    I just wanted to clarify that where we load is 100% their property and they have every right to tell us to stop. But my frustration is that they are going back on a long standing agreement in a very dirty and underhanded way. We are currently building a new road regardless of what the outcome is. I wish no ill will on anyone, even the hot shot that caused the problems. It will work out in the end and I will keep you posted on the new road progress. 😎

      I’m no expert but I think you have what’s called ‘open and notorious possession’, where your access and use gains rights, just as they gained rights by using your stretch of the road. Give a call tou your attorney, might be a simple negotiation to formalize your use of railroad property.

    Sometimes the best course is to hire a surveyor to mark out the property line and build a fence. I certainly wouldn’t be letting them use my gate ever again

    Get the property surveyed , went thru that kind of crap with them in Platte Co, MO. Over farm land access , They don’t own what they think they do , till then lock your gate access so they have no access and tell them to piss off.

      I wouldn’t block them permanently, but for the time being that’s the only place I have to park. I’ve spent who knows how many hours sitting and waiting on trains, so they can wait for a little bit on me while I finish the new road 😆

      The problem is the railroad could pull eminent domain and take that section of your land for whatever price they see fit.They are basically thieves with the government standing behind them.

      Yes, but in order to do an eminent domain on someone’s only access to their property, they would have to purchase it for market value (which isn’t much honestly) but also they would have to create a new access. I would be perfectly fine with that.

      Hi, how is your Dad? Has he had his 1st surgery yet. He must be a force to be reckoned (or is it your Mom) with. Waiting for him to be away from the yards is bullcrap. The letter you received with no contact information, no return phone # etc, etc, makes it’s also not valid. Someone is playing games. Jealous people are greedy and dangerous. You have something they want. Lawyer up. And get a Big protection dog or 2 for the yard and cameras . Don’t forget to put up cameras everywhere.     From personal experience I have found some RR police can be very impressed with their powers. I once was taking some photos of some Cabooses (Cabeese?) lined up in a yard. I was standing on the shoulder of a public and heavily traveled road. A RR cop tried to tell me I was standing on RR property which was absolute BS, their property started about ten to fifteen feet away from me.
    When you send them a letter, which you should do instead of calling them, include a plat map of the properties and point out that they are claiming ownership of property that you own and have been paying property taxes for years. Tell them if they do not cease and desist, you will be forced to sue them. Someone with a modicum of intelligence will eventually see that letter.

      I was parked on a busy road in a marked space when I had to deal with one... Seems the parking block had been knocked forward (not by me) and the very nose of the car was slightly over the property line I measured it later, just to see. At most it was 6" but based on the pins I could find it probably wasn't or possibly 3/8" over at most. There were OTHER cars actually parked on the property (not in spaces) but I was there he wanted to harass someone since he had to drive 70 miles since a concerned citizen had called the railroad about them. Ten minutes of dealing with attitude and hate for a non-issue in a public parking space that wasn't fenced or maintained properly by the city or the railroad. He threatened a ticket etc, etc but in the end it amounted to nothing other than a waste of time....

    Go get the survey. Build a fence right down the property line. Then post it no trespassing. If they don't have enough room to use your side of the property then the Railroad can spend thousands like you did and build a new road down the other side of the tracks.

    Ya that's BS. Be Firm and Clear with them. Tell them you are going to block access to there property if they don't let you load out there. If you give a single inch they will try to take advantage of it. That's exactly how these big corporations work.

    Go to court and block them from using your road. And I agree with the comments, a surveyor from the county should be able to set things straight.

    50:10 Brings back memories. We had a ‘68 or ‘69 4-Dr TBird Landau like this. Was a dealer demo so it was loaded with every gizmo to be had plus 429 Thunderjet. Dad’s door armrest looked like the control panel from the USS Enterprise.😂. All the vacuum stuff gave him fits though. I loved the su|c/de doors in the back.

