According to the rating criteria, PTSD is rated at 100% when the condition causes “total occupational and social impairment.” That means a veteran with a 100% P&T rating for PTSD is presumably unable to work and would not otherwise have the rating. Hello, Devin. You can work with a VA rating of 100%, but veterans with this rating are generally unable to work. If you're rated 100% for ptsd but it's not marked as permanent, do you have to keep seeing a therapist or psychiatrist every few months? Somebody told me that if you don't, VA can reduce the rating because you're not permanent...
From what I have read and listened to, the VA can if you continue to show improvement in your condition. So, if you are having continuous issues (which you more than likely are having at 100%) make sure you have ways to document these continuing issues such as statements from friends/family or through therapist appointments at the VA or private sector. After 5 years the VA may request a follow-up appointment to reevaluate your condition. They will not lower it unless they can prove you have shown continuous improvement. After 5 years they will not reevaluate you unless they have proof you have shown continuous improvement or if you file a new C&P claim, possibly for a secondary condition related to your disability. Bottom line is that unless VA can prove that your condition has improved then you will more than likelyremain at 100%. Hope this helps

Good question! TDIU is based on your ability to work. If your condition, such as anxiety, improves with the help of medication, can the V.A lower your rating? Assuming you were rated initially on symptoms without medication.
Unless the effects of medications are specifically included in the impairment rating criteria for your condition, the VA is not allowed to consider whether a particular medication moderates your condition in determining the degree of disability.
For mental health, your rating is more about how the condition affects your daily life. Your rating will be determined based on how your condition, with or without medication, impairs your ability to function.

If someone has a 70% static mental health condition that finally starts to improve with medication, will the VA re-evaluate or potentially reduce based off of this improvement, even though it is considered static and has been in effect for 7 years?
@@woodslawyers Yes, and have had it over 7 years. There is no future evaluation scheduled. Just concerned that seeing a VA Psychiatrist that shows improvement with meds would cause a re-evaluation.
Seeking treatment through the VA does not trigger a re-evaluation of your rated disabilities. If the VA has scheduled no future C&P exams for you for this condition, your rating is considered permanent. If you sought a rating increase for your mental health, however, the VA would then be allowed to consider new evidence, including your VA treatment records, in evaluating your rating. I know it's confusing, but I hope this helps!
A 100% rating is given to disabled veterans with extremely severe service-connected conditions that usually make the veteran entirely unable to work and mostly unable to care for themselves, including bathing and dressing. Base camp Clark airport and roam around. Never been to Bagio but I'm gonna go stay a few days. Hope you are well

If someone has a 70% static mental health condition that finally starts to improve with medication, will the VA re-evaluate or potentially reduce based off of this improvement, even though it is considered static and has been in effect for 7 years?
When you say "static" do you mean that the VA has granted you a permanent rating for that condition?
@@woodslawyers That makes sense, thank you for the clear explanation, I appreciate it.
The qualifications for 100%would have been helpful
A 100% rating is given to disabled veterans with extremely severe service-connected conditions that usually make the veteran entirely unable to work and mostly unable to care for themselves, including bathing and dressing. Many veterans do not meet this criteria but are still unable to work. If that's the case, they may qualify for individual unemployability benefits, which pays the same as a 100% rating.
@@woodslawyers thank you for the information appreciate what you do for veterans
@@woodslawyers what if you are able to work at 100%? I'm rated at 100% for mental health because I have lots of symptoms but I've been told that being 100% for any mental health conditions makes you unemployable. Could you please provide some insight?
@@rev6925 Not true. You can work unless you're deemed unemployable in your Claim. TDIU. Even with TDIU you can still make money it just has to be under the poverty line. Which is around $13,000 a year.
Really good thank you!
