  • 2020 - Video 68 (WITH POLICE OUTCOME)
    YT19 EKZ, YT19EKZ, YT19-EKZ Burton Roofing (www.burtonroofing.co.uk/) 12/05/2020 At 15:25 - travelling East bound on the A657 (just where New Line becomes Carr Rd) heading from Greengates Bradford in the direction of Calverley Leeds... The "Burton Roofing" HGV, REG: YT19 EKZ passed me with literally centimetres to spare... I do not know what this driver was thinking. This pass was utterly criminal and really freaked me out. Genuinely thought I was going to die. At the time of the event I was shocked, but when I watched the footage back I felt sick to my stomach. Police were equally shocked by the footage, and summoned the driver to an interview. The driver apparently apologised initially saying he was sorry to hear the cyclist was so scared, but insisted he had done nothing wrong and that cyclists shouldn't be in the road if they scare so easily. The driver was then shown the footage, at which point the police were appalled to report that he still denied any wrong doing. The police explained that had he demonstrated an understanding of what he did wrong and shown remorse, they would've gone back to me, the cyclist, and discussed going the route of a caution. The driver became more indignant at which point he was asked to accept an Fine of £100 and 2 points on his license. The driver refused and told the police based on the video evidence this would get thrown out of court. The courts doubled the points and fine. What saddens me - this is anecdotal evidence I can't erase from my world experience that there are some truly cold, cruel and deluded folk on our roads. Even in the face of disciplinary action/conviction, this maniac was still happy to push on with their warped anti-cyclist agenda of promoting fear and violence on the roads.

      If there were only many more drivers like yourself, Paul. Good man.
      Sadly, being 'discourteous' to many entitled drivers by preventing, or even trying to prevent them them from overtaking in dangerous places, seems to give them the green light to kill and maim cyclists.

    I’m a professional lorry driver & acting manager. If that came across my desk, someone’s in serious trouble. Happily conduct an interview, & pass up to 2nd line management as they can dismiss! Were it an agency driver, not even an interview, just straight on to the Non-Preferred list.
    I’ve on occasions driven 3 miles averaging 10mph safely behind a cyclist on country roads, (cue song by C W McCall), rather than risk an unsafe overtake.
    Point to note, you can also ask Police to involve the Traffic Commissioner, whom has the power to revoke Group 2 licences & operator licences.

      Faith in humanity restored. Thanks Paul, and thanks for the tip re the Traffic Commissioner. Sorry to read you were put in a strung out situation behind a cyclist for such a length of time - the done thing would have absolutely been for the cyclist/s to pull in periodically to let traffic by and keep the flow going. I believe if a cyclist is doing 10 mph or under and isn't making an effort to share the lane, then it is considered causing an obstruction. The only time I'd ride in a primary position consistently would be if I was keeping up with the vehicle in front or if I knew I was keeping to the speed limit. In this particular clip I'm receiving lots of negative comments suggesting I should've in someway yielded to the HGV. I'm not sure if this clip has been shared on some dodgy facebook group for marauding top gear fans or something, but what these commenters probably don't appreciate is I was riding (and do ride) passively, leaving plenty of room to show my willingness to share the space in the lane and allow for overtaking when there's space.

    I do think as cyclists, out of politeness, we should be aware of larger vehicles who might have more difficulty overtaking us and if they are behind us for too long- maybe let them past when it's safe.
    But this is a very different situation; the driver just rolled up behind at a speed barely 2mph faster than the cyclist and kept going at the same speed even though it wasn't safe to overtake. A very incompetent driver.

    • @MiseEnZheng
      @MiseEnZheng  2 роки тому +6

      Fully agree. And often/many times I would pull in when it's appropriate to let traffic pass and ease. Sure, cyclists have every right to the lane, but there's no reward for being stubborn or belligerent. This particular case, I really didn't realise the HGV was there as it was keeping well back at first and I was having to concentrate on road conditions in front of me. Immediately after the bend in the road everything straightens out and the road widens, but the driver purposely timed this really obnoxiously.

