    My worst nightmare is seeing my husband like that, calling 911 and then having experienced detectives point their arrows at me while I’m grieving. I can’t think of a worse mental torture.

      Yes, I don't think it's right that they questioned him so soon after seeing his wife with her head half blown off. I know they needed to question him, but it seemed rather callous of them to at least not put it off for 24 hours or so. But then again if he were in fact the killer, he could have probably tried to skip town/leave the country.

    It frustrates me when police just go for one suspect and try to build a case around that person.

      They look for evidence, and at evidence, and then focus on a particular suspect or suspects. There was circumstantial evidence pointing to the husband, and for me he remains the person who most likely killed her. First, Darlene wasn't the victim of a random crime: Somebody doesn't just pull up to a rural farmhouse in the middle of the day and shoot one of the occupants. That almost never happens. Somebody had to have had a motive to killer her--and so who? Other than the husband, the only other possibility, apparently, was her brother--and while he had some problems, brothers don't have kill their sisters. I put very little weight in the supposed eyewitnesses who supposedly saw a white car at the farmhouse and speeding away. It's been proven many times that eyewitnesses often make mistakes and are not often reliable.

      Yeah, as I heard all the evidence I kept thinking (I assumed a twist was coming) that it seemed like the husband was either obviously guilty or he just had the worst luck possible- turns out the latter was the case.
      I did feel like his emotions were too sincere to be the guilty party though. For the most part you can tell from the 911 call often times. There are always exceptions though.

      Nothing was definitely linking the husband! Too circumstantial for me! He never changed his clothes… unknown dna on gloves, etc nothing linked him in this case!!

      Likely murder weapon makes no sense…,none of stolen property found or weapon. Needed z definite link and there wasn’t one and children changed their story of the sound after being around others. People react differently when one loses a loved one or becomes lonely!!

      The credit-card angle is nonsense. It's a huge leap for someone to go from fraudulently use a credit card number to murder---and what would the motive be? There wouldn't be a motive. Police didn't follow up with that lead because it was, and remains, far-fetched and weak. Didn't happen. I also doubt the eyewitnesses who claim to have seen a white car speeding away from the crime scene. Eyewitnesses often claim to have seen things that they didn't really see---or they just get details wrong. Eyewitnesses are well known to be unreliable. The only person other than the husband who could have killed her was, it would seem, her brother--and I don't think he did it. The person who most likely killed her remains the husband.

    Love your videos. Very professional. As a lawyer, I would caution anyone whose spouse is killed or harmed to seek legal counsel before talking to the police. The idea that you don't need counsel if you're innocent is naive in this day and age.

      Murderers are convicted on the basis of evidence collected - some of it circumstantial . They are NOT convicted on the basis of
      anything said in a Police interview ! Especially when the interview is filmed. ! It's irrelevant whether a lawyer is present or not .!

      @@2msvalkyrie529 I don’t think it’s anything specific what a person might say. It’s that the police aren’t your friend. They will twist and turn everything to suit whatever ends they want. They’re allowed to lie, we’re not. That alone should be enough. Guilty? Get a lawyer. Innocent? Even more reason to get a lawyer.

    the credit card usage was not followed up as well...shoddy and very lax police work...they just focused on one suspect!! RIP Darlene, hope your killer is caught by the cold case team!

      Not near enough evidence , bumbling detectives. They cant check the body temp like EVERY crime lab in the country for decades to see if she was killed earlier?

      @@SpicyTexan64 Missing Glass was too much for me to get over. The Dry Shower is a complete Dead Give Away, something is not adding up. I think he may have "Arranged" this. I do think he smashed the back glass door. Very troubling.

      Though he did say his ears are extra sensitive. Unless you have his ears and heard that exact sound on that day you will never know. He did say glass at the start and that was unbiased in my view. Being with the mothers family for years and speaking again he had a slightly different account. It’s called manipulation.

