23 years as an Air Force Officer. I worked around and close to about a dozen generals/admirals. All but 3 were empty suits who couldn't lead and were only there because they kissed butt. The worst of the bunch was a Marine 4-star who couldn't make a decision even if lives and livelihood were at risk. Lucky for him he had good Field Grade officers around him to make the hard decisions. Of the good ones, one was an Army Brigadier and the other 2 were Navy Rear/Vice Admirals, smart men of courage and good leaders.

UPDATE: He filed a lawsuit in the US District Court for the Northeast District of Ohio two days ago, case 4:23-cv-2200. He sued Columbiana County, the city of East Palestine, Major John C. Harris Jr., and four other law enforcement officers in their personal capacities. I hope he gets a fat settlement or wipes the floor with them all in court.

Worked with that reporter years ago. Super professional and great guy. Was great to all the production crew, especially those new to the journalism scene.
This doesn't surprise me. You can tell he's professional by how quietly he is speaking to the officers even after being pushed by the National Guardsman. In a high stress confrontation, he had the awareness to remain quiet during the briefing. Speaks volumes to his character and professionalism.
This just seemed like a discriminatory action by these police. The reporter got targeted and kicked out of the conference because the police wanted to do it and not because any laws were broken. And of course no cops were disciplined after this so it’s going to happen again unfortunately.
He didn't seem very professional. He behaved like an ass in this clip, thinking that being a reporter entitled him to be a disruption. The fact that this is being reported as a first amendment issue is ludicrous.

I have a degree in journalism and have worked with law enforcement as a psychologist. It is still infuriating to see law enforcement employees behave in such bullying ways to wield their power, clearly to build up their egos. Kudos to Mr. Lambert for his fortitude, clarity of thinking, expression of the law, and standing up for what is right for American People. I hope this is shared with more law enforcement groups.

@@xivix6710 That's the bodycams pre-event buffer. Body cameras record continuously, but don't save it all to memory. Instead they have a 30 second buffer that gets captured once the bodycam is triggered. @1:31 you can see a hand touch the camera and hear a buzz, that's the officer actually activating the camera. The video before that is what the buffer captured. Why it doesn't record audio, I can't say. If I has to guess it's probably police not wanting what they say recorded until they hit the button deliberately. Realistically there's no reason it can't save audio as well.
I'm from the area and this was incredible. They had absolutely no right to remove him, and clearly he didn't escalate one bit. The way the police tried to sweep this under the rug was insane. It's a good thing this was a national story because otherwise who knows if this would have blown up the way it did.

Presumably the Attorney General's office has such people. There's a false arrest,in some states that will fall under adifferent name though, also assault and battery, again that may not be the correct charge in Ohio but it will be a crime regardless of name. There's at least the appearance these crimes are part of a conspiracy involving the sherriff which at the very least demands investigation.
I liked how, even through all of the commotion and frustration, Mr. Lambert kept his speaking volume low to not cause anymore unnecessary distraction to the proceedings that were going on. The professionalism on his part was commendable considering the scenario and especially because anyone that's been in a school gym knows how sounds effortlessly echo around in those places.

Saying the right things is only lip-service if they don't follow through with disciplinary actions against the offending officers involved. I'd give him a grade of "Incomplete" pending any real action beyond simply "dismissing" the case and hoping it goes away and the attention of the public dies down.

@@svbarryduckworth628 Don't we on this channel harken de-escalation tactics and discretionary arrests? personally I don't think arresting the an officer for misdemeanor false imprisonment would be worth it, especially since as ATA stated, its possible the journalist could have SOME charges against him since he was asked to leave. The only one I see having any real charges levied against him would be the Major General, and again, discretionary, is it worth it to arrest him on it when he de-escalated and walked away? Maybe, but I feel the journalist suing is a better option in both cases.

