    I have a client charged with DWI after blowing a 0.00 and having a blood test which showed neither drugs nor alcohol. She overheard a supervisor say to the arresting officer “you shouldn’t have arrested her.” This is going to be a big problem for the county.

      Lol this is nothing I had a cop detain me and search me 20 times because he's senile friend told him I'm a bad guy...
      He would stop and search me every time he saw me.
      I ended up moving to another city

      I once knew a guy who used to be a cop and he told me there are two types of people who become cops 1. assholes and 2. people who were picked on or bullied in highschool and want retribution on society.

      I've been woken up and arrested 3 times for sleeping in my truck after a 6 pack or more, in a private parking lot.

      You make a good point. To be completely honest, whilst I don’t condone driving while intoxicated at the illegal blood alcohol level, if she did that after she had to deal with this, I wouldn’t blame her.

      Alternatively their Uber could have taken them back to one of their houses and they could have slept it off and collected the car the next day.... Oh wait, they couldn't do that cos despite being 19 they were illegal to drink and would have got reamed by their parents for drinking at a party so they went to a car park instead and technically did a mild crime. Cops were horrendous and it ended in a mess. Wrong all round.

      Police officers have discretionary powers to make judgement calls. She (the cop) could've had the girl call an uber, family, or friends to pick her up & leave it at that. But no, she'd rather destroy her life with this overzealous crap.

      I’m the only one that doesn’t buy that there was an Uber. I would’ve been calm but upset that I’m getting arrested if I didn’t drive. They were respectful cause they were lying.

    My brother was asleep in his car in the parking lot of a bar. While cops were cruising the parking lot they saw him, woke him, and after talking to him for a few minutes they arrested him for DUI. His lawyer not only got the officers reprimanded, but he also got my brother $60K for false arrest because the car was off, they never actually saw him driving the car, and they didn't offer him a field sobriety test. In our state, if the car is off, the engine is cold, you're asleep, and the car is parked on private property they cannot arrest you for DUI.

    Under these laws you could be drinking in the comfort of your own home, forget something in your vehicle, go out to get it with no intention of operating said vehicle and still be at risk of a DUI charge if the cops happened to notice and investigate. It's ridiculous.

      I know a cop who was off duty and got hit with this same situation. Outside his own apartment and went outside to his car to smoke. It was a cold night in Colorado so he had the engine running for warmth. He has been drinking inside and got a DUI.

      1) Uber home instead of to your car
      2) Dont get caught drinking under the age (saying "dont drink under age" is not realistic)
      She was a smart kid, but tried to cut a corner of ubering to her car and sleeping it off instead of home to save a dollar.

      Always invoke 5th, refuse all tests, ask for lawyer. Don't talk... not even to tell them your name. Don't even talk to confirm that you even exist. Your only legal requirement is to produce ID when you are being arrested or pulled over for citation... depending on the laws of your state... but no talking... Say nothing other than to ask if you are free to go or that you invoke your 5th rights or asking for a lawyer. Talking to the police cannot, and I do mean CANNOT help you.
      "Anything you say can and will be used against you."
      It makes a Lawyers job easier to fight for you if you say NOTHING!

      @jsmesavery9584 Yes,and on the other side of town drunks everywhere people getting robbed but they are all here with this young harmless girl feeling big...I dont drink at all and had my 6 year old son in back seat sleeping under his blanket, i left out to go pick my husband up from the bar to keep a drunk off the rd...I parked a d before he came out 4 different time an officer pulled behind me...one wanted to know who i was hiding in my back seat...I said my 6 year old son...the next officer ask how much i had to drink, the other pulked up and said my tags didnt match my car but hes not gonna tow me cause its cold and i had my son...few mins later 10 men in black jumped out of the tree line and surrounded my car like a bunch of fools...I was doing nothing and they got me for nothing just harassing me...meanwhile at least 6 different people drove off drunk off there ass with no problem, they were to worried about me, the only sober one on the lot...I said alot to each and everyone of them but i dont wanna write a book for u to read on here😂😂😂...LE are out of control everywhere!!!!

