Here we go again, another big, scary change coming to the platform that has Creators shaking in their boots. I'm talking about COPPA, the Children’s Online Privacy and Protection Act. Now COPPA has been around for a while but not too long ago the FTC and UA-cam got into things over whether or not UA-cam was in violation of it. The results have a lot of channels - family, gaming, art, and many more - scared for their jobs, their livelihoods, and their homes on this platform. Today, I want to talk about the reality of COPPA going into 2020 and what we REALLY have to worry about and what we don't.

You can't put everything on the creator, they do not have complete control over who watches their content. They can put warnings in or on the video, but kids can easily ignore those. It's like the games that ask you "Are you 18 years or older" and all you have to do is click a button or lie about your age. It's not hard math to give yourself a birthday that makes you seem older.

find the terms of service, read it carefully, and you'll see they contradict themselves a lot when it comes to establishing youtube's dependency on advertisement.
they state they depend on advertisement, and then it states that a channel eligible for advertisement can't affect their viewers engagement with the channel, so they can't call for subscribers, or likes, or views, or favs, or anything that alters the "natural flow of data".
so, if the channel eligible for advertisement then suddenly drops the revenue from advertisement and youtube loses money from that drop, it's all "meant to be".
by their own declaration, they exist to flop.

The FTC is going to break the 8th Amendment which states, “Excessive bail shall not be required, nor EXCESSIVE FINES imposed, nor cruel and unusual punishments inflicted.” If the FTC were to fine 42k per video on thousands of UA-cam channels that would count as excessive fines. LET THE WORD SPREAD OUT!

You'd think, and hope, that would be the case but unfortunately we in the west live in a society where the mantra is, almost quite literally in some cases, "not my problem".
Because the US and Canada are very capitalistic/materialistic focused societies the generation currently in their 30s to 40s, aka the generation with the largest number of parents currently, is so focused on earning wealth and increasing their pay check that anything which stands in the way of that, a smelly, annoying kid for example, is ignored in favour of spending more time making money.
So where are these kids going to turn when they're ignored by their parents in favour of gaining more wealth? The internet usually. Either that or they get pawned off on teachers who are forced to teach children the basic skills that should have been instilled in them by parents, basically being used as free daycare, but that's a whole other can of worms.
Because parents are acting irresponsibly towards the raising of their kids other people are being blamed for their incompetence while parents get off scot free, if they're lucky they might even get some money out of it because they'll sue the people who obviously aren't teaching their children properly, or are allowing their kids to watch inappropriate content.
Anyway, sorry for the rant, but this is a subject that I'm rather passionate about, my mother is actually a teacher so I've seen her needing to deal with these kinds of issues whenever it comes time to renegotiate her work contract.
Listen, its not that parents shouldn't let kids watch the videos, but its the parents job to teach the kids why watching videos that aren't suited for them is inappropriate. I have a younger cousin that loves watching horror (as well as Roblox) and she watches that UA-cam channel that has creepy monster shorts. I think its called CryptTV. She's super young too.
All this is, is the government trying to sanction more limitations on a platform that grew too large. UA-cam has a monopoly on the Online Video market, and its why having other forms and ways to do things is necessary. I hope that different sites like Bing and Vimeo grow enough and improve their site's enough to gain more traction.
@@dragonmaster1500 As a very proud Canadian, I can see the point you bring up happening in schools everywhere. That's the one thing I hate so much about my country. I would have to say that I am very left wing when it comes to economics, as I agree that far right capitalism causes our younger generations to lag behind other countries' children of the same age.
I too have spent a lot of time dwelling on this thought and have considered doing many school projects on this topic myself, but haven't been able to because I can't for the life of me find a good solution. That is why I will now ask you what you think the best solution to reduce the effect of this issue.

Don't get me wrong, I agree with everybody's statement here but sometimes kids are also responsible for their actions. My family and I tried to supervise my sister's content as much as we could and point out to her what she shouldn't be watching, we thought we did our best yet she still watches some inappropriate content (for her age) and develops an unacceptable narcissistic behavior and etc. She acknowledges that behavior is unpleasant but she still does it anyway.
*My point here is don't just blame parents, the kids are also responsible for their behavior.*

By the logic of COPPA, anything that *_looks_* like it can be kid's content would be kid's content, and anything that *_doesn't_* look like kid's content would be adult content.
Or, rather: anything they decide falls under those four categories they believe are "made for kids" even if they're technically not "suitable" for kids is on the chopping block.
Looking back on this, I got such an extreme wave of nostalgia. I remember this was going to be the end / apocalypse. And even brought me back to the Area 51 rare 😂/😢

I would say the same thing but the retailers brag about how children like to watch fireworks (to sell the product) and then stick it to the manufacturer when the law comes in. Would have been fine if parents just didn't let their kids play with the fireworks. (Yes. I'm attacking parents because they should know about children's UA-cam and giving kids addictive technology in the first place without restrictions is kinda lazy and irresponsible parenting.)

Yeah it's everyone else's fault that UA-cam broke the law and then bragged about breaking the law then blame the content creators when they got caught breaking the law and now when they break the law the fines are going to go directly to the content creators and they can continue their shady practices because they are just an ethical billion-dollar company.

it has more to do with the fact that TV cant track the viewing habit of kids explicitly, while youtube can and does. It isnt showing adds to kids, its illegally collecting data and targeting adds directly to children using this illegally gained advertisements. basically, if youtube only collected viewing data from accounts, and not IP and browsers, they'd legally be in the clear

I agree! Parents need to be more self aware of what there children watch. UA-cam and the FTC can't be in charge of if children sneak on to the UA-cam platform if they are under aged. And it's very unfair to the UA-camrs for giving them such shitty outlines on how to categorize their videos.

@Simple DuckyMoMo When it comes to young children, parents should be the ones in charge of what apps they have installed, so YT kids isn't useless if parents actually watch what their children download. Children under the age of 10 shouldn't even have moblie devices of their own in my opinion, because it causes a range of problems, also parents can actually monitor what their children watch/use.