@@jonhohensee3258 They are trained to yell "STOP RESISTING" when trying to arrest someone. They are also trained to yell "DROP THE GUN" or "GUN GUN" before shooting someone. This way, when they call witnesses to the trials, the witnesses will be more on the cops side because, even though they might not have seen exactly what happened, they can recall what the cops shouted. He was the only National news journalist there. They were attempting to limit the access of media in order to keep a lid on the Ohio train derailment. That alone is unconstitutional. We then see the rest of the abhorrent behavior of the public servants.
Points to remember on this. 1 - He was doing a scheduled live broadcast when the Governor decided to come out to talk. 2 - If you watch the broadcast you see him try to quietly and quickly wrap it up so he can cover the press conference. 3 - He was so quiet in the back of the gym that the Governor said he never heard him in the front of the gym. 4 - When told about the arrest, the Governor said the reporter had every right to do his job.

It's too often that officers will knowingly violate your rights and then take a "I'll worry about the consequences later" attitude. Which usually there are none. Which dosen't help the matter either.
The fact that the officers, sheriff, and major general were so unprofessional really escalated this. I truly hope they all get disciplined in some sense.
More than unprofessional, major general butthole had zero authority to require anyone to do anything, then went on to commit battery on a journalist. He should have been the one arrested pure and simple. The good news is that the military really doesn't like it when soldiers, especially officers in uniform become public spectacles. I'm so glad you covered this case! I live in Dayton, Ohio, and we've all been trying to get the word out about this situation! East Palestine has been abandoned by our federal government and Mr. Lambert was purposely refused access because they knew he would report the truth, not the agenda and reteoric government officials have worked hard to spew. Animals are dying, people are sick, and water and streams are contaminated with a rainbow sheen covering the water while dead fish line the shores. I know there is already 1 diagnosed case of cancer, and it's cancer only related to exposure to the toxins that were spilled and burned from the derailment. The woman diagnosed with cancer also lives about 500 yards from the derailment site. Many townspeople haven't gone home, and a few have been financially able to relocate, but many don't have that option because East Palestine is a lower income community. A whole community, many families are generational residents, have been hung out to dry and financially ruined. Properties have plummeted in value, equity in property is destroyed, and our federal government could care less. While Trump came to visit bringing clean water, resources, and meeting the community and listening to their needs, Biden went to Ukraine. Mr. Lambert experienced governmental corruption at it's finest and here in Ohio, we all know it! Justice for Mr. Lambert!

It made huge news amongst the truth community when Mr Lambert was arrested, as many said they knew he would show the state governor in a very bad light. His arrest and tackle to the floor by the bouncers was shocking, to most people around the world. If it's any comfort, it backfired, because now we know that there is a much worse problem with corruption than we outside the US realised.

I didn't think of it until just now when I read your comment about the big bad army dude being afraid of the journalist. As soon as I read it, I immediately thought about the Three's Company Season 6 Episode 11 where Jack gets arrested for decking an undercover cop. Toward the end they were in the booking room when the desk cop says to the undercover cop that the rest of the guys are going to get a real good laugh at his expense when they all find out that some little pip squeak like Jack laid him out like an old blanket. I'm so glad you covered this one. What was so insane about this is that it appeared that the reporter cut his live shot short when they asked him to stop. He literally did exactly as they had asked and then immediately the Major General went after him anyway. MG needs to be demoted. He was completely out of line. Everyone involved needs to be disciplined except the woman cop who was stopping the MG from further getting in the reporter's face. Also, I'd like to see all of the body cam video for that day because you know the cops went up to the building owner and solicited a trespass. There's no way that business owner did that on his own.
It was a public school building being used presumably because of its space. The building supervisor is about as important as the janitor. The sheriff and state police clearly weren’t exactly constitutional scholars. They deserve to be sued for arresting the wrong guy.
No police officer should be given the rank of General, it's demeaning to actual General officers in the US Military. It's a military rank, and thus demonstrates how the police think of themselves. It's contrary to what they are hired for, and what they should be doing.