      That's the new way don't you know! It's a result of them being overstaffed abd seriously I learned this statistically there has been a decrease in serious crime so they spend their time harassing and arresting innocent citizens for petty misdemeanors. Oh abd btw they only resolve 5% of serious crime investigations. Nit an impressive track record. It's become blatantly obvious too b many cops show up to a simple traffic stop

    Its really sad this wasnt an opportunity to build trust with the public. This young lady did all the cooperating a cop could ask for, and they still arrested her.

      I mean it's easy. The cop decided she was guilty as soon as they pulled up to her car. Can't get more clear cut than that, the officer is trained in determining who is a criminal, and that girl was a big one!

      @@Watchmanadmin I dunno about "a big one" since I felt she had a valid claim that they were just sitting in the car. But I do agree the intent from the start was to arrest her.
      I understand the cops did nothing wrong here, but still really wish this girl was given a warning instead of a DUI charge that will have major impacts on her life. She seemed to have the type of demeanor and character that could benefit more from a close call/warning, even if it was her intent to drive home that night.

      @@anonymoush5454 and that's why I made sure at the end of my comment to make it a point that she still may have had the intent to drive home, cause I agree, it was very strange her friend lived there and they didn't go inside. My best guess is that she wasn't allowed to stay overnight in her dorm, and she was planning to drive home.
      Still doesn't change my view that she could have benefited more from a warning. It's hard to recover in life from some of these charges, and sometimes people need a second chance.
      If we all were judged so harshly on our mistakes, all of us would have a miserable life.

But they showed impairment in their decision making because nobody thinking logically would choose to sober up in their car instead of their friends house. Especially when they’re in the parking lot of her home. And if she’s sobering up, but passed out, she’s not sobering up any time soon. I’d dui them for sure because you never know if they’ll do it again and make the wrong choice to drive next time

      The key was in the ignition and the tail lights were on. She was underaged driving. The law is the way it is because there is no way to verify that she wasn't about to drive, so they set the line at being in the driver's seat with the keys, which she was.
      Now, that said, there are a couple things I would have liked to see the cops check. First, put you hand on the hood to see if it's warm. That checks to see if she has already been driving. Next, ask her if she is willing to show her Uber account info. If she and her friend had already been sitting there a while her claim that they were not planning on driving is a bit better...
      But here is the thing... a lot of drunk people might sit and wait until they felt safe to drive, but a lot of drunk people would still decide to drive well before they are safe to drive.

    So the incentive is to drive when you are drunk because you will certainly be charged with DUI if you think you had too much to drink and want to wait in your car until you sober up to be safe. Brilliant, truly brilliant. Years ago, cops would thank you for being responsible and ask you to sleep it off.

    Considering that she likely wouldn't have gotten a DUI if she had actually just driven home, these officers are actually making the roads more dangerous by effectively encouraging you to just drive home in this scenario.

      This is what I was thinking....police teach people the "wrong" things from their actions....next time, this girl may just drive intoxicated instead... because of this bad interaction. I missed a court date once for a traffic ticket....I called and asked how to fix this mistake I made....they told me to just come in to the police station and I could get a new court date issued.....I showed up and was immediately arrested ...having to post a $200 bond to get out of the jail.....Tried to do the "right thing" and got screwed over....lesson learned....I now never trust police.

      Yep! It's because those FREAKING cops have a *QUOTA* for absolutely everything: tickets, citations, fines, arrests. It's policing by numbers and it's got nothing to do with protecting the public. Every cop is compelled to make their quota. It's policing by numbers which is meaningless.       I wouldn't go that far. It was a jack-ass thing to do, for sure but the cop was within legal rights to do as she did. I imagine there must be a course that would benefit her though. Like there are courses for de-escalation for cops that make matters worse, something similar but that applies to what she did. Maybe something that teaches cops to apply the laws in the spirit they were given because this young lady was clearly not an intended target for this law.
      The real problem, in my opinion is the law. Some sort of proof that the person had driven, or was intending to drive while under influence should also be necessary at the very least.

    My sister got a charge of “Permitting a DUI” by having her boyfriend at the time drive her car. Fun fact: her boyfriend was breathalyzed on the scene and blew a 0.02…he beat his DUI and she STILL was found guilty of Permitting a DUI when no DUI occurred.

