I can't believe that he was found not guilty! The father having a motive does not negate the physical evidence against David. I'm completely dumbfounded!
I couldn't agree more. For me, all I needed was that 911 call - his weird (fake) cry and how his voice went to cold in a matter of second when he said his last name. That was so chilling. Of course all of the evidence backs this up. And someone should investigate how it was possible to LEGALLY BURN THE CRIME SCENE 17 days after the massacre. This is a crime itself! Such a sad story and definietly justice not serverd!!!

I was in prison with him. The only reason he got compensated or even got any attention at all after the horrendous crime is because a retired millionaire rugby player got involved for reasons nobody in NZ understands. It seemed at the time Joe Karam was just trying to cash in on the case by writing a book about it which made him David's champion by default. To this day many insiders to the case still find it all very confusing and even the extended family still argue over David's guilt or innocence. Personally I think he is 100% guilty.
This is why professional athletes should have no say in matters that do not concern them. You throw a ball and tackle for a living you are not a judge or police officer or forensic expert. What a joke :/
What an interesting case! I do like to listen to both sides but I’m sorry, you can’t dismiss the forensic evidence and replace it with circumstantial. The bullet trajectory, blood on clothes, injuries etc certainly point to David and I have to admit it gives me the chills that he’s been compensated - it’s like he got what he wanted after all, just a little late. Reminds me a little of the Bamber case. Thanks Adrian, another fabulous video!
I agree! So many lazy son's in the US & Canada hav killed their families so they could inherit it ALL. So selfish! Forensic evidence was overwhelming yet the Jurors looked up to that Sport figure like a God & he smiled at them and they did his dirty bidding.

Ive studied this case for years. And one fact remains.. IF it was the father a frail weaker old man then.. how could be have fought his fit sporty 14 year son for so long and finally over come him! David Bain got away with murder.

out of curiousity, is there a demograpbhic trend for who thinks he is innocent or guilty in nz? Like, do more sports fans think hes innocent because he was championed by an ex rugby player?
@@kat-ju8jbYes, a lot of the country were suss that he was innocent. Personally I always thought he was innocent - I think the father did it, waited for David to get home from the paper run to finish David off but they got into a fight of course and David killed him. That's my opinion anyway, a lot of people I've known over the years had slightly differring opinions on it but majority I knew all thought he was innocent as well.
I believe David is 100% guilty. The judge was right to keep the “motive” out of court cause it literally is just Hearsay. People going to any circumstantial evidence for David innocence and just ignored all the actual physical evidence pointing to his guilt. There was no reason for Robin to keep David alive, there was no reason for him to waste time waiting for a computer to turn on when he could’ve just written a note, so much just doesn’t make sense.
The motive could have very well been the reason for it all to begin with. Perhaps David was aware of certain elements of things and realized that his father was capable of snapping, so beat him to the punch so as not to be a victim.
That’s exactly what I was thinking.. when people hear the story of how evil Robyn was and what he did to his daughter, they will be so focused on that, that they might be blind to the physical evidence, that says otherwise.. so I think it was the right call to suppress that evidence, to get a more clear picture of what happened.. and as soon as it is brought up, he is acquitted?! I never heard them give an explanation for who Robyn shot him self! Which to me is the most crucial point in this case, regardless of motive and anything else.. if cannot prove that Robyn shot him self, then David shot him, end of discussion!

I lived with an extended family member of david's and she said that without a doubt, he absolutely did it and the extended family member told me when he stayed with her and her partner he acted very odd and strangely. She told me as well that there were a lot of information left out of the court cases and also a lot of false media representation. She said to me she knows that he did it and he got away with it for many reasons that should not have happened.

Thank you for doing justice to this case. You suprisingly did well with your Maori pronunciation for a non-kiwi! Robin Bain was my school principal. I was almost 9 when this happened. Robin lived with my family for a couple of months. He was a kind, gentle man. He played banjo and sung with us, teaching us about Papua New Guinea and inspiring a longstanding to this day love of music and reading in me. His daughter Laniet came with us on a school camp either the same year or the year before they died, my memory escapes me. I thought she was amazing and she was about to begin teaching me to play violin. I later took it up at school as a way to remember them. Dean Cottle was Laniet's pimp. I hope this shows his level of "trustworthiness". Laniet herself had lots of issues, she'd had a history of lying about unsual things, and I'm fairly certain looking from an adult perspective that she did in fact have abuse in her history. Everything in me wants to scream that this could not possibly be in relation to Robin, but how in fact could I possibly know? Joe Karam was a washed up has-been that only those following rugby in the 70's knew of, until this case. He may have put his own money into the case, however he also made a shit load of money out of the four books. David, and his crusade to prove his innocence, made him a significant penny. Regardless of this, the physical evidence does show over and over again that David was the perpetrator here. Rest in peace, Bain family. I remember you.

Maybe David was raping Laniet & she threatened to tell the family! Her dad lived in a trailer, David was in the house and Mum's favorite, so he probably got away with a lot. Im sure the Aged sports guy made tons off those books. He needed the trial to have writing material bc all forensic evidence points to DAVID.

