Absolutely! He did an amazing job with dismantling this witness' credibility. At 1st, I was ok the witnesses side and felt sorry for him. By the middle of this video, I couldn't believe anything he says. Now, with no information about the case, I can say that I couldn't take anything he says as truth

This guy is a great example of why you should not talk too much when on the stand. Slow down when answering, give the opposing counsel time to object, and at least know a redirect is probably coming if you're not comfortable. You would have done a great job even if there were no extra comments, but his comments just handed your entire point right to the jury.

Not a killer cross examination. A good, thorough cross examination during which the prosecutor was asleep. There were many, many questions that should have been objected to as being compound, argumentative, immaterial or calling for a legal conclusion. In addition there were several answers that were non-responsive, to which the defense attorney could have asked be stricken from the record.

How could you even call this a "good" or "through" cross examination? The witness made multiple long speeches and explained everything he wanted to explain. The defense attorney completely failed at making the witness look unreliable, he moved on from a question at the witnesses request and stopped going down that path. The questions being asked were too long and left too much room for the witness to talk about other things. This is objectively an awful cross examination, the witness walked all over this attorney .

What he means by that statement could be that he isn't trying to intentionally mislead the court. It's possible that he's trying to draw on his actual memory of events rather than on his memory of a story he's been instructed to rehearse, tell and stick to. He seems somewhat ashamed or embarrassed by some of the details of his testimony, and he even admits at one point to having perjured himself and lied to police.
The cross examination wasn’t bad, but this kid held his own. He is a goofy/quirky sounding kid, clearly some social issues or whatever going on, but I do think he did well all things considered.

As a juror, I would be so aggravated by your questions. I believed the witness 100% in spite of your badgering him. I related to him more because of how you were trying to tie him up in twisted convoluted questions, and although I could see the points you were trying to make, and where you were going with it all, it fails everytime because of your approach. You start off by basically accusing him of being high, because he takes a prescription for ADHD, and then make him even more relatable by questioning his desire to lie to avoid being arrested during a raid… I don’t get it. I’d be interested to hear and see the outcome of this case.
A liar who is terrifying against his client. So if he's lied under oath once, who's to say he's not lying about his testimony against Joe now. Poke enough holes, make this witness seem unreliable, and you increase the chances of the jury questioning the evidence against Joe.

But they can plead the fifth for questions that they deem are self-incriminating. But a witness subpoenaed to testify must testify. If you refuse the subpoenaed which is a court order it is punishable by jail, a fine, or both.

This guy is a great example of why you should not talk too much when on the stand. Slow down when answering, give the opposing counsel time to object, and at least know a redirect is probably coming if you're not comfortable. You would have done a great job even if there were no extra comments, but his comments just handed your entire point right to the jury.

Not a killer cross examination. A good, thorough cross examination during which the prosecutor was asleep. There were many, many questions that should have been objected to as being compound, argumentative, immaterial or calling for a legal conclusion. In addition there were several answers that were non-responsive, to which the defense attorney could have asked be stricken from the record.
Agree. In my mind I was objecting repeatedly. Plus how could she not prep her witness and advise him on 5th amendment implications of some areas of inquiry. Total fail
I mean, he successfully impeached an adverse witness’s credibility, which is ultimately what the goal was.
How could you even call this a "good" or "through" cross examination? The witness made multiple long speeches and explained everything he wanted to explain. The defense attorney completely failed at making the witness look unreliable, he moved on from a question at the witnesses request and stopped going down that path. The questions being asked were too long and left too much room for the witness to talk about other things.
This is objectively an awful cross examination, the witness walked all over this attorney .

What he means by that statement could be that he isn't trying to intentionally mislead the court. It's possible that he's trying to draw on his actual memory of events rather than on his memory of a story he's been instructed to rehearse, tell and stick to. He seems somewhat ashamed or embarrassed by some of the details of his testimony, and he even admits at one point to having perjured himself and lied to police.

You start off by basically accusing him of being high, because he takes a prescription for ADHD, and then make him even more relatable by questioning his desire to lie to avoid being arrested during a raid… I don’t get it. I’d be interested to hear and see the outcome of this case.

Police/Detectives lie every day, it is a tactic they use on a daily basis and they lie to their advantages. Police and/or Detectives are allowed to lie and they suffer zero consequences from lying. It's very common that you will be deceived by Police and if you honestly believe that it's not "a normal" encounter based on the deception of a Detective or officer.... well then you are ignorant. Of course the Detective is going to tell the youngster, "it's in your best interest to tell us the truth and we'll work something out, you're young you don't want these charges hanging over your head, you have a whole life ahead of you" that is a tactic they use when they have nothing and unfortunately this kid was a rookie and the officer probably knew that- via- separating him from the group and talking to him privately. Always deny deny deny with simple answers or exercise your right of the 5th amendment. This kid is a habitual liar you can clearly get the vibe that he was throwing the 'host' under the bus as soon as he understood the detectives were interested in Joe (the host) and not him. Which is normal because if they raid a home that has 50 people in it, drugs everywhere and non of them were specifically possessing the drugs then who do you think the Detective wants? I do not necessarily condone what the defense attorney was doing (leading questions, trying to strong-arm the kid and confuse him with red herrings and vague threats... etc), but I respect someone who is good at their job.
He wasn't trying to confuse him! He just brought his contradictions to the light so the jury could see. That stupid prosecutor just didn't prepare her client well

She cannot bring an objection if the questions are proper. Most of the questions are proper so she couldn't object to them, even if her witness 'felt tortured.'

yeah, it's a crap job. like, you have to defend a dude who you know did it and do the best you can for him or her. Or, you're on the other side and you have to just prosecute prosecute prosecute and do your best to win the case as if it was a sport even if you know that the dude or the woman probably didn't do it. I mean, I don't have a better answer of how to go about it and deal with crime and all that but you are totally right.

My guess is he's trying to save his client from a case involving giving drugs to young men among other things. This kid struck a deal with the state to give evidence against Joe. Neil is impeaching his credibility with prior inconsistent statements in hopes of discrediting the state's key witness.