    I learned this almost 20 years ago in a small town in MO. I got hammered at the bar, decided driving wasn't a wise decision. Hopped in the passenger seat to sleep it off. Cop shows up and informed me that I could still technically get a DUI. BUT the officer appreciated my decision and simply told me to be careful in the future as I could get a DUI, but he wouldn't punish a obvious smart decision with a technicality of the law.

      @@barongerhardt Back in the late 1990's, I got ran off by Virginia Beach police while sleeping in a parking lot. I drove drunk to a secluded dirt road and went back to sleep. The next thing I know my car was lit up like daytime and two very angry MPs were yelling that I was on a military base. Not a good night but no DUI.

      @@barongerhardt the cops did that to me when i was 19. I was drunk in my apartment and they got called on a noise complaint. Idk what I said, but I was being belligerent. The cop then said they were going to arrest me for public intoxication and I said "this is my private domicile, it is not public property by definition as there is a lock and I reside here" ... the officer then physically yanked me and as soon as my foot touched the pavement outside my apartment, he slammed me to the ground and said "well look at that, you're not in your private domicile anymore" - I was then arrested and charged with PI, MIP, resisting arrest, disorderly and spent 3 days in jail before my parents came to get me out.

      You know, good policing could’ve handled this differently. Verify the student did indeed take an Uber to the car, and that she wasn’t driving it, then carefully explain to her that in Florida you _can_ be arrested for DUI just for sitting in the driver seat with ready access to the keys, write her a warning or documentation for the incident, have her secure the vehicle and call a cab or ride share to take everyone home safely.

    Great job police! You completely destroyed a young 19 yr old's life forever! You've set an example for the young generation letting them know that you're going to have a better chance of driving home drunk, not getting caught, rather than sitting it out and sobering up... What a disgrace!! Shame on them! I knew someone that this happened to. It really destroyed them financially for years and years. They said that the courts owned them for life and they'd never get caught up or get the job they wanted. It's really awful.

      It's just a dui lol, and honestly you're not allowed to be in the driver's seat under the influence. If they chilled in the back it would have been a different story.
      Literally learned this back in the early 00s when I got my license. We learned shit like if you go to your vehicle at a house party - unlock it from the house with the fob and enter it thru the passenger side. If you didn't have a fob then unlock it from the passengers and put your keys on the ground before you lean in.. because if a cop decided to hang out and catch kids then you'd be in the clear. Law is a law, man. Just follow it when it comes to serious shit.

This actually only shows people it's a better bet to drive home drunk than to wait it out. The cops should have used this as a teaching moment, they're underage they don't know that when they feel "sober" they aren't actually. Teach them that, teach them to not be behind the wheel (stupid law imo but there's nothing we can really do about that) and teach how to make better decisions. They wanted to get her with a DUI charge from the get go seeing how she eagerly asked the other officer if she still could charge her. Absolutely disgusting. No care in the world that they're actually doing more harm than good.
      And listening to how that law is worded, I have my car keys hung up at my door. I could be on my couch drinking then get in my car and drive within 5 seconds. My car is "easily accessible" but am I gonna just get in it and drive drunk? No. Did she drive? She could have eventually but did not yet. The cops came at the right time but went about this the absolute wrong way. They should be ashamed and im honestly surprised seeing so many people defending them

    If it's not running or moving, there is no physical control necessary. This line of prosecution needs to be struck down. She could have arrested her for prostitution, since she possessed the equipment necessary.
    The common sense approach would have been to observe that she wasn't driving, thank her for having sense to not drive, and allow her to go home. This interaction didn't 'protect' anyone, and only damaged the person trying to do the right thing. Oh, and the attorneys and courts will make money.