There’s quite the power struggle going on in the video. I love how the guy got intimidated by the reporter because of how big he is, yet he was the one who caused this whole situation to blow up by putting his hands on the “guy who was so intimidating”. If the reporter (or anyone else for that matter) puts their hand on an officer the way they did the reporter then it would be a felony because he put his hands on an officer. I would seriously consider filing a lawsuit because he was absolutely assaulted and brought to jail.
I remember from an episode of Judge Judy, a guy walked his cart into a car then tried to say that he was fearful and she wasn't having any of his crap. You don't get to be fearful of a situation you created.
As military, he did not have any authority over the civilian. When a disagreement arose, he should have immediately deferred to civilian police. The civilian police gave more weight to the aggressive military officer than the civilian, where in reality it was an equal 17:28 he said vs he said situation.
I love that all the camera people ran to film the arrest instead of the press conference. Causing the commotion that they we're alleging was being created by the reporter.
The natural reaction when people grab you is to pull away. It drives me crazy that people are charged with resisting arrest for that. Give them a second to understand what’s happening before you throw people to the ground and charge them with resisting.
Exactly non violent resistance should not be criminalised. Like how some counties won’t charge you for attempting to escape prison (only other acts like damage or violence in the process) as it’s natural to want to escape confinement

I’m saying to give them a minute before slamming them down or throwing them around. In this one, why did a TV reporter need that level of aggression that quickly for something so little?
A 2-star general who is frightened by anything other than a direct threat of violence in a combat situation should be relieved of duty and strongly encouraged to retire.

This Sheriff straight up bought this lawsuit. It's gonna cost tax payers plenty not only for the wrongful arrest, but also the money they lost by him not getting to report on this tragedy. As a former Trooper from another state this was clearly handled totally wrong by local law enforcement. Also I noticed the Troopers present didn’t participate in the clearly unlawful arrest. All involved should be sued to the full extent of the law. Every law enforcement officer should know these basic laws

We all know a person need not "resist" an officer for them to tackle you and repeat "stop resisting". It's part of their training to verbalize to make witnesses believe them.
They very rarely are charged or placed in prison for their crimes: Our government and employees are corrupt from the depth of their bone 🦴 marrow to the out side on all levels.
You're more likely to be executed by law enforcement than being able to hold them accountable. A lot of our legal systems make cops effectively immune to the law. There's no real punishments in our current system that even requires the officer to face penalties.
I also forgot to mention the fact of the major general should be arrested for assault, and since clearly that hasn’t happened, and I almost can guarantee it will never happen. It just goes to show government ploys can do almost anything they want to almost anybody they want almost anytime they want for almost any reason they want and walk away scot-free. The major problem I have with these cases is I have seen this happen too many times where police unlawfully detain or arrest people and then all that happens is the charges are dropped. However, it is a still a method of law enforcement illegally controlling people with no repercussions, because unless a person is seriously injured during the arrest, it is unlikely that cases like this will ever see any sort of compsentation (or any changes). So it encourages law enforcement to continue to do stuff like this (when they don't like how you look, or how you are behaving, that includes if they get their feelings 'hurt', even if you aren't violating any laws, it still gives them ability to get rid of you).
They should be stripped of their immunity and personally prosecuted and held financially responsible, not the city or the agency or whatever....because taxpayers pick up the bill in those cases.

There are a lot of things you don't know then. The cop showed good restraint by not hurting that NewsNation journalist for resisting arrest. If a cop tells you to do something, you listen. You don't stand there arguing like a child. If anything, the journalist's immaturity might cost him his job.

I've been in the Army for 14 years. An officer for half. MG Harris is way out of line, it's really mind blowing how he acted. Lots of skeletons in that man's closet IMO. He will be retired with full benefits soon (my opinion).
He has to be national guard because at the date of the incident, Feb 23, Ohio's governor had pointedly refused all federal assistance. In my experience, there's a marked difference between guardsmen and full-time members of the military.
You have to give an A to Attorney General Yost for clearly standing up for civil rights! His statement clearly put law enforcement on notice to the illegality of their action and the fascism they displayed. I really hope legal action will be taken against the officers and the Major General for their actions.
UPDATE 7-12-2024: In February of if this year he was awarded $112,000. He will receive $80,000 and $32,000 in attorneys’ fees and costs for the Reporters Committee for Freedom of the Press and the First Amendment Clinic at Case Western Reserve University School of Law, whose attorneys represented Lambert in the action. He received the settlement in December 2023, month after he sued. Rather than fight Lambert’s claims, the city and county quickly agreed to have the U.S. District Court for the Northern District of Ohio enter judgment against them in the journalist’s favor. Lambert voluntarily dismissed his claims against the individual officers. (So, yeah, no one was held accountable. Idk why he dismissed them)
And the funny thing about this is, the Governor DID NOT initiate this encounter nor did he care. That General and patrolman were being a-holes on their own accord. I hope the governor had him released as he was made aware after the interaction
Its not the patrolmen that arrested him it was the sheriffs office. Watch the video again the state troopers don't do anything wrong in my opinion they come to see what is going on when the general is bothering the reporter. General gets physical that the state troopers stop by separating everyone. Then the sheriff runs in and starts escalating the situation when the state trooper is trying to de-escalate it. Then the sheriff and his men arrest the reporter while the state troopers record it and look confused as why he even got arrested. I would say the state trooper did his job but the sheriff was the one who blew the thing up.