The only money that David "won" was the compensation for being wrongfully accused and imprisoned for 17 years. Side note: I do not have an opinion one way or the other regarding David's innocent or guilt because I do not have enough information. I would need to hear all of the evidence presented by both sides to form an opinion.
As a New Zealander I initially thought that David was innocent, however over the years and learning more about the case I believe that David did kill his family. There is just so much evidence to indicate that he was the murderer and not his father. Good job on the pronunciation of the town with the longest name ever! Being a Kiwi myself I can’t pronounce it. Agree, I too have many friends who whole heartedly believed David was innocent but after considering all the evidence, it became clear that David was the culprit, even more so after reading Karams book.

The physical evidence says that David possibly killed the father. But the physical evidence says that the father probably killed the mother and the children.
For me, the forensics overwhelmingly support David’s guilt. The “motive” information for Robin neither erases the forensics against David nor produces forensics against Robin himself. It is also disturbing to see the former Rugby player sitting in the front of the courtroom, right where the jury can see him and making it clear what HE thought about David’s guilt/innocence. In my opinion, he influenced that second trial a great deal.
Yeah overall the second trial is stupid. We get new information that the father had more skeletons in his closet, so what? I don't get how that info essentially erased all of the physical evidence behind David's obvious guilt in eyes of the jury

The thing that sets your channel apart from other true crime channels is the respect you actively show to victims, their friends, and their family, as well as to the cultures, cities, and countries throughout the world where these events take place. It helps emphasis to us all that whoever the monster/s are that commit the crimes you cover, there is more to this world than them. You dedicate significant portions of every video to this and it's just something I really appreciate.
David killed them all. The emergency call was very telling when he immediately stopped sobbing to clearly pronounce his last name. The physical evidence certainly showed that the father was not the killer.
The physical evidence showed that he did not murder the rest of his family. But he may have killed his father. If that is true, then the evidence would present as has been observed.
His hysteria calmed when he was simply asked his last name like the tone changed and the list of evidence that he didnt bother to clean or hide. Imo he did it 🤷🏾♀️
My ear picked this out from that call immediately too. He tried to show his voice hysterical and when asked a simple question of his last name, he just switched and said it so calmly.

@@zoe.lilith We say that pretty much every time something like this happens. Killing an abusing parent is...justified, I think. When a victim can gather the gull to make that choice, it shows tenacity. Or maybe it is a way of giving up. I do not know. Any siblings killed, is unacceptable. But I have never been abused or even considered merc'ing my family.
I really do believe that Adrian is the best UA-camr in this category. There are other youtubers in this genre who have become really smug and instead of focusing on narrating the case they have let the comments that praise their 'humour' go to their heads... Adrian is so respectful and considerate in their narrative when covering these incidents. Really well researched, brings focus in such a positive way to the victims and their families. Timeline inconsistencies, the fact that only David knew where was the key for his rifle and his economical motivation say David was the killer. Also , it seemed quite impossible for his father to commit suicide with that rifle . The bullet's trajectory also revealed that.
I think David came home and shot his father in revenge after his father killed the family. David then turned on the computer and staged the suicide as to not be charged with his father's murder. all the clothes washing and house burning was so he wouldn't be charged with the one murder I believe he did commit, which is that of his father. his father also caused the injuries to him.

The murderer was David!! All the evidence points to him, and he said he 'zoned out', a line that's normally used by killers when not wanting to take responsibility for a bad situation. He also didn't phone emergency services for a while after 'discovering' the crime scene, and his phone call did not sound sincere. In my opinion David has gotten away with murder, and been compensated for it! The sentences in New Zealand are also shamefully lenient and not much of a deterrent to crime. Life should mean life, unless there are mitigating factors, and not if you kill 5 people!! Eligible for parole in 16 years means just over 3 years for each murder!! I don't see how this is justice. Well done Mr ex-All-Black who probably took on this case for self publicity.
It's the same in Sweden. Life in prison is usually 25 years, of which many don't get the full 25 and get out after 12. Tougher sentences deterr crime. Not all, but at least some.
Do you feel rhe same about the Timaru moron who killed 5 of his friends and only got 2.5 years. He murdered people too and only has to pay 5 months per life.

I definitely believe David is the killer. The evidences that points to him are solid facts. Robin might have reasons for killing his family too, but all the evidences in the crime scene points to David.
I was a teenager living in dunedin when this happend, it devastated the community. There was so much sinister shit going on in that family! also every cop that worked on the case 100% knows David did it.
My thought is that due to Robin and David's closeness, it's possible they both planned to carry out the crime. Robin killed the other members of the family, then convinced David to shoot him because by doing that, he would be killing a murderer. After David finishing his dad off, due to nervousness, there's a possibility he wasn't confident with the set up of the original crime thus tampering hence leaving loopholes. Another possibility is that Robin convinced David to kill them all.

well, David did spend 12 years of his life behind bars, and he got what $900k, where his lawyer lost $500k so... i don;t think David would have seen much of that compensation money, also remember 12 years behind bars...

