    Not all dads are bad and Dayne is an example. Many children are damaged by usually the mother using them as ammunition without a thought of what it is doing to the children . Nobody is saying that children should not be protected from violent parents be that Male or Female but they need to put their children first .

  • @PrincessNads1
    @PrincessNads1 18 годин тому +7

    I hate to simplify this but in all honestly he would have won custody regardless. Thd child was already in his custody and had her life with him, had her friends and school etc. No judge is going to uproot a child from stability like that. On the other hand, if the daughter had been in his ex wife's custody at the time then there wouldn't have been anything he could have done to stop it, unless he could have put a good case across to show that uprooting the child would cause harm.

    • @istudios225
      @istudios225 3 години тому +1

      I don't think it is so simple. There is a bias for courts to award custody of young children to the mother. The mother could also have fabricated reasons why he should not have custody. She may not have had proof about her allegations, but he had prepared all his documents carefully and thoroughly.

    As I understand it, Common Law is to do with precedent (Latin: Stare Decisis) from previously established case law made by judges when passing / delivering judgement (in contrast to legislation which is made by a competent legislative body). Lower Courts are bound by the decisions of Superior Courts etc under Common Law. This case might not necessarily have been one won by case law precedent but he sounds like he did successfully navigate the system and persuade by reason the merits of his position. Congratulations and well done on getting a positive result 👏 👍

      You are quite right Damien. We loosely used the term common law but rather meaning more Natural law regarding maintaining a "private capacity". The first angle was that the judge/courts are without right, interfering with my right to property.

    • @genuinearticle33
      @genuinearticle33 16 годин тому +1

      That is the co-opted common law of the BAR, the original common law is essentially a libertarian custom that posited all was lawful in right of your own person and property until you trespassed upon anothers right, Common law was corrupted by the Courts in the 18th Century when they had a spat with the Admiralty Court over who is getting more Business and ended up co-opting that jurisdiction into Common Law ... which is why we have the legal maze of complexity that the Courts are playing around with today.

      @@LoreByDeJure I don't regard this as being a natural law. I made a comment elsewhere here regarding my thoughts about this. To me it was more Trust Law & Contract. Not quite. You are talking about Common Law as defined by Statutory Law courts. They call it Case Law or Precedent Law, as you've said. Me personally, if I had to fight to see my child, I would never use the courts. The reason I say this is because at some point someone used the court and if it wasn't you, then it was her. And if it was her first then why did she need a third party? The first to instigate a court (win or lose) has lost morally. When will we realise that we don't need anyone to tell us what is right or wrong and if we lose the things that we need the most then at least we will die knowing we did what was right.

      I lost access to my two daughters when my former spouse decided that it was a good way to punish me .I didn't instigate divorce proceedings and my ex was really only interested in having a couple of children and the then new system of sole parent benefits (Based on Lyndon B Johnsons family law legislation) would see her paid to be a stay at home mother. I decided early to not create a fight or fuss over getting access. I went to the courts thinking it was the right move and soon learnt that it was all wrong. I tried to see my children for 18 months. For my own mental well being and to separate myself from any court action I emigrated to another country. It's been 40 years now and there are grandchildren I will never meet.

    The judge would have made his decision in accordance with the Children Act 1989, which states that the welfare of the child is the court's paramount consideration. And no amount of sitting down and playing name games and word games will change that. Common law has nothing to do with this statutory requirement.

    "Master" until the age of 7 years, as you are still the "Master of your own vessel", at 7 you become Mister, a naval term being of the lowest rank, after 7 seven years you can be declared as "lost at sea" and the insurance on the lost package can be claimed, this is then traded via the "birth" certificate. It is a "bond" that the nation can trade with the bank, this "bond" and all "bonds" (certificates and licences) are held with the BIS (Bank of International Settlements). This isn't just a rabbit hole this is a whirl pool deep into an ocean of piracy...

      @@organickevinlondon Historically, “Mister” was used as a form of address for officers up to the rank of Lieutenant Commander (O-4), regardless of gender. This title was an expression of respect and affirmation, similar to “Sir” or “Ma’am” used in other contexts.
      For example, a junior officer might address a senior officer of the same rank as “Mister” followed by the officer’s surname, such as “Mister Johnson” or “Mister Smith”. This title was not limited to specific roles or positions, but rather was a general term of respect for officers below the rank of Commander.

Is the pension scheme a way to remove the experienced heads from society ?. I think we may have a huge win for 'private equitable honorable people power' ,will take a while to get its boots on ,but I think it officially happened on the 23rd ,which is 7 years from the sign of the son of man in 2017 ??.