Yep, and even if your arrest turns out unlawful, they can still make up any justification for "reasonable suspicion" and convict you of resisting the unlawful arrest regardless. Both "resisting arrest" and "reasonable suspicion" are very broad terms that offer enough flexibility to get you under pretty much any circumstances. Even if you follow every instruction to a T, it's still at the arresting officers discretion whether the arrest goes smoothly without resistance, cause they have ways to make it impossible for you not to "resist" and they will get away with it. This is tyranny!
The statement the police put out claiming that they approached Lambert to "de-escalate the situation" is so ridiculous. They were clearly doing the exact opposite and going out of their way to create a problem even over his efforts to calm them down.

23 years as an Air Force Officer. I worked around and close to about a dozen generals/admirals. All but 3 were empty suits who couldn't lead and were only there because they kissed butt. The worst of the bunch was a Marine 4-star who couldn't make a decision even if lives and livelihood were at risk. Lucky for him he had good Field Grade officers around him to make the hard decisions. Of the good ones, one was an Army Brigadier and the other 2 were Navy Rear/Vice Admirals, smart men of courage and good leaders.

UPDATE: He filed a lawsuit in the US District Court for the Northeast District of Ohio two days ago, case 4:23-cv-2200. He sued Columbiana County, the city of East Palestine, Major John C. Harris Jr., and four other law enforcement officers in their personal capacities. I hope he gets a fat settlement or wipes the floor with them all in court.

Worked with that reporter years ago. Super professional and great guy. Was great to all the production crew, especially those new to the journalism scene.
This doesn't surprise me. You can tell he's professional by how quietly he is speaking to the officers even after being pushed by the National Guardsman. In a high stress confrontation, he had the awareness to remain quiet during the briefing. Speaks volumes to his character and professionalism.
This just seemed like a discriminatory action by these police. The reporter got targeted and kicked out of the conference because the police wanted to do it and not because any laws were broken. And of course no cops were disciplined after this so it’s going to happen again unfortunately.
He didn't seem very professional. He behaved like an ass in this clip, thinking that being a reporter entitled him to be a disruption. The fact that this is being reported as a first amendment issue is ludicrous.

It is still infuriating to see law enforcement employees behave in such bullying ways to wield their power, clearly to build up their egos. My blood pressure was far too close to normal this morning, so I watched this video to make sure I could feel my pulse pounding in my head. As a veteran, I have nothing but contempt for that National Guard officer.

@@xivix6710 That's the bodycams pre-event buffer. Body cameras record continuously, but don't save it all to memory. Instead they have a 30 second buffer that gets captured once the bodycam is triggered.
@1:31 you can see a hand touch the camera and hear a buzz, that's the officer actually activating the camera. The video before that is what the buffer captured.
Why it doesn't record audio, I can't say. If I has to guess it's probably police not wanting what they say recorded until they hit the button deliberately. Realistically there's no reason it can't save audio as well.

I'm from the area and this was incredible. They had absolutely no right to remove him, and clearly he didn't escalate one bit. The way the police tried to sweep this under the rug was insane. When a cop says "stop resisting" 9.9 times out of 10, their victim was not resisting. They are trained to say this for the bodycams.
Has anyone ever thought that when you have 2 people pulling on you in 2 different directions, that the 2 people feel the other of the 2 people pulling and it isn't the person being arrested doing anything other than getting pulled?
If I grab your wrist, your natural instinct is to pull away. If I try to knock you off balance or push you to the ground, it's your natural instinct to stay upright. Cops do these things to escalate violence and get charges added on.

