    As a 30-year veteran law enforcement officer, I can say that this cross examination is EPIC! Many officers allow themselves to get rattled and it screws the entire case. This Officer said that throughout his 15 years he did 15,000 traffic stops? He is FoS on that one! There is no way that he has 15K traffic stops under his belt. I don't have anywhere close to 15k traffic stops, and i have been a law enforcement Officer (now a Sergeant) for 32 years now. Mr. Rockind (The Rockweiller) is brilliant! Officers need to realize that their smugness in front of a jury, is plainly evident and their contempt for a "defense" is obvious. Officers need to realize that cross examination such as this, is part of the foundation of our Constitution, which is more important than any conviction for ANY crime. Excellent job Mr. Rockind! I would love to meet this attorney and shake his hand one day!

      You don't have anywhere near that because you're a lazy cop, or a faker pretending to be one so you can feel cool on the internet. if we assume a 5 day work week, 1,000 stops a year only requires on average 3-4 stops a shift. If you can't do that than you're a zero pretending to be a cop to your family. How many troopers can go an hour without doing 3 stops? I'll wait.

    It’s ironic that the officer who jumps to incorrect conclusions, without getting all the facts & who doesn’t take the time to document statements made by the man he accused/arrested of a crime (& other details) is lecturing the lawyer for being too thorough. Maybe if the officer had to pay the consequences (financial & otherwise) for his lack of effort & investigation, he might realize the benefits of being thorough & precise.

    • @dwayners13
      @dwayners13 4 роки тому +11

      @Frank Stein No need to apologize, this is an issue that really bothers a lot of people. Being a police officer is one of the only professions where, if they screw up (ie., arrest an innocent person) the only real consequences that arise fall on that innocent individual & their family. They end up having to go through the often slow & burdensome legal system & pay thousands of dollars for lawyers, just to prove that the police made a mistake. In the end, even if you’re found not guilty, your out of thousands of dollars, your reputation is tarnished, possibly fired from your job or out of thousands of dollars in income (due to the often lengthy jail stay waiting for trial) & yet the officer continues on as if nothing happened. Even if you are simply issued a traffic ticket or are arrested, then have the charges dropped within days, you’re still the one who ends up paying for the officer’s mistake (whether intentional or unintentional).

      Because the cop tried to apply extra charges like having an open liquor container in the front cabin. Except the cop didn’t have 1 single shred of evidence to support this claim. So the judge is looking to find out if it was even a legal stop to begin with (was there probable cause), because if not all the charges will be dismissed. Like you said, his license was totally valid, and the cop said so himself when Rockweiller asked him if his name came up in the State system. When the cop said “Yes it did”, that was proof of validity of his licensing right there 🤦🏻‍♀️🥸. You are right though, there doesn’t seem to be any original valid reason for being pulled over in the first place. Let alone making an arrest! The cop was going on a whim and doing a fishing expedition.
      This is very EYE OPENING about how much time, energy and tax payer resources go into each and every time a cop does this (fishing expedition = inventing an arrest out of anything he feels_ like making up). This attorney is great. You’re right they shouldn’t even be there, no probable cause (it seems) and no need for an arrest, but since they _have_ to be there because of an officers illegal arrest, the attorney might as well (and very tactfully) demonstrates the officers blatant negligence in how he did his job that night at every turn 😂😇👏🏻👌🏻
      Wow. But such a huge waste of time and money though 🤦🏻‍♀️

They can even ask questions that demonstrate a bias to either side or something that seems or is irrelevant and COMPEL an answer from the witness; if they failed to answer satisfactorily or refused to answer, the judge could even hold them in contempt. Depending on the specifics, such as if the judge was asking biased or inappropriate questions and punished the witness with contempt, then they (the judge) could - and most likely would - have to face a disciplinary board and could be sanctioned or otherwise penalized, but that subsequent disciplinary process DOESN'T detract from nor negate that during the actual examination of ANY witness, Judges have TOTAL discretion to interrupt and ask their own questions at any time.