I passed David in the street in Auckland while he was awaiting his 2nd trial. He smiled at me & I smiled back before suddenly realising who he was. It's a difficult case for NZers. I feel some empathy for David but I do think he killed his family. His parents were awful really but it's the lost lives of his sisters & little brothers that are sadly forgotten in this case.
After hearing that call to the police who could have ever thought it was anyone other than the son? That's about the worst attempt I've heard of a person trying to show shock & emotions.

@@markmike7933 I didn't even notice that, to me you could just hear it in his voice, in his replies to the operator. He was so damn emotional and then when the operator asked him a question, he answered it with such a change in demeanor. It was so apparent.

My fiance did point out that there were corruption charges filed due to how quickly the house was demolished after the fact, before they even properly searched it for further evidence. G'day to you in my home country from across the Tasman in NZ :)
The jury's decision and the information from this video indicates to me that there simply wasn't enough evidence to implicate him beyond a reasonable doubt. This may be disappointing, but I think it is preferable to the alternative: a court system where you're considered guilty and it is your job to prove your innocence or else you'll be sentenced. And additionally, I don't think he poses a danger to others right now. He probably just wants to live his life peacefully and not get in trouble. That, to me, begs the question as to what's even the point in locking him up? In my mind the point of prisons is to keep society safer, and the main goal towards criminals should be to make sure they'll reintegrate in society a better person after their sentence is served. I only believe in punishment insofar as it makes the likelihood of recidivism lower (and of course to serve some sort of justice to victims).
My family lived down the road from them. My mum and dad were taxi drivers and often took the family into town. They were absolutely shocked and couldn't really believe that it happened. I still live in Otepoti/Dunedin and the massacre is still speculated on today. Also solid attempt at the Te Reo name. Love your work, and thank you for covering cases in a comprehensive and respectful manner.
Based on what I’ve learned from watching your video, it sounds like all of the physical evidence points to David being guilty. I’m just struck by the juries decision of not guilty and wonder how they came to that conclusion
They probably had information we don't. Outside of cases of SA or authority figures abusing their positions, most juries imo tend towards overconviction rather than under, so I'm overall inclined to trust them when they say there isn't enough evidence to be sure.

I went to school with Arawa in Papua New Guinea. She was a lovely, polite and soft-spoken person. I often wonder if things would have been different if the family stayed back in PNG. Such a sad tragic story.
How David got away with this murder is ridiculous. All the evidence is there. I also don't believe for a minute that he "blacked out" for 20 minutes; what a bunch of ish. He got PAID to kill his family essentially. Absolutely aggravating.
The government gave him nearly a million dollars to stop litigation. Even though everyone knows he murdered 5 people and only spent a few years in prison he was paid in order to stop further legal action.

@@markmike7933 making an opinion that is way too far off is worth disregarding that opinion, that is what bothers me. whoever is found guilty is in the hands of the judges, jurors and the rest of those upholding the law. i am not the law.
They need to have a "casual" approach to coax the caller to remain calm, for themselves to remain calm, and have a clear head to get all of the information possible. Try going on a walkthrough at your local emergency office to see how it is to work there, so you have an idea before you criticize a job you don't understand
@@torachan23 im not criticizing them… im actually very impressed that they are able to handle all that stress so well. The only reason it strikes me as funny is because its so very different from the way an average person would respond. They have a mental strength that most people do not… they would have to, in order to handle these calls every day.
I wonder if they found him not guilty because he’d already served most of his sentence prior to parole eligibility and they figured that they’d give him an early parole. I don’t see how they could disregard the physical evidence and really believe that he was not guilty and in effect convict the dead Robin of crimes for which he could not defend himself.
Interesting update to this, after Bain was released he got married and one of his groomsmen has been found guilty of rape and murder (for the second time I might add). Quoting below "Speaking to the Herald at the time, Joe Karam said Wilson was Bain's best and oldest friend. The pair were two of the longest-serving inmates in their section of the prison and, though other inmates came and went, the two remained close." Paul Tainui (name changed from Wilson). Look it up. So wierd.

My god, it doesn’t take a brain surgeon to know that given the evidence that David Bain clearly killed his entire family. The fact that this grandiose former rugby player exposed his own personal views to sway away from the truth is a truly despicable human being. I hope that David Bain never has a day of peace, happiness or is shown any courtesy from the public.
You would expect that jury would have an own brain to put the huge dots together. Instead they all had the brain of the 26 million sheep who live in that country
I'm from New Zealand and have studied this intensely. You did do a good job of covering this though. Many people don't know, David bragged to a friend months before that he was planning a rape, and would use his paper route as an alibis. He had previously been told by an old woman who he delivered papers to that he must never go on her deck as the dogs barked and woke her up. He never did, except for the morning of the murders when he went on the deck, waking her up... thereby solidifying his alibis. He was also caught faking his seizure at the house by paramedics, and again in prison he faked it again. This time the officer there who knew him yelled at him to "cut it out", and he did immediately. There is an excellent detailed podcast about the Bain murders called "Black Hands"

