Regarding SCOTUS Chevron decision: Many SS experts consistently say that COLA is unfairly calculated for seniors because it is based upon the cost of living expenses for an administrative job. They say it should be based upon the cost of living expenses that seniors face, which is about 2% higher. What’s your legal opinion of the likelihood of a federal judge to change the standard from an administrative job to the typical costs of living of seniors? Would it take a class action suit or documentation of seniors living below the poverty rate, food insecurity, inability to pay utilities and rent?
If you are using all the terms properly the answer is typically no. You only get Social Security Disability if you are not on Social Security Retirement.
Great job 👏 your so right but I’m in Ohio and SSI here will determine your pay by how much disability you get so there is no off set I believe I’m currently receiving both due to a bad accident at work but it’s been 3 yrs now and I still have not heard from my doctors what my impairment is am I ever gonna work again that’s my I was recommended to apply for SSI 10 months after I stopped working

I know a injured worker that was approved for social security disability and the state legal doctor/ qme for worker compensation injury also found it to be unable to work in open labour market permanentaly. that means the injured worker is totaly permanent disabled in worker compensation system too? qme found severe disability with walking assistive devices and multiple body parts affected.
It depends because it varies from State to State and Social Security and Workers Compensation use different standards for what it means to be "disabled."
I’m in Delaware so I know you can’t help me but I’ve been on worker’s compensation since 2009. I do have a WC attorney who is amazing. I did apply for SSD over a year ago and am on my 2nd appeal. I can’t find a SS attorney that will take my case because it’s been so long since I’ve worked. The judge at SS stated she only wants to hear about my disability from 2009-2014. I can’t get an attorney to understand that. Do you have any suggestions to help me word my case to a SS attorney? Anything would be greatly appreciated. Thank you
Very well explained! I'm 100% P&T through VA disability compensation and I also receive $4300 a month (after the 15% attorney fee) from worker's comp pension (Also P&T). This also explains why my former employer was pushing hard for me and my attorney (I live in WA State) to file for SDI. They want to offset their loss. I do love the irony....they fought the hell out of my claim in court and lost. Now they want me to cooperate with them and play ball??? Yeah, no. I'm 54. I can wait until I reach 62 and draw social security early. The way I was mistreated by my former employer and spied on constantly, they can pound sand and pay the court ordered claim. No love lost.
I just got full approval on SSDI, but I’m getting workman comp money. Workman comp said they pay for 7yrs r til I’m 62yrs old, SSDI check is pretty low. Will SSDI go higher when I’m 62yrs retirement age when workman comp fully paid me.

In New York State I had work related injuries that left me permanently disabled. And was fired. After my first surgery in 2018 I received payments for 6 months and then they stopped fully. Even with a deformed right quad a crushed knee and bruised spine Than I had my second surgery in Feb 2020. Still after second surgery New York State workers comp never began paying benefits. And than the following year In 2021 I had back surgery. And once again In New York state I received no benefits. Since 2019 I’ve tried to provide work market attachment. I was denied in 2020 because I never submitted my searches into board website as I was just reading them off. And than just recently I was denied 2 years of labor market attachment because even though I submitted the proper forms with jobs info on it, the state of New York denied me because they say I have no proof of application. And what really hurts is they denied in person job interviews I went on beginning in June of 2022. NYS workers compensation treats its black claimants as if were lazy and not truthful.

I had a PPD from a previous vaccine injury. I was mandated to get the Covid vaccine and it was given at my job to keep my job (nurse). I got vaccine injured and was out of work without pay on FMLA from my jab injury. My job fired me because I "took too long" while out on FMLA. They never called to tell me I was terminated and I didn't find out until I brought my Return to Work paper to work. Is this legal?
Since when does our employer have the legal authority to be our medical advisor? Our government does not have the legal authority to be our medical advisor. Last, the mandate does not equal law. Hire an attorney.

I had to apply for ssdi couldn't get WC benefits or unemployment, I have no for a little over 4 months what else can I do!
