajit Pai. I dont trust the FTC farther than i can throw them. And I have a weak throwing arm.

Yeah vaguely worded laws should be made illegal in itself as vaguely worded laws are the ones that are abused the most in malicious ways. In other words, the Idealogy that vague laws end up causing more harm than good needs to be deeply rooted into our legal system. This is because the best way to make a profit is by doing so immorally behind the facade of a well intention yet purposefully vaguely defined law. So those who profit the most from "legal" fines have a strong incentive to make as many vaguely worded laws as possible to maximize their profits and the only thing to stop them from doing so is a sense of morality which we all know by examining history isn't a strong defense against wrong doing in itself.
This has always been a problem with the human race since the beginning of human civilization and we still haven't conquered the issue and perhaps we never will but at the very least we can certainly still improve in this area greatly.
It's kind of funny but I think they'll need more lawyers. The sheer volume of people liable is insane. If youtube was a good company they would just take the hit here and make sure every account that is age under 13 is provided with all the tracked information(for their parents to view). Instead they announce that everyone is going to be liable when it's their own fault...
Let me be really clear here, creators have no say in who watches their videos. However youtube does, especially when you consider how they are curating recommended feeds.

Random people made a law and force companies to go by it
They care for the parents responding about the internet, not the people that use it.
They are really vague
They want big companies fined to get a lot of money and not the small companies
They also care for only kids, not the people that are innocent and caught in the crossfire

Every website that’s not already “age restricted” is in violation of COPPA. My 5 year old son can ask Siri about the FTC and she’ll take him to FTC.Gov where they will collect his device information, IP address, cookies and anything else required to load the website on his device. I actually called them and asked “who’s allowed to visit FTC.gov?” The representative said “anyone”. That means they are knowingly taking information from children (WITHOUT EXPLICIT PARENTAL CONSENT) who happen to visit their website. Of course, this includes most of the entire internet but my point has been made. Unless you’re website has an age restriction already in place, then, you’re probably gathering ILLEGAL information as stated below in the FTC guidelines....

Not really, or at least not by much, the article passed but will come in effect only in 2 years from the day of passing. Passed in may so it will happen in may of 2021. The article was also an attack on freedom of speech and more but people made it about memes to help spread the message, which failed, (as in, it spread very little) and then almost no one further explained that it wasn't about memes but more about free speech (for us, it was corporate greed for them as they were being paid by all the big industries for this). They then proceeded to change the name to article 17 to confuse people and it worked cuz no one is talking about it anymore... :/

I've learned from experience that petitions don't work.
Laws are difficult to pass. They are nearly impossible to repeal.
You have to address to your state's Congress men about this appeal for the notion to deny.
Cause regardless of the law, the country is democratic therefore needs votes for approval. The word the FTC and cappa are using are scripted to be viewed as good guys saying "it's for the kids".

Further to restrict all communication because they can't stop kids from speaking is a Violation of the First Amendment.