@@kiillabytez I'm not particularly current on Ohio law so I'm not sure, you would of course need someone specifically familiar with Ohio law to craft the indictment. Presumably the Attorney General's office has such people. There's a false arrest,in some states that will fall under adifferent name though, also assault and battery, again that may not be the correct charge in Ohio but it will be a crime regardless of name. There's at least the appearance these crimes are part of a conspiracy involving the sherriff which at the very least demands investigation.

I liked how, even through all of the commotion and frustration, Mr. Lambert kept his speaking volume low to not cause anymore unnecessary distraction to the proceedings that were going on. The professionalism on his part was commendable considering the scenario and especially because anyone that's been in a school gym knows how sounds effortlessly echo around in those places.
He even smiled several times. An ability I do not possess when I am angry.

Wish you had given AG's a grade as well. Cause the Ohio state AG Yost was spot on, and deserves an A+. Not only dropping the charges, but releasing a statement essentially chastising the officers involved as well. I personally commend him.
Saying the right things is only lip-service if they don't follow through with disciplinary actions against the offending officers involved. I'd give him a grade of "Incomplete" pending any real action beyond simply "dismissing" the case and hoping it goes away and the attention of the public dies down.

The only one I see having any real charges levied against him would be the Major General, and again, discretionary, is it worth it to arrest him on it when he de-escalated and walked away? Maybe, but I feel the journalist suing is a better option in both cases.

1 - He was doing a scheduled live broadcast when the Governor decided to come out to talk.
2 - If you watch the broadcast you see him try to quietly and quickly wrap it up so he can cover the press conference.
3 - He was so quiet in the back of the gym that the Governor said he never heard him in the front of the gym.
4 - When told about the arrest, the Governor said the reporter had every right to do his job.

I'm so glad you covered this case! I live in Dayton, Ohio, and we've all been trying to get the word out about this situation! East Palestine has been abandoned by our federal government and Mr. Lambert was purposely refused access because they knew he would report the truth, not the agenda and reteoric government officials have worked hard to spew. Animals are dying, people are sick, and water and streams are contaminated with a rainbow sheen covering the water while dead fish line the shores. I know there is already 1 diagnosed case of cancer, and it's cancer only related to exposure to the toxins that were spilled and burned from the derailment. The woman diagnosed with cancer also lives about 500 yards from the derailment site. Many townspeople haven't gone home, and a few have been financially able to relocate, but many don't have that option because East Palestine is a lower income community. A whole community, many families are generational residents, have been hung out to dry and financially ruined. Properties have plummeted in value, equity in property is destroyed, and our federal government could care less. While Trump came to visit bringing clean water, resources, and meeting the community and listening to their needs, Biden went to Ukraine. Mr. Lambert experienced governmental corruption at it's finest and here in Ohio, we all know it! Justice for Mr. Lambert!

It made huge news amongst the truth community when Mr Lambert was arrested, as many said they knew he would show the state governor in a very bad light. Arrested, kept from reporting on an important issue, assaulted, put in jail for 5 hours, I'm sure thousands of legal fees paid (that most couldn't or wouldn't pay), then case completely dropped weeks later, and no repercussions for the people that did this. System working as intended!

UPDATE: In December 2023, Lambert settled the case for $80,000 plus attorney's fees. That's all well and good, but as usual, the tyrant cops get off without any repercussions. The insurance company pays out the dough, and if the county's premiums go up, the taxpayers suffer the consequences. Therefore, nothing really changes for the better.

As soon as I read it, I immediately thought about the Three's Company Season 6 Episode 11 where Jack gets arrested for decking an undercover cop. Toward the end they were in the booking room when the desk cop says to the undercover cop that the rest of the guys are going to get a real good laugh at his expense when they all find out that some little pip squeak like Jack laid him out like an old blanket. I'm so glad you covered this one. What was so insane about this is that it appeared that the reporter cut his live shot short when they asked him to stop. He literally did exactly as they had asked and then immediately the Major General went after him anyway. MG needs to be demoted. He was completely out of line. Everyone involved needs to be disciplined except the woman cop who was stopping the MG from further getting in the reporter's face. Also, I'd like to see all of the body cam video for that day because you know the cops went up to the building owner and solicited a trespass. There's no way that business owner did that on his own.

