It’s funny because now cpd acts like they don’t care and are retiring. They hate the mayor we have because she holds them accountable to the highest extent. And Illinois just passed the bill that you can’t search the car because of a “weed smell”. It was getting so bad with officers using that as an excuse, they ended up just passing that bill.
You should read NJ Supreme Court about police searching vehicles but kinda funny you do need consent to search unless there is probable cause to do so like before mass legalization by many"smell like weed" for officers to do a search...
Any time a cop doesn't show up for court, it should go on his/her record as making a false statement and they should have to pay all court costs and attorneys fees.
Personally pay all costs the actions of the corrupt police started. The driver may have felt the need to have a lawyer. Like most of us, lawyers like to be paid for their work.
That's actually a really good idea but since no district attorney, judge and city council member can get elected without the police union nothing will ever change.
Hahaha that would means the courts, government, the whole system would be on trial and would arrest itself. Clearly the government won't ever let that happen. It would mean taking sole responsibility of over 100 years of the failure that is the government and court system. It would mean the rich and the privilege would have to resort of going threw courts rather than paying themselves out of trouble
I want to fully agree with you, but i still hope that one of these days ill rightfully be accused of a crime but get off because of the cop not showing up. I hear a story of one guy getting a ticket. He looked up his officer on social media, found out the day his wife was due to give birth, and changed his court date to it. Cop didn't show and he got off scott free 😂 So maybe have that as a requested opption and not a default penalty for a no show cop.

I don't consider myself an auditor, but after an interaction I had (and lackluster did a video on) I have became VERY PRO police accountability and transparency.
Frauditors all need to die. All they do is harass people, nothing else. They don't "audit" anything. The last auditor that trespassed into my office on the grounds it's a "public building" (which it isn't) got peppersprayed after refusing to leave, then bodily and none-too-gently thrown out on the pavement with the promise that if he ever returns, he'd be carried out in a body bag. Fucker claimed he'd sue. Sadly he didn't.
This was a single ticket. In Cook County even the alleged violator isn't required to attend. They can mail in the fine. If the cop did attend, this ticket would not have been dismissed, and he would have lost so it is often actually an overwhelming advantage to the person who feels they were wrongly ticketed for the cop to not show up to traffic court when a ticket is disputed.

Therefore, if you have the time and it's not too inconvenient you should always contest a minor infraction - there's a good likelihood the officer will not show up.

Yeah but not always. Those cops in the hotel hallway murdered a guy. The video was not lost. It went to trial. They were acquitted. Cops are not afraid of body cams. They know they will likely be alright even in a court room.
Absolutely. As a white guy who has grown up in Louisville, I can say without a doubt that being white in a black neighborhood will get you pulled over and harassed. I had two friends who lived in the projects near my house, and I must have gotten stopped at least once a month walking to and fro their apartments. Really sickening behavior. A black lieutenant in an unmarked cruiser would pull me over every time he saw me, saying I matched the description of a suspect until finally I had enough and said,"You have a description of a white guy with a mohawk wearing a purple Eeyore hoodie? This is getting ridiculous, dude. You stop me every time you see me." Never stopped me again.

Just another 'tool' police use... subtle intimidation. I was pulled over one time, and three cops tried something similar. I was driving home one night and was pulled over for some supposed violation (making an illegal turn). It was around midnight and I had just left an anonymous meeting. One cop turned into three within a few minutes. After being asked to exit the vehicle in order to perform a roadside sobriety test (which I PASSED) officers started questioning me. At first it was the normal... driver's license, insurance card, registration... blah blah blah... which I handed over. At one point they asked to search my car... which I refused to give consent to. They then started questioning why I was out at midnight, where I was going... ALL the while slowly entering my 'personal space'. When they didn't wait for any answers and just keep asking over and over... I knew what they were doing and allowed it... in fact I encouraged it. After all I know my rights (to a point), and I knew these cops were trying to 'fluster me' into giving into their 'request' to search my car.... with the intention of find something illegal to use against me (drugs, booze, weapons... etc.). Well... me being a young gay man... I HAD to let them know I was enjoying being SO close to so many beautiful well built officers (I sort of lied). I even mentioned (I sort of lied again... kind of) that I had a little fetish... that I dream of an encounter like this.. big strapping men in uniform... with handcuffs AND the feel (I made the motion to touch one of their leather jackets but stopped)... and smell of leather... ohhhhh. I purposefully relaxed my posture, and thought about all the 'body language' cues I had learned over the years... especially those cues that said I was flirting. I NEVER propositioned any of them... but I did make it clear that I was enjoying their close proximity... and FAR from making me uncomfortable... it was getting me hot. Well...LOL... at this point I saw the realization pass over one of the officer's face... it was PRICELESS. A quick conversation ensued between the three of them...and VERY quickly these three officers were trying to INCREASE the distance between us... one actually extended his arm in the classic 'stop' motion when I tried to step up closer. A minute later i was told I was free to go... with no ticket... and no apology... just a clipped 'Drive safe'... and it was over. I will NEVER forget the look of realization that swept across the cop's face when it happened. It was a two-fold look... first was the realization that i was gay, and enjoying the encounter... and then the second look... was the look of defeat when he realized I had won the 'intimidation game'. PS- He was the officer who said... Drive safe.
What rights were violated? Even the content creator admitted they were within the bounds of current case law, and he tends to skew in the direction of individuals and against the police.

