The problem is you can't just issue copies of licensed products without a license to do so. Using different fonts then MS would easily identify the copies as "home made" legal backup discs, i guess. All in all i have to say, making theses copies was not a good idea, also from an e-waste perspective. (100.000 CDs) Even most old systems support Win installation via USB drive.

Still, this machine would be restored, up and running with modern build of Linux to both keep up with current protocols and security concerns and utilize a 15-year old hardware.

He's owned that recycling company for a long time now, that said, there's plenty of videos of him over the years talking about what he's doing and him advocating for responsible handling of e Waste. He isn't just putting on the charity act for the camera now that he was sentenced to prison, he's been walking the walk and repurposing millions of pounds of waste that would otherwise be leaching into the groundwater right now.

As far as I understand it he was selling the valid key that he recovered, which is legal and including the dell restore disk. if you have a valid key for a MS product you have a right to the software, but like iFixit, if you look at the batteries they dont have an apple logo on them because the logos are copyrighted too.
It's perfectly legal to download the software and use it, it's free. But what he did (I think?) was download the software, and (this is important) put Dell & Microsoft's trademarked logo on it, and distribute it to thousands of people. That's the illegal part, I think.

Its OK when a computer shop does this to repair your computer, you have that legal right as the computer owner. The Computer shop is not mass producing copies in China and importing them into the USA.

Maybe if the owner downloaded the file then loaded it onto a cd then handed it to the pc shop, but that isn't how they are working.

Most people don't have time or motivation to learn Linux and deal with the problems of Linux itself, Wine or stuff like documents written on LibreOffice gets weird on MS Office. So much Windows-only proprietary software is needed for work. I hate the MS but I don't want to deal with Linux unless it is in a VM. I want ReactOS but it is still in alpha because there is not enough contributors and donators.
Until pulse audio and alsa stop being ignored (the Linux audio stack is garbage), until we stop having competing desktop environments (gnome vs. kde), window managers and display servers (xorg, weyland, etc.), until we stop having competing package managers and packaging standards (rpm vs deb, etc.), until we have standardized device management, Linux will remain a backwater for general purpose desktop computing, and will not be a viable replacement for Windows. The “not-invented-here” syndrome in the Linux community is absurd, but rampant, both between distro’s and between Linux and other platforms. Hell, Microsoft is likely, via WSL2, to make Windows the dominant Linux desktop over the next few years. I want Linux to succeed (natively) as a broadly used desktop solution, but dealing with the community for over two decades, the inability to drive a fully unified set of standards, still prevents the platform from being a suitable desktop OS (a far more difficult use-case to satisfy, versus server workloads).

But, in the admittedly more complex stack of interactive desktop workloads, that complexity and target ambiguity is inverted. That I can have two Linux boxes, both fully configured desktop environments, and they have nearly nothing in common beyond the kernel, might be super-neat to nerds, but it’s a usability (and development) disaster for the rest of the world. Despite Microsoft blowing up their own user experience every 10 years, forking their own development targets and frameworks, and generally being terribly obnoxious, it’s still somehow less annoying than the complete schizophrenia of desktop Linux. I would highly enjoy working for this Man and it would be awesome if he created a program for former inmates who want to become technologically savvy and learn more about this type of career in technology and computers. For most folks who don't game or do anything particularly fancy, several desktop Linux distributions are freely available that will allow your hardware to be useful for most day-to-day activities free of charge without having to license the privilege from a private company, often repeatedly. Especially for government workers who are typically using it for the web browser and office suite (Firefox and Chrome are available on Linux and Libre Office does all of the things a typical office user does as well as MS Office for free as well). Having a community supported system, that's available free of charge, is of immense benefit. Especially when you look at the issues this man had providing restore disks to allow hardware that was already paid for to be used as it was when it came out of the factory. It's a non-issue if more people transition off of a proprietary, licensed desktop OS.

When huge companies go after an individual, over something that does not affect their bottom line or company image...it really shows what is important in today's society...and it's not us. There are multiple reasons why Microsoft doesn’t allow people to arbitrarily mass-duplicate and distribute copies of their OS, not the least of which is they aren’t able to verify quality and originality of the distributed software, components or drivers. However, in the event these “unofficial” disks are distributed with malware, it does potentially become (directly or indirectly) Microsoft (or the OEM’s) responsibility to remediate, for which they incur cost. Whether you like it or not, you don’t get to take copyrighted material (which encompassed more than just Microsoft’s IP) and duplicate it without permission. This isn’t a matter of e-waste and recycling, he’s using that argument to deflect from the core issue: he insisted on copying someone else’s copy-protected property without their permission. He kept doing so after being asked to stop, in direct contradiction of the law. Microsoft, in their usual ham-fisted fashion, mishandled the optics on this, and the Fed’s shouldn’t have pursued a prison sentence (IMHO), but the fact remains that he violated some pretty clear-cut law, and defends his actions through the use of an emotional appeal, not a logical one.