    Your videos are really amongst the best I’ve seen and I watch a large number of them! No nonsense, straight to the point, no tangential bs, just really solid reporting! Can’t thank you enough! So tired of the way all the other channels seem to think we’re interested in the country it happened in, the storyteller’s personal life, etc! Very well done!!

      Things were a lot cheaper in 2009. My dad bought a house 3 bed room in 1991 for $81,000 making only $15hr. It wasn't in a rural area where homes are cheaper, it was right in the capital of the state, 3 miles from downtown. He worked as a teacher's assistant and did bus duty.

    Another great video, Kevin. I live about 45 mins from Coldwater and don’t recall this case but I am glad he had a retrial because the amount of circumstantial evidence was overwhelming. Had I sat on that jury, there is no way I would’ve voted guilty. It’s a shame the police squandered leads and have allowed the case to go cold post acquittal. She deserves justice and so does Tom.

      I was about to change the video until I finished this comment. The fact that I saw “acquittal” is what kept me around because I was getting frustrated. I’m not even halfway through! The “investigators” are pathetic.

    It’s the fraudulent credit card thing for me . They should have looked into that avenue further . And meanwhile this innocent man sat in jail for 2 years while his son was brainwashed by the family 🤦‍♀️ these cases although not surprising, are always sad . Police get tunnel vision & don’t explore other options in so many cases .

    Before you even mentioned the additional evidence that the police didn't investigate, I was like: I'm not sure he did this. I feel like they went straight to him, and didn't pursue anyone else, and the fact that they haven't done any more investigating proves how close minded they are, and is very frustrating! Her brother is extremely suspicious, and it makes me wonder who he knows on the police force. 🤷🏼‍♀️

    AS it turned out, the case was bigger than the prosecutor. She should have been tarred, feathered and run out of town on a rail for allowing the case to go silent once he was acquitted.

    Using lil kids should be banned in court. They're easily manipulated and live in a fantasy world. My 7 year old saw me cleaning my gun, called the police. Not until the police talked him into what type of gun, it became a machine-gun. (First time he saw a gun and it scared him). Police came and saw my 357 cleaned and in a holster. See how kids interpret their world around them, especially with the help of others?

      I agree. Kids say silly things and end up believing their own stories. Thats just how their minds work. Some people never grow out of it. Like my dad. He kept inventing stories till he died. His words could never be trusted. And worst of all, he believed his own babble.
      Kids stories don't belong in court.

      They have such a low bar for what they consider a motive for murder.
      Especially when virtually all murders are committed without much motive and are simply over-reactions to unfolding situations.

    That was a very interesting case. Absolute reasonable doubt in Tom's guilt. Don't know whether he did it or not but I think the jury came to the correct conclusion.

      Idk, there’s just TOO many coincidences. Like him telling the boys to go outside and play BEFORE going to get ready for the party. The boys hearing a loud sound while playing outside. I get that the police didn’t directly ask him about the loud sound before trial, but most often (than not) they’d usually ask a suspect about what they did in a day. I would think that’s a pretty significant thing to just forget during the course of multiple police interviews.

      @@deevasquez1171 Except that, if the bag was originally from his home (like the stolen paperwork, etc.), why would it NOT have his fingerprints on it? Did they ever identify a DNA match for that glove found at the scene (they had stated that the DNA on it matched neither Tom nor Darlene).

    Excellent story Kevin. I do hope some day there will be justice for Darlene (and Tom).

    Pressing these young boys to define a sound they heard from a distance and putting words in their mouths by offering specific suggestions should've made their statements about it inadmissible. If the information told here is all there was this matter should not even have gone to court. They had nothing. The jury needs to be reminded they are not required to convict anyone. They are well within their rights and responsibility to return a verdict that nothing was proven. Sometimes I wonder if there are 12 people anywhere who could be assembled as a qualified jury.