I reached back into the box on the floor behind the seat for a towel to wipe it up quick, then put it back and sat there for about five or six minutes waiting for someone to walk up to the door. Two more cars showed up speeding like crazy, then they all jumped out and surrounded me with guns drawn, screaming over eachother. I was pulled over for a headlight being out _in the daytime_ and held at gunpoint for keeping my car clean, which they thought looked like I was going for a gun. Lessons are: Stay ABSOLUTELY still with your hands on the wheel. Don't forget to switch off your track light. Don't drive with scalding hot lava with the lid off to cool it down.
"Do you what the 4th amendment to the constitution is?" "Yes, I do!" "Tell me what it says" "I'm not explaining myself to you" Wow. I'm not saying that says it all, but that says it all.
Exactly what I was thinking. Not exactly in a position to gain immediate access to weapons in his car when there are two officers between him and his car, and another directly at the passenger side door where they claim he leaned towards.
“You’re the one searching my car, *you’re* the one searching my car! You can’t even read a fucking insurance card?!” That is exactly the appropriate amount of incredulity when dealing with such absurd stupidity.
Ugh, so much ambiguity built into the law to protect police corruption. “I smell weed” “You leaned over” All subjective, requires no evidence, and leaves the door wide open for them to do what they want, regardless of actual observable facts.
His passenger side door was unlocked so she opened it. That's why I changed the way my car operates. My car used to unlock all doors when shifting into park. I changed the settings to lock. Now they would have to reach inside the car to unlock it which is a 4th violation
@@RetiredWatchguy9337 smart. Honestly that’s just good security in general. I hate when my car assumes I want everything unlocked. Trading convenience for a possible carjacking or in this case, a constitutional violation.
"I smell weed" is no longer an acceptable reason in most courts now and days, especially if you live in a recreational or medicinal state, which covers damn near half of the country
Most of the rights we lost happened during the Civil Rights era in the 60's. These laws were meant to keep Black people in check they weren't designed to affect White people. Terry v. Ohio comes from that era. The judge couldn't believe that the cop couldn't grab the black man and pat him down just in case. Qualified Immunity for police comes from this era because Blacks were suing police for excessive force and winning big cases. The SCOTUS wanted to put a stop to that. Gun control in California because the Black Panthers had rifles on the steps of the Capitol. Most White people supported these laws but now they are affecting everyone.
This is why no one likes the police. They have every right to kill you, rarely suffer any consequences from killing anyone, and stomp all over everyone’s rights because they “fear for their life”.
Law enforcement agencies really need to stop training their employees to be lying, power-tripping scumbags and actually teach them the laws they are hired to enforce.
The guy is out of his vehicle, the windows are down and it's broad daylight but yet she's searching his car without good reason or his permission. It's like they're trying to distract him with questions but they wouldn't stop what they were doing.
Bruh when he cited Terry v. Ohio, the case year and it's precedent regarding the 4 Amendment, I shed tear. I then shed a laugh after Officer Barbie was left speechless. Great interaction.
I love the inherent conflict between "people leaning over to the passenger side of their car" being a valid excuse for cops to suspect someone is hiding something and the fact that the glovebox, where most people keep their cars information, requires you to lean over to the passenger seat.
Always keep your registration and insurance card in an overhead console or securely fastened to the visor in front of you. You won’t have to reach across the car or go in the glovebox.
There is a quote from Robert H Jackson Supreme Court Justice from 1941 - 1954, he said that '“Any lawyer worth his salt will tell the suspect, in no uncertain terms, to make no statement to the police under any circumstances.”'
And that is the problem. If they truly exist to "protect and serve" why must we always act in trepidation and suspicion of their behavior? We are paying for a legally protected mafia.