I moved to the intersecting street three years after the massacre and was one of the people who signed the petition for the re-trial. There was a good argument that the first trial had flaws, but the second trial was much more comprehensive. So comprehensive, in fact, that it was clear that David was guilty. That is why everybody in David's team goes from looking dejected to surprised when the verdict is read. The jury were seen talking and laughing amongst themselves instead of paying proper attention, and David Bain seeking compensation was met with outrage.
Rather amazing that they used a circumstantial argument to win a case that had forensic/physical evidence that shows obviously that David is the murder. Can't wrap my head around the mental gymnastics here
I was _actually_ shocked when they read the second verdict 😳 I mean, I’m over here in the US, where probably nothing should “shock” me anymore, lol 😩 but still! I was not expecting that. The amount of evidence *_against_* him in insane! I guess I don’t remember hearing anything about the actual times of death by a medical examiner/coroner, but based on timeline alone, it seems like it’s rather obvious who the killer is? And yes, I do find it interesting that the father apparently had these allegations against him, but.. what would be the reason for David being “the only one who deserves to stay”? That makes no sense to me. Like, “you were on your paper route, so I guess you’re fine to live 👍🏼” ???? What a wild ride this one was. I don't know his compensation was met with outrage. He spent 13 years behind bars only to have a retrial and have him acquitted of all charges. A million dollars wouldn't be enough if it were me.

Omg I remember the re-trial being on television when I was a kid. My parents were so invested and thought it was absolute insanity that they were even considering he was innocent. Now watching this as an adult, I have to agree. I thought this was a crazy thing to happen in Aotearoa and am still shocked when cases like this pop up.
I would have been 11 during the re-trial but for the life of me, I don't remember this case or hearing about it until I was in my late teens. Wish I did though, the crime junkie in me, would've been glued to the TV
I can't make up my mind about it. Bit there was a huge amount of public support for him. And I suspect the jurors were influences by it. There was also a story about some jurors celebrating with him after the verdict.

To say what others have been saying, his Father had motive, but considering the trajectory of the bullet wound to his head, the washing of clothes and agreeing to having the house burnt down (WTF!), it points to David. Good point about the public influence, I feel like high profile cases in a country where stuff like this is uncommon probably weighed in to the decision, maybe. We'll never know for certain. That is insane though... To celebrate afterwards... Yikes!!!!
Its a case that has and still divides new Zealanders today. It was awesome to see you do this case I was six when this happened and I still remember it being all over the newspapers, TV and even our teachers talking about it trying to explain about the issues that it involved not many things like this had happened her before then. I personally believe he did it but unfortunately I don't think he will see justice in this lifetime for the crimes he (may have) committed. Dude murdered his entire family to get the life insurance, then burnt down his house with all the evidence inside, not only that, he was found innocent and got 900k. Dad was a scrambled egg, but his prints weren't on the weapon and no gunshot residue was present on his hands. The bullet's path wasn't consistent with suicide. The location of the blood recovered, the booting of the computer, the fresh injuries, access to the weapon, and the timeline lead me to believe that Deadeye Dave got away with murder.
Yes.. they did test for residue on Robin and there was none.. David on the other hand, admitted to showering after getting blood on his socks from his dead brother, before calling authorities.. so it was obviously pointless to test him for residue.. one more reason to point to his guilt. ALL evidence points to David.. his motive? His inheritance of course! What 22 yr old is doing a paper route?? He would never get out on his own with that income! And his dream of being in the opera..? His performance looked like a zombie! No chance would he ever perform in an opera! He was going nowhere.. and wanted to be the sole inheritor of his parents money.. I mean my god, he even wrote it on the computer.. ‘you are the only one who deserves to live’! What evidence was there that the father molested his sister..? What evidence was there that she was going to expose this? HOW does a man commit suicide with NO FINGERPRINTS ON THE GUN?? I don’t believe Robin could have possibly shot himself with a rifle based on the evidence.. David was a narcissist who killed his whole family because he believed that his parents owed him something for his lousy upbringing… he admitted he was the only one with the key to the murder weapon for god sakes!! How more blatant can it get?! And why wasn’t the computer dusted for fingerprints to prove WHO had typed the last message?? If not for a rich ex-rugby player who used the case to make money and attain more fame, he would still be in prison.. which is where he belongs.

@Kate Sharp be careful, avoid the big cities, they're pretty much run by government supported and protected pacific islander and indigenous gangs, so the streets are really dangerous, especially at night and especially if you're what New Zealand calls "pakeha" its even worse now that the only firearms here are in the hands of those gangs too, and they're not afraid to use them. @@silverdale3207 Robin Bain (the father). All of the circumstantial evidence points to him. It was falsely stated that he could not have killed himself the gun. That was later proven to be untrue. He even has gun powder on his finger, after he died. How else could it have got there?