A restore CD is a freeware separate from an OS license you use to bring your computer's OS back to factory settings. It's not going to "update" anything, it's not going to install a new OS, it's literally performing one of the most basic and essential thing with any piece of electronic : resetting it to factory setting. That's it and that's all.

Microsoft is saying “profits are more important than the environment”. Literal dumps of millions of tons of electronic waste that is often not recyclable or not economically feasible to recycle. And all Microsoft cares about is the next profit from their newest model all while pushing planned obsolescence in their electronics.
To be honest that is what most americans do. Convenience and comforts are more important than the electronic waste and the environment. Why go on those road trips, why use air conditioning, why travel for vacations, why constantly buy new electronics, why buy the cheapest or highest performance consumer products even though there are more environmental alternatives that aren't as cheap or aren't as performant. So its a problem for all of us as a society, not simply the big companiesl.

I had a very similar case. Long story short, someone lied and it got brought before a judge. After being put under oath I ask the defendant if he lied. He says yes. I ask him if I am in the right and he as no defense. He says yes. The judge deliberates for 2 minutes before favoring the defendant who admitted on record he was in the wrong. Fuck our legal system.

It's quite possible that even if he had done that one thing since the beginning, not knowing the future, it could have well been some other charge the he'd go to prison for. If a company as big as Microsoft wants to come after Joe Blow, they'll burn all the cash they want to make it happen. In most cases it's just a battle of attrition and the companies resources will ensure Joe Blow gives up eventually, to them it's not a question of "if" they win or lose, it's "when" are you going to give up.

After some time the computer manufacturers realized they could save lots of money by not giving those discs. They did however, giver the consumer a way to make their own recovery discs, but the consumers did not bother to educate themselves on the aspects of backup and recovery. Had they bothered to arm themselves with that knowledge, there would be no need for people like Eric Lundgren to offer that service.

@no Name The copy of the OS is free to download on Microsoft's own website. Anyone can download and make ISO / Images / copies whatever right off of their own website. It's the keys that you pay for. Those allow you to run the OS as a "genuine" copy. Every PC you buy off the shelf has a key and most the time you can re-use it. Back in the windows 7 days you could re-use a key on any OEM no problem if you had the right tools. ( SLIC for example ) Or you could just download Jellybean Key Finder and pull it right out of the registry. From what I read a while ago the problem is this. The man was selling repair disks (Which are free from Microsoft) But charging for the disk that you put the software on. If what I read is true, the man was NOT selling the keys for the operating system. So this seems as if it could be a service fee, really. But unfortunately this put him under "selling" Microsoft's IP. Technically Illegal. But they've made it a point to villainize the guy. I'm not defending his goof. I'm just saying that Microsoft is an asshole.

You actually have to do a lot to piss them off, and he messed with two companies and made money off the backs of their licensing model. Judges in the US are elected. All MS has to do is say "It would be a real shame if we had to run a campaign against you next election to replace you with someone who better understands technical cases like this."
The problem is you can't just issue copies of licensed products without a license to do so. Using different fonts then MS would easily identify the copies as "home made" legal backup discs, i guess. All in all i have to say, making theses copies was not a good idea, also from an e-waste perspective. (100.000 CDs) Even most old systems support Win installation via USB drive.

Still, this machine would be restored, up and running with modern build of Linux to both keep up with current protocols and security concerns and utilize a 15-year old hardware.

He's owned that recycling company for a long time now, that said, there's plenty of videos of him over the years talking about what he's doing and him advocating for responsible handling of e Waste. He isn't just putting on the charity act for the camera now that he was sentenced to prison, he's been walking the walk and repurposing millions of pounds of waste that would otherwise be leaching into the groundwater right now.

As far as I understand it he was selling the valid key that he recovered, which is legal and including the dell restore disk. if you have a valid key for a MS product you have a right to the software, but like iFixit, if you look at the batteries they dont have an apple logo on them because the logos are copyrighted too.

It's perfectly legal to download the software and use it, it's free. But what he did (I think?) was download the software, and (this is important) put Dell & Microsoft's trademarked logo on it, and distribute it to thousands of people. That's the illegal part, I think.

Its OK when a computer shop does this to repair your computer, you have that legal right as the computer owner. The Computer shop is not mass producing copies in China and importing them into the USA.