What confuses me is why they searched his car for “officer safety” after they removed and searched (what they considered the threat) him. The search should have started and ended with him after he was removed and they verified he didn’t have a weapon on him to ensure “officer safety” She had 0 right to be in his car especially considering he repeatedly said he didn’t give her consent to search his property. Those cops know what they did was wrong, I’d bet money that’s why they didn’t show up on the court date. The fact 4 cops were present over a seatbelt stop is ridiculous, that’s a blatant intimidation tactic in my opinion.
Exactly! and to add to that, they should announce to the driver what they need to do before doing the search after they've already asked him to step out of the car and he complied to the orders, that lady officer was trying to be some sort of hero when she finds a weapon and was sneaky coz' exactly right after the driver stepped out and being questioned by the other cop she immediately got in and did the search until the driver notices her in the car. Clearly they still violated this man's rights and should be held accountable for it.
99% off drivers have their insurance and registration in their glove box. So anyone who reaches for that stuff before the cop walks to the car gives the cops reasonable suspicion to search the car I guess
Good point. It's probably better to wait until the cop asks for the documents before reaching for them. Except that Philando Castile was shot and killed because he reached into his back pocket to get his wallet. And the cop who killed him was found not guilty by a jury.
@@jonstone9741 ANNNND he only reached because the officer told him to give him ID... as a PASSENGER... who previously VOLUNTEERED that he was legally carrying a concealed weapon! If someone takes the initiative to tell you they're carrying, and afterwards you request ID, it was 100% YOUR responsibility to instruct them how to provide it in such a manner to allay your fears of them drawing their weapon.
@@Ronin_Noir That's smart. I'm going to start doing that. Usually, when I'm looking for my documents, I have to rummage through other stuff until I find the right documents. Sometimes I find expired registration or insurance, then I have to keep looking for the current documents. It would be better to keep the current documents attached to the visor.
@@Ronin_Noir Where I live, all that info is linked to your license plate. All the cops have to do is run it. You don’t need to carry any documents, just your driver’s license.
I knew a kid in kern county who leaned forward in the passenger seat while police drew their fire arms on them out of instinct to avoid being shot and was then fired upon by seven officers who dumped their entire clips on him. He was 14, and they found no weapons. I think it was just a speeding stop and his brother, who was driving, survived.
I think you missed another point about officer safety justifying the search: once they removed him from his car, whatever might have been there was no longer a factor as he couldn't reach it. By taking him out, maybe even closing the door, they assured their safety from anything that could have been there. Thus, the search, while perhaps legal by the letter of the law, exposes their likely intent to find more "dirt" on him and NOT about officer safety. The search reveals the stop to be almost certainly pretextual to try to find more serious crimes. Legal, yes, but not community-endearing.
But they didn't do an exhaustive search, which I find to be odd, if they thought he had drugs. Maybe he scared them off because he strongly articulated his rights? And/or because he had no outstanding warrants? Dunno.
simple you get pulled over dont lean over and "reach or appear to reach for something" again in chiraq so reasonable suspicion to search his vehicle and they checked where he leant to, not the enitre car. food for thought what if they don't check and he had a weapon, then a witness placed him at a shooting or if he hid drugs to sell and someone od'd etc? don't act like an entitled child and with an attitude especially in chicago
How TF did you give the cops a C, after they purposely hid Incriminating evidence? There was a reason he only got 2 bodycam videos. There is always a reason... they always suppress the videos that makes cops look bad. Often it's conversations between each other as they conspire to create a crime that didn't exist. It is what they believe their job is.
look bad doesnt mean having done something bad, and assuming there is such thing is highly fetched to start with he could have very well resend the request and got the last 2 as a tip of how baseless your accusation is while performed in not the best manner, the cops did nothing wrong like it or not, and this channel go through a huge amount of work to relate to law/explain both side in a neutral way, the bare least is to show respect for that work and not bring such bs/claim ;)

