The company is responsible for shutting them down permanently. Any land or property that's abandoned in Oklahoma from 30 days or a few months, is considered abandoned, and anyone can get the title and take over paying property taxes on it.
Go off grid solar . You could install a couple of small systems at each building. Use the generator as a back-up during winter. Will save you on electricity infrastructure also.
I know it's not my situation, but I honestly feel sick to my stomach for you guys. Please speak to an attorney before going forward. I'm so incredibly proud how you're dealing with this. A lot of people would have come on and been a train wreck, but you two handled this with such grace. I know you're extremely stressed, but wow🙏👏I will be seriously praying for God's hand over this.
I'd be checking at the land titles office to make sure there isn't an access easement on the property (I might have missed that part trying to fend off my dog who was wanting attention), and then check with the State Mining Department to see if the well is actually listed as "abandoned". If it is, I'd try to have the easement removed and the well recovered and remediated at the well company's cost, and then you'd have your property free and clear. Fair warning, it'll likely cost a fair chunk of change to have that done (if it can be, that is), but it'd be money well-spent to get it done.
I’m reading the comments, apart from feeling for you Jason and Danielle I’m just gutted because it’s not just you guys now it’s you guys and all the animals and the dogs. All this way through they’ve been your priority and I know they still will be , sending my love
Sounds Crazy, but maybe you could get that company to pick it up and move it to a better location on your prop. I would also contact the oil company and a lawyer and the guy that sold you the property. Good Luck!
WOW... We have 10 acres in OKC and our driveway is 1 of 2 oil gates on the property... shipping container, RV's and boats are parked within 10 ft of the other oil road that goes to a disposal well. They did a workover on it 10 yrs ago and belly ached about clearances, but they managed... You're supposed to have surface rights and they have mineral rights. They should be able to work with you... Downside is pollution of your water table...
So sorry to hear about all this. I would definitely arrange a meeting with the oil company executives to find out just where you stand. And get a clear map of all the boundaries and parameters needed to properly CO exist. Before moving forward with any more projects. I know you two will figure out the best Game plan for your future.
@@tinybubbles263 It shouldn't matter 60+ acres much less a house on small lot, still has to be surveyed and so on or you could be building stuff on someone else property. Plus it has to go through a title company in order for this to be even sold and they require it to be surveyed and everything on the property is marked with in that survey especially on land purchases. If this did not happen then they got suckered in. If they are this gullible then I got some old cans they kick on down the road for sale.
Wow I am so sorry ! Here in Alaska the Realtor or owner of property must disclose things like this and more . It seems so wrong, the Realtor could withhold this information . Knowing you wanted to build a home and have animals . I hope there is a way to find some kind of relief for this situation. Keep us all up to date of course we will keep following you on your adventure through the life you all are looking for ! ❤🥰🙏🏼
I have a bad feeling they didn't use a title company to close the deal on the property. A title search would have disclosed all of this during escrow.😟
I wonder if there was a real estate company. Perhaps they bought it or even leased or financed it directly through the owner. I think the property in TX was owner financed and it reverted back to him if it was not fully paid.
I’m so sorry for what you have found yourselves in. A title company would have been helpful before but may be worthwhile to follow up with one in the area that’s familiar with the area now, especially if your planning on selling. I’d cut my loss and try to pick up the tiny house to another area, IMHO. Good luck! And all the best to you 2🙏
I'm thinking one of their haters called in the same people who have called animal control etc these people are nuts that do this and will do anything they can to harm a UA-camr who does not bend to their wil.
“Officer”? What department or agency is he representing? What laws, ordinances, or policies is he empowered to enforce? Who failed to perform their fiduciary duties in disclosures during the closing of the real estate transaction? Why don’t you know these things?
Vince Lombardi once was looking for his quarterback to be. He had the team attempt getting to the other side of a wall which was to high to get over. Player after player attempted to go over without success. Bart Starr walked up, assessed the challenge and walked around the wall to the other side. Vince Lombardi found his quarterback. You two possess what it takes to get on the other side of the wall you now face! I believe in you.
How is it that all this wasn't disclosed during the signing at time of purchase? Also, it never fails, they haven't touched or utilized the wells or lines in decades, the moment you improve the property, they all of a sudden have some sense of urgency to fire the systems back up.
My experience with the drilling companies in OK is if it has been abandoned, most likely it will not be reopened. They don't "own" the land. Were you told if you got minerals right along with the land?
Keep the property. Ideal location despite a few large hurdles. The studio building is portable and can be easily moved. Use the barn as long as possible and build another as you can. You can do it 👍👍👍👍👍
WOW!!!! Just wow!!!! Speak to an attorney before deciding on anything. 99% are saying the same!! We all have got your back!!! Much respect for the positive way you both are handling all of this. Love and prayers for you both!!!
Not so easy. I share a water pipeline easement through my 12 acre property in one corner with my neighbours. The neighbour at the rear wished to subdivide into 1 hectare blocks and lodged a planning application at the council. I rang and spoke to the person processing this application. Council had inquired with the local water retailer as to the status of the pipeline and had been told it was no longer used. I work as a contractor for the local retailer and know it is the main pipeline for Mornington Peninsula. Any problems you see to call Melbourne water who control the easement not south east water who are the retailer. Ownership of these easements in Australia are complicated as the original easements may have been issued over 100 years ago and do not point you to who the current owner is.