    I'm sorry you have to go through all of that crap and I hope it will resolve without legal action being taken. It's likely some young kid trying to make a name for himself and you just happened to be the lucky business target. I'd go ahead and build your road and regardless of the out come use your new road and DO NOT let them on your property to get back to their crap! Make them have to figure it out like you had to. I've never seen a railroad being an issue but I also live in a podunk town that is lucky to have 12000 people living in it and most of our rails are shut down except the one major one (Burlington North, Burlington Iowa Railroad). I will give them some props though, they do the yearly Santa Train which is pretty cool. They stop for Santa to meet the kiddos, give candy and I believe they do a quick tour of one or two of the cars (I don't remember if there is one or two passenger cars on it or not, I want to say yes because of Santa). I wish you all the luck one can muster, you may need it and all you can get to deal with this situation.

    Life is difficult enough, without such petty distractions, unnecessary in the first place. Not being able to just talk to someone, and explain the situation, is particularly galling. You've done a amazing job of cleaning up a very neglected area. In the long run I'm sure you'll be glad you did. The uncertainty in how to proceed, especially the money involved, and being left just hanging, is awful. Best of luck in finding a prompt resolution to the issues!

    Great video! Very interesting story in regards to the long standing agreement with the railway and the issues you faced. Having to make a new Road was interesting and tidy up some of the property at least is a positive- especially finding your own solution. Its more of a documentary at this point! Very cool!

    Not qualified as a lawyer but I remember something about easements from a real estate class which said . Once an easement is established it cannot be revoked . I think this may apply to both parties in this case . Good luck .

      The property line is over 100' from the tracks which is the typical easement on RR tracks, and nothing is on their property or within that easement. The legal gray area arises in the fact that the use of each other's property has been all verbal agreement, but over the decades they have assumed that both sections belong to them. We will build our new road and go on with life, but I owe them no favors and will not ever work with them again in the future. They have needed to use our other property multiple times in the past, and we were always more than willing.

      Before spending on the road you should make sure the top guy is informed of the property limits he may just agree on the first cheaper option if they will loose access to your part

    You are wiser to stay calm and work the problem. Getting angry is your right, but it will only raise your blood pressure. My compliments to you for your approach. I’m certain this isn’t a vendetta with the railroad, but some little fish who thinks he’ll get a gold star. In fact, it’ll be ignored by the BNSF. It’s a good idea to clean out an obstructed area. Ultimately, you win by staying calm. Anyone can be a jerk, you’re not one of them.

    Love these long videos, & watching you clean up the yards those in my opinion are the best videos, I know a lot of people love the auctions but I think you got enough stuff to keep you busy lol, love the videos man been watching for a very long time now back when you use to drive the dodge truck and the jeep, I also do UA-cam my name is ghetto garage I’m not a big channel by any means but I do enjoy watching your stuff very much, I hope to be successful on here one day like you are.     The 1st box with all the drop down doors was a beverage truck box. I remember loading them up when I worked for dr. pepper..

    :30 It was a delivery truck for soft drinks. When I was 10 (1962) we (four little boys) would check if a neighbor (1/2 mile from my house) left the doors open or unlocked on that kind of truck. And steal sodas at 10:00 PM in the dark (4 each) then hide them in our back yards. On those hot Mills, Wyoming days, in the summer we would hide and drink our hot Pop.

    I find it so alarming how few regulations there are for scrap yards in the usa. All the oil and liquids just run onto the ground and contaminate the soil...

      That's not true. When the law requiring all fluids be drained within a set amount of time from the date of purchase, many salvage yards closed up. That was many years ago, and some of the regulations may be state imposed rather than federal requirements.

      That is far from the truth. We drain the liquids out of them. Can’t have bare tires sitting around or open top barrels. There are TONS of regulations.

    At the crossing there's a phone number to call if you're stuck on the tracks. They might be able to help you to get to the right people. Also there's a federal law that the public can't be within 25 feet of the tracks. Good luck.

    You are exactly right about the property seems like some young man wanting a promotion.I have property along the railroad and made a deal with them If they let me put a small storage shed on a part of it where it does not effect anything there doing and I will keep almost 500 feet mowed for them.Never had any problems with them for any reason.Last year they had no place to park several trucks I let them park them where there is plenty of lighting and inside a secure fence at no cost.They did me a favor and I did them one no complaints from either side in 20 years.     Ok after looking closer , I would say , that Radio tower in the vlog , is the rail roads property,, and it looks like 100 feet from the rail,you can’t fight the rail road, ok I see a big tall fence on the opposite side of those rails, they could put up a fence like that too on your side ok BigAl California thanks

      Contacting the higher ups is not easy like it used to be. Have to go through layers of button pushers and don't know anythings.