    • @oliverpolden
      @oliverpolden 2 роки тому +3

      I can probably say for a lot of cyclists that they usually know the road ahead and will either let traffic past if they know there’s a long stretch where it would be dangerous for cars to overtake them, or they will take the road and give it back soon enough when it is safe for cars to overtake. The problem is, there are drivers that get agitated and impatient and overtake when they could instead wait perhaps just ten more seconds for the road to open up.

    • @MiseEnZheng
      @MiseEnZheng  2 роки тому +2

      @@oliverpolden Absolutely, I was aiming to take the fastest line through the corner to create opportunities for a safe pass sooner. Would just mention that the LGV was keeping its distance too at first, my eyes were firmly fixed on the road and road conditions ahead, so until it made its move to pass me I was unaware it was behind me. I caught up to the Vehicle multiple times until our Journey went separate ways in Kirsktall. There's a big difference between making it hard for vehicles to pass on a long stretch of uninterrupted rural national speed limit road, and going through suburban sprawl with multiple traffic lights, road works, 20 mph speed limits etc. Bikes are ultimately faster and more adapted in that environment - never an excuse to punishment pass.

I'm not a cyclist, but they are like me are road users and have every right to position themselves in the road to avoid confrontations with motor vehicles. Saying he should have stopped or slow down is ludicrous and just shows a total lack of understanding of "how it works" between road users. Three years ago, I had a similar outcome with a taxi driver, who refused to give me priority on the road. At road junction, and I'm going straight ahead, but on the other side of the junction, is a taxi, and turning right. The taxi driver clipped my wheel, and shouted at me, and then drove of. I was lucky as when I moved of the light were just changing to green, but had they been green, I would have been cycling faster, and think it would have been a fatal accident
    I contacted thee taxi company and asked for a video apology, but the driver refused as he thinks he done nothing wrong. I even quoted the highway code, and why he was in the wrong. I asked a further two times for an apology, but he refused, and he was seeking legal advice
    We eventually ended up in court, and all my emails and video were presented to the court. The final outcome he was given 6 points and a £500 fine, and the police removed his taxi licence

    • @MiseEnZheng
      @MiseEnZheng  2 роки тому +9

      Yeah, there's a few comments and a bit of debate about my position in this clip in this comments thread. Truthfully, damned if you do damned if you don't. My position was such that I was trying to take a line through the bend that would see everyone out of the congested narrow section as quickly as possible - I knew the road straightened and widened immediately after the corner - I used to ride demonstrating a willingness to allow folk to pass, but I can't account for the ones who choose to do so in a terrible way anyway. There have been times when I have ridden assertively and the traffic behind did not know what to make of it, and I have incurred the typical "why are you in the middle of the road?" Road rage that you often see. Road bikes are pretty rare on the suburban and urban areas around bradford and Leeds, and really angry, really bad, really impatient, really immature drivers are a dime a dozen. When I rode, it really was just constant aggro.

      @@MiseEnZheng Yeah, the 'get off the road, ride in the gutter' types are always going to critical no matter what you do.Thier position isn't reason based, there's no point trying to appease them. I think riding in the safest position is always the way to go. There may be the odd driver that doesn't get defensive riding, but isn't a biggot, they should understand what you're doing when you make room for them to overtake when there's space to do so.

    I'll be honest with you, I was expecting another of those _"oh yeah, it doesn't look that bad"_ type of close passes. But OMG, I actually winced and held my breath as the truck brushed past you. Just pause the video at 1:31 and see how close the wheel nuts of the final wheel are to the camera!
    What surprised me though is that he seemed to hold back for a good minute being a good citizen before deciding to overtake you. But then goes and tosses it away with the closest pass I think I've seen on UA-cam. I'm amazed you didn't actually make physical contact (i.e. brush the dirt of his sides with your arm). And I think the Police initial "offer" of 2-points and £100 fine was a bit low anyway, it should've started at the £220 and 4 points in the first place...

