A **VERY** generous read of the "because you're going to file a complaint" would be "because you're not getting the point about what you did being dangerous and unlawful" -- that said, this cop kept coming back to the well to argue with this guy. Bad form, and it's good he didn't rough him up, but did not do his job to diffuse the situation by leaving after his intervention was complete.

The ultimate cheat code to dealing with police is the 5th amendment. Every word you utter that isn't "I'd like to speak to an attorney" increases your likelihood of arrest. A defense attorneys job is to get to you before the police do. Too many people like to get into verbal confrontations with police to explain their side of the story, where if they could just shut up for a long enough period of time the police don't have any evidence against you.

I'm not sure why 'paid leave' is considered a punishment in law enforcement. We need to have a reckoning in our law enforcement agencies. They are broken and lawless.
Just a thought, what if after the investigation, it is determined that the officer was in the wrong, the money they received is taken back? That could be done by withholding money from future paychecks or if fired become a bill they must pay.

For those who don't know. This took place in a Buccee's. If you're not from Texas, this parking lot is MASSIVE. It's bigger than a shopping mall with dedicated driving lanes inside it. There's no posted limit, but people doing 20-25mph in this parking lot is quite common.
I’m not going to claim that the officer was right. I _will_ say that it’s foolish for anyone to drive 20-25 mph in a parking lot-no matter its size. A parking lot has so many obscured sight lines and consists solely of cars and people suddenly moving. Going 20-25 mph in a parking lot is begging for a poor outcome.

Obviously. He kept making things personal and having this back and forth and then holding it against him for having the back and forth. The officer instigated it in the beginning by asking a question and then gaslighting him that his answer is "talking back". He made tiny manipulations the entire time to create the outcome he wanted. He even started using language like "you might continue committing these dangerous actions around others" when all he did was show annoyance for an unnecessary stop. How that could negatively affect other people in the future is beyond me.
And the guy even said towards the beginning, there's cameras here to show what happened. Not just the officer observing his version, but the video will show if the guy was acting dangerously when he entered the gas station.

It's a gotcha game. Once you're officially warned, that should be documented then the next time you should be liable for the appropriate punishment. I used to be a security guard and I had a coworker that was literally just like this cop. He loved bragging about writing lots of tickets and had an insane ego. He would seriously wear a bulletproof vest to work when the actual dress code was just a regular collared shirt and dress pants and ratted on other coworkers for not wearing a hat or wearing a sweatshirt. He was seriously just obsessed with cops, during work he would constantly watch videos of cops tackling people and you could tell he was jealous and craved that kind of power. Really glad I don't work there anymore.

In my state, if you get into an auto accident in a parking lot, cops refuse to come take a report, but they will come get you for stuff like in this vid. It's preposterously stupid.

I think it probably used to not be as bad. We had much less funding and fewer cops so they actually had to focus on real crime. It was also much more dangerous to be a cop than the not even top 20 most dangerous job it is today, so if you were a cop and wanted to push your luck with someone over some nonsense, you were putting your life at risk and reputation with the other cops who would make fun of you for chasing stupid stuff down. The cops today are bored, lazy, overpaid, overstaffed, very little real crime, and most of it is digital. Hell even investigations today are nothing, everything is recorded and a Judge will rubber stamp a warrant for phone GPS, call logs, texts, and etc. so it’s pretty easy to prove anything they feel like. Honestly those plate reading cameras combined with speed cameras can do 99% of what most cops do for less.

So I'm from North Texas.. I've known about private parking lot signs being irrelevant unless in a crash. Mentioned this in my Motorcycle MDF course and no one believed me until I pulled up the statute. The instructors were pissed and argued instead of accepting the fact they were wrong.

