      That was the exact moment when arrest became an inevitability for that cop. He was (rightfully) pushed into a corner and decided to do whatever was required to make sure the kid was arrested. That pride/spite is gonna cost him (or rather his town’s taxpayers) severely.

      It didn't matter if he said it or not. The cop was taking him in for DUI. The cop made up his mind before he pulled him over. The cop got him out of the car and flat out lied and said he smelled alcohol on his breath. The cop knows not a thing will happen to him for arresting sober drivers for DUI so what is the incentive to not do it? The incentive to do it is they get promoted based on the number of DUI arrests they make along with other factors. It doesn't matter if those arrests later get dismissed.

      @@flatcube3706it's true though. We need to hold the bad ones accountable, but I have a good friend named John Preston who works for Owensboro ky police department. He would die to protect anybody, and give you anything you needed. He would never drudge up a lie to try to frame you he has a beautiful soul great guy I promise. That's not to downplay the bad ones we all know they're out there in abundance but there are a few gems I promise.

      He was surely coherent as there is no way you could say it wasn't easily possible to follow his meaning, and the occasional push backs about the officer looking stupid were both true, and easily understood and didn't make the whole any less understandable.
      Not that you should have to be polite when falsely being accused of crimes, that seems an untenable position, if someone needs only rile you up enough to get you being even slightly impolite to hold that against you.

    I was a cop for two years, and I am sitting here honestly wondering how anyone could be expected to respect the police. One night one of my co workers tased a guy going into diabetic shock because he wasn't "immediately compliant". There is a sad disconnect here, and I don't blame the public at all for their lack of trust in law enforcement. This is embarrassing.

      When did we allow officers to be come judge jury and executioner , when qualified immunity was created giving the scales of justice so much bias it’s still not recovered . Body cams and dash cams have helped but the controls of them still allow evidence for or against to be lost

    For anybody who is wondering what is going on with the lawsuits….
    On 2/14/2024 federal judge ruled that the kids lawsuit may proceed forward as to the judge it was clearly and obvious from the start that he was not intoxicated.
    For the officers counter suit.. judge ruled that the kids comments about the cop being “on the slow side of the spectrum” and the cop being “unfit physically and mentally” were not defamatory and were thrown out. However, judge said the cops could proceed with the lawsuit due to the kid saying the cop was “convicted” of domestic abuse. In reality, the cop was served a restraining order from his ex under the grounds of alleged abuse.

      @@erickperez3551 I checked after I saw your comment. No update since this ruling in February. These type of civil suits can take a long time to play out (years), and this one seems no different as I don’t even see another court date scheduled yet. My guess is the police department and this kids attorneys are likely at the negotiating table for a settlement. As someone who lives in Chicago, and whose police department is sued all the time… majority never make it to a civil trial. I bet this case never does either and the police department and the kid will settle for an “undisclosed amount” with the cop dropping his countersuit.

    I live near the town this happened in. The police officers filed a lawsuit against the kid recently for defamation. These police officers are abusive and disrespect young adults all the time. It's pretty sad.

      It's also possible one of these men has a medical condition that makes them smell like alcohol there's at least one condition I'm aware of that basically turns your body into an alcohol factory wherein your body naturally produces alcohol from the sugars in your body

      First, and I am sure you know this, but you don't need a degree in law to be a cop. Second, and I have been through the academy, more time is spent learning compliance techniques than actual law. At the end of the day, the law matters very little. It's all an ego thing.
      You'll notice when radioing he makes numerous exaggerations. To say this is common is an understatement. There is this constant aura of intimidation. This goes for within departments as well. I got in a physical altercation with one of my supervisors on a training day, that ended up being why I left law enforcement. Mind you, I wasn't fired. It's almost impossible to fire a cop. I left. I can go into this story if you're interested.
      In conclusion, you're right. School yard bullies who are used to getting their way. That's what it boils down to. The bully on the playground didn't have to admit he was wrong. Why would he? In your words "Sad as hell", and in my opinion, I couldn't have said it better.

      Any time a cop uses "smell" as a criteria for probable cause and it's proven that there was no such substance, that cop should be considered a known liar by the courts.
      There's an auditor in my city who focuses mainly on the right to drink in public. "Drink," not "be drunk." One of the things he does is walk around with a root beer bottle in a paper bag. Cops have claimed to smell alcohol from his breath or the bottle several times, only to be proven to be liars after doing a search and finding that it was root beer. He never consents to these searches, meaning they're done without probable cause since the smell is a lie.