    As a police officer myself, this infuriates me that these officers didn’t explore other avenues prior to resorting to arrest, although they may have had no other choice since I know some law enforcement agencies don’t give their officers very much discretion as to whether they arrest, cite, or educate and release.
    My department is good enough to allow us significant discretion in this manner, and I always try to avoid arresting someone since that will follow them for the rest of their lives. If I place someone under arrest then you can guarantee that either the victim pressed charges which forces me to make an arrest, or the suspect became aggressive or rude with me, as long as you remain polite, don’t have significant or recent history of offenses, and I have the choice in the matter, I will likely educate you on the law, confiscate any illegal substances or items, then release you with a warning.
    The fact that you received a warning will go into the computer system, so if you get caught again for the same offense then you will almost certainly be arrested or cited if it was a minor offense.
    For example misdemeanor drug possession with no history of offense, I’m gonna educate you, give you a list of resources, confiscate the drugs and release you with a warning, but felony drug possession and yes you are going to jail. Also my state is the same as Florida, if you have the car keys, are sitting in the drivers seat, and you are drunk, I could arrest you for DUI, but the way I handle it is as long as you found just sitting in the car like this girl was, and again you have no history of offenses, I would educate you that you could be arrested, then ensure that you get home safely, and release with a warning, but if I catch you actually driving or you have a history of DUI, then yes you are gonna go to jail.

      They do encourage people to sleep it off, you're just not supposed to have the car on or keys in the ignition. I've done it a few times and had the cops come knocking a few times. So long as the car is off and keys are not in the ignition they just check on you and make sure everything is ok and leave.

    There have been a couple times in my life I have, through poor planning, been in this situation. On one occasion it resulted in a deputy knocking on my window at 3 am to ask if I was ok. After explaining that I did not feel I could drive home safely and opted to (sleep it off), she thanked me for not driving. If just sitting in the drivers seat of a vehicle is considered "control" then you may as well give everyone a speeding ticket because they "could" speed... they "could" also run over a bicycle... they "could" also run over a pedestrian... or run a red light... or... hell just throw them in jail for "thinking" about driving. This is a perfect example of why people don't trust the police.

      Part of the reasons why such laws exist is because of people abusing the trust of cops. Many stories from cops where this is pretty much the exact situation that happened cops decide to just let it go and person later drives drunk and wrecks, killing themselves or someone else. Part of the issue is plenty of people do drink and drive thinking they are below the legal limit but in truth are over it.

It says yes you have a car, yes you have the keys, and yes you are in the car therefore you "could" drive and possibly hurt or kill someone. The same holds true for gun owners. Yes, you have a gun, and yes it is loaded therefore you "could" possibly hurt or kill someone. Yes, you have a bat, yes you use the bat and therefore you "could" possibly hurt or kill someone. Yes, you have a steak knife, and yes you are using a steak knife therefore you "could" possibly hurt or kill someone. Why do we not automatically prosecute people who own guns/bats/steak knives? Sitting in a car trying to keep warm does not equal "driving". Responsible people will take care of themselves and those around them. She knows she is not fit to drive so she has taken responsibility for her actions and is not driving. I am all for prosecuting to the fullest extent of the law those individuals who don't care about others' safety and choose to drive while impaired. The wording of the law needs to be changed. Operation and control of a vehicle hold too broad of a description. It needs to be an actual moving vehicle to be dangerous otherwise parking lots would be dangerous...

      I was homeless sleeping in my car. Sleeping in a public park that I had slept in for 3 months. I got checked on, on Halloween and had been to a bar with a friend. Went to sleep in my truck which was very obviously my home ( had a mattress and everything I owned in there) got a dui cause my keys were in my car and I " could drive" so got arrested and paid $9000 dollars and spent almost 2 yrs on probation for my 'first dui' I wasn't driving I was sleeping and they woke me up by banging on my windows. Oh and the park allowed you to park there over night. So nothing illegal. Lol

    I don't care what the case ruling were, this is f--k up. If a person is trying to be responsible, like these girls, and not drive while under the influence, this should not have happened. It is clear that they were resting, the seats were reclined. Would the law want them driving and killed someone ? Where would they have gone, sleep on the sidewalk? Some ruling don't make sense and this is one of them.

    I am going to be a lot harsher. The police deserve a D- for ABSOLUTELY choosing the most extreme action while dealing with a polite and reasonable driver, who was trying to do the right thing. I give the driver a B. Despite the bad initial decision, she seemed to have good intentions and should have been given the benefit of the doubt. Common sense should be applied... but as Voltaire said, "Common sense is not so common."