Most people don't have time or motivation to learn Linux and deal with the problems of Linux itself, Wine or stuff like documents written on LibreOffice gets weird on MS Office. So much Windows-only proprietary software is needed for work. I hate the MS but I don't want to deal with Linux unless it is in a VM. I want ReactOS but it is still in alpha because there is not enough contributors and donators.
Until pulse audio and alsa stop being ignored (the Linux audio stack is garbage), until we stop having competing desktop environments (gnome vs. kde), window managers and display servers (xorg, weyland, etc.), until we stop having competing package managers and packaging standards (rpm vs deb, etc.), until we have standardized device management, Linux will remain a backwater for general purpose desktop computing, and will not be a viable replacement for Windows. The “not-invented-here” syndrome in the Linux community is absurd, but rampant, both between distro’s and between Linux and other platforms. Hell, Microsoft is likely, via WSL2, to make Windows the dominant Linux desktop over the next few years.
I want Linux to succeed (natively) as a broadly used desktop solution, but dealing with the community for over two decades, the inability to drive a fully unified set of standards, still prevents the platform from being a suitable desktop OS (a far more difficult use-case to satisfy, versus server workloads).

My argument is if you want Linux to become a mainstream general purpose desktop operating system, then this is exactly the kind of thing that needs to stop: competing audio servers, competing display servers, competing window managers, competing shells, package management systems, etc.. I mean WTF, you got Canonical sanctioning this mess (speaking of JACK) with Ubuntu Studio. Just pick a single damn audio server for your already forked-to-hell Debian derivative. Everyone else stop reinventing the damn wheel, instead fix what’s out there!! Stop the ego-driven, nerd circle-jerk nonsense!!!
Linux succeeds in the server space because only a few of the issues noted above (mainly package management) exist in that world. Generally, Linux server instances (from bare metal to container user-lands) are super-simple, in contrast to Windows Server with its considerably more complex management, auth and servicing footprint.
But, in the admittedly more complex stack of interactive desktop workloads, that complexity and target ambiguity is inverted. That I can have two Linux boxes, both fully configured desktop environments, and they have nearly nothing in common beyond the kernel, might be super-neat to nerds, but it’s a usability (and development) disaster for the rest of the world.
Despite Microsoft blowing up their own user experience every 10 years, forking their own development targets and frameworks, and generally being terribly obnoxious, it’s still somehow less annoying than the complete schizophrenia of desktop Linux. I’m sick to death of Microsoft and Apple, but until a commercial entity jams some standards down the community’s collective throat, putting an end to this proliferation of competing system components and frameworks, desktop Linux will remain a niche for nerds tailing syslog, and a few specialized solutions.

For most folks who don't game or do anything particularly fancy, several desktop Linux distributions are freely available that will allow your hardware to be useful for most day-to-day activities free of charge without having to license the privilege from a private company, often repeatedly. Especially for government workers who are typically using it for the web browser and office suite (Firefox and Chrome are available on Linux and Libre Office does all of the things a typical office user does as well as MS Office for free as well). Having a community supported system, that's available free of charge, is of immense benefit. Especially when you look at the issues this man had providing restore disks to allow hardware that was already paid for to be used as it was when it came out of the factory. It's a non-issue if more people transition off of a proprietary, licensed desktop OS.
The irony of the recycling bins behind the glass partition in the MS office when he drops off the letters, before going to prison for helping recycle e-waste is hilarious!

However, in the event these “unofficial” disks are distributed with malware, it does potentially become (directly or indirectly) Microsoft (or the OEM’s) responsibility to remediate, for which they incur cost.
Whether you like it or not, you don’t get to take copyrighted material (which encompassed more than just Microsoft’s IP) and duplicate it without permission. This isn’t a matter of e-waste and recycling, he’s using that argument to deflect from the core issue: he insisted on copying someone else’s copy-protected property without their permission. He kept doing so after being asked to stop, in direct contradiction of the law.
Microsoft, in their usual ham-fisted fashion, mishandled the optics on this, and the Fed’s shouldn’t have pursued a prison sentence (IMHO), but the fact remains that he violated some pretty clear-cut law, and defends his actions through the use of an emotional appeal, not a logical one.

A restore CD is a freeware separate from an OS license you use to bring your computer's OS back to factory settings. It's not going to "update" anything, it's not going to install a new OS, it's literally performing one of the most basic and essential thing with any piece of electronic : resetting it to factory setting. That's it and that's all.

