I just wanted to clarify that where we load is 100% their property and they have every right to tell us to stop. But my frustration is that they are going back on a long standing agreement in a very dirty and underhanded way. We are currently building a new road regardless of what the outcome is. I wish no ill will on anyone, even the hot shot that caused the problems. It will work out in the end and I will keep you posted on the new road progress. 😎
I’m no expert but I think you have what’s called ‘open and notorious possession’, where your access and use gains rights, just as they gained rights by using your stretch of the road. Give a call tou your attorney, might be a simple negotiation to formalize your use of railroad property.
Sometimes the best course is to hire a surveyor to mark out the property line and build a fence. I certainly wouldn’t be letting them use my gate ever again
When it rains it pours! There hasn't been an issue for nearly 3 decades, but now that my dad is temporarily down they decide there's a problem. It is what it is, I'll sleep next year 😆
Hi, how is your Dad? Has he had his 1st surgery yet. He must be a force to be reckoned (or is it your Mom) with. Waiting for him to be away from the yards is bullcrap. I wouldn’t block them permanently, but for the time being that’s the only place I have to park. I’ve spent who knows how many hours sitting and waiting on trains, so they can wait for a little bit on me while I finish the new road 😆
The problem is the railroad could pull eminent domain and take that section of your land for whatever price they see fit. They are basically thieves with the government standing behind them.
Yes, but in order to do an eminent domain on someone’s only access to their property, they would have to purchase it for market value (which isn’t much honestly) but also they would have to create a new access. I would be perfectly fine with that.
I think you and every youtuber I watch that puts out a video or more a week are Machines.... I say business as usual until you get formal notification. Then lawyer, then lock the gate.
@@AdventuresMadeFromScratch it's not their ONLY access they can come in by Rail... on THEIR own rails.. Not very convenient but not really your problem at that point..
From personal experience I have found some RR police can be very impressed with their powers. I once was taking some photos of some Cabooses (Cabeese?) lined up in a yard. I was standing on the shoulder of a public and heavily traveled road. A RR cop tried to tell me I was standing on RR property which was absolute BS, their property started about ten to fifteen feet away from me. When you send them a letter, which you should do instead of calling them, include a plat map of the properties and point out that they are claiming ownership of property that you own and have been paying property taxes for years. Tell them if they do not cease and desist, you will be forced to sue them. Someone with a modicum of intelligence will eventually see that letter.
I was parked on a busy road in a marked space when I had to deal with one... Seems the parking block had been knocked forward (not by me) and the very nose of the car was slightly over the property line I measured it later, just to see. At most it was 6" but based on the pins I could find it probably wasn't or possibly 3/8" over at most. There were OTHER cars actually parked on the property (not in spaces) but I was there he wanted to harass someone since he had to drive 70 miles since a concerned citizen had called the railroad about them. Ten minutes of dealing with attitude and hate for a non-issue in a public parking space that wasn't fenced or maintained properly by the city or the railroad. He threatened a ticket etc, etc but in the end it amounted to nothing other than a waste of time....
You are wiser to stay calm and work the problem. Getting angry is your right, but it will only raise your blood pressure. My compliments to you for your approach. Ultimately, you win by staying calm. Anyone can be a jerk, you’re not one of them.
I'd change the driveway and when they call you, then you can throw that new guy for railroad under the bus and make him look bad, then all will go back to normal after the railroad can no longer Access thru your property, and I bet they fire his ass
Great video! Very interesting story in regards to the long standing agreement with the railway and the issues you faced. Having to make a new Road was interesting and tidy up some of the property at least is a positive- especially finding your own solution. Its more of a documentary at this point! Very cool!
@ It’ll most likely come down to them needing to use your access for something and won’t be able to and it causes problems and delay. And then someone up the chain will say “Well who’s the dumb@ss who made THAT decision?!” And when they find out there’s simple solution they’ll go back to the status quo. But sounds like you could get a more efficient situation with a loop road which means more trucks get in and out quicker and so you can do more volume in the same amount of time. Good luck with it!
That's exactly what will happen. But this time we won't be pressured to agree to anything since we will no longer be dependent on their section of property.
