I've heard that Workers compensation will affect your SSI or SSDI which most workers comp are much higher than your monthly ssi or ssdi payments which it will greatly reduced your social security benefits.. When it comes time to settle your work comp claim, you will want to make sure your settlement documents include an addendum with the Hartman formula language. Once again another great video thank you I watched all of your videos Thursday I have my first deposition I believe I am almost at the end of my case already got surgery and already did physical therapy one question I do have HR department did not know that I had a lawyer and when they found out all of a sudden they took away my medical my dental and my vision insurance I was released two weeks ago back to work with modified restrictions and it just told me yeah we don't have nothing for you when I know that there is work they're treating me different do you think I could sue them for unfair treatment and also retaliation

Keep in mind, the timing of the benefits. Sometimes you can continue to have benefits for a certain amount of months then it stops if you stop paying into it or if their coverage stops. The timing could have been coincidence or they may claim it was. Your employer can say they have no modified work during the temporary part of your case and you should be receiving TTD. But when you have permanent restrictions, it should be a more involved process. Unless the company is super small, they should really try to find you a position. Nothing really "happens" when your case is 20 years. The only changes come with general rule changes i.e. you used to do things the old way but now everyone has to do things the current way. Also, you lose some things at the 5 year mark from your date of injury. But nothing that I can think of afterward. The Medicare thing will happen if you age into the system during your 20 years or if you have social security disability for 2 years. That triggers the medicare set aside requirement. I have been wanting to do an MSA video but do not have an expected time right now. So many other videos to do first.
Is there anyway to find out if settlement documents have been sent to a judge yet to be approved? My husband signed settlement papers with the law firm he hired on 05/11/23, but trying to get any information out of them is very difficult.
Christina, Sometimes EAMS will show when a settlement doc is filed. It does not always come up. Sometimes it skips straight to saying approved. Not sure why it says so for some and not for others. Edward, Apply now and start working asap. When checks stop depends on when defense gets notice you are P&S. Sometimes they are sent a work status heads up and then they stop before they receive the final report. If they don't get the memo and send another check, they will want credit when you settle. Once I got me a lawyer, they offered me a light duty job at a non-profit organization for $17 an hour when I was getting paid $30 an hour as a gas hauler....I can't live off wkers comp benefits of $675 a week that cause me Bankruptcy...smh
