    Failure to be transparent means something crooked is happening. HOA's are supposed to be there to service the homeowners but most HOA act like a dictatorship.

      If you call them your call goes to voicemail. If you e mailed them they delete the e -mail and move on. If you stop paying your HOA fees they have power to charge you late fees and also kick you out of your home and sell you home. Most HOA leaders are very greedy and selfish people you will ever come across. They also have a very short temper like teenagers. I think they worship money.

    Once you uncover evidence that a board member is stealing it's time to take it to the attorney general or law enforcement.

      Totally agree 1000%. They do need to be investigated to its entirety. There is more embezzlement in HOA’s than anything because they don’t have anyone governing them.

      @@stew24. Not True, the NRS 116 is a set of laws governing HOAs. Understand NRS 116 and you can have compliance and justice.

      @@bruceredden no that’s not true, the HOA I live in has been doing their own thing. They have breached a lot of their own by-laws. We just discovered tonight at a meeting that there was embezzlement going on. All of the owners here has been suspecting that and it was true.

    Investigate all the HOA’s , especially one’s with the highest HOA and $20k assessments 🙄 ridiculous!

      Luckily my hoa dues are 220 per year, and we get a a breakdown of where the money is being spent along with the dues.

      @@gimne I wish I lived where you lived because the highest dues where I live is $600 and they don’t keep up the maintenance and they don’t let us vote on anything. That’s how I know it’s some type of embezzlement going on, I’m thinking about calling an investigative journalist to put them on the news.

    Yes all HOAs need to be investigated and regulated to maintenance only! And have rules to don't allow hoa to take your property through fines and fees! It just sounds like a money/property steal scheme!

      An HOA can only, at the most, put a lien on the property, just like a contractor or anyone else.

      That being said, an HOA is only as evil, or good, as the people that are on the board. The worst thing about HOAs is that you're often just one bad election away from things getting out of hand.

      Lol, first thing I thought of too - no way is he not also deducting that mileage that he already reimbursed himself for. Doubt the IRS will audit such a small fry unless they're compelled to as part of a criminal case or conviction though.

    For those that don't know, petty cash is typically for small expenditures where going through the process of requesting a check, invoicing and entering it into the books at the time is inconvenient. This is stuff that doesn't have much of a material impact on the finances and as long as it does eventually get entered into the financials it's not much of an issue. For example, if you're needing to buy a few stamps for official business. You'd buy the stamps with money from the petty cash and then put the change and the receipt back. Periodically the petty cash gets refilled and balanced against the receipts. $20,000 in one year is a lot, because most of those expenses would typically be paid via check or card and entered into the books at that time. It could be just an effort to avoid being bothered while working, but it is rather odd.

    The HOA's accounting practices don't make sense, if this report is accurate. Petty Cash is not an expense category. It's a Current Asset. For every time there is money taken out of Petty Cash (Credit to the Asset, thus reducing it), there should be an offsetting Debit to a defined expense category, increasing the total expenses to that category for the fiscal year. It should literally require nothing more than clicking on a button to execute an existing report query to produce a statement of revenues and expenses for any homeowner who requests one.
    I was the Business Intelligence Lead for a large state university in the Midwest. Our finances were 100 times more complex than any HOA. But we never, ever, said no to any student who requested financial information. They were the reason we existed, and we worked for them. The homeowners are the reason the HOA exists, and the Board works for the homeowners.

    I remember when I was an HOA board member, and I questioned some of the expenditures… the HOA president had me shunned by the entire community.

    The history of embezzlement in HOAs around the country is comparable to an untrained house dog that claims the entire house available for relieving itself. The available bank account with no overseer on the board is a similar condition.

    When I worked, I submitted receipts for EVERYTHING. If I submitted for mileage reimbursement, I listed mileage for each day. This is standard business practice.

    The people in HOAs are all the same. Talking about how outside of their community is like Mad Max. Complete and total anarchy in the streets. No law enforcement, dogs running at large, unmowed lawns, car repairs. It is so scary driving to the coffee shop through these places...

    I do find it odd that public entities seem to stonewall any questions about the issues they face. Nevada government, school districts, commissioners..seem to feel offended if anyone asks a question..

    I live in a development with an HOA. My wife was a board member 25 years ago. The HOA is still operating as it was set up 45 years ago. Sorry you had a bad board.

    Government, including state & federal, such as IRS, have a procedure to ascertain whether entities, such as HOA's meet their responsibilities & adhere to codes, rules and regulations. These include HOAs qualify as non-profit entities; that they comply w/all rules & regulations, including incidental Federal rules & regulations, such as periodic tax and reporting as with information reports such as 1099's when they pay or reimbursement persons ... Did the president report the amounts required to be reported on those 1099's, even if he didn't receive 1099s?
    -- Example of codes, rules & regulations failures to adhere to codes, rules & regulations: When my HOA accepted stimulus funds to build facilities... swimming pool & whirlpool--one requirement was that the facilities were open to the public. But, they never were. When an entity runs afoul of its members or the government, there are consequences.
    -- Entities, notoriously, run afoul of government rules & regulations, seemingly w/ until they are caught; individuals outed on news programs like this and/or prosecuted and the consequences hit them in the purse string.

    Sadly, Nevada statutes NRS116 needs to modified to mandate early and ongoing communications and transparency to homeowner questions especially with financial matters rather than leaving homeowners in a fog. I asked for months by email for information on dues and was not informed the responsibility had changed so I faxed the new company and received no response. The training from the Real Estate board to HOAs includes concepts that they are to be the 'fiduciary' but it's really just lip service. Until NRS116 is modified, the little guy is at risk.

    My town government is strictly controlled by State law. No money can be spent unless authorized at the annual Town Meeting, and all expenditures are reviewed periodically by an elected budget committee and by the elected Board of Selectmen. Like all town documents, the annual audit by a professional firm is readily available. Meetings of all town boards and their subcommittees are open to the public, and detailed minutes are taken and posted for the public.
    HOAs lack these controls. They function like a petty government, but there are few laws that are enforced to regulate them. They can hold secret meetings, their officials can expend association funds at will, their documents and reports are not readily accessible, and their enforcement of rules can be arbitrary and far-reaching. While an HOA can perform valuable services, they frequently run out of control, and there is no established means to stop them. I would not live in an HOA community.
