- A video case brief of Miranda v. Arizona, 384 U.S. 436 (1966). Read the full-text brief here: www.quimbee.com/cases/miranda...
Ernesto Miranda (defendant) confessed after questioning by Arizona police while he was in custody at a police station. Before confessing, the police did not advise Miranda of his right to counsel. Miranda suffered from a mental illness. The State of Arizona (plaintiff) charged Miranda with kidnapping and rape. At trial, the court admitted his confession, and a jury convicted him. The Supreme Court of Arizona affirmed Miranda’s conviction. Like Miranda, Michael Vignera and Carl Westover (defendants) confessed to crimes after extensive custodial interrogations without being notified of their rights. Their convictions were affirmed. However, the Supreme Court of California reversed Roy Allen Stewart’s (defendant) conviction because the record was silent on whether he had been advised of his rights. Stewart had dropped out of school in the sixth grade. The United States Supreme Court accepted these four cases to determine what kinds of custodial-interrogation procedures were required to adequately safeguard the Fifth Amendment right against self-incrimination. The Court held that without certain hallmark warnings regarding the right to remain silent and the right to counsel, statements made during custodial interrogation were inadmissible at trial.
*Who else was assigned this for school*
Just a Traffic Cone me
Swing the answers
Nah I was watching NCIS and a suspect said this law
lmao i gotta make a meme outta this with my pal
lol
Cop: **Mirandizes a suspect after arrest** "Do you understand the rights I have explained to you?"
Suspect: "Yes, I Understand"
Cop: "OK, So what happened?"
Suspect: **Proceeds to incriminate self**
Cop: *Bet*
my favorite is the subversion of miranda by a two stage interrogation and the miranda rights never given
Lmao fr
lmfao I just understood that. That is so damn true, wow. SMFH lmfao
Miranda rights are not required to be given until custodial interrogation begins. Most officers (if they're smart) do not Mirandarize the suspect upon arrest.
@@zanderthawope. Custody should start when a person's movement is restricted similarly to those with formal arrest.
I m an Indian. A law aspirant
Came here after Watching shawshank redemption when detective comes to arrest the officer in shawshank and he reads exactly what is written in the paper
Anything you say can and WILL be used against you.
Everything is leverage, every single bit of information.
Excellent. Thank you. 💐
Well Said.
Does it frighten anyone else to think that a man as shrewd and well-rounded in his legal counsel as justice Harlan would actually dissent from the majority in this case? Am I not seeing this clearly?
Love this channel

At 00:10 the video indicates that the Miranda case established the right to remain silent, which is not true. The right already existed (5th Amendment) and the Miranda case created the requirement for police to advise the arrested defendant of that right before questioning.
the miranda case established the right for suspects to know their rights
@@lils2910 Yeah. That’s what I said. the video is wrong