    Fun fact if youre drunk and sitting in your car dont sit in the drivers seat and dont have your keys near you, put them in the trunk. If your keys are in the ignition you can get a dui, if you have your keys in your pocket you can get a dui.

    This reminds me of a friend of mine who was arrested for an "open container" violation, while he was cutting his front lawn.
    He was cutting his grass on a riding lawnmower, and drinking a beer. The cop waited until he cut close enough to the road for it to be in the "right of way", then executed a traffic stop.

    The real problem is the wording of the law. Years ago in Montana I heard the story of a man who got a DUI because the officer found him sleeping in the back seat, inside a sleeping bag, with the keys in his possession. He argued that he could not reach the steering wheel or pedals, the judge ruled that possession of the keys was sufficient.

      Wording is purposefully vague to lend more power to authorities. In such a case it would have been better to leave the keys outside the cabin of the car. Inside the fuel flap or on top of a tire out of immediate view of the public.

    One cop told the other "you can still GET THEM (for dui)". That is the letter of the law, and NOT the spirit of the law. The girl was well aware of her need to sit there for several hours before driving. She should have been given the benefit of the doubt. This is "over-enforcement".

    Someone is over the limit and sits in their car hoping to regain sobriety before driving. They go to sleep and, an hour or two later, wake up, and, in a confused state, forget why they are sleeping in the car, and drive home still over the limit and perhaps being involved in a serious accident. That is why this law exists. Also, drivers over the limit will try to claim they intended to sleep. Similar laws have been enacted in many states and countries.

    I think the worse thing here is that the cop immediately sounded very caring and out for her best interest but was looking for a reason to arrest her when she made a responsible decision to not drive. I personally know other officers who would just let her off with a warning, maybe even give her a ride back home or to her dorm because she made all good decisions except one: to sit in the driver’s seat instead, and she shouldn’t be going to jail for sitting in the wrong seat.

The DUI is extremely damaging. If she wants to go into medicine, she'll need a waiver to practice. If she wants to go into law, she'll need a waiver to practice. If she wants to go into government, she'll need a waiver, and obtaining any type of clearance will be a challenge. A DUI is very damning.

    It's so sickening hearing the 'we can get her for this' verbiage at the start, and then watching them make that girl go through those sobriety tests, when it was pretty damn clear that they already knew they were going to arrest her. That poor girl is thinking doing these tests could somehow vindicate her and save her from an arrest. But in actuality its just a series of humiliating actions they make her go through just so they can compile a few extra data points that they'll interpret in the worst faith possible in their report so that the prosecutor has extra evidence against her to ensure a conviction.

    Those other cases referenced were for a guy that was stopped in the road with his foot on the break. This is totally different. They were just using the car as shelter, while they sober up, and even took an Uber to their car. This is totally unacceptable, and sends the wrong message to people.     It was pretty clear from the start that Sophia was polite and honest… which was rewarded with typical cop “discretion” that likely only taught her to have zero respect for law enforcement in the future. If the objective was to teach her to not drink under age, they could have explained what she could have been charged with and the likely consequences. In other words, scared the crap out of her… then driven her home. Too many cops are lacking in common sense.

      I concur wholeheartedly….. tell them what the consequences of drinking could result in, and simply drop them off at their room…which is much safer than being in a car late at night….Where is the teaching and common sense these days?

    Wow this cops really taught her a lesson she will definitely not do the responsible thing ever again but instead will just drive home . The ignorance is truly outstanding

      21 is a stupid drinking age..
      18 works well in 90% of the countries around the world (and did in the US until the 80s) but the US needs to be specials as sual

      @@entreri76x i can't say for UCF but some colleges don't allow guests within your dormroom for extended periods (including over night) without proper paperwork or sometimes not at all. if they were drunk it's more than likely they would have potentially violated campus rules if the girl did go inside till she was sober enough to drive. given how broad Florida's law seems to be on DUIs i'd bet money they'd have still arrested her had she left the car on for warmth and laid in the back seat. given that she had 0 intentions of driving that night the cops are definitely in the wrong on this one and really don't deserve to wear a badge to "uphold the peace".