There were so many issues with this interaction, but the thing that bugged the most, and one that's very common with cops, is the "don't give me attitude" and/or "watch your language" crap. I wish people would start responding to this by informing these wannabe tyrants that they are public servants and the respect flows from them to citizens first and foremost. This reminds me of the first time I got pulled over. I was 17. The offier claimed I was following too closely. I had just gone through a green light, where it was a 30mph zone before the intersection and 40 after. There was a line of cars getting up to speed in front of me; so I began to slow down as I caught up. The officer asked if I knew the rule, 1 car length for every 10mph, which I did. He then asked me how far I thought I had been from the car in front of me. I pointed to a road sign up ahead. He looked and said, "Yeah, I'd agree with that. Now that's about 60 feet." So I was like, "Where's the issue here?" He said, "40 zone, 4 car lengths, should be more like 80 feet." I told him there were 2 problems with what he said. 1. I was only going 30, and slowing. Not 40. 2. How do you get 80 feet from 4 car lengths? He told me the average car is 20 feet, and even tried to say his cruiser was 24 feet long. His Chevy Caprice is actually 17.8 feet in reality, and the average car is less than 15 feet. When I argued this point, very respectfully, he became belligerent and said he wasn't going to sit and argue with me all day. I told him that nobody was forcing him to stay, he had stopped me; but I had a right to dispute his claims. He continued to try to lecture me. I was about to tell him to just write a ticket and I'd see him in court; but he gave up and left me with a verbal warning. Police aren't in the right just because they're police; and those who act like they are need to go.
I'd argue that the First Amendment retaliation holds up because the officer had stated that he would have issued him a ticket, but didn't have the printer and handed him back the ID, thus ending the traffic stop. Since the stop was arguably concluded, everything that took place from there would require another set of circumstances of probable cause of a new crime, as the prior incident had already been handled. Since you can separate the arrest from the initial traffic stop, one could argue that the arrest was over pure speech - especially given Harrel's own stated reasoning.
He mentioned the attitude (that only he felt, seriously?) several times. He was also worried about possible complaint against him, so “he had to see this thru”, thats retaliation, plain & simple. Maybe cops should talk less while the bodycam is on, because they keep messing up in imaginative ways.

What would have saved both of these men some grief, is if the officer would have just left after he stated that he wouldn't write him a ticket. He didn't have to stay and debate, making matters worse.
As far as I'm concerned, that's the moment the traffic stop is over. If the person says anything that's protected by 1A and the officer then arrests or detains him, it should be a violation of the driver's rights. How long can the officer arrest the guy for reckless driving? Is the guy expected to not be able to exercise his 1A rights until the statute of limitations is up on reckless driving?
He was waiting for Christopher to bend over and lick his boots and suck him off for the fake magnanimity of not writing a ticket (even though he said he wasn't writing it because he'd already used up all his tickets on other victims, not because he was giving him a break). 😒 Christopher didn't thank him for not falsely grassing him up, so the cop got angry.
Wow! This could have been over after the first 2 mins of interaction. No tickets, cop takes any attitude (of which there was practically zero) and they both get on with their day. I’ve worked with guys like this. A situation de-escalates, everyone is about to go on with their lives, then the mouth piece has to start things running again.

For those who don't know. This took place in a Buccee's. If you're not from Texas, this parking lot is MASSIVE. It's bigger than a shopping mall with dedicated driving lanes inside it. There's no posted limit, but people doing 20-25mph in this parking lot is quite common.
I’m not going to claim that the officer was right. I _will_ say that it’s foolish for anyone to drive 20-25 mph in a parking lot-no matter its size. A parking lot has so many obscured sight lines and consists solely of cars and people suddenly moving. Going 20-25 mph in a parking lot is begging for a poor outcome.

I used to be a security guard and I had a coworker that was literally just like this cop. He loved bragging about writing lots of tickets and had an insane ego. He would seriously wear a bulletproof vest to work when the actual dress code was just a regular collared shirt and dress pants and ratted on other coworkers for not wearing a hat or wearing a sweatshirt. He was seriously just obsessed with cops, during work he would constantly watch videos of cops tackling people and you could tell he was jealous and craved that kind of power.

A number of accusations of retaliation found to be accurate should result in immediate dismissal without benefits earned or otherwise and be considered as an unhirable person for law enforcement thereafter.

I think it probably used to not be as bad. We had much less funding and fewer cops so they actually had to focus on real crime. It was also much more dangerous to be a cop than the not even top 20 most dangerous job it is today, so if you were a cop and wanted to push your luck with someone over some nonsense, you were putting your life at risk and reputation with the other cops who would make fun of you for chasing stupid stuff down. The cops today are bored, lazy, overpaid, overstaffed, very little real crime, and most of it is digital. Hell even investigations today are nothing, everything is recorded and a Judge will rubber stamp a warrant for phone GPS, call logs, texts, and etc. so it’s pretty easy to prove anything they feel like. Honestly those plate reading cameras combined with speed cameras can do 99% of what most cops do for less.

