      As lawful orders are concerned, a cop can ask you to step out of your car. But can a cop ask you to go back in your car? Does PA vs Mimms apply here?
      How about Commonwealth vs Barr? Because odor does not give probable cause to search..

      Is "get back in the car" a lawful order? Maybe. They love to make us do Stupid Human Tricks, just because they can. They can "detain" while they investigate, but does detainment give them the right to search?
      That officer was scrambling to get out of his car, like this was a known desperado, before the man was even out of his vehicle. He couldn't possibly have smelled "odor" at that point. So he got out trying to make trouble where it didn't exist. Sometimes I think that "racial profiling" is an excuse. Not this time. This "officer" is going on the idea that "he's black, so he must have been smoking weed".

      @@JackFromLeivasy The driver had just come from a "high crime" area. The cop did this with no other information other than he was parked in that area. Even if this guy was a drug kingpin, this was straight profiling with a guilty until proven innocent mentality. All for the way this "peace officer" handled the situation.

      In fairness to the cop he did tell Malik to get back in his vehicle twice. This isn't about a cop overreacting. It's about Malik and other "auditors" who over dramatize every interaction to get a response for likes on their YT channel.

    This “I smell marijuana” exception to the 4th amendment needs to end. There is no way to “prove” the cop is not lying.

      If we had a fair system, records would be kept as to how many times an officer claimed to smell marijuana, alcohol or whatever, and a later search or blood test showed no evidence of either. Such records should be (but probably are not) admissible to challenge an officer's credibility in court.

    When a cop claims that he smelled the odor and never finds anything, that cop should never be trusted when he claims that he smells the odor. This cop should be fired.

      Yes. Marijuana has a very distinct and strong odor. 100% reliability is not realistic, but at least there should be something else that can explain the smell. It doesn't come out of nowhere.

      Qualified Immunity was introduced by the Supreme Court (not Congress or the President) in 1967 ( Pierson v. Ray). The Patriot Act was introduced in 2001.

    Twice, the cop illegally tried to access his phone. Once when he took it off him probably to see if it was recording and again when he told siri to call someone. To me that's a 4th amendment violation.

    If you watch the full video, there's a portion where:
    1) that officer said, "Found a gun... and I know he's a felon." He's NOT a convicted felon
    2) a dispatcher says to that officer, "UNFORTUNATELY, all these charges were dropped and he has no warrant or convictions"
    ...in the end, he was released with only a warning for seat belt.

    Come on. Everybody has figured it out now. If you want to stay in your car, you get out of your car. Then the cop will tell you to get back into your car, and everything is as you wanted it to be. If you don't do this, the cop will tell you to get out of your car. It is all about the cop experiencing being in control.

      People who have a great need for certainty or need to be in the “driver’s seat” are more reactive (and more ‘reactionary’) to do the opposite of what the reverse psychology ploy is suggesting.

    If a policeman states that they 'smell drugs' and then no evidence is found to back that up, the officer(s) should be drug tested to prove it wasn't them who had brought the smell of drugs onto the scene of the crime.

    I think the best counter to the "I smell Mary Jane" claim by police is to clearly state on the THEIR body cams when they say it, is to reply "Yeah man I smell it on you really badly, did you just smoke a blunt in your cruiser before you got out? You stink of weed". Now their claim is rebutted right there, and there is no way to prove either of those claims.

    I am in a state that was decriminalized and now legal for cannabis. I’ve been at the gas station and had a under cover come up to me and say “you listen to rap music do you want to buy some weed”. They definitely profile in every instance but they do it to the lower class & black people and again I am black.

    I’m black and they definitely racially profile with the weed smell allegations but they also profile by class. I’ve seen this happen to white people on UA-cam too. It happens to us blacks on a larger scale but it’s also depends on class.

    Crazy. I’m a retired trooper from nj. Attorney general directives, policy and standing case law has made it very clear, you can’t frisk for weapons absent RAS that the person is armed and dangerous. What state is this that a cop can Willy-nilly go hands on just bc they feel like it?

    This officer is full of B.S., plain and simple. I say that because of his hostile approach to this citizen, demanding he gets back in his vehicle, placing him in hand cuffs, and inappropriately points a taser at him. The law enforcement officer could have toned it down, introduced himself as an officer, stated crime or violation of the criminal code he was observed doing, and wrote the appropriate citation. Instead escalate by going into his vehicle and then ask his back up officers do you smell SOMETHING. After the fact of entering his automobile he announced he smelled something and nothing was founded to confirm the alleged smell, I called B.S., it is classic racial profiling.