It was a public school building being used presumably because of its space. The building supervisor is about as important as the janitor. The sheriff and state police clearly weren’t exactly constitutional scholars. They deserve to be sued for arresting the wrong guy.

There’s quite the power struggle going on in the video. I love how the guy got intimidated by the reporter because of how big he is, yet he was the one who caused this whole situation to blow up by putting his hands on the “guy who was so intimidating”. If the reporter (or anyone else for that matter) puts their hand on an officer the way they did the reporter then it would be a felony because he put his hands on an officer. As military, he did not have any authority over the civilian. When a disagreement arose, he should have immediately deferred to civilian police. The civilian police gave more weight to the aggressive military officer than the civilian, where in reality it was an equal 17:28 he said vs he said situation.

You're more likely to be executed by law enforcement than being able to hold them accountable. A lot of our legal systems make cops effectively immune to the law. There's no real punishments in our current system that even requires the officer to face penalties.
I also forgot to mention the fact of the major general should be arrested for assault, and since clearly that hasn’t happened, and I almost can guarantee it will never happen. It just goes to show government ploys can do almost anything they want to almost anybody they want almost anytime they want for almost any reason they want and walk away scot-free. It is absolutely effing disgusting and it makes my stomach turn.

The major problem I have with these cases is I have seen this happen too many times where police unlawfully detain or arrest people and then all that happens is the charges are dropped. However, it is a still a method of law enforcement illegally controlling people with no repercussions, because unless a person is seriously injured during the arrest, it is unlikely that cases like this will ever see any sort of compsentation (or any changes). So it encourages law enforcement to continue to do stuff like this (when they don't like how you look, or how you are behaving, that includes if they get their feelings 'hurt', even if you aren't violating any laws, it still gives them ability to get rid of you).

I've been in the Army for 14 years. An officer for half. MG Harris is way out of line, it's really mind blowing how he acted. Lots of skeletons in that man's closet IMO. He will be retired with full benefits soon (my opinion).

He has to be national guard because at the date of the incident, Feb 23, Ohio's governor had pointedly refused all federal assistance. In my experience, there's a marked difference between guardsmen and full-time members of the military.

His statement clearly put law enforcement on notice to the illegality of their action and the fascism they displayed. Its not the patrolmen that arrested him it was the sheriffs office. Watch the video again the state troopers don't do anything wrong in my opinion they come to see what is going on when the general is bothering the reporter. General gets physical that the state troopers stop by separating everyone. Then the sheriff runs in and starts escalating the situation when the state trooper is trying to de-escalate it. Then the sheriff and his men arrest the reporter while the state troopers record it and look confused as why he even got arrested. I would say the state trooper did his job but the sheriff was the one who blew the thing up.

Yep, and even if your arrest turns out unlawful, they can still make up any justification for "reasonable suspicion" and convict you of resisting the unlawful arrest regardless.
Both "resisting arrest" and "reasonable suspicion" are very broad terms that offer enough flexibility to get you under pretty much any circumstances. Even if you follow every instruction to a T, it's still at the arresting officers discretion whether the arrest goes smoothly without resistance, cause they have ways to make it impossible for you not to "resist" and they will get away with it. This is tyranny!

He did resist rhe arrest by going limp, however there could be a strong argument the arrest was unlawful so he had every right to resist it.

The statement the police put out claiming that they approached Lambert to "de-escalate the situation" is so ridiculous. They were clearly doing the exact opposite and going out of their way to create a problem even over his efforts to calm them down.
They don’t care. Nothing will happen to any of them. They are all thugs working together. It’s the same excuse every time. Charges dropped. And either we investigated ourselves and found no wrong doing. Or they let the offending officers quit save their pensions and go commute 15 min longer to next town over and get a promotion for the inconvenience. The whole thing is so laughably obvious.
