    Problem is that calling them incompetent releases them from responsiblity. They would get away with that which they want to get away with unless you can further restrict them. Certainly if incompetent they should not be allowed to drive, but if free to wander the streets they will drive anyway but are deemed too incompetent to symtand trial. We need more mental institutions.

      Absolutely not. Those individuals end up in state run psych hospitals but the charges don't just disappear.
      Either way, it sounds like this guy is caught in the nexus of his sovereign citizen ideas and his psychopathology. I may have missed the Dr saying it but to me it sounds like the man has TBI or traumatic brain injury. I would want an MRI done and or find out if he has had any accidents where he hit his head.

      Can't do that or it would give the air of legitimacy to his asking that cop for $500. This is why common law can not be the law of the land alone. Any judge could slip up and accidentally set precedence that some yokel will misinterpret. If the judge asked for $500 he would then be sited by every sovereign citizen until it gets straightened out by the Appellate court. Then you know some fool like Balen (I think that was his name) will take it all the way to the Supreme Court. Which would take years. This is why written law overrides common law every time.

      Mike and all you people who laugh at sovereign citizens, I get it their easy targets, I’m not defending the individual people trying to go against the grain , it’s sad but if you know history our founding fathers were sovereign people, they believed in common law and Gods law , as well as English law and jurisprudence, they didn’t go to court and screaming about a right to travel , however the years since have seen our personal liberties and freedom being eroded, so a lot of so called sovereigns , don’t know the law but they feel they are loosing their freedoms too , and their getting more and more radical like the black panther in the 1960 s keep nit listening to the people and the mobsters will take it over .

      There IS a distinction between "driving", "traveling" , etc. and "operating" in some ICC regulations and possibly IRS rules. But they would not apply in this instance. Laws often define words in the context of a particular case. So a burglary statute might define the act burglary as including the attempt to escape or conceal the act, whereas a self-defense statute might include burglary among the enumerated felonies that would justify using deadly force, it would not authorize use of such force to prevent the escape of the suspect, absent a continuing threat of death or serious injury

    The judge is trying to do work that’s going to help its colleagues nationwide because this isn’t just a nuisance and novelty anymore. These people are really starting to clog up the court system and become a serious liability.

      Yes you’re exactly right - it’s slow moving but the courts are working on seriously disrupting the legal processes in order to stop this this type of behaviour in its tracks. They’ve been classified as a terrorist movement by the FBI because their beliefs are suggestive of anarchism.

      @@iamamish I forget the title, it’s an egghead PDF with no pictures it’s called sovereign citizens: a growing concern, something like that. It was pulled out by one of the organizations representing the legal profession. They absolutely go all the way to court all the time. People run entire UA-cam channels filling their days with nothing but people doing this, and imagine only a fraction of courts have their video feeds available.

      I know the SC types show up in court and everyone makes videos about it, but that doesn't really tell us how common it is.
      For example, what percentage of court cases (could be divorce, civil cases in general, criminal, etc.) involve an SC? I'd be shocked if it is more than a fraction of a percent, but maybe I'm wrong.

    They should put up a sign on entering the courtroom, that says: If you are a Sovereign Citizen and you don't Identify yourself with a clear and valid identification, to the court, you will be found in contempt and you will be going to jail. Quit wasting the courts time.

      The best sovcit comeback by a judge was when the defendant refused to give a name, while claiming to represent the defendants trust. Judge threatened to cite suspect for failure to appear. Brilliant 😂

      The PSYCHO LOGIST was paid to evaluate this defendant's mental status and is not an expert witness who has studied the SovCit moveMENt so why this Judge is asking that question in open court is inappropriate in this case.

      There are PhD programs in psychology. The University of Arkansas has one (as I'm sure every large school does). The doctor has such a degree. His website says such.

      He’s made the false assumption that there’s logic motivating these people. I just saw a video earlier today that was about an interesting paper that was written about stupid people and he had 5 laws of stupidity that he outlined. One of those laws decoupled the person’s stupidity from any other classification or education, because there are stupid people of all varieties. His definition of stupidity was based on how the behaviors of a person benefitted themselves or others. This guy falls right into the definition of a stupid person, which is someone whose behavior does not benefit and actually harms others and himself. If their behavior does not benefit/harms themselves, but it helps or benefits others, then those people are hapless/helpless. If their behavior benefits themselves, but harms others, those people are referred to as bandits. The people deemed intelligent are the ones who benefit society and themselves.
      It was a pretty interesting point he was making because he argued that stupid people are far more dangerous than anyone assumes, because they are not predictable like a typical bandit who will act rationally.
      In this case this guy is not behaving or following any rational thought, and he’s clearly only hurting himself more as he inflicts annoyance and frustration on the court and everyone in his life.
      I would say he’s stupid by any definition, but I think that if we stop prosecuting people for their stupidity, then we’re going to have some serious problems with the justice system.