I would contact a attorney, I worked as a landsman. And there are many things a surface owner can do to reclaim unused easements from abandoned oil wells.
So sorry to hear of this, I have had a quick look and found Mahaffey & Gore, they are attorneys who deal specifically with Oil & Gas including titles, mineral rights etc. Maybe worth getting in touch.
Just keep doing what you are, things get thrown at you for reasons, only God knows, but sometimes it's takes something like this to open your eyes not to move but to really look what you have over, you two have done a wonderful job don't give up. Keeping doing what your doing. Till next time God Bless.
It's just a thing... You have a beautiful piece of property with great potential! Take a moment to adjust and make necessary changes... Then move on with your new vision... You got this! Take care!
If they have an easement, that doesn’t mean you can’t use the land. It just means they can access it if they want. At least that’s the way it is where I live.
California Land surveyor here. While every state is different, I have NEVER seen a remote access road match that of the written legal description for said road easement. I mention this because the road/path itself may not be at the legally recorded location for said easement. These things become tricky if written before 1972 as the verbiage is typically vague. In short, it would behoove you to have a surveyor review the language of the access easement and have them stake the centerline of access per the document. I highly suspect you'll find that the path and the recorded easement are not the same. With any luck the route of the recorded easement will work in your favor, but you definitely do not want to invest in utilities until the road location is set by a surveyor. You would also benefit from recording a "record of survey" with the county tying the access road the established monuments. Good luck!
These people are too dumb to develop vacant land. They need to rent an apartment. Local street cops have no authority over civil issues like mineral rights and access easements, yet these fools call this cop "officer" and listen to his every word. The cop probably knows less about real estate law than these people.
Always confirm important information in writing cause people will tell you want they think you need to make your decision. Here in New Zealand a realtor can be sued if they give you wrong information or don’t make you aware of issues relevant to your purchase such as oil wells or boundaries etc
Jason, it's no coincidence that the officer came by 24-48 hours after your neighbor came over and had a long talk with you..Humm ! All that being said, how would the police know you were there and within so many feet of what he told you ? And I'm guessing this officer told you, that you had no mineral rights to this property ?? I'm also guessing the title /deed search never gave you any clues to this potential situation that someone or something else owned part of what you just bought and paid for ..sounds like a legal issue of someone trying to scam you out of money and property you bought ..I do think you need a lawyer .. One who has knowledge of these things & issues..and please know you have more rights than the officer was letting you know.. He has only been told one side of a possible issue with your property. ..please check it out legally..a good attorney will give you a free initial consultation. This would be to know if indeed you have legal possession of YOUR property ..hope this helps
Okay…my question is 1) did you go through a title company when you purchased? 2) did they do a title search? It is their responsibility to find this stuff out.
My biggest concern is if it is an active well cite, is it toxic? How will that effect your health or the health of your animals? Other than that, take your time. Look at all options. I'm 100% sure Jason will figure out a game plan. Then we will watch those awesome videos. I would be checking into previous owner selling you oil field land and the price of the property you bought would come down drastically if you choose to stay.
Ask the oil field people where your lease money is. When we lived in Oklahoma we got lease money from a gas well not even on our property but close as they had angle drilled under us.
Wow! That wasn't expected. You are getting a lot of good advice on here and you should take them all to heart. We will be sending up prayers for you guys. Whatever you decide we will be along for the ride.
That is why you always research the land you are looking at buying at the county courthouse or register of deeds before putting money down or have a contract written that gets you the deposit back if the land is not free and clear from issues like this. Hope you all get it figured out.
Damn!! You guys just can't catch a break!! I am so sorry to hear of these complications. Praying it all works out for you !! Can't wait to finally see you guys in your forever home where ever that may turn out to be...I'm deeply invested and in this for the long haul!! Hang in there
We have been looking for property in Texas and Oklahoma and was warned that something like this could happen if we didn't buy the mineral rights with the property. How scary!
It's almost impossible to obtain mineral rights anymore...I'm a former lease and title analyst of 15 years. Most land that is sold now days is surface to the sky.
Sounds like you guys got the royal shaft!! If like the officer said this happens all the time, there should be a law to protect the buyer! If it's not one thing it's for you guys! There has to be a solution and I pray you find it! When you think you have come to the end of your rope, make a knot and hold on! My favorite saying!!!
As Arthur commented, below, contact an attorney if for nothing else to make sure this isn't some type of scam. You wouldn't believe the kind of detailed research some scammers will go to in order to fool property owners into giving up their rights and even their homes/homesteads! It's sickening that there is so much scum allowed to exist, in the world but, unfortunately, it's a fact of life. At least an attorney will be able to determine, without a doubt, if it's legitimate, or fake.
Obviously all the details aren’t in this video. To me, it sounds like they don’t own the mineral rights, and whoever does, whether that’s the government or private oil company, has future plans for their wells. Still though, even as the landowners, they have a lot power. They definitely need to meet with an attorney who specializes in the oil and gas industry.