No marks on him despite violent struggle with Stephen, no blood on his clothes, meanwhile David had bruises, and his broken glasses in Stephens room. Robin would need to have been a genius at covering his tracks before removing all blood of his hands changing his clothes and killing himself awkwardly with a long rifle then setting the spent shell casing upright in his dying moments. If all the evidence pointed to him why did they convict David. So much evidence against David, none against Robin.

I think David came home and shot his father in revenge after his father killed the family. David then turned on the computer and staged the suicide as to not be charged with his father's murder. all the clothes washing and house burning was so he wouldn't be charged with the one murder I believe he did commit, which is that of his father. his father also caused the injuries to him.

Dude must have had 7 foot long arms to be able to kill himself from a couple feet away with that rifle. A silencer would have actually blown more powder and hotter powder onto the man’s head at a closer distance. The stippling would have been just brutal if it was a suicide. Wow! Can’t believe David got away with this.
This case was huge and it treads such an incredible fine line between "David did it," or "Robin (the dad) did it." The simple fact is that the forensic work done by the police was an absolute disorganised shambles, Dunedin police were simply unprepared for the scale of the murder (way back in 1993) and they cocked it right up. Many people were let into the crime scene when they shouldnt have been there. Karam took a lot of advantage of the many evidential holes in his claims. Many of the younger police cops involved in the matter changed their careers to real estate agents.
This made me feel like there was some back door dealings with the rugby player going on. Please do a followup video covering more of the events leading to him being released and ultimately acquitted.

I’m from this town in NZ. My good friends parents now live at the same address as the Bain family murders occurred (two properties on the section now) and it’s always such a weird thought when you’re walking into his house, a friend I grew up with, his dad was the first police officer to turn up, or enter the house, I forget, but on the odd occasion it came up in conversation, he said they had never dealt with something like this so they messed up a lot of the crime scene and a friends dad was higher up in police with a desk job and said they thought the evidence would’ve proved itself. I even broke my nose years ago and the older nurse who helped me was the nurse who was at hospital when he was brought in after this. Small place here. What’s also random is that David used to wear older woollen sweaters (as you can see) with odd patterns on them, now they’re looked at as vintage and quite a lot of people own them and everyone calls them Bain sweaters. I don’t know if I’ve ever commented on a UA-cam video before but I had to on this one. Still puzzles me

Magaret was in to nutty things and in her words David was always a strange boy. David has new identity lives in Australia with his wife and kids. I would have to say that David is obviously guilty, and has got away with this horrendous crime. I do not understand how any jury would find him not guilty, unless the celebrity status of the rugby guy swayed them.
Maybe if the crime scene wasn’t burned down, the authorities would’ve had an easier time convicting him. Ultimately, functional Justice systems must designed, in a way that guilty people can sometimes take advantage of. Why? Because if it was impossible for guilty people to abuse the system; then innocent people would almost NEVER be found not-guilty.

I couldn't agree more. For me, all I needed was that 911 call - his weird (fake) cry and how his voice went to cold in a matter of second when he said his last name. That was so chilling. Of course all of the evidence backs this up. And someone should investigate how it was possible to LEGALLY BURN THE CRIME SCENE 17 days after the massacre. This is a crime itself! I was in prison with him. The only reason he got compensated or even got any attention at all after the horrendous crime is because a retired millionaire rugby player got involved for reasons nobody in NZ understands. It seemed at the time Joe Karam was just trying to cash in on the case by writing a book about it which made him David's champion by default. To this day many insiders to the case still find it all very confusing and even the extended family still argue over David's guilt or innocence. Personally I think he is 100% guilty.
This is why professional athletes should have no say in matters that do not concern them. You throw a ball and tackle for a living you are not a judge or police officer or forensic expert. What a joke :/

@@kat-ju8jbYes, a lot of the country were suss that he was innocent. Personally I always thought he was innocent - I think the father did it, waited for David to get home from the paper run to finish David off but they got into a fight of course and David killed him. That's my opinion anyway, a lot of people I've known over the years had slightly differring opinions on it but majority I knew all thought he was innocent as well.
I believe David is 100% guilty. The judge was right to keep the “motive” out of court cause it literally is just Hearsay. People going to any circumstantial evidence for David innocence and just ignored all the actual physical evidence pointing to his guilt. There was no reason for Robin to keep David alive, there was no reason for him to waste time waiting for a computer to turn on when he could’ve just written a note, so much just doesn’t make sense.
The motive could have very well been the reason for it all to begin with. Perhaps David was aware of certain elements of things and realized that his father was capable of snapping, so beat him to the punch so as not to be a victim.

I lived with an extended family member of david's and she said that without a doubt, he absolutely did it and the extended family member told me when he stayed with her and her partner he acted very odd and strangely. She told me as well that there were a lot of information left out of the court cases and also a lot of false media representation. She said to me she knows that he did it and he got away with it for many reasons that should not have happened.