I am actually sovereign on my federally recognized tribal land that I reside on, even still any road way I drive on I still need registration, insurance and a license. If you own your home, I guess you could transport in your driveway, traveling on the roadways without, you deserve being arrested. Quarter of a million, I guess thats your problem to buy an island to put them all on, in the meantime follow the laws and pay your dues or leave and/or get arrested. My guess is you’ll get the second choice and still get a home in a jail cell.

      I'm so crazy I'm on disability. They're never offensive about it. It helps get proper medication treatment to keep you off the ledge, away from addiction or in his case out of the vicioius loop of the justice system

She cooperated with the police and...it appeared to me... was reassessing her desire to be a part of this relationship. Hmmm...stand by your man or cut your losses?     Wow, I love this. Finally a judge asking for competency of a Sovereign citizen. This will go down in history. Mike can they use this testimony in this court hearing in the future for other sovereign citizens? Also, will this lead to further competency hearings in the future. I think the courts are getting tired of having to deal with sovereign citizens.

    I've been studying the Q Anon movement for several years and just started looking into this sovereign citizen issue. It's amazing how the Q Anon individuals have integrated some sovereign citizen ideology. I wasn't aware the revaluation and birth certificate issues came from the sovereign citizen movement.

      SovCits abhor cooperation, they lack any coherent philosophy and seek only their own selfish ends, thinking nothing of attempting to use law enforcement and courts in perverse manners to obtain even their most ridiculous whims why simultaneously grasping at every straw to avoid the slightest consequences to their own actions. I recommend looking into the case of Naomi Arbabi for an example of this behaviour

    after watching so many of these videos, I'm so impressed with the judges who are handling these cases. They are so concerned about protecting the rights of the people in their courts. It really makes me feel so positive about how much these judges care about the people in front of them. I really want a team Judge Simpson t-shirt. He's my hero when it comes to compassion and yet maintaining the ethics and historical value of the judiciary.

    I got pulled over a couple of weeks ago and for a split second thought about telling the police officer that I wasn’t driving, I was traveling. I’m not driving a commercial vehicle for hire. But I just apologized to the officer and handed over my license, registration and proof of insurance. The whole encounter had me on my way in less than 5 minutes.

The annotations are highly entertaining. Carroll was brilliant in several areas of scholarship & current events, as evident from his “Alice” stories. This JuDge violates HIPPA laws to the 9s in this simple case of traffic violations .... ... yes we as a society need to shame these soveREIGN SHITizens to stop abUSING our government employees who are low hanging fruit ... they should be contacting their ELECTED officials and take up their grievances with them!! who make laws$ for US to obey and pay v them and Judges who abuse their AUTHORity as in this simple traffic case ....

I know as my son and I were victims but fortunately and unknown to Judge Jorge Solomon and his Sister Elizabeth Epstein who refused to allow US to present evidence from our own Family DR's and ordered ME to pay their chosen court whore psychologist. DR GREEN but fortunately for ME and my son, I AM educated and practiced in psychiatry as an RN ... I contact DR GREEN by phone advising him of the HIPPA laws so he notified Judge Solomon who had no choice but to ditch his plan to screw me over as I AM a gOVERnMEnt wHIStle blower MENtored by the best in LAW, poliTICS$ , reLIGion$, FINances$ and huMAN behaviors$ and so I WON custody but it did cost me my wealth and health so now I teach others similarly situated in civil matters$ that turn into criminal matters through no fault of their own

Christianity itself, not the different churches, but the raw concepts from it are helpful to many people. Such as caring about others, and forgiveness. I am an agnostic, a hairs width from atheism.     I reject the Doctor's main premises that this defendant making a simple misdemeanor into a much harsher charge being the reason he determined incompetency. He actually said that isn't the case in other "sovcit" cases. At least on UA-cam, more than 50% of the cases are exactly that -- usually driving without a license being escalated to this nonsense.

      It's an actual psychological term though, at least it was when I took some undergrad psych classes in college. It's used to describe the stream of language from people with conditions like schizophrenia where the language is a shuffled combination of words and ideas that don't lead to a logical narrative or comprehensible point, and is not an appropriate response to what preceded.
      There's a few different verbal behaviors like this that can aid in diagnosis of mental or neurological disorders. Psychologists distinguish how the language is being distorted, and word salad describes a distinct kind of distortion.