      @ It’ll most likely come down to them needing to use your access for something and won’t be able to and it causes problems and delay. And then someone up the chain will say “Well who’s the dumb@ss who made THAT decision?!” And when they find out there’s simple solution they’ll go back to the status quo. But sounds like you could get a more efficient situation with a loop road which means more trucks get in and out quicker and so you can do more volume in the same amount of time. Good luck with it!

    Silas, it’s getting really bad State and county level in the metro Detroit area. An individual in the news was told a county official to clean up their relatives property because it was not properly maintained. Even Michigan Environmental Agency got involved to remove the abandoned vehicles trees that were dead and not maintained. Even worse, a new subdivision is being built in the same area. Someone I know has multiple complaints about the vehicles that he buys from Copart, IAA and other auction sites, where he stores the vehicles on his relatives property (farm). The complaints from county officials are that you can’t run a business in a residential area. he has at least 5 storage trailer worth of automotive parts. Couple of miles down the road, they are building a new subdivision and a new gas station in the future ( Buccees ). A company bought a Hughes pieces of land to build the gas station. How bad can Kansas public officials or Corporations get. It’s getting bad in Michigan with environmental groups and officials.

    Those are some complicated sucky issue's. I hope it works out well eventually. I have wanted to know for a while about a particular shorty school bus (white in color) on your dads property I saw months ago and that I have seen since in other videos as well as the blue Ford shorty bus in this video, What kind of condition are they in( rust,mechanical ect and are either of them for sale.

    There is always something satisfying about yard clean up. It just seems right.
    The shredder yard will buy that tractor with those big tires on it? Around here that would be one hell of a disposal fee. People just leave them in their field for the cattle to play with.

    I liked those Pontiac J2000 sunbirds. I always thought the 2 doors and 2 door fastback hatch back were really good looking with the split grill and triple front lights. The groaning , growing, gutless engines were pretty terrible sounding and lame however. The Buick jHawk version with the turbo was a hot cookie until the blew up.

    I had a '76 Cutlass Supreme. It was my first car. Maroon with a white vinyl bonnet. It was fast! I loved it! They just don't make cars like they used to. ❤

    My employer bought and built a new building where I currently work. After the building was 90% completed, the neighbor comes and says the parking lot for the building was over on her property. Of course the property had been surveyed long before any construction had started but she said nothing. She takes my employer to court. The court asked for a new survey to prove the neighbors claims. The survey was done and it confirmed the original survey. The neighbor didn't like that answer so she had a second surveyor come out. The second confirmed the first two. She still was determined and had a third survey done. This one came back and said her garage was actually 3 feet over the property line on my employer's side. At this point the court dismissed the suit for lack of evidence. The neighbor also sued for court cost, attorneys fees, etc. She lost that too.

    I hope your dad and you can work it out. From watching your videos ,you've never stopped a train are caused any trouble . And I'm sure your dad has never caused any trouble. Just big people ,trying to keep honest people from trying to make a living. If in the spring and past I'd be welling to come out and help your dad and you for a couple of weeks. Ive got a camper and so as long as i have a place to rest my head that's pretty much all i need. And before people start calling me stinky I'm sure i can find a truck stop with showers😊.

    a tip volvo 740/760 complete usa headlights front in working and half good condition costs about 400-600usd and in good condition up to 1400usd. and there are several parts that are becoming hard to come by. applies to volvo 1/2/7/900 series. have a good evening greetings from sweden.

    Definitely go to town and get the gis survey printed on paper for you, look your deed over well and make sure you give plenty of distance for when their lawyers come attacking.

    I’m retired from Bnsf Seattle lowboy,some people new have a headtrip going on!! Just be nice but have all your fax in order. The old road/yard masters were pretty cool people, R/R police if that’s what you dealt with are doing whats told to them…sorry hope everything goes good for you!! Thanks Dean

    Put up a few no trespassing signs. Then, if they pass over your property, call the police and have them charged with trespassing. You don't necessarily have to have it enforced, but if it's posted, you have the option .

    That chevy trans is turbo 400 with Pontiac bolt pattern it can still be used for race cars everyone cuts bell housing off puts sfi aftermarket on it