It’s appalling that the Texas City PD continues to say this incident is “under investigation.” It’s been nearly two months. How long does it take for Internal Affairs to investigate an incident that was captured on video in its entirety? This is not the crime of the century we’re talking about. It doesn’t take Sherlock Holmes to see what happened.

That’s what struck me as well. He didn’t give a justified reason for why he arrested him, other then he talked back. That other cop was like “oh ok, yeah” not even questioning of what he did was an arrest-able offense.

He arrested him for constitutionally protected speech. Qualified immunity does not apply in any case where an officer violates a previously established constitutional right. You need to know what constitutes qualified immunity before you start complaining about it.

So I'm from North Texas.. I've known about private parking lot signs being irrelevant unless in a crash.
Mentioned this in my Motorcycle MDF course and no one believed me until I pulled up the statute. The instructors were pissed and argued instead of accepting the fact they were wrong.

There were so many issues with this interaction, but the thing that bugged the most, and one that's very common with cops, is the "don't give me attitude" and/or "watch your language" crap. I wish people would start responding to this by informing these wannabe tyrants that they are public servants and the respect flows from them to citizens first and foremost. Citizens have no obligation to modify their speech when expressing their dissatisfaction with substandard treatment from a cop. Please start putting these A-holes in their place.
This reminds me of the first time I got pulled over. I was 17. The offier claimed I was following too closely. I had just gone through a green light, where it was a 30mph zone before the intersection and 40 after. There was a line of cars getting up to speed in front of me; so I began to slow down as I caught up. The officer asked if I knew the rule, 1 car length for every 10mph, which I did. He then asked me how far I thought I had been from the car in front of me. I pointed to a road sign up ahead. He looked and said, "Yeah, I'd agree with that. Now that's about 60 feet." So I was like, "Where's the issue here?" He said, "40 zone, 4 car lengths, should be more like 80 feet." I told him there were 2 problems with what he said. 1. I was only going 30, and slowing. Not 40. 2. How do you get 80 feet from 4 car lengths? He told me the average car is 20 feet, and even tried to say his cruiser was 24 feet long. His Chevy Caprice is actually 17.8 feet in reality, and the average car is less than 15 feet. When I argued this point, very respectfully, he became belligerent and said he wasn't going to sit and argue with me all day. I told him that nobody was forcing him to stay, he had stopped me; but I had a right to dispute his claims. He continued to try to lecture me. I was about to tell him to just write a ticket and I'd see him in court; but he gave up and left me with a verbal warning. Police aren't in the right just because they're police; and those who act like they are need to go.
Cop knew his battle of wits was a losing one. Happens regularly.
If the cop thinks the complaint will not do anything, why is he continuing to escalte? Why do anything at all? Let the guy waste his time.

I'd argue that the First Amendment retaliation holds up because the officer had stated that he would have issued him a ticket, but didn't have the printer and handed him back the ID, thus ending the traffic stop. Since the stop was arguably concluded, everything that took place from there would require another set of circumstances of probable cause of a new crime, as the prior incident had already been handled. Since you can separate the arrest from the initial traffic stop, one could argue that the arrest was over pure speech - especially given Harrel's own stated reasoning.

What would have saved both of these men some grief, is if the officer would have just left after he stated that he wouldn't write him a ticket. He didn't have to stay and debate, making matters worse.

As far as I'm concerned, that's the moment the traffic stop is over. If the person says anything that's protected by 1A and the officer then arrests or detains him, it should be a violation of the driver's rights. How long can the officer arrest the guy for reckless driving? Is the guy expected to not be able to exercise his 1A rights until the statute of limitations is up on reckless driving?
He was waiting for Christopher to bend over and lick his boots and suck him off for the fake magnanimity of not writing a ticket (even though he said he wasn't writing it because he'd already used up all his tickets on other victims, not because he was giving him a break). 😒 Christopher didn't thank him for not falsely grassing him up, so the cop got angry.

Wow! This could have been over after the first 2 mins of interaction. No tickets, cop takes any attitude (of which there was practically zero) and they both get on with their day. I’ve worked with guys like this. A situation de-escalates, everyone is about to go on with their lives, then the mouth piece has to start things running again.
Ego sets into officers heads after a few months of people licking their boots. When one refuses to lick the boot, they will be harassed and possibly arrested.

I don’t think I’ve ever gotten a solid, confirmed answer regarding whether or not cops get extra payouts for issuing tickets. I’ve heard that for decades but I’ve also read that it’s not true. Maybe I’ll actually look into it today, finally know for sure.
