Miranda did not have the right to counsel under the 6th Amendment during his custodial interrogation because he was not in a criminal prosecution and was not formally charged yet. You may want to correct this part of the video. The right to counsel under the 6th Amendment will only attach after a formal charging. Under the Fifth Amendment, a person who is in a custodial interrogation by the police may have an attorney present during the interrogation. However, this right must be asserted by the person under custody. That is the difference between the 5th and 6th Amendment, because once someone is formally charged with a crime that carries 6 or more months in prison, the right to counsel AUTOMATICALLY attaches.