Robin Bain was my school principal. I was almost 9 when this happened. Robin lived with my family for a couple of months. He was a kind, gentle man. He played banjo and sung with us, teaching us about Papua New Guinea and inspiring a longstanding to this day love of music and reading in me. His daughter Laniet came with us on a school camp either the same year or the year before they died, my memory escapes me. I thought she was amazing and she was about to begin teaching me to play violin. I later took it up at school as a way to remember them.
Dean Cottle was Laniet's pimp. I hope this shows his level of "trustworthiness". Laniet herself had lots of issues, she'd had a history of lying about unsual things, and I'm fairly certain looking from an adult perspective that she did in fact have abuse in her history. Everything in me wants to scream that this could not possibly be in relation to Robin, but how in fact could I possibly know?
Joe Karam was a washed up has-been that only those following rugby in the 70's knew of, until this case. He may have put his own money into the case, however he also made a shit load of money out of the four books. David, and his crusade to prove his innocence, made him a significant penny.
Regardless of this, the physical evidence does show over and over again that David was the perpetrator here.

Side note: I do not have an opinion one way or the other regarding David's innocent or guilt because I do not have enough information. I would need to hear all of the evidence presented by both sides to form an opinion.
As a New Zealander I initially thought that David was innocent, however over the years and learning more about the case I believe that David did kill his family. Agree, I too have many friends who whole heartedly believed David was innocent but after considering all the evidence, it became clear that David was the culprit, even more so after reading Karams book.
Same, also from New Zealand and also thought David was innocent at first and am now strictly in the Justice for Robin Bain department!

For me, the forensics overwhelmingly support David’s guilt. The “motive” information for Robin neither erases the forensics against David nor produces forensics against Robin himself.
It is also disturbing to see the former Rugby player sitting in the front of the courtroom, right where the jury can see him and making it clear what HE thought about David’s guilt/innocence. In my opinion, he influenced that second trial a great deal.
Yeah overall the second trial is stupid. We get new information that the father had more skeletons in his closet, so what? I don't get how that info essentially erased all of the physical evidence behind David's obvious guilt in eyes of the jury
I get that technically he has the right to be there, however I dont think celebrities who very clearly have influence should be allowed in a court.

The thing that sets your channel apart from other true crime channels is the respect you actively show to victims, their friends, and their family, as well as to the cultures, cities, and countries throughout the world where these events take place. It helps emphasis to us all that whoever the monster/s are that commit the crimes you cover, there is more to this world than them. You dedicate significant portions of every video to this and it's just something I really appreciate.

David killed them all. The emergency call was very telling when he immediately stopped sobbing to clearly pronounce his last name. The physical evidence certainly showed that the father was not the killer.

You have every right to believe that, but the courts deal in facts. Your emotional response to the 911 call is not evidence proving his guilt.
The physical evidence showed that he did not murder the rest of his family. But he may have killed his father. If that is true, then the evidence would present as has been observed.
His hysteria calmed when he was simply asked his last name like the tone changed and the list of evidence that he didnt bother to clean or hide. Imo he did it 🤷🏾♀️

The jury found out that the motive for the crime was the economy. The house was burnt out, so they had to give him 1 mill. to achieve his goal!
Justice system in other countries really sucks. It's not that good here in the US sometimes but it's much worse in places like this, just my opinion.
Timeline inconsistencies, the fact that only David knew where was the key for his rifle and his economical motivation say David was the killer. Also , it seemed quite impossible for his father to commit suicide with that rifle . The bullet's trajectory also revealed that.
Plus his bloody fingerprints on the rifle that he couldn’t explain..
I think David came home and shot his father in revenge after his father killed the family. David then turned on the computer and staged the suicide as to not be charged with his father's murder. all the clothes washing and house burning was so he wouldn't be charged with the one murder I believe he did commit, which is that of his father. his father also caused the injuries to him.

The murderer was David!! All the evidence points to him, and he said he 'zoned out', a line that's normally used by killers when not wanting to take responsibility for a bad situation. He also didn't phone emergency services for a while after 'discovering' the crime scene, and his phone call did not sound sincere.
In my opinion David has gotten away with murder, and been compensated for it!
The sentences in New Zealand are also shamefully lenient and not much of a deterrent to crime.
Life should mean life, unless there are mitigating factors, and not if you kill 5 people!! Eligible for parole in 16 years means just over 3 years for each murder!! I don't see how this is justice.

It's the same in Sweden. Life in prison is usually 25 years, of which many don't get the full 25 and get out after 12. Tougher sentences deterr crime. Not all, but at least some.

My thought is that due to Robin and David's closeness, it's possible they both planned to carry out the crime. Robin killed the other members of the family, then convinced David to shoot him because by doing that, he would be killing a murderer. After David finishing his dad off, due to nervousness, there's a possibility he wasn't confident with the set up of the original crime thus tampering hence leaving loopholes. Another possibility is that Robin convinced David to kill them all.