Hi Jason and Danielle. Sorry to hear about the officer that brought you the bad news. You two have big decisions to make. I will 🙏🙏 that you will sort it out. Will always be here and support you two. Be safe, Love you two💕💕
Hiring a lawyer that is not affiliated with the oil company is always necessary !Water is your key ! Leaching? Solar is an option but do want to live that life? As you always do, deep breath. This is when your friendships with your neighbors will help. Ask them if they own the oil on their land. If not how do they deal with the company. Seek out the neighbors that have found a good balance with the companies. If you feel the oil companies have primary power over you and there is a possibility they can take you freedoms away, leave. If not work with the worst case situation and protect yourself from it. Remember when you move there will always be problems. They will just be different. Ask your lawyer the questions about other people have come across in the worst case. That should be your baseline.
Holy smokes! This is quite the hang-up. Good luck with this. I hope y'all get everything figured out. I hope you can stay after all the work y'all have done. I would definitely look into solar and wind.

Prayers and positive thoughts you guys ways!!! I hope you guys figure it out and everything works out the way it's supposed to! Positive vibes 🤙🏻 and much love to you!! ❤️
Jason and Danielle, I’m so sorry that this has happened to you. Everything was looking so good on your property. Maybe there’s a chance you both can talk to the oil company about this situation and they will be willing to work something out with you. That would be my first option. The second option would be to leave everything the way that it is for the time being but move your trailer to a different location. Then figure out a plan B. You both have done so much to this property within a years time that I can’t visualize you having to lose your property and rebuild your dreams. Figure up how much it will cost to relocate your electricity poles, etc. In other words, talk with the oil company and the electric company. Then you will know which direction to take. Sending prayers up for you both. Much love to you both. ❤ Until next time.
Check your state laws re real estate disclosures…in Florida it is against the law to sell a property without disclosing easements and encroachments. Good luck,,,,
It's crazy how they can take ownership of a road that you put in. I hope that your able to stand on this property as it has become your home. I understand if you decide to sell since it seems like it may be harder to get things done that you need done to make it your home.
They have a lot of power as land owners that I don’t think they realize even if they don’t have the mineral rights. They need to meet with an attorney who specializes in oil and gas industry. They keep saying oil field, but aren’t clear if it’s privately owned oil wells or government owned.
How did the officer happen to even come out? Did someone complain. Did the oil company try something? It's not like an officer to just show up checking on things is it? You poor kids what a shock. Lots to think about.
I also live in Oklahoma and on property that is on an oil field you need to pull a building permit to the State fire Marshal if you ever want to be able to obtain a certificate of occupancy. I'm dealing with this same issue and I'm on a 6 month wait list
Jason and Danielle my husband and I found out we had a water easement through our property after we moved into our home. After going through the county and state we where able to get the easement moved but it took thousands of dollars. The best thing we did was hire a surveyor to come out and survey our land mark our easement. It was the cheapest way to find out what we where working with and how to proceed. They will mark the easement for you then you can figure out how to move forward. That is my 2 cents it did work for us. Much luck to you and Danielle.
DANG, OR SHOOTDANG!!! But don’t give up. You’ve come this far, just work it out. Do solar for the tiny house, barn and studio. That’s what I would do. I watch a channel, Wild Wonderful, that run their large home and barn off of solar. Good luck, Joanne ❤️😊🙏
Next investment absolutely should be an attorney to handle this entire situation for you. Don't even consider trying to deal with this without an attorney
So ten grand to an attorney rather than reroute the electric? Paying an atorney for what? For buying land cheap and not doing your due diligence? All I remember from last year was how smart they all thought they were and couldn't believe how lucky they were. Total hubris and non-'stop bragging.

