In America and depending on the state, if you walked in on a cheating spouse and killed them on the spot or caught them directly afterwards, things are the same. As long as it's not planned and you are surprised, you can claim temporary insanity. There is a human condition where people may lose control. Some of it is real and some not. But with a lawyer, you can get off.

@@DrsIrHenkJanJansen They're just using hypothetical examples of what could happen. They're not saying this happens all the time. But why would the police ask you if a girl had given her consent unless a girl filed a complaint against you? Unless you saying a woman filed a complaint against you and the police never questioned you.

Yes! A great many laws in the Philippines are just tragically ridiculous and unfair, and, unfortunately, reflect the religious immaturity of a kind, but (primarily) poorly educated third world population that badly needs to revise laws and thinking that is based upon long-ago discredited sections of the bible, in order to be taken seriously as a respected member of the free world in the 21st century. Can people navigate around this craziness and corruption? Of course they can, and many will prefer it. Money talks, bribery can work, and if they "flip a coin" they may even find out who their next mayor will be. A country where you could be sued for libel and lose in court for telling the truth about a politician"s evil deeds and nasty character...who would have believed it?? I don"t believe that all this does justice to the great majority of fine people who live in the Philippines, so wondering if significant change is on the way?..While I do hope so, I also rather doubt it.

Definitely agree with not acting superior or being arrogant. Being respectful and considerate is a big deal in their society. Once was in the province hanging out with my wife's relatives at the front of their house when the local "gangster" showed up wanting to introduce himself to me. I had him sit down with us, we had a few shots of tequila, and chatted for about 30 min. And as he left, I gave him a bottle of tequila. He was so happy, he told me that if anyone around town gave me any trouble, to say that I know him personally....lol
So for the price of a $10 bottle of tequila, I made a new "friend". Easier to catch more flies with honey!

This exact thing happened to me a couple years ago. I was picked up at Cebu airport by a cute girl who I'd met on DIA. We spent the next 5 days together and it was great! Well, little did I know that she had a local (expat American) older boyfriend. After I returned to the USA, she filed a criminal affidavit against me for rape and kidnapping (!!). I wouldn't have heard about it except that the old guy (who it turned out was really behind the whole thing) sent me a hostile email pointing out the same. I hired a lawyer on Mactan to run over to the courthouse and see if there was an action against me. Indeed there was. It took me 8 months and $3000 to get the charges dropped. What a ridiculous country!!!

But keep being positive, a fair skinned and blue eyed Christian is not illegal here.
American fellows should not complain of their legal rights in the U.S. - you have at least the right to own a home (a land with a house) and have a job, something generally you don’t have in the Philippines 😎

Hi. I like these videos with the lawyer. I work in a law office, so my interest is professional and personal. All of this video is fascinating. I like the that this attorney help with the police report. I have visited the Philippines. From my experiences, I think Foreign Nationals are treated differently, both good and bad. She is right when she says there is a language barrier and that gives the edge to the native speaker. The police don't seem to go out of their way to harass me and are often pleasant. The most unfriendliest police encounters have been in Cebu. The nicest police were in Bacolod. I think respecting their office and remaining calm is key for a good outcoming. Thank you for all the videos you do! Take care.

Hey Pea, thank you for having this Attorney on your video. Very helpful information. I look forward to visiting the Philippines someday after covid is over.
What I find ironic about westerner men , especially American men worried about being arrested in the Philippines , is how easy it is to be arrested for domestic violence or a any sexual offense without any evidence. In many states an accusation becomes evidence. A man can be handcuffed, finger printed, mug shot and spend the night in jail. If there was no evidence they release you from jail but the dismissed charge remains on your record. The rationale for this draconian legal action is supposedly to teach the man that domestic violence will not be tolerated.
What really is bad is if the woman later admits that she lied. The courts will not punish her because they will think its part of the “battered woman syndrome”
American Men worried about arrest in the Philippines should consider they are at much more risk of jail in America. From what I have learned about a Filipinas , most are very honest and would never lie as would many American women do.
In summary, an American man can be arrested for “domestic drama”in many American states.
Thank you for this video and your attorney friend 🙏🏽

What I find incredibly amazing here is that you seem to know your Bible very well 19:10, you are right, it came from The Bible and this is one of many laws that THE MOST HIGH GOD gave to The Israelites while they were in the Wilderness, during the early days of their Pilgrimage out of Egypt. Now you've really captured and Secured my attention to your channel, and everything you are saying is welcomed information and very entertaining, I am intrigued, I don't know your professional Background or qualification, but you are definitely brilliant and charismatic ! You remind me of my 7th grade and Home Room Science teacher, She was Filipina.

Most laws in the Phils are founded in common sense. If you behave well, you won't have a problem. Keep in mind that, if you do have a legal problem there, many incidents can be negotiated with the law enforcement officer. When that can't happen, have your lawyer consult with the family as most often they will accept a reasonable settlement to forgive you (you MUST have them sign off that the issue is settled permanently). Lastly, your lawyer can often negotiate something creative with the judge. Fortunately I have never had a single issue in the Phils however some foreigners "loose their heads" when they get there and think that they are invulnerable. Forget that, you are not and if you don't maintain a humble attitude, you may well become a target. I'm not a lawyer. Attorney Gracelyn is giving excellent advice in this video, thanks to her host.

The driver spoke great English and helped me understand a few things. I'd love to return after the political stuff calms down.

The laws of every nation are so varied and NOT necessarily based on common sense that it is almost impossible to stay in compliance with them. It therefore becomes almost necessary to consult an attorney when you enter a new country in order to stay out of potential trouble. Even here in the United States the laws of each state can vary tremendously. This opens the door for some people to USE the law for personal benefit. Unfortunately, most laws allow persons to "play the system" in order to extort or achieve personal gain using the power of the State. Everyone (in any country) should be aware that there are those out to entrap the unwary for their own personal benefit. Since I am coming to the Philippines after the pandemic I specifically appreciate your video on the laws of the land there in the Philippines. Like most me I sometimes make assumptions about the law that may not always be true everywhere. Thank you for another very informative video Pea. Hugs and kisses from the United States.

Yeah, due to the many comments I have read here, I am cancelling the purchase of the penthouse condo in Cebu City and I'll be looking at a different place to retire. I just don't need these kinds of shenanigans, people are experiencing, in my life. It is supposed to be 'better' than the US, not worse.

One "situation" comes to my mind. I was NEARLY A VICTIM.
Met a young woman on line date site. She said she was 30. I arrived in Manila to meet her. We were ready to go to a hotel and I asked her for her ID so we could register. She had none. We talker about what to do, then from nowhere her Father appeared. He informed Me SHE WAS 17!!!
I immediately left the Philippines. This type of thing happens regularly. A Foreigner can be Forced to PAY to keep out of Jail

What about foreign squatters? Are foreigners prosecuted for tent camping on private property? What about public property? Imagine a tourist on a budget, or a survivalist using available resources for food and shelter. In the states,it is legal to do this on public land as long as you only stay for two weeks per year in one location. Many years ago, squatting on private property for seven years without complaint from the owner was legal ground for title to the property. It is still done in some cases if the squatter pays the property taxes and makes his intent to obtain legal title clear. It’s a gray area in the law that probably gets manipulated more than most people think.in my neck of the woods. I’ve heard the numbers are high there for swuatters in the provinces