I passed David in the street in Auckland while he was awaiting his 2nd trial. He smiled at me & I smiled back before suddenly realising who he was. It's a difficult case for NZers. I feel some empathy for David but I do think he killed his family. His parents were awful really but it's the lost lives of his sisters & little brothers that are sadly forgotten in this case.

The jury's decision and the information from this video indicates to me that there simply wasn't enough evidence to implicate him beyond a reasonable doubt. This may be disappointing, but I think it is preferable to the alternative: a court system where you're considered guilty and it is your job to prove your innocence or else you'll be sentenced. And additionally, I don't think he poses a danger to others right now. He probably just wants to live his life peacefully and not get in trouble. That, to me, begs the question as to what's even the point in locking him up? In my mind the point of prisons is to keep society safer, and the main goal towards criminals should be to make sure they'll reintegrate in society a better person after their sentence is served. I only believe in punishment insofar as it makes the likelihood of recidivism lower (and of course to serve some sort of justice to victims).
My family lived down the road from them. My mum and dad were taxi drivers and often took the family into town. They were absolutely shocked and couldn't really believe that it happened. I still live in Otepoti/Dunedin and the massacre is still speculated on today.

Based on what I’ve learned from watching your video, it sounds like all of the physical evidence points to David being guilty. I’m just struck by the juries decision of not guilty and wonder how they came to that conclusion
The reason maybe the fact that they had 3 months of evidence- not just 30 minutes, and who knows what parts of that evidence resonated with them.

I agree. The only thing I can think is that the jury was going on emotions rather than evidence.
They probably had information we don't. Outside of cases of SA or authority figures abusing their positions, most juries imo tend towards overconviction rather than under, so I'm overall inclined to trust them when they say there isn't enough evidence to be sure.

They need to have a "casual" approach to coax the caller to remain calm, for themselves to remain calm, and have a clear head to get all of the information possible. Try going on a walkthrough at your local emergency office to see how it is to work there, so you have an idea before you criticize a job you don't understand

I wonder if they found him not guilty because he’d already served most of his sentence prior to parole eligibility and they figured that they’d give him an early parole. I don’t see how they could disregard the physical evidence and really believe that he was not guilty and in effect convict the dead Robin of crimes for which he could not defend himself.

Interesting update to this, after Bain was released he got married and one of his groomsmen has been found guilty of rape and murder (for the second time I might add). Quoting below "Speaking to the Herald at the time, Joe Karam said Wilson was Bain's best and oldest friend. The pair were two of the longest-serving inmates in their section of the prison and, though other inmates came and went, the two remained close." Paul Tainui (name changed from Wilson). Look it up. So wierd.
David is clearly guilty. He's only lucky that some celebrity took an interest in him and lobbied for his release.

I'm from New Zealand and have studied this intensely.
You did do a good job of covering this though.
Many people don't know, David bragged to a friend months before that he was planning a rape, and would use his paper route as an alibis.
He had previously been told by an old woman who he delivered papers to that he must never go on her deck as the dogs barked and woke her up. He never did, except for the morning of the murders when he went on the deck, waking her up... thereby solidifying his alibis.
He was also caught faking his seizure at the house by paramedics, and again in prison he faked it again. This time the officer there who knew him yelled at him to "cut it out", and he did immediately.

The embarrassment of the nation of New Zealand.
I moved to the intersecting street three years after the massacre and was one of the people who signed the petition for the re-trial. There was a good argument that the first trial had flaws, but the second trial was much more comprehensive. So comprehensive, in fact, that it was clear that David was guilty. That is why everybody in David's team goes from looking dejected to surprised when the verdict is read. The jury were seen talking and laughing amongst themselves instead of paying proper attention, and David Bain seeking compensation was met with outrage.
Rather amazing that they used a circumstantial argument to win a case that had forensic/physical evidence that shows obviously that David is the murder. Can't wrap my head around the mental gymnastics here

The amount of evidence *_against_* him in insane! I guess I don’t remember hearing anything about the actual times of death by a medical examiner/coroner, but based on timeline alone, it seems like it’s rather obvious who the killer is?
And yes, I do find it interesting that the father apparently had these allegations against him, but.. what would be the reason for David being “the only one who deserves to stay”? That makes no sense to me. Like, “you were on your paper route, so I guess you’re fine to live 👍🏼” ????

Omg I remember the re-trial being on television when I was a kid. My parents were so invested and thought it was absolute insanity that they were even considering he was innocent. Now watching this as an adult, I have to agree. I thought this was a crazy thing to happen in Aotearoa and am still shocked when cases like this pop up.
I would have been 11 during the re-trial but for the life of me, I don't remember this case or hearing about it until I was in my late teens. Wish I did though, the crime junkie in me, would've been glued to the TV
I can't make up my mind about it. Bit there was a huge amount of public support for him. And I suspect the jurors were influences by it. There was also a story about some jurors celebrating with him after the verdict.