      No it's not. When you live in the country, you're parents tell you to go outside and play all the time. It's a daily occurrence. My parents told my brother and I that all the time so they could get stuff done without us running around the house.

    I wonder why those witnesses didn’t come forward earlier. Thankfully they came forward eventually. Definitely reasonable doubt in regards to his guilt. The credit cards, finding different DNA at the scene. Seems like shoddy police work from the outset. Great presentation as always. Rest easy Dar. I hope your killer is found ❤🇦🇺

    This is really an interesting case, and I do think follow-ups should have occurred before they completely fingered Tom. Too many cars, sardines by neighbors that were never brought up in court so far as any follow-through by the police. The police were the problem in this case, due to the lack of investigation..

    What are these "legal grounds" that caused Tom to not collect any monies that he was rightfully owed because of a wrongful conviction? Poor man. Poor son. What a bunch of lazy incompetent law enforcement people from the police all the way up to the prosecuting attorneys/officials. It's easy to blame the husband right off the bat....end of story...our work here is done. Shameful

    I can't imagine how frustrating it would be to have found a loved one murdered only to find that you are the ONLY suspect!?...
    The manipulation of his own son is a crime in itself...and as soon as you said the brother had a shotgun... unreported to have been stolen?.... mmmm...???
    An all round shit show from the word go...and a refusal by the cops to even question neighbours or look at other suspects?
    A terrible and so tragic a story.... blessings to all those affected by the loss of Darlene....❤

      Totally agree. And forgot to mention I was saddened to learn his lawsuit was dismissed for being wrongly incarcerated for two years. That's two years of his life lost... birthdays, holidays, etc. Certainly he should have been entitled to that money in my opinion.

    Cops are great... Yes, it is the husband in most cases so they said - "F the investigation, let's indict the husband and have few beers. Work? Police work? Work is for suckers." The only thing missing in this case is the psychic saying - "it was the butler.. hmm... no butler you say? the husband then!"

      And in most cases, it is the husband. This is well known. Or the wife. Especially when on a muddy day, no muddy shoe prints were found on the floor! So naturally the suspicion falls on the husband.

      No, it is NEVER the husband.
      The pigs always set the husband of boyfriend up.
      WE have ZERO proven cases in hundreds of years of having courts and judges.
      They just get to decide what they want to have happened, because they have no way to investigate what actually hapapned, we as a society do not develop factual tools for investigating, we instead use prosecution tactics to set men up.

    That first jury was incompetent. Prosecutors 'evidence' was horribly lacking. There is no way I would have convicted him even the first time. I'm very happy this poor man was let loose.

    So the small boy whose mother's head was blown off with a shotgun, whose father was in prison for shooting her, is taken on a church outing where they get to shoot off shotguns that brings back the memory of the day his mother died. That's therapy for you.

    I dunno. What I do know is most times these detectives have tunnel vision when they have one suspect in sight. This causes them to ignore everything and everyone else.

      In reality there is no way to investigate what actually happens, at the very best an eye-witness can testify, but the fact is that eye witness testimony is disproven more often than it holds up, so it is better to stop interfering and just let people be.

    I dont think the husband was guilty at all and thankfully the 2nd jury felt the same. With all the ppl coming forward for the 2nd trial, it seems they really rushed to prosecute him originally. And once again, as in SO many cases, there was a ton of reasonable doubt and yet the first jury found him guilty. That is so scary. Just his reaction when they first interviewed him. I mean, I know there are some good actors out there but to me he seemed truly crushed. My heart goes out to Darlene, her family and friends. I hope they find out who really did this to her because its my opinion that there is a murderer walking the streets.

      The trail of the stolen crredi cards should have been pursued. But the police was too.lazy to act after framing a potentially innocent man. That's as bad as the crime itself.

      Agree with all you say and I don’t think any actor in the world could be that good. That was real pain and you could see it and feel it. Detectives prosecutors don’t like to be wrong. They go hunting in wrong directions often. It happens more than most would know. If your defence is weak you are in strife even if you are innocent.

