- Oh man, the taxpayers spared no expense on this building. Everything was easy to navigate and very easy to find. Signage for restricted areas were very clearly marked. I enjoyed that there was an escalator as an alternate method to traverse floors.
For the most part, most public officials respected my rights to report in the public spaces of this courthouse. However, there were some to include some sheriff’s deputies that did not. Mr. Patrick just wanted me to mosey on and had deputies called when I would not just comply. Assistant Chief J. Jackson made the statement there is a no loitering policy. I was under the impression that loitering was a law rather than a policy. However, one can’t be arrested for not following the Gwinnett County Policy.

If there is one place that you definitely should be able to record it is inside a courtroom. We definitely need transparency and accountability in the judicial system.

Taking pictures and photographs is real buisness and therefore can't be loitering.
Asking questions to a public official who's job is to answer questions can't be deemed disturbing or disrupting. Questions can be pointed and uncomfortable
It's a private business, they have the right to refuse service and ask non-cusomers to leave

The U.S. Supreme Court invalidated an ordinance that prohibited individuals that the police believed to be gang members from loitering in public because it left too much room for arbitrary and discriminatory enforcement by officers because the ordinance defined the term loiter as “to remain in any one place with no apparent purpose” the court argued that the law gave too much discretion to law enforcement stating that “the no apparent purpose” standard for making that decision is inherently subjective because its application depends on whether some purposes is “apparent” to the officer on the scene.

the "disrupting operations" was the unreasonable statement, he mentioned loitering in response to you asking him about his questioning. he never asserted you were loitering, only that his questioning was to determine if that was the case.

You have to cause alarm or present an immediate threat to the people or property in an area to be accused of loitering in Georgia. Since there are cameras everywhere, someone using one cannot meet that threshold. But if you made this video, you were lucky you weren't arrested when you went through a door and into an area with clerks where people conduct their business with government officials. A court would probably deem that to be a tenant space, and you'd be convicted of privacy violations just as if you recorded in a public restroom. Being able to walk into a space does not mean people do not have a reasonable expectation of privacy in it. Over a year ago I tried to explain this to Christopher Cordova, Denver Metro Audits. He didn't grasp that an office is no different than a courtroom, and the people working in a tenant space can limit your rights within that tenant space. Now he's got two criminal convictions for entering a tenant space in a Social Security office and recording when told to stop. Stay in the building entrances, lobbies (not office lobbies), hallways, corridors, and auditoriums if an auditorium is being used for a public meeting. Stay out of anywhere people are working and interact with the public regarding anything private.