To say what others have been saying, his Father had motive, but considering the trajectory of the bullet wound to his head, the washing of clothes and agreeing to having the house burnt down (WTF!), it points to David. Good point about the public influence, I feel like high profile cases in a country where stuff like this is uncommon probably weighed in to the decision, maybe. We'll never know for certain. That is insane though... To celebrate afterwards... Yikes!!!!
Its a case that has and still divides new Zealanders today. It was awesome to see you do this case I was six when this happened and I still remember it being all over the newspapers, TV and even our teachers talking about it trying to explain about the issues that it involved not many things like this had happened her before then. I personally believe he did it but unfortunately I don't think he will see justice in this lifetime for the crimes he (may have) committed. Thanks for another in depth story allowing the memory of the victims to live on and their story told.
I can't even wrap my head around the fact that it actually divides New Zealanders. It seems so glaringly obvious he murdered his family.
Dude murdered his entire family to get the life insurance, then burnt down his house with all the evidence inside, not only that, he was found innocent and got 900k. He now has a family and a life his siblings never got to have. He 100% got away with murder. Truly sickening.

Dad was a scrambled egg, but his prints weren't on the weapon and no gunshot residue was present on his hands. The bullet's path wasn't consistent with suicide.
The location of the blood recovered, the booting of the computer, the fresh injuries, access to the weapon, and the timeline lead me to believe that Deadeye Dave got away with murder.

@Kate Sharp be careful, avoid the big cities, they're pretty much run by government supported and protected pacific islander and indigenous gangs, so the streets are really dangerous, especially at night and especially if you're what New Zealand calls "pakeha" its even worse now that the only firearms here are in the hands of those gangs too, and they're not afraid to use them.
Go to the South Island, Queenstown and the surrounding area would be my recommendation.

@@silverdale3207 Robin Bain (the father). All of the circumstantial evidence points to him. It was falsely stated that he could not have killed himself the gun. That was later proven to be untrue. He even has gun powder on his finger, after he died. How else could it have got there?

No marks on him despite violent struggle with Stephen, no blood on his clothes, meanwhile David had bruises, and his broken glasses in Stephens room. Robin would need to have been a genius at covering his tracks before removing all blood of his hands changing his clothes and killing himself awkwardly with a long rifle then setting the spent shell casing upright in his dying moments. If all the evidence pointed to him why did they convict David. So much evidence against David, none against Robin.

I believe David is guilty. The blood, washing the clothes, the angle of the rifle, the sole access to the rifle, the convenient schedule of his activities, the purported "zoning out," the bogus premonition, etc., none of it adds up to innocence. Professional presentation as always, Adrian.
I think David came home and shot his father in revenge after his father killed the family. David then turned on the computer and staged the suicide as to not be charged with his father's murder. all the clothes washing and house burning was so he wouldn't be charged with the one murder I believe he did commit, which is that of his father. his father also caused the injuries to him.

Dude must have had 7 foot long arms to be able to kill himself from a couple feet away with that rifle. A silencer would have actually blown more powder and hotter powder onto the man’s head at a closer distance. The stippling would have been just brutal if it was a suicide. Wow! Can’t believe David got away with this.
You can use that rifle on yourself easier than you think. Even if it’s unlikely. The 2nd court had people demonstrate this.

This case was huge and it treads such an incredible fine line between "David did it," or "Robin (the dad) did it." The simple fact is that the forensic work done by the police was an absolute disorganised shambles, Dunedin police were simply unprepared for the scale of the murder (way back in 1993) and they cocked it right up. Many people were let into the crime scene when they shouldnt have been there. Karam took a lot of advantage of the many evidential holes in his claims. Many of the younger police cops involved in the matter changed their careers to real estate agents.

I’m from this town in NZ. My good friends parents now live at the same address as the Bain family murders occurred (two properties on the section now) and it’s always such a weird thought when you’re walking into his house, a friend I grew up with, his dad was the first police officer to turn up, or enter the house, I forget, but on the odd occasion it came up in conversation, he said they had never dealt with something like this so they messed up a lot of the crime scene and a friends dad was higher up in police with a desk job and said they thought the evidence would’ve proved itself. I even broke my nose years ago and the older nurse who helped me was the nurse who was at hospital when he was brought in after this. Small place here. What’s also random is that David used to wear older woollen sweaters (as you can see) with odd patterns on them, now they’re looked at as vintage and quite a lot of people own them and everyone calls them Bain sweaters. I don’t know if I’ve ever commented on a UA-cam video before but I had to on this one. Still puzzles me

Magaret was in to nutty things and in her words David was always a strange boy. David has new identity lives in Australia with his wife and kids. I would have to say that David is obviously guilty, and has got away with this horrendous crime. I do not understand how any jury would find him not guilty, unless the celebrity status of the rugby guy swayed them.
Maybe if the crime scene wasn’t burned down, the authorities would’ve had an easier time convicting him.
Ultimately, functional Justice systems must designed, in a way that guilty people can sometimes take advantage of. Why? Because if it was impossible for guilty people to abuse the system; then innocent people would almost NEVER be found not-guilty.
