If the LEO is terminated for committing an offense against department hiring policy, they cannot replace that officer with one who has done the same or even been charged or convicted of other offenses. And, there's a little law about being able to testify in court as an officer. If you're proven to have been convicted, your testimony will not and most likely cannot be used as one as being given from a trustworthy person with clean hands. One might not even qualify to be able to write a meter ticket. That's why it's so important to not get into trouble. That way when one gets done horsing around and decides to establish or have a change in career, they cannot have blemishes from their past. LE agencies are firm believers that a prime indicator of future behavior correlates to one's past behavior. I hope that helps a little.

Rejecting a field sobriety test is absolutely not an arrestable offense. They are entirely optional. The reason that people get arrested after rejecting one is that cops almost always already have probable cause for an OVI arrest before they even ask if people want to do the optional exercises. The point of field sobriety tests is for police to gather evidence to support an eventual conviction, not to establish probable cause for the arrest. That's the reason that most DUI lawyers advise people not to participate in the tests -- because all it does is strengthen the state's case for OVI.

The reason that people get arrested after rejecting one is that cops almost always already have probable cause for an OVI arrest before they even ask if people want to do the optional exercises. The point of field sobriety tests is for police to gather evidence to support an eventual conviction, not to establish probable cause for the arrest. That's the reason that most DUI lawyers advise people not to participate in the tests -- because all it does is strengthen the state's case for OVI.
