- Apple was recently forced to stop selling their new Series 9 and Ultra 2 watch models in the US. With their website listing the products as currently unavailable. So what happened?
Well, it turns out that the watch sensor used to measure blood oxygen violated a patent held by Masimo. A medical technology company that sells products to hospitals.
Disputes between the two companies have been ongoing for over three years. With Masimo filing two cases, one with the US District Court in California, and one with the US International Trade Commission. The second of which Apple lost, and resulted in the ITC banning the Apple Watch Ultra 2 and Series 9 from being imported from their manufacturing location in China. - Наука та технологія

Ya, it’s scummy. I love my Apple products, always have, but I’m not cool with this at all. They could have done the right thing and make it right with Masimo, instead they screwed them and stole their employees. I just bought an Ultra 2 a week ago, returned it after I hear about this. Loved the watch but I’m not supporting a $2 Tril. Company who wants to steal tech.

@@mrsoisauce9017 that’s just false. They may have a similar sensor but that doesn’t mean it’s a 1:1 copy. And if it is, they have to come to a settlement. Hoping the US president will bail you out so you continue screwing Masimo is wrong.

The fairest and best option overall is 2, but Apple can be really mulish at times. I hope this issue is resolved promptly and Masimo are compensated fairly so that Apple Watch users can finally start having their devices repaired again

Forgot to mention that apple was in negotiations with Masimo and likely didn't like how much $ Masimo wanted for licensing. So they basically poached a bunch of their engineers likely offering them a lot more money and basically copied their patent anyway.
Who gets to patent and claim a blood oxygen sensor anyway? Thats a health related topic and should be public use.
The solution to Masimo's problem would be to pay their engineers more. But it's the American medical industry, so they're cheap.

Keep in mind you’re defending the same company that claimed intellectual property over “rectangular” phones after ripping their initial idea of a graphical user interface from xerox. well, "using patented technology" is not the same as " first approaching the masimo to get their patent, then backing out of the deal, and poching dozens of their employess, and replicating the tech in house with the help of the said employees"

Usually I despise this kind of over-patenting, esp for a feature that is generally good for public use, but Apple has both the capital to licenses/settle and are damn hypocrites. If the tables were turned they'd aggressively sue the smaller company out of existence (and have done so over pettier, non-innovative "features").

And enter the medical industry? Masimo isn't just a patent IP company, they actually manufacture and sell products to hospitals and other healthcare organizations. Apple buying them means entering an industry they have never been to before.

I dislike Apple for many reasons but medical equipment being locked behind patents sounds insane to me. "Oh you can't use that way of health tracking because this random company found it first and wants money".

So feb 2024, just caved and bought the Ultra2 after loosing my 7. To my surprise the oxygen feature is working on my new ultra watch. Im wondering if its because I had a 7 connected to my phone before too and its inactive. Hesitant to update and lose the oxygen censor. I’ve turned off updates for now until. I guess buy from your mobile provider or big box store if you want it.

As he says in the video, all Apple Watches with blood oxygen sensors are affected by this. That includes the Series 6, 7, 8, 9, Ultra 1 & Ultra 2. As I understand it, you can continue to use your watch as normal, as the ban only applies to the production of new Apple Watches. Existing ones are safe for now, but Apple may decide to use software to disable the sensor, so prepare to have your ability to check blood oxygen removed in the future. If worst comes to worst, though, Apple may be forced to recall all Apple Watches from the series 6 on up (minus the SE & SE2, of course), and in that case, you are certainly NOT safe.
@@mbcommandnerd If Apple have to do that bye bye Apple Watch. But this is David and Goliath kinda legal fight in which Apple will get revenue in the form of more media advertising and a lot of profit, again. The real question here is how much time will need Apple to settle the demand.

apple doesn’t repair parts on the watches, they only replace them with exchange units, thats why they wont “repair them” even if the screen has nothing to do with the sensors

Just got the 9 series. Knew nothing about this lawsuit. I’m just glad I got the watch with the EKG feature. I believe it’s a great investment. As far as the O2 sensor goes, I’m not impressed. I’m an RN and have used O2 sensors on many patients. This watch just doesn’t seem accurate comparatively to the finger sensor.