You are exactly right about the property seems like some young man wanting a promotion.I have property along the railroad and made a deal with them If they let me put a small storage shed on a part of it where it does not effect anything there doing and I will keep almost 500 feet mowed for them.Never had any problems with them for any reason.Last year they had no place to park several trucks I let them park them where there is plenty of lighting and inside a secure fence at no cost. They did me a favor and I did them one no complaints from either side in 20 years. The property line is over 100' from the tracks which is the typical easement on RR tracks, and nothing is on their property or within that easement. The legal gray area arises in the fact that the use of each other's property has been all verbal agreement, but over the decades they have assumed that both sections belong to them. We will build our new road and go on with life, but I owe them no favors and will not ever work with them again in the future. Go get the survey. Build a fence right down the property line. Then post it no trespassing. If they don't have enough room to use your side of the property then the Railroad can spend thousands like you did and build a new road down the other side of the tracks.

Sorry to hear about the run-in with the railroad big boss…… but where youare Silas had a very busy piece of railroad…. I was unaware one of your shots and show the diamond double mainline going east and west and double mainline going north and south it’s a very dangerous place to be as for the railroad property…….he was concerned about you getting close to the railroad or being up on the tracks !!!!!!!!!!!!!!!!!!!why don’t you put in a guard rail 20 feet off the main track where that siding tractor runs alongside there that way there is a backhoe or the machine or tractor trailer would never get near the tracks………..I worked on the road for 32 years s’more things I’d like to mention everybody getting too close to the mainline not pretty be a bigger man but they’re all come on the property but get everything in writing after this if they let you keep loading on railroad property with the fence put up if they won’t let you on the Rail road property then I would lock the gate and tell them you know what you better get a drone to get over there cause that’s the only way you’re gonna get there I’m just like you nice guy kill some ass all pushes the wrong buttons Samuel bacon
The tracks right beside where I load trucks are a grain elevator spur and rarely have trains on them. They were actually built long after we bought our property. The main tracks I could definitely understand not wanting us close to, but they are 100+ feet away.
Silas, I'm no expert on these things. As a matter of fact I know just enough about a lot of things to be dangerous. The only thing I can offer is a prayer and wish you the best 🙏
Silas, on the honda odyssey in the back under both side windows is the motors for the side doors.. they sell used for 300.00 each on ebay! Thought you might want to know..
I used to pay $1500 for early 00s Kia Sedona minivans. Each of 3 cats was worth about $700 and then the van would bring another $600 by weight. Now I'd be ecstatic if I could even get $1000 for everything lol
Not illegal in any way. Actually extremely common. Most scrap yards keep radioactive pipe on hand to test their Geiger counter. There are mountains of radioactive pipe and oilfield equipment all across the country. It’s not dangerous to health unless you sleep with it under your pillow.
Holy cow, I have a honda odessey in driveway I need to get hauled off. I had no idea the converter was worth that much but it doesn't matter no one around me will buy them from individuals , I think because they think they are stolen
Hi, live in the UK so the law may be different. If 3 company's share the access road it would take 2 of the 3 to agree to a change in use, best to read the agreement thoroughly.
There is no written agreement. It was a verbal agreement between multiple deceased parties. Just a giant can of worms that should have never been opened.
A lot of people believe that they and what they want are the most important things in the world and your just a service for them when ever they want, your feelings , health and well being doesn’t matter. I get to experience this on a daily basis.

If you know where the IPFs are you should mark them with surveyor’s ribbon so the railroad idjit can see them. I would also have a copy of your dad’s plat in the truck.
Yes, we are putting large, visible, and permanent markers in on the property corners next week.
@@AdventuresMadeFromScratch I'd be putting a fence or barrier of some sort on the property line or in your case, maybe build a wall of cars.
i had a 91 sunbird 4 cyl stick shift and a 94 sunbird v6 stick shift. both 2 dr.
I can’t believe people don’t want to work in the yard !! Mind boggling to me, if I lived there I’d be there in a instant and I’m 69 👍
Silas, I'm no expert on these things. As a matter of fact I know just enough about a lot of things to be dangerous. The only thing I can offer is a prayer and wish you the best 🙏
That truck body looks like it may have been for soda canisters and beer kegs delivery. They would also have hauled o2 tanks
I'm guessing oxygen because of the flammable decals.