Microsoft is saying “profits are more important than the environment”. Literal dumps of millions of tons of electronic waste that is often not recyclable or not economically feasible to recycle. And all Microsoft cares about is the next profit from their newest model all while pushing planned obsolescence in their electronics.
To be honest that is what most americans do. Convenience and comforts are more important than the electronic waste and the environment. Why go on those road trips, why use air conditioning, why travel for vacations, why constantly buy new electronics, why buy the cheapest or highest performance consumer products even though there are more environmental alternatives that aren't as cheap or aren't as performant. So its a problem for all of us as a society, not simply the big companiesl.

Long story short, someone lied and it got brought before a judge.
After being put under oath I ask the defendant if he lied.
He says yes.
I ask him if I am in the right and he as no defense. He says yes.
The judge deliberates for 2 minutes before favoring the defendant who admitted on record he was in the wrong.
Fuck our legal system.

Linux is free and works on old PCs. But it's easier to sell old PCs when you say they have a Windows disk rather then a Linux disk.
Why didn’t he just burn it to a CD and write “restore” on it when they warned him? That would make it hard for them to call it “counterfeiting”.
He might have not had the legal counsel to make certain everything wasn't going to come back and bite him in the he ass. Plus this is hindsight. Like he said around the 7 min mark "if I would've done one thing differently..." He said they threw a bunch of charges at him. It's quite possible that even if he had done that one thing since the beginning, not knowing the future, it could have well been some other charge the he'd go to prison for. If a company as big as Microsoft wants to come after Joe Blow, they'll burn all the cash they want to make it happen. In most cases it's just a battle of attrition and the companies resources will ensure Joe Blow gives up eventually, to them it's not a question of "if" they win or lose, it's "when" are you going to give up.

This judge was an idiot. Using the Microsoft Logo WOULD be an infringement if he were using it on HIS software, but he didn't. The Microsoft Logo was used on Microsoft software, which is where the logo belongs, for the purpose it exists in the first place.
Not only is this company being malicious, fraudulent, and oppressive by prosecuting this man, but the prosecutor themselves, and the judge willfully aided and abedded in perpetrating these crimes.
A crime is damage to person or property. This man committed no crime. Microsoft did. The prosecutor did. The court did. The criminals are running the judicial system and calling it justice.

After some time the computer manufacturers realized they could save lots of money by not giving those discs. They did however, giver the consumer a way to make their own recovery discs, but the consumers did not bother to educate themselves on the aspects of backup and recovery. Had they bothered to arm themselves with that knowledge, there would be no need for people like Eric Lundgren to offer that service.

@no Name The copy of the OS is free to download on Microsoft's own website. Anyone can download and make ISO / Images / copies whatever right off of their own website. It's the keys that you pay for. Those allow you to run the OS as a "genuine" copy. Every PC you buy off the shelf has a key and most the time you can re-use it. Back in the windows 7 days you could re-use a key on any OEM no problem if you had the right tools. ( SLIC for example ) Or you could just download Jellybean Key Finder and pull it right out of the registry. From what I read a while ago the problem is this. The man was selling repair disks (Which are free from Microsoft) But charging for the disk that you put the software on. If what I read is true, the man was NOT selling the keys for the operating system. So this seems as if it could be a service fee, really. But unfortunately this put him under "selling" Microsoft's IP. Technically Illegal. But they've made it a point to villainize the guy. I'm not defending his goof. I'm just saying that Microsoft is an asshole.

Anyone in the business knows you can just sell it with an old RAM stick if you didn't, you know, have the PC. You can't charge for a restore CD Dell paid for that they have the right to offer on their support page. The reason he is the asshole is because it is very easy to get the information if you work in IT, unless you are being shady. You actually have to do a lot to piss them off, and he messed with two companies and made money off the backs of their licensing model. He wasn't sued for reselling hardware, he was sued for the shit he wasn't allowed to sell in a very particular way. Again, he had people reach out to him from customs. Even the biggest dipshits have to work hard to get themselves into that kind of trouble. You can find legit keys in the trash.

In the '90s Microsoft was being sued by the Federal Govt for being a monopoly, now the Govt is helping Microsoft infridge on a tiny portion of Microsoft's profits, the US has gone backwards a lot, but that is what happens when you rely on donations from corporations instead of acting in your constituents interest.

Correction: Vice has painted Microsoft as a greedy force by concentrating on issues that had nothing to do with this case instead of the basic facts: he produced and distributed millions of counterfeit discs that had their logos on them for his own profit, potentially compromising security for thousands of end users by giving unknown Chinese copy-makers direct access to the user's basic OS installation.
Gorky D the Chinese could easily have gained a copy without his assistance. And having a copy of an OS does not automatically compromise the security of the other users of said OS.
