A cop asking not the driver for their license is kind of like them asking for your SS number. Sure they are allowed to ask for that I guess, but you aren't obligated to comply. It was fun when a cop pulled me over on my bicycle and asked for a drivers license. I was able to be incredibly polite and dismissive at the same time., and since I'm white I didn't even get tazed.
I'm having a little trouble phrasing this first bit, but is it safe to assume that your central premise is that failing to obey an unlawful order from a police officer is inherently disrespectful? There are so many holes in that I barely know where to begin. Well here is a bit of fun backstory for you. I ride the bike all year round; which as it turns out is completely lawful in Michigan. At least that is what I would have to assume considering the section of the traffic code that specifically addresses bicycles is about 2 pages, and I'll be the first to admit I'm no expert on the corresponding case law, though I assume its pretty sparse on this subject. On the day in question it was about 10 degrees Fahrenheit and snowing heavily with strong winds. I was on my daily commute to work, on mile 12 out of 15, so when I was pulled over with the whole siren wailing and lights flashing deal it's was a tad annoying. I got to take a minute and strip off my face mask, goggles, scarf but not my gloves, because again 10 degrees not including windchill. He first asks me Where I was headed and if I had my driver's license. I reply that "I'm commuting to work, the same way that I do every workday, and that I probably do have it somewhere in my backpack". That is all I say on that point, considering the situation I have no obligation nor inclination to fish it out in inclement weather. He then mentions that the reason that he pulled me over was that they had received phone calls from concerned drivers about me riding in this weather. I find this to also be somewhat annoying since in Michigan, and I assume a lot of places you need reasonable suspicion to perform a detainment and what I was doing was completely lawful and relatively safe. Hell I over dress for the weather so my personal safety was hardly in question, and I use a flashing red tail light and a flashing white headlight that I turn on for low visibility. From the situation that I've outlined it seems to be the case that he didn't have reasonable suspicion to believe that I was breaking any laws, or acting in a way that was a danger to myself or others. In the fine state of Michigan you do need reasonable suspicion for every traffic stop, that's why drunk driving checkpoints are not legal here, because traveling down a particular stretch of road at a particular hour doesn't constitute reasonable suspicion for every vehicle involved. But I don't bring any of that shit up, because it really doesn't matter and I want to get to work on time. So after he explains his reasoning I say "that's fine, but I do this most days and I'd like to continue on my way to work. Am I free to go?" He then mentions that they like to take the names of people involved in stops like this. Since I did not have any intention of filing a complaint and there was no possible benefit to me for this interaction to be on the record I replied. "I understand, I would prefer not to give my name, am I free to go." After a brief silence he says" Yes. Drive safe and have a nice day" I respond with "You too". That was the end of the whole interaction. To touch back upon your thesis statement; I would counter that I was dismissive because to me he didn't appear to me to be doing his job properly, but I was respectful because he wasn't being an asshole about it. Though I'd be insane if i didn't think that the interaction might have gone a bit differently for someone with a darker skin tone.