Nice work Silas Just keep doing it
@4:11 that gmc grill is way better than mine! let me know if you sell it. also needing the headlight bezels depending on price
It is sold already
@ dang alright thanks . are the headlight bezels sold?
Silas, on the honda odyssey in the back under both side windows is the motors for the side doors.. they sell used for 300.00 each on ebay! Thought you might want to know..
I used to pay $1500 for early 00s Kia Sedona minivans. Each of 3 cats was worth about $700 and then the van would bring another $600 by weight. Now I'd be ecstatic if I could even get $1000 for everything lol
@@AdventuresMadeFromScratchI have a 2024 Kia and it doesn’t have any cats, because it’s 100% electric.
I like that spot on the Chevrolet belair .
Could look good on my 53 Pontiac ?
Silas the railroads can be a pain in the butt ,❤LOVEJIM J&R MOBIL SERVICE AND GOD BLESS Y'ALL AND YOUR FAMILY
Good Luck
Sometimes you are the windshield in life……and some times you are the bug😀👍🏼👍🏼
I would not have mentioned anything being radioactive!!
Not illegal in any way. Actually extremely common. Most scrap yards keep radioactive pipe on hand to test their Geiger counter. There are mountains of radioactive pipe and oilfield equipment all across the country. It’s not dangerous to health unless you sleep with it under your pillow.
I sure hope things work out for you . the Corporate world is always a hassle.
Awesome always thanks
That RR guy is a pain in the ---! Hope dad is doing better after his fall..
Holy cow, I have a honda odessey in driveway I need to get hauled off. I had no idea the converter was worth that much but it doesn't matter no one around me will buy them from individuals , I think because they think they are stolen
They aren't anymore, they've dropped a ton. It was just a temporary 5 or 6 year span that converters were worth a fortune.
Wonder if you have a 1960 mercury comet or maybe a 1959 rambler custom 4 door out there?
Hi, live in the UK so the law may be different. If 3 company's share the access road it would take 2 of the 3 to agree to a change in use, best to read the agreement thoroughly.
There is no written agreement. It was a verbal agreement between multiple deceased parties. Just a giant can of worms that should have never been opened.
Ya I know one apple falls and all the other's seem to go bad to still on the tree 😞
A lot of people believe that they and what they want are the most important things in the world and your just a service for them when ever they want, your feelings , health and well being doesn’t matter. I get to experience this on a daily basis.
Many need cleaning scrap metal
I loved this video, one of the best, and I have been watching it for a long time. Maybe Dad can handle the railroad buttheads? One last thing, what is in your opinion the most EXPENSIVE car you have crushed?
Crushed a brand new $40,000 car in 2009. Had slight damage while unloading, so insurance totaled it and demanded it be crushed.
Sounds like a waste to me!
keep up the good work you do
i got a few cars i can get rid of 1 is a 81 gmc 2500 runs and drives but needs wiring fixed , also have a 08 for taurus awd runs and drives just using it for parts for the one i hit a deer with , and also have a 03 trailblazer doesnt run did until it got loaned out
... ??? .... soooo ....what is your point ?? Do you live near Hutchinson so that you can sell these to Silas ?? or - - are you just babbling like a four-year-old ??
Don't you wish you had a big ass damn magnet back in the day I ran a high rail with a magnet on it best damn invention ever to pick up metal
They can’t deny you access to your property
Great video!
You don't get to see a triumph spitfire and a tr7 in the same crusher very often!
If its your land and you can prove that it's your land what can they do!
Tell them to get lost and because of their attitude THEY are no longer allowed to use your part of the road!!
Good luck dealing with these seat polishing bureaucrats who have probably never done a hard day's work in their lives!😊
Any papers on cars care about saveing
I need a specific piece of chrome. Where would I 🤔 email 📧 about the possibility of either buying it from you or you keeping an 👁 eye out for it. It's a non running project car, so time is not an issue.
Nice job Silas!!
Wash board like a gold sluice box? If so I’m interested
i'd Lock your gate out so they don't have access to whats theirs.. i'm sure someone will contact you at that point... then you can explain the situation face to face with someone..