    Disgusting! I just had the same situation in Orange County, CA and I told them I wants drinking, anyway they did all the roadside test along with a breathalyzer and said I had blew 0.081 twice in a row without letting me see the results. Then they put me in jail for almost 24 hours and when I got out I had no charges because I never had a thing to drink. Now I am suing the PD for arresting me and breaking the 4th amendment. I cant wait to put these disgusting tax paid servants on trial and hopefully taking their jobs so they cant harm anymore tax paying citizens.

      Edit: as a side note those field sobriety tests count for nothing at least here in Denmark, there could be many reasons why ones speach might be slurry or you could perform certain tests.
      Which is why the police do blow testing as well as drug testing. If any of those exceed the threshold, they take you to the hospital, where the do proper lab tests using bloodsamples.
      Which to me at least seems way less fear inducing.

    This is honestly one of the craziest ones I've seen. Kid gave absolutely ZERO indication of being intoxicated. Cop was aggressive off and very short off jump while the driver was incredibly respectful/cordial with all of his requests.
    Cop just saw he was a teenage and heard "coming from my friends house" and assumed he could get away with it. The fact stuff like this can happen and they can still keep their job blows my mind.

      I don’t trust the police anymore, though I shouldn’t have long before I’ve seen all this police misconduct, because I too had been in a similar situation as this kid being falsely accused.
      I know we want to say not all cops are bad, but when the issue is this rampant the issue extends far beyond individual cops. We need to start by getting rid of qualified immunity.

    He’s 19. The reason he was “fumbling over” his registration and insurance is because he doesn’t really know what they look like. He just knows his parents keep them in the glove box.
    I’m 28 and when I get pulled over for the first time, I will struggle to recognize which paper in the glove box is which.

      I just got my license and I’m so nervous for this. I have no idea what insurance or titles even are STILL. I have a dysfunctional family no one taught me anything, they didn’t even show me where my headlights and defrost were which was on the test :(

      @@TaphsAJ I recommend keeping registration and insurance under the sun visor with a rubber band.
      that way you can get to it in a snap and not have to worry about that part.
      Also each car has different locations for the defrost and headlights.
      Most cars keep the headlight switch to the left of the steering wheel as a knob.
      Or in some cases on the steering column on the same stick that controls the turn signal.
      Defrost is mostly located to the right as an independent button.
      Reverse all the directions if in a European or Japanese vehicle.

Completely derailed my life. 25 years later thinking about the damage it did is sickening. the thing is, once you've been labeled as a criminal the standard becomes multitudes lower. Any police officer that doesn't think to him or herself, "before I arrest this person were they truly doing anything morally wrong in anyway whatsoever?". If there is a hell, may they go there and find themselves inflicted with all the harm they inflicted on the innocent.

He reached in, unlocked my door, grabbed my arm and pulled me out of my car. No ticket, no charges, because I did nothing wrong, but that opened my eyes.     That cop knew right away that he was charging that kid with a DUI no matter what happened. He knew that when he blew clean and passed all the field sobriety tests that he was going to say, "Well, I still think you're intoxicated and you're going to jail.." That's just so messed up.       If you can handle watching shows about this kind of thing, you should check out "Paradise Lost: The Child Murders at Robin Hood Hills". (I said the first part because it's genuinely disturbing when massively unfair preventable things happen because of a corrupted system, it was not intended as sarcasm.
      The show is hard to watch though. Basically these kids were accused of murder and they went to trial, but the prosecutor used evidence of them being interested in metal music and one of them owning a book about witchcraft as evidence that it was a ritual killing by them. The police also repeatedly used fear tactics against a mentally challenged kid to force him to confess to being involved, including showing the child jarring disturbing pictures of the naked mangled bodies of the murder victims. The confession included a description of what the police thought happened because they guided the confession instead of letting the accused explain without outside influence on the story, leading to a lot of misinformation about the case in court.
      I think the worst part about this is that the killer completely got away with it because the police and courts were so convinced the suspects were guilty that anyone else who could have been actually involved in the murders probably escaped completely undetected.