Here in southeast Kansas oilfield companies work around you say you want to build a gate over the road or driveway if it’s on your property they have to work around you they just need to use the driveway/road they need to know the combination to the lock or put their own lock on it but you can do what you want because it’s your property they will cut their own road but after you can make it the way you want as long as they have access to the oil well
They have to pay you for surface use! We looked into buying another 40 acres and it had wells. They only have access to the oil and only when they pay for surface usage! You need to give the oil company an invoice for what you’ve done
2nd this approach, but only after they refuse to work with you. Remember every little single thing you have done, such as example maintenance to the road, and the expenses you can pass back to them in a fight. Hopefully not needed.

@@milliewilkie1969 Someone said, when someone says without any proof to back it up. Then you can't take that with a grain of salt.
Go off grid solar . You could install a couple of small systems at each building. Use the generator as a back-up during winter. Will save you on electricity infrastructure also.
ID OF NEVER HOOKED TO THE MAINS IN THE FIRST PLACE.
You have a point. I know a couple of homesteaders who live completely off grid.

$5000 for a sufficient solar system.

I would full solar and wind building a shed to house the batteries and power equipment.
That’s why you go through title company. They figure all that out before you buy it. They check for easements and mineral and oil rights
These people are dumb as rocks. This is unwatchable.
How was the easement not found during the sale? A title company should have located this? Do you have title insurance? Have you thought about solar?
I'd be checking at the land titles office to make sure there isn't an access easement on the property (I might have missed that part trying to fend off my dog who was wanting attention), and then check with the State Mining Department to see if the well is actually listed as "abandoned". If it is, I'd try to have the easement removed and the well recovered and remediated at the well company's cost, and then you'd have your property free and clear. Fair warning, it'll likely cost a fair chunk of change to have that done (if it can be, that is), but it'd be money well-spent to get it done.
Easements are required to be on the deed and disclosed by law.
Consult with a lawyer who has experience dealing with this type of situation in OK and go from there. Best of luck.
For sure get a lawyer, this is bigger than most normal people can handle. This stinks big time.
Sue the real estate company as well as the survey company for not enclosing all of this at closing!!
It was a facebook deal
@@tinybubbles263 😮