    wow i wish i had you as my lawyer in my assault with a deadly weapon trial (it was self defense). one of thr sheriffs not only lied but made up a bunch kf stuff that did not happen at all (after stabbing my attacker i saved his life by putting a turnikit on him a stopping the bleeding cuz i hit an artery in his leg, i helped the sheriffs when they got to the scene remove the turnikit and place a legit one on him. during the pre trial the sheriff said not only did i never help the “victim” but was paceing up anf down my driveway and did not at all seem to be worried about the “victim” which is bullshit because the “victim” was and still is my best friend and he has even thanked me for not letting him bleed to death infront of me). if you want i can tell you the whole story cuz this is just a tiny part of it and prolly sounds very weird lol. the first deal they offered me was 2 years in prison and id have to plead to a felony but my public defender (imo he was a decent lawyer) got it down to a misdemeanor with 90 days sheriffs work release. after the sheriff straight up lied during the pretrial i 100% lost my faith in the justice system. my friend/ attacker admitted to starting the altercation by assaulting me on thr street infront of my house and i did not defend myself and was trying to back up into my house but he followed me onto my property continuing to assault me until i (very stupidly) pulled out a knife and told him to leave me alone. i thought he’d realize since i was now armed he would be a fool to attack me but i was wrong and he ran up n threw me on the ground n when i hit the ground i just instinctively reacted and stabbed him in the leg. he was immediately loosing so much blood he was loosing consciousness and turning very pale so thats when i ran inside my house and grabbed a dog leash and towel to use as a turnikit and compress and immediately called the police. i am actually still best friends with him and hangout with him regularly.
    sorry if this is hard to read even tho its been almost 2 years im still pretty emotional about it all

The complete arrogance and cockiness and just f****g rude IN COURT speaks volumes on what kind of a cop he is. That judge should should put him in his place but we all know local cops, DA’s and judges are all buddies in it together. When citizens loose in local court and take it to appeals and win there should be punishment for the judge that excused the case. This good ol boy buddy bs needs to stop, law is law that’s it, not oh I know u so we won’t make u look bad bs

    Sadly this Trooper is a great example of what's wrong with policing today. Even when you're breaking the law, violating somebody's rights, or just being a douchebag, always act like you're the superior person and you're in control.

  • @zacharywilliams5869

    Is why police officers need to answer questions with yes or no when possibly, trying to outwit an attorney or sound like you're the smartest person in the room .this makes you look like you lie and trust me a jury will pickup on that. This trooper has an ego the size of Michigan and is likely not being honest in this testimony.

    🤷‍♂️ ~ But what was the outcome of this case? Even though you did a good cross examination did you lose this battle, it kind of seems so since I’m not seeing any information about the conclusion.
    When I was watching the several videos of this same cross-examination when they were originally posted five years ago I saw somewhere, maybe it was in the comments or something, that somebody said thank you for letting us know the outcome of this trial. I don’t remember where I saw it, but it must’ve been the comment section. But I didn’t see anywhere where any outcome was given.

    This cop has obviously not testified or given depositions very often, or often enough! He needs some SERIOUS training on how to testify from the local prosecutors/City Attorney. WOW, I was a cop in Los Angeles for over 40 years and I wrote a crap-load of tickets but no where NEAR 15K. He's lucky that attorney didn't do a records request for copies of all those tickets he claims he wrote. NO WAY did he write that many. This was an absolute train wreck of how to testify. I sure hope he was re-trained.

    I love it when the cops are so arrogant they honestly believe they are smarter than the lawyer. What's worse is that he has absolutely no remorse for Wrecking this poor mans life without any Probable Cause all because of some fairy tale paranoia he has. He knows at the end of the day Absolutely Nothing will happen to him, even if your client sued under USC title 18 deprivation of rights, which he should. This officer and his paranoia would still be out there wrecking lives. Now I don't know if the Judge goes to the Same Funky Handshake Lodge as this officer but I feel he protected him way to much. Part of the fun of taking an officer that did wrong to court is watching him squirm in the hotseat as your lawyer really grills him. It's also a little payback for the hard time he gave you out on that lonely road.
