      That's why I laugh whenever I hear a lawyer talk about how we have the right to ask for the warrant, read it, and watch the cops while they search your house. They aren't wrong. However, this video shows what really happens. I hope a judge strips these cops of their QI. I also hope those children learn about their rights and how horribly these cops violated those rights.

It will put police on notice that they will have personal exposure to lawsuits in the future. Sometimes the principal is more important than the money. And if it goes to a jury in conservative Idaho, the jurors will likely agree that being secure in your home is sacrosanct.

      The problem is that this is not easily a million dollar lawsuit. There are no punitive damages like there should be, only actual damages. No one was hurt and the only property damage might have been to the front door. Courts don't reward as much as they should for civil rights violations. This is a high 5 digit or low 6 digit lawsuit, not a 7 digit one.

      Good job calling though, as an Idahoan, you certainly DO have the right to ask questions and to expect answers from your officials. I’d further that with an email to the chief of police/sheriff so there’s a paper trail.

      The homeowner was entirely too homey to them. These uniformed house breakers need to be aware when the door opens that they just walked up to Paris Island and R. Lee Irmey opened the door. Don’t take their threats of calling SWAT. I have seen 4 ft tall women who knew how to handle this. Let them call for SWAT and a helicopter as they are scooting back across the lawn.

    I got so upset when he sat n talked to those people's kids. he violated their rights, he kicked in the door, he was aggressive, he talked down to the parents and threw tons of false charges to them, attempted to arrested the father sitting in front of his kids, and then sat and lied to the kids about what and why he did what he did. This officer is an example of why people fear police because tho they are not all bad, the bad ones have the ability to do this type of stuff without strong prosecution from our government.

      @@mitchio83 Given that none of us know all the details, I think it's far more likely that they vaguely knew he was out on parole, but didn't know he wasn't allowed to visit them in Idaho. And when the woman said "I will" open the door, the police immediately escalated to kicking it in, and then later lied saying she said she would not open the door. If they are really concerned about him being armed and dangerous, you would think a good police officer would want to get the kids out of the way. This is not complicated, you need a warrant to search somebody else's home. Good police are important, but good police get at least the basic simple stuff correct.

      @@mitchio83 That does put a different perspective on it, although it does reinforce my impression that at least *initially* she didn't know. While police do have a difficult job, channels like this focus on when they mess up, and don't necessarily put out info that makes police look good.
      It's good to remind myself that there are two sides to every story. But it sounds like in this case, nobody covered themselves in glory. Which is sadly what happens much of the time.

    They call him a felon for possessing a firearm but he served his time for those charges and is only wanted for a parole violation. Their action was not justified because he was not considered to be armed and dangerous. These cops watch too much tv and act like the Gestapo. They have no authority to come into her house because it is not the residence of Jericho. The officer knew he screwed up by kicking in the door because he just stood there and didn’t enter the house. I hope they get a good settlement because the children were traumatized too.

Doing so would have ventilated the house and made the tear gas less effective. And although the department had dogs, none were at the scene because the situation did not correspond with any need for their abilities.

      Aside from breaking all the windows and then gassing the place being self defeating, there is no streamlined way of figuring out whether you or someone you know has a warrant for arrest since each country has their own records. You can look up records as public info but i'd say at least 95% of people don't find out they have a warrant until arrest. The other 5% have bench warrants so they likely know prior to arrest.

      From personal experience. Keep running your mouth. Make the cop hit you, they can't contain themselves. Charges will be dropped no matter what they are to stop further investigation.
      Getting a lawsuit is the hard part.
      I always keep a spare 5k in my bank to cover the first 6 months of lawyer costs and get to the point of requesting trial by jury.
      Everything gets dropped. These goofs have no leg to stand on.
      Sometimes you have to remind your attorney that you aren't as dumb as the rest of his clients or he won't do a good job.

There was no concern for the family or the first thing they would have done was gotten the children out of the house.       Cops want to go in kicking down doors and going all out because that’s how they train and they want to experience that training in real scenarios. They want to play action hero, they want that adrenaline rush.
      The cop’s thought process and concerns he later explained was reasonable, but that doesn’t give them the right to do what they want. It’s frustrating when cops expect us to follow laws while they break them.

      Yeah, I saw a ring camera of cops knocking on the door of a house. The home owner spoke thru the camera, saying he was in bed and those cops would not leave. They're like just come to the door, but he didn't. Cops can just be batshit insane thinking they can just have anyone answer the door without a warrant and will not go away even when told repeatedly that he's not answering the door. It was a back and forth argument.