    • @MiseEnZheng
      @MiseEnZheng  3 роки тому +9

      Hi Mark. Cheers for the comment. Indeed, some passes feel worse than they look... the camera doesn't always accurately capture the binaural experience of the sound of a car rushing up from behind, your ears get trained to pick up whether a car behind you is moving out or not. Also the turbulence and movement of air around you. Especially on some of these lighter bikes, when dealing with the elements you can be braced for cross winds or head winds, and then if something screams by 2 ft away (which wouldn't look close) it has a physical effect of basically whipping you with heavy gust of air which can really challenge your handling skills...
      Weirdly, even though this was scary, it was kind of like experiencing my own death in slow motion... it didn't cause me any shock or a particularly nasty spike in adrenaline or anything like that, which some less close but higher speed passes really do... it did however put me off riding for a while after I reviewed the footage. At the time I was riding to do errands both for my work and my family. My dad is really poorly, so on this trip I was out to pick up his prescription. As it wasn't too long after lock down, I volunteered to collect and deliver laptops to colleagues who didn't have anything to work on from home... as an excuse to be able to get out on my bike more than just the recommended 1hour of exercise.
      Point being, I felt my health and life was challenged with absolutely no provocation while I was doing what I felt was the right thing and perhaps a good deed. This kind of thing can really sour in the mind.

The motorist who ended my cycling career in April 2021 (and subsequently pretty much ruined my life) also only got "without due care and attention" - even though they accelerated through 2 give ways into an active dual carriage way without making observations when they hit me. Two camera angles caught the incident... he was also heard by the camera repeatedly lying stating I had come off the footpath into his vehicle. He got 6 points and £500 fine (I got a caved in rib cage, punctured lung, torn aorta, haematoma's on my liver and spleen, a fractured arm which needed surgery and 18months of rehab, a heavy case of PTSD, developed a dependency on alcohol, became obese, became toxic to be around, my fiancee left me for another man, my children dislike me, I'm under-performing in my job... have no social life... and yeah... while I was in hospital this video was still drawing in trolls). The reason less "cyclists" are dieing on UK roads today is not because the roads have become a safer place for other road users beyond those who drive powered vehicles. It is exactly the opposite. I now try and avoid any busy trunk road as they have become in my view"death zones", where I take my life in my hands when forced onto them due to no alternative. The reason that today, the death of "cyclists" is at an all time low, is because we have been forced to self exclude ourselves from major parts of the road network due to fear of aggressive, lethal driving , encouraged by some in the UK establishment , imbued with an utterly hostile attitude to road users outside of the entitled car driving public. The Daily Mail has been quite strident in its editorial hostility to "cyclists" or anyone else advocating a sensible transport strategy for this sick land. As ever the European Union and its many members are a hundred years ahead of UK, when it comes to inclusive transport policies, things can only get worse, or better if u are an entitled SUV driver, tearing the roads up , desperate to get the kids to school, as u run over a much loved cat.

      It's depressing but it's true. I was in an RTC in April last year and was told by a thoracic surgeon 9 out of 10 people die of the injuries I sustained at the road side. I was loving my riding, and diligent about safety. I had built a custom whip for the roads that handled beautifully... agile fast and durable. 7 years road cycling under my belt, regularly riding upward of 300 miles in a week. I used to work with/help and encourage others who wanted to take up riding. Many of whom the barrier was that the roads were unsafe. Now I will never ride again. Nearly a year since the collision, and I'm still physically and mentally recovering. I'll eventually put the footage and a video about it all up on this channel. Not to dissuade cyclists, but just as a cautionary tale to any road user that thinks the safety of others doesn't apply to them.

    I’m from the states and I’m curious how this works there. So if you have video evidence of violations on the road, is the vehicle owner automatically assumed to be the driver or do you have to also prove who was driving for the charges to stick?

    • @MiseEnZheng
      @MiseEnZheng  3 роки тому +3

      Great question and one that I am pleased that I can answer. Hehe.
      So in the UK you can only drive a vehicle that you are insured to drive. It's a criminal offence otherwise. I think this is the first area where things differ slightly with the states. The very first thing after a member of the public submits evidence of an offence being committed is the police write to the registered keeper of the vehicle asking them to nominate who was driving at the time of the offence. The letter is called an NIP (Notice of Intent to Prosecute). If the registered keeper doesn't respond to this request within 4 weeks then they receive a court summons and end up receiving the full prosecution themselves, as well as having to pay the court fees... so what could've been dealt with via an educational course, or £100 fine and 3 points very often ends up costing closer to £1000 and they'll take 6 points, as the fixed penalty issued by police in prosecuting is almost always more lenient than the court's view.
      The problem with the system is it is slow, and sometimes if the offence is relatively minor and the registered keeper just takes the "If I ignore it, it will go away stance." It sometimes just does, as our Police is hugely underfunded here in the UK land they have much more important work to be doing than simply straightening folk out for minor traffic offences... frustrating, but that's just how it is right.