    One of the saddest parts of this story is of the son, Heath Foley…. How, over time, he remembered things differently, possibly coerced by family members while his dad was the only suspect for killing his mom…. It seemed like the glass pane incident evolved into a gun shot memory, pinning his dad on the crime? So sad.
    Praying that Heath and Tom’s relationship was fully mended and their hearts are healed from this entire, multilevel, life-shattering tragedy.

    Police procedure in cases like this is to visit and speak to as many neighbours as possible as many people are afraid of coming forward. That they failed to do this in this instance shows sloppy and lazy attitudes to their work, compounded by a prosecution equally incompetent. However, if we can judge by the hundreds of cases now available for scrutiny such attitudes are relatively rare and I am struck by how thorough most police forces are in their search for the truth.

    Man, I'm So glad the poor guy got out within a few years rather than decades. What a terrible miscarriage of justice, and a showcase of justice system tunnel-vision/corruption. Some other innocent victims of the justice system never escape a railroad like this.

    If your spouse is murdered: 1) NEVER talk to the Cops. 2) Get a lawyer ASAP. There are MANY innocent people in prison today who were wrongly convicted of murdering their spouse.

People apparently don't feel that way any more. That's because our System is actually on Revenge, rather than on true Justice.

      Men don't think clearly. My husband would prob do that if I didn't have a cellphone. Shit he don't worry for me after couple hrs that I should of been home. Not that he doesn't care. He knows I can take care of myself and just isn't that type of person. If I ever went missing or God forbid anything else he'd be so suspect for NO reason.

      Well If someone is running an hour late and picking up 3 boys ten minutes apart, maybe you would believe he would be at least at the 2nd house? You wouldn’t think she would be still at home an hour after ? Well I wouldn’t and without mobiles in those days, I would ring to see which boys have been picked up. Common sense

    I remember this case from a long time ago. I have no idea if he’s guilty, but a few things stand out:
    1. Why did he tell the kids to go play in the barn when they were playing video games inside before the party? That’s seems kind of odd.
    2. Does the sound of glass breaking make your ears ring? Does it carry that far? I don’t think it does?
    3. Why would alleged assailants in a white sedan choose this farm? Why a shotgun? Why kill the homeowner? Why no defense wounds on Dar?
    4. The credit card use in another location is exculpatory, but what if he dumped that stuff somewhere and it was found by a random scumbag?
    5. Also exculpatory: There’s no way he would leave those shell casings in his own basement, in a bag with his prints, while getting rid of jewelry, paperwork, and credit cards.
    6. After Dar didn’t show for the birthday party at 5:00, Tom went straight home to check on her. Phone records show he never called. This goes in the guilty column, imo.
    7. He left the party at 4:00-4:30 to get ice. Partygoers didn’t understand why as apparently, they didn’t need any. This could have been to dump the credit cards at a gas station?
    8. Snow had melted and it was muddy out, but there was no mud in the house. Did the burglars politely remove their shoes?

      @sarahs2288 best comment here. Afa the bag with the shell casings, perhaps he gathered them up in a hurry and with everything else going on, he simply forgot about them. He prob left them in the center of his basement to remind himself to grab them before he left, but the cops found them first. A couple of add'l things, the bath was dry and he seemed to have planned this. So I would imagine he knew his kids would need to see him in the same outfit. Therefore, he prob changed to kill her then changed back in the same clothes so his kids wouldn't know. Too bad a shoddy investigation got this murderer off.

    This happened in my home town. Mrs. Foley was in the school when I was there. She was the funnest lady to be around. Everyone wanted to hang out with her. I recently had something come up while researching another true crime. I don't think this had enough coverage and I truly hope that interest can increase and get this case looked at again. He either hired someone (that person in the white car) or he borrowed another vehicle between that 20 minute drive. Tom Foley did this and got away with it. Dar was an amazing woman and she was taken.