It would mean the rich and the privilege would have to resort of going threw courts rather than paying themselves out of trouble

This was a single ticket. In Cook County even the alleged violator isn't required to attend. They can mail in the fine. @@Bacteriophagebs that argument falls apart as soon as they pulled him out and did a pat down.
What are they still scared of in an empty car? They will use anything you say or do against you to initiate a search.
There was a video on this channel about a cop pulling people over and saying they were nervous and shaking so he could do a full vehicle search. None of the people were nervous or shaking.
The police just want an easy way to look for drugs and get their arrests up. They can make up any reason to search a car.
Personally, I feel that if a police officer is willing to go through the trouble and time to pull someone over, detain a person, search their vehicle, and then not show up to court, that officer should be held accountable. Issue a bench warrant for his/her arrest. Just like any other person would be. Charge them with contempt if they refuse.
Especially considering the fact that she failed to show up in court while on duty. Not only is it her obligation to show up in court, it’s her job. Citizens of Chicago’s tax dollars are paying a person who is not doing their job.
If cops showed up to every case that went to court then they'd always be in court
I was thinking the same thing if I’m going to be held accountable so aren’t they
@@armymatt83 Oh well

The biggest problem i see all the time is there are 3 or 4 cops all asking questions to intimidate the citizen.
The biggest problem is that all of them carry guns.
@User0000000000000004 No. Guns are not the problem. People who were pushed and bullied in school become cops as a way to feel bigger. I have roughly 30 guns and I've never shot anyone. Guns are not the problem.
For a seat belt ticket in this case too.
Drive safe.
Cops telling people to “stay calm” after or while stripping them of their rights always gets me on this channel lol…

As a rule, every gun is loaded unless you are actively feeling and seeing the empty chamber. If you see a gun, it's loaded, end of story.
It's extremely ironic how untrained citizens are expected to act with composure and calmness when surrounded at gunpoint by police, but supposedly trained cops are allowed to "fear for their lives" at the slightest and act rashly and recklessly
A citizen should be notified by email within 48 hours if court will take place or not (officer not showing). If it is an actual last minute emergency, every effort must be made to contact defendant to notify. This is a purposeful tactic used to exhaust defendant's funds and patience

I love the inherent conflict between "people leaning over to the passenger side of their car" being a valid excuse for cops to suspect someone is hiding something and the fact that the glovebox, where most people keep their cars information, requires you to lean over to the passenger seat.
Why I don’t keep my registration in the glove box, I keep it on my sunvisor just to keep this kind of stuff from happening.
And just about every woman would have to lean over to the passengers seat to get her purse to get her ID.
Always keep your registration and insurance card in an overhead console or securely fastened to the visor in front of you. You won’t have to reach across the car or go in the glovebox.
No thanks
Right and I’ve always been one to have my info ready by the time they get to my window so when I see lights I instantly reach over lol
Why didn't the Judge put out a Warrant for the Police Officer for non attendance.
I guess the old, “Don’t speak with the police….ever.” Is still the best way to proceed.
Always. Every lawyer will tell you that. You will never win an argument on the street, but you can incriminate yourself by talking too much.
@@Mars_Ultor_CasualGamer Serve and Protect, after Uvalde I think we need to reevaluate that concept
That’s why I keep my registration and insurance in my driver side visor
Dunno.
Illegal search; he never admitted leaning over anyway; he was just mocking the woman cop.
simple you get pulled over dont lean over and "reach or appear to reach for something"
again in chiraq so reasonable suspicion to search his vehicle and they checked where he leant to, not the enitre car.
food for thought what if they don't check and he had a weapon, then a witness placed him at a shooting or if he hid drugs to sell and someone od'd etc?
don't act like an entitled child and with an attitude especially in chicago
@@gengarpokemon7731 Yeah. And don't swallow your spit because they might suspect you of ingesting evidence. 🙄
@@gengarpokemon7731 What if? What if? What if? - What if is not a justification for anything, it's a lame excuse for everything.
Quote from a cop who wishes to remain anonymous, "every traffic stop is a fishing expedition".
Educating us & protecting us is NOT what cops do!
That cop isnt a cop...just a thug with a badge
I wonder why that cop want's to remain anonymous?
How TF did you give the cops a C, after they purposely hid Incriminating evidence? There was a reason he only got 2 bodycam videos. There is always a reason... they always suppress the videos that makes cops look bad. Often it's conversations between each other as they conspire to create a crime that didn't exist.
It is what they believe their job is.
look bad doesnt mean having done something bad, and assuming there is such thing is highly fetched to start with
he could have very well resend the request and got the last 2 as a tip of how baseless your accusation is
while performed in not the best manner, the cops did nothing wrong like it or not, and this channel go through a huge amount of work to relate to law/explain both side in a neutral way, the bare least is to show respect for that work and not bring such bs/claim ;)
It’s normal when you’re getting pulled over to start looking for your documents. Reach for them. Not suspicious! Normal!