    Just imagine that ' someone ' thought they should have a competancy hearing over some traffic violations. I doubt the arresting Officer called for the hearing. Someone further up the chain of command was alerted and became aware of it... and felt this was the road to take.

    First, he's not an attorney and has representation so he can't object. Second, if he doesn't step into the gallery to speak he will not be heard (I’m kind of angry that the judge is letting him do that.) Third, as we saw in the Mohammed Ibris case, if you don't acknowledge that you are the person in question and show up, then a bench warrant should be issued for failure to appear.

    I was making the same argument on VanBallian’s video. It would be easy to claim incompetence thus avoid jail time/fines However being involuntarily committed isn’t a rosie thought. I think there are some that are susceptible to the scam who are not playing with a full deck but there are too many who like the chaos they create with this belief system. Slippery slope indeed.

    Mike, I want to thank you for your analysis, I believe you were spot on. The judge does not want to set a precedence that we begin to say, Sovereign citizens must be crazy so we should lock them up. It is like Plessy vs Ferguson in 1896, the Supreme Court basically said it is ok to segregate people as long as you don’t hurt them. We saw what happend with that ruling over the next 70 years! This was a very good hearing with much wisdom. Thank you again.

    I watched an interesting lecture yesterday by a psychiatrist about sovereign citizens. He basically stated the same thing as this psychologist. In general they are legally competent and legally sane. And for the most part they don’t qualify for a specific DSM diagnosis but they demonstrate traits of various psychotic, delusional and thought disorders. He further suggested that there might need to be a new type of diagnosis created for these people. But there’s a difficulty in discerning if they actually believe the things that they say. It’s definitely a complicated issue and I’m glad this judge is taking it seriously. We need cooperation between law enforcement and the mental health field to come up with a strategy for the evaluation and holding accountable of these individuals

    I bought his book for $5.99, kindle edition! It's AMAZING. He explains in excruciating detail exactly which documents you must sign in blue-ink, which you need to register with a county recorder in Maryland, and which you must send registered-mail (NOT CERTIFIED! OMG) to some federal agency in Puerto Rico.... if you follow all his steps you will be free!

    When I watched this on Van balian's Channel, I commented that I thought it was the same guy because he was the first one I had ever heard mention honor and dishonor during the traffic stop and he mentions dishonor at the end of this video. Also, I commented that I feel like the defense attorney knows that he is definitely competent because she couldn't even finish her last sentence when she was explaining to the judge about his quote incompetency quote.

    He was declared incompetent, sent for 'regrooving' (reference to Firesign Theatre) and next appeareance is Aug 15, 2023. So far 431 pages in his court docket for the offences so if the intent is to disrupt, then it is working. All viewable via Brevard Electronic Court Application

    Just googled his full name. He is an author with books on Amazon. The books appear to be about the Sov Cit movement. His biography on Amazon clearly is a Sov Cit, but it states he used to work for the DOD and handled top secret documents. He is also an actor and has appeared on America’s Got Talent.

    Mike, they aren't crazy. They just can't afford or aren't willing to do what's required to get their licenses or IDs so they think this gives them an excuse instead of being financially or legally responsible. That's why they always have warrants or no licenses, or are owing the money alleged. They have nothing to lose so why not go the sov cit route?

      That is true for some of them, but there are a TON who truly believe it and persist in upholding the faith while incurring more severe consequences (jail time, additional charges, increasing fines, etc.).

      I agree with you. They drag everything out. And this works for them. How many times have we seen the judge drops his fines, gets no penalties. Also these people ramble on about all these laws. They know them in and out, and the codes. So that part they are intelligent. The rest of us don't care to even try to understand these citizens.

    I've been an acute care Rn for 12 years. When i dont know something, i dont speculate. Especially if i was under oath.
    The fact that the psych md just said a sov cit *wouldn't take this approach for small misdemeanors* shows a complete misunderstanding of the sov cit movement. It is precisely the low-repercussion crimes that they choose to use it. When the felonies come calling, they lawyer up and stop talking (usually).
    How didn't Mike jump all over that?
    If the md can be so wrong about this very important quality of sov cits, how is he offering testimony about it? And what else is he offering conjecture about?

      With all this said, I love the idea of saying they're all nuts and they don't get to talk in court and if they want to push the issue they can go to a psych facility

    The BABS Test is a self-reporting scale, therefore, would depend on the client's responses (verbal) to test items. And, exercising his 5A is very sensible, not crazy.
