    You are awesome. I have herniated disc's from an accident at work. My attorney is asleep at the wheel. He seems irritated when I call or ask him questions.

      This is happening to me too. The insurance has send gang stalkers to harass me. The doctors has put chips in my body. The attorney withdrew just because he asked me we close the case and I declined. Was paid temporary disability for only 6 months and that was it. The case is on trial stage don’t have an attorney and I seriously need one. My phone is hacked . I live in San Diego,CA. I pray to God one day I shall get the justice . Please advise

    i was injured on the job didn't get paid or treatment for months. When I did start treatment I never got treatment for the injuries I sustained. I informed my attorney he refused to speak on it yet the doctors advised further treatment. The settlement is an insulet I wish I had you as an attorney at this moment

    I'm in New York state and my advice is to never settle if you doctor says you need surgery. After some serious research your private health insurance will not pay for any surgery or treatment after you settle your worker's comp case work related injury/worker's comp insurance my attorney said that my private health insurance will pay for future treatment, false. Seek a second opinion, get all the facts, a few dollars is no insurance you are going to get treatment in the future. Get all the facts.

      I would like to add also if they mess up you could be permitaly disabled as well.
      (That's why I won't get eye surgery because if they do make a mistake I could go blind forever)

    I had cervical spine fusion surgery C-5, C-6, C-7 plus Rotator Cuff surgery and re entry in same shoulde been off for 2 years now do to falling at work on to a palet was all seen on video was unconscious for about 10 to 12 seconds

    Once a workers comp case is settled is it normal to get paid out in monthly increments over a year or 2 instead of 1 payment

      I can only comment about Florida workers’ compensation settlements. That is definitely not the norm in Florida cases.

    the workers comp adjuster has requested my lawyer to write a demand letter, Do i need to have a say so in how the injury happened & how it's affecting me now in the demand? Do i need to contact my lawyer & request a copy of the demand before it go out to the defense? can my lawyer sent it out without me reading the demand letter? The reason for all these questions is due to my lawyer has been keeping me in the dark about the case--so i had to make contact with the adjuster when i shouldn't, requested a face to face talk with him and was given a date 2 months down the line, Want to fire him , but we're to close to settling now & no other attorney want to take on my case & share fee's---what shall i do now?

      Good day. I’ve seen this comment as well as another you posted. The first thing is I can only really give you any advice if this is a FL work comp case as that’s all I handle. You have a lot of questions and commenting back and forth is not the best vehicle to discuss them.     Question..a bad back injury shooting random pain from work injury.going up porch step the back injury shot a pain causing a fall, brain damage and permanent head injuries.does back injury cover the fall costs?

      Sorry to hear of your injuries. There’s a lot in your question and the facts of your scenario are not entirely clear to me. If this is a FL workers’ comp claim, please contact my office for a free consultation and we can discuss your situation in greater detail. If you’re saying you have an accepted low back injury that caused a fall outside of work while at home, the fall would be covered by work comp as long as your industrial injuries (the back injury that was accepted) is greater than 50% of the cause of the subsequent fall when compared to any other causes. For instance, if you had a seizure and that caused the fall, it wouldn’t be covered. Hope that helps.

      I can only speak about Florida. In Florida, you do not NEED to have an attorney to settle. In general, I’d recommend it though. An attorney will know how to properly evaluate the value of your case. In Florida, you have to attend a hearing in front of a Judge of Compensation Claims if you settle your case without an attorney representing you and the settlement is not final until the Judge approves it at that hearing.

    Literally the best and most genuine video I've watched about this topic. Im currently off work with a cervical stenosis and bulging discs, probably facing surgery but navigating my way toward settlement. I just want to be free of this and live, love and learn.

    Hi, l am a FL resident. I was working when I fall from a ladder and I injured my dominant arm shoulder. I had a rotator cuff surgery and still receiving therapy, l still can’t fully lift my arm. l returned to light duty work with restrictions and only part time. Now , they scheduled a mediation meeting and possibly to offer a settlement though l don’t know the rating percentage of my disability. I do only manual work for living. How much do think they may offer? and is it possible to settle without evaluating my disability?

    Have a global settlement in process, we're at the demand stage--how do i get the pd ratings from all injuries to calculate a number already had a msa done by the defense & was blessed by cms, now comes the indemity part-How does this intell with the msa figure?Do my attorney get a fee of the msa? It states that all money in the msa has to be spent on injury only-how can this be if he take a fee? Have 4ea. injuries on different dates & surgery has been requested, but i want the surgery to be done under my msa account instead of workers comp due to many denials on treatments needed!

      You definitely can. Whether you should or not is a decision you and your attorney should make together. An IME may be necessary in order to make sure that you receive fair value for your case.

    Strange the worker's comp judge approved my surgery now the employer's insurance carrier filed an appeal to not have the surgery, and to my knowledge the judge's decision is 90% solid so I'm having surgery they say they will not pay but surgery is needed so I can on with my life. We will deal with the who is paying thing later.

    For my lawyers said they offer 100 and that's it then they said 120 then they said 150k why so many different amounts in one phone call to me

    Thank you for your video I've settled and closed my case in December I have received my settlement check and was awarded future medical but neither my attorney nor my selected Dr has heard from the insurance company I honestly don't know what to do.

    Can your employer not pay you while going through medical treatment and use retaliation because you filed a complaint because of nonpayment. This includes blocking unemployment benefits

      Any questions regarding unemployment should be directed to a labor and employment attorney. Whether you get paid while receiving medical treatment for a work related injury boils down to what your doctors say you are physically capable of doing. Happy to discuss if this is a FL claim.       In FL work comp cases, this is not something you are compensated for. The closest thing that exists is payment of permanent total disability if you cannot work even a sit down job within 50 miles of where you live once you’ve reached MMI.

      If this is a Florida work comp case, usually, the Employer will require you to resign as part of settlement. Not always. But probably 90% of the time.

      In FL workers’ comp cases, an attorney can be paid a fee that comes out of the settlement which is technically paid by the employee and/or a fee can be paid separately by the Employer if the attorney successfully litigates entitlement to benefits.

    I've had surgery on my strongest arm and now I'm unable to use my arm, hand and fingers, constantly in some level of pain. Having trouble with other arm due to over use, do you think I should settle. Surgery was 2020

      I only handle FL cases. Settlement is your personal choice. I can’t event tell a client whether they should settle or not. All I can do is tell them what value their case has IF they want to settle it. Remember, settlement means you will never get any further benefits (medical or lost wages) in exchange for a single payment.

    I have a 7 percent MMI rating , the attorney for the insurance company called me and told me the value they would settle for . The question I have is .. I resigned from the company since. I noticed the attorney never sent over the documents for me to sign . Is the attorney delaying settlement because I resigned? Can they delay? And should I seek an attorney?

      There’s a lot to unpack here. First, I can only speak to Florida. Second, in general, I say always talk to an attorney, especially if the consult is free. It’s not uncommon for the settlement documents to take 1-2 weeks to be sent depending on workload so if you aren’t concerned about whether you are receiving enough and just are concerned it is taking too long, I’d follow up with the attorney on the status of preparation of the documents.

      In Florida, if you are hurt at work and your claim is accepted by the employer/work comp insurance company, no. Your treatment is provided and paid for during your case and when you settle, the only thing deducted from your settlement would be your attorney’s fee, their costs and possibly child support if you are under an order to pay child support and are behind on payments.