      @wonjez3982 Рік тому

      @@MiseEnZheng You just need the right arguments, such as stating the obvious in an understandable way. I Appreciate the video, it's what people endure every day or give cycling up on. It's a perfect example of "in my perspective there was nothing wrong" and we need to educate people to always care for others.
      Just put the truth in their face:
      First, the line is NOT to be crossed by any vehicle. Bicycles are treated like any other vehicle in this case. The only difference is, this rider knows it, while others just squeeze by, he bahaves as by the book, stays in the line and is thus safer, more visible and his intentions are more predictable. Anyone who argues with that has no idea how traffic works really.
      Think about what wold have happened if the cyclist did cross the line? The truck barely managed to overtake in the short time the line was there (see 2:40). Hence the cyclist can and did make the dicision, to not move over as far as possible, because then he'd be stuck on the shoulder.
      And usually, when somebody gets off his lane like you say he should, how would anyone know he's not making a left hand turn? Worst case, the truck starts going by when the cyclist merges back. If the shoulder was any shorter, the truck would have no time to avoid the cyclist who's rightfully going back onto the road.
      So, this specific clip might look like the cyclists fault for not using all the space, but rules are not made by good exceptions, but by the bad things that might happen and the most vulnerable people out there, thus, ALWAYS stay in your lane and keep your distance even if it's unfortunate at places. You can also never know what the other party thinks of it, a commentator might be ok with a truck next to them, but their mom or kids might not be, as would be people who actually got ran over in situations like these. The 1.5m rule was made because common sense has to be regulated for some people to actually apply it.
      And in the end, even if anybody does a mistake, that's no fucking excuse to run them over.

      Some A roads are more forgiving than others. There's one between Burley and Wharfedale and Otley down here that is very frequently used by cyclists, I did it the other day and I'm happy to say there's no way in hell I'm doing it again. This was before the safer roads portal in west yorkshire, so I actually called the non-emergency line to report the incident. After describing what had happened to them they allocated me an police constable who I liaised with, they took a verbal witness report from me and reviewed the footage themselves, and as they saw me as the victim, they kept me updated with the prosecution. The police did state to me that they call the driver in for an interview, and that's usually enough, the driver is fully freaked out and then they're apologetic, so the police get back to the victim to see id the victim is happy to drop charges and let them off with a warning. My PC wanted this but said that my video footage didn't show any evidence of an offence, and that he was only sorry that I as a cyclist scared so easily, so the PC was as happy as I was to see him prosecuted at court (especially after saying the judge would "laugh the PC and Cyclist out of the court..."

Once a mushy human enters there vehicle, they are only interested in their own self importance and not another human on the road. I drive 10'000 miles a year, cycle commute inbetween. Drivers simply don't care about other humans who are somebody's daughter or son and could be somebody's father or mother. I want the courts to send the drivers to the bereaved family for life carrying out parent duties and replacing the income they took away from that family.

On the other side of the coin , I have no time at all for the vindictive cyclists in some cities , who ride around with cameras , deliberately getting into conflict situations with drivers then dobbing them in to the police ; often regarding phone use in stationary traffic . Much as I disapprove of phone use by drivers , it is not the job of general public to go around obsessively filming them ; one day THEY are going to cause a crash , or be attacked by one of their victims ; I already pointed out to one of the most prolific that if he did this in the USA he'd have been SHOT by now . Ride safely , try to get on with others , and share the roads nicely .

    The problem here seems to be the road markings - which are out from the kerb - as it goes past the junction - this seems to narrow the road . The lorry seems set up to pass giving more room which then reduces dramatically as the cyclist follows the edge of the white lines to avoid the road junction and the lorry length makesbit cut the corner off making matters worse. Lorry should have held back and let cyclist get past that bit.
    Also lorry still had his warning lights flashing , so obviously not fully attentive. Hopefully will be more so in the so in the future now or loose his licence.
