    I've been practicing law involving many chapters of the UCC since 1987. I've studied it, I've written about it, I've taught it, and I've briefed many sections of it in legal arguments. After listening to Defendant's mumbo jumbo argument my brain hurts.

      Just because judges let them go on - doesn't mean that the judges are persuaded. In fact, considering how ridiculous their claims, the judge probably wants as much of their nonsense on the record as possible. It makes the eventual ruling so much easier - and the defendant can't claim they didn't have due process. Everyone gets their day in court - if they want to waste it? Well....

    Why was he not held in contempt? He not only disrespected the Judge, but was coddled. Shouldn’t have been ordered to return the trailer on their own dime and had a conviction of fraud on top of it all. Not enough consequences for these people. They will just head on to the next victim.

      @@andrea8844 I don't think so. Maybe I'm wrong but as far as I know a case without enough evidence to be prosecuted criminally can be taken to civil court but not the other way around. Please let me know if you find out

      Regardless, even in civil court these types are treated with kid gloves as the host states. I think it’s because judges often want to make the effort to show the sov cit they are being treated fairly, more fairly than they should be. It seems to be a futile effort every time, but no one who studies or has a fair understanding of the law can say they weren’t treated fairly.

      As I recall it's a chilling effect argument, if courts have a reputation for throwing the book at people who self-represent, it might discourage people with genuine issues from coming forward.

It's not a battle of two attorneys, the judge very clearly knows that he is blatantly giving the benefit of the doubt to these people, every professional in the room knows it, the out of line sov cits arent gonna be calmed by the opposing side insulting them, everybody wants them out ASAP anyways, it would be obvious in watching the footage or reading any sort of transcript how bad they are, so what is the upside of telling a judge how to run their court room?

    Mike, thank you for posting this without editing out the attorney's statement. I know it must have been painful for her to explain the defendant's statements and actions but it helped to clear up some of the claims that sovereign citizens always make regarding payment for property and services without legal tender.

    My first job out of college was auto collections. Praise be this sov cit bs wasn't a thing back then. I did have a customer call to brag they'd destroyed their truck I had out for repo and I just laughed and said now you're paying the entire balance without the offset from auction.

      No way because they themselves don't know how to turn them into currency. Even if signing over a 1099 could in some way be used the same as forwarding a check. Most people wouldn't even take a forwarded check as payment.

    So when the defendants bought a trailer under a contract and knowing exactly what they were doing to purchase it, then they waited to do a sovereign citizen move all along, I see this as premeditated sovereign citizen fraud.

      Not really. Defendant lost completely. And (maybe in another video) - the judge advised them to be smart and make sure the trailer was carefully cleaned and, perhaps, returned to the lien holder. In order to save themselves the lien holder's costs to come pick it up and clean it.

      I politely disagreed. He let both parties speak, asked considerate questions, ruled in the plaintiff's favor and then explained his ruling. No, he didn't directly say the defendants sucked but I dont think thats on him.

    The couple seemed very happy they get their papers back. The Attorney did add they said they sent bond coupons but hasn't been received or proof of being received. They can try to take them back to court to get them but it will cost them more.

    I guess there’s a reason I’m not a judge, but if I were the judge, in this case, I would ask to see those documents submitted as purportedly payments, and make the declaration that I would be looking into whether they submitted fraudulent instruments.

      Exactly. If the guy sent Monopoly money, would he require the creditor to return it? You just saying something has value doesn't mean it has value under the contract terms or the law. Let this guy try to find a way to sue for the return of these papers that he sent unsolicited of his own accord.

    If the defendant claims he didn't recieve a notice of cure letter then they would have to reset the hearing after sending the proper documents.