      @@methane13 the boy doesn’t have to go into the police car. It’s his right to refuse this and he should have questioned it and said no, because it’s his rights to remain silent and not be interrogated or anything without their rights and the officer can not enforce anything. There was nothing to allow the officer to be able to enforce anything, he could only ask. And the boy could refuse, and should have because the officer was being unreasonable and obviously accusing him of DUI.
      It’s been awhile since i took a class on criminal and justice, so I can’t give great detailed explanation of this. BUT I do know that the officer was being out of line and he shouldn’t have abused the fact that the young boy doesn’t know he doesn’t have to do what the officer says. And it’s happened before to a pilot where a situation like this happened and he even knew his rights but the officer bullied him into obeying anyways by basically arguing with him about it and the pilot lost his job cause the arrest went on record, even tho it was clarified after lab tests by a hospital he was COMPLETLEY SOBER.
      Some cops are assholes and abuse their power and think they can just boss people around knowing they don’t know their rights in the moment to refuse. And they get arrested like this guy… and it goes in your record even if you weren’t Intoxicated. The officer didn’t have any evidence or reasonable proof to even accuse this.

      @@FLIPPER1439 it’s the rights when in situations like this that people don’t always know. And some officers will purposefully or even think they can force someone to comply to them even if the law is the person has to choose to comply. And officers will make it seem like they are in the power to make you do what they say, and you do it cause you think I got to obey but then you end up in a mess cause you don’t have a lawyer and they waste your time etc.

    I had this exact situation happen to me as a kid. told I was drunk.. blew 0.00... then told I was high. I was 1000% sober. Did the eye follow test. Told I "passed" but my eyes were shaking "so we know you're high". There was 5 cops telling me I'm inebriated when I'm not. I was scared wondering what the hell is going on.
    Towed my car, took my license.. cop told me to hitch-hike home at 3am.
    Was a great way to learn about the corruption of police.

      A good lesson to learn early, but unfortunate since they put it on your record.
      I have kept a clean record myself by stating to them that I would not press charges under threat of arrest when they threatened to arrest me over a stalker following me, breaking in, and assaulting me. I already knew cops are corrupt, but they went out of their way to threaten my safety.

    Even when they're wearing body cameras, it's amazing to see there's still a lot of cops out there doing bad cop things. Also after Googling this case, it turns out this Officer Winters has a no contact order for domestic abuse after beating his ex-girlfriend in 2021.

    This one really gets to me because of the stakes for this kid. Anyone who has played college sports knows that something like this, guilty or not can destroy is athletic career. This same situation happened to me right as Covid started. It was 7 am, and I was sick on my way to the doctor. I was pulled over, and accused of being intoxicated because I was ill and I wasn’t as sharp as the cop thought I should be. I blew a triple zero, and took one too many steps during the sobriety test so I was arrested and taken to the PD for a drug evaluation. When I passed the drug evaluation I was released, but still charged with DUI. I had to pay an attorney to get the DUI charges dropped, with the stipulation of getting a medical evaluation due to me being under the weather that day. Agreeing to the medical evaluation was the biggest mistake I have ever made. 3 years later I am still going back and forth with the DMV medical department and unable to renew my license. I have paid for 3 different physicals, with 3 different blood panels, all in which my doctor cleared me as healthy to drive. Despite this, and because the Florida DMV is completely inept, I still do not have the ability to drive. Before the incident, I owned a moving company, and now can no longer work in the industry because I can’t even drive my own truck legally. We need serious change to our Policing in America.

      @@workliferecognition7002 actually in Iowa having high beams on in most towns is illegal. I believe it’s a county law, but I could be wrong. Cops don’t really ticket/fine someone for not dimming them though, it’s really just used as probable cause for a traffic stop as in this case

    A big part of the problem are the awards given out to officers for DUI *arrests.* They provide incentives for officers to make things up in pursuit of that high score.

      To be honest, as a cop for more than a decade in a foreign country, the big problem you face in the USA with your police forces is that your officers lack either formation and common sens. Another issue is the lack of management : it seems that every agent is doing whatever he wants whenever he wants. This can't work : you need strong leadership.

    I failed a sobriety test while sober when I was 18. I didn’t have good balance back then and I was scared of cops. Especially while nervous.

      He claims to have smelled alcohol, but when that didn't pan out of him, he pivoted to weed even though pot is INFINITELY more smelly than alcohol yet he never mentioned it until AFTER the PBT showed 0.00. That's 100% proof he was fabricating a charge. 😠