Im in Oklahoma and would like to have my own homestead in the next few years so this is all valuable information
Good luck! And all the best to you 2🙏
Y’all seriously did not do any research on utility easements? I am flabbergasted.
Ya and ZERO due diligence
Or have a survey done
My question is what made that officer come out? I would be contacting a lawyer 😢
My thoughts as well
I wondered that too. It could be just by chance.
maybe he watches youtube?
Excellent example!!
How is it that all this wasn't disclosed during the signing at time of purchase?
Also, it never fails, they haven't touched or utilized the wells or lines in decades, the moment you improve the property, they all of a sudden have some sense of urgency to fire the systems back up.
Good idea to do in depth searches on property when you buy it and would have discovered it sooner. Steer clear!
My experience with the drilling companies in OK is if it has been abandoned, most likely it will not be reopened. They don't "own" the land. Were you told if you got minerals right along with the land?
This ^^^
Keep the property.
Love and prayers for you both!!!
always thoroughly check the property out before purchase
I agree 100%
It's just a thing... You have a beautiful piece of property with great potential! Take a moment to adjust and make necessary changes... Then move on with your new vision... You got this! Take care!
If they have an easement, that doesn’t mean you can’t use the land. It just means they can access it if they want. At least that’s the way it is where I live.
Do you have any permits for all of this a land survey? That should have shown you all of the easements
All I can say is WOW!! Sending good vibes you get it figured out soon.
Always confirm important information in writing cause people will tell you want they think you need to make your decision. Here in New Zealand a realtor can be sued if they give you wrong information or don’t make you aware of issues relevant to your purchase such as oil wells or boundaries etc
That is some crazy stuff. You guys do some amazing work. Fingers crossed for you
Jason, it's no coincidence that the officer came by 24-48 hours after your neighbor came over and had a long talk with you..Humm !
This would be my concern too. Do you want to live that close to the chemicals they use in a drilling operation? Is the water contaminated?
Yes, and it is costly to cap or close those toxic wells. It was on CNN Nightly News a few days ago.
Property owners this is a good lesson before building. Do your due diligence! Save time & money. Best wishes for what comes next.
Ask the oil field people where your lease money is. When we lived in Oklahoma we got lease money from a gas well not even on our property but close as they had angle drilled under us.
The original property map with your title etc, would have shown easements. An easement is an easement.
It’s all about the 6 Ps :- Perfect, Planning, Prevents, Piss, poor, Product. We all live and learn it’s not been the same since his brother left.

Nobody checked the legal description of the property to see if there were restriction on it from the oil company when you bought it?
THIS.....👍
That is why you always research the land you are looking at buying at the county courthouse or register of deeds before putting money down or have a contract written that gets you the deposit back if the land is not free and clear from issues like this. Hope you all get it figured out.

What about the shop? That obviously was property of the oil fields also
Hiring a lawyer that is not affiliated with the oil company is always necessary !Water is your key !
Who did your Title search for your property? Did you purchase Title Ins? Always a must when buying real estate.
Holy smokes! This is quite the hang-up. Good luck with this. I hope y'all get everything figured out. I hope you can stay after all the work y'all have done. I would definitely look into solar and wind.

Good luck,,,,
Just discovered your channel. and I noticed the hoodie you are wearing, That was my brothers old high school in Woodland Park, Colorado.
Hello Kay how are you doing today
What goes around comes around buddy!!! i hope you understand that. Call your brother and sort your relations

I'm sorry you guys are going through this. I can not believe the realtors can sell property like that without telling you.
Realtors are as bad and shady as dealerships are...dont ever trust them...
Did the title company inform you about these easements? It's really the title company and not the realtors burden.
Best advice Yet.

Hello
Next investment absolutely should be an attorney to handle this entire situation for you. Don't even consider trying to deal with this without an attorney
ABSOLUTELY!!
So ten grand to an attorney rather than reroute the electric?
Paying an atorney for what? For buying land cheap and not doing your due diligence?
All I remember from last year was how smart they all thought they were and couldn't believe how lucky they were. Total hubris and non-'stop bragging.
@@sb_db9350 LOL you won't get any argument from me about his usual show of arrogance and know-it-all attitude however after the fact he still needs to use his head and get an attorney in hopes of bailing himself out of another mess he's gotten himself into. I used to feel sorry for her thinking she had not a clue what she was getting herself into but some have to learn the hard way. And some like Jason never learn it all.
One has to wonder why the officer turned up in the first place. Either someone has reported it or the oil company plan on moving in.
Stay positive and believe in your dreams... I understand that it's disappointing but, thankfully, it's not destruction... all the very best.
If u cant use that part of the land cant u ask for money back from the oil company or ask for rent off them ? I love watching u guys and how far u've come it'll be sorted u will sort it out look on the bright side of things it'll work out
