I ride roads with 30 to 40 mph speedlimits. I have 3 ebikes. The 20 mph is way to dangerous on the road. My 32 mph is ok sometime's but some people still pass and honk, etc. My 42 mph bike has been awesome . Most people respect you riding with traffic. Faster is safer if your dealing with cars. I slow down on bikepaths for obviouse reason's.

As a California resident, I'm choosing option 3..... I have been illegal since day one. Im not riding crazy and wild. But drivers here are bad, always in a rush. Being able to have a throttle and hit higher speeds is a safer position for a rider. I also am 6'2" and over 230lbs. I need a 1000w or higher motor to get me up the hills and through traffif from a dead stop. I am in my 50s and have a disability. So yes, I need the motor assist to be able to ride and keep my independence. Im not lazy, I pedal 99% of yhe time. However, since I also have Neuropathy and loose feeling in my foot, I def need a throttle at times to be able to make it home. If they want me to stay within the written laws, then they need to start enforcing the education of driver responsibility, enforce the laws against street takeovers, sideshows, and store thefts. Why is it You can buy a car that can do 150mph+ that cannot be used in a practable manner anywhere in this country but I cant use my bike over 28mph for safety? I'm disabled and have an e-trike, I use it to go to therapy every other day and it has a thumb throttle, and if they're going to take away my e-trike then I will send gavin newsome the bill for my transportation. the guy is an idiot, everyone with an e-bike should vote out all those politicians who voted for that bill, if anyone injured is or killed their families should sue the state of california, it's obvious that those politicians weren't thinking about the whole situation, they just thought about what they can control, because they're in the pockets of the oil companies, and the oil companies can't be losing their profits.
Nobody is going to enforce the throttle thing to be honest especially if you do get pulled over and you can prove you bought the bike before the law took effect most cops really won't care and the rumor on the streets is it's going to be like a $20 ticket or something ridiculous. I don't see anyone taking their bike to a shop to get it downgraded especially people who pay out the nose for a specialized mountain bike or trek or anything with a bosch motor like that. I see many companies switching to 750 watt mid drives that put out 160nm of torque like the bafang m620 and m630.
I've tried to register my e-bike once and got rejected. it has everything a moped would have lights, turn signals, pedal foot protection, and etc. I got rejected due to no vin numbers, weatherproofing, fire safety, and need an inspector approval due to being a diy bike. I guess the only way to get it register is to pay extra for an e-bike like the Sparkcycle brute or javelin that is built to be able to register with the DMV from the start.
I do not think they care about the 28mph speed (which they should), they are just waiting for the zillions complaints to get in to justify taxing class 3 eBikes.
Older ebikes already sold before the law took affect are grandfathered in the firmware update is only for the bike shops in California to be able to sell their bikes so they don't have to sell them as vehicles and still be able to sell their bikes but ya I wouldn't willingly downgrade my bike
They need a new classification and allow all ebikes on all roads other than highways. Even if the new laws insist that any bike that goes faster than 29mph must be licensed and insured. I am okay with having to license and insure my Wired Cruiser.
OUT RUN THE LAW! Im a very old senior citizen and for the sake of safety, EBikes should AT LEAST be able to keep up with traffic. My next bike will be extremely fast. It will have off-road ability, and it will be able to easily out run the law and escape these legal clouds with the simple twist of the throttle! Fleeing and eluding suddenly becomes much more sensible, than confiscation, tickets, court dates and legal fees. A 62 mph Surron or E ride Pro SR will be my next scooter!
if you have a cadence sensor you dont need to actually put in any work to get up to that 28mph, that is if you even remove your throttle in the first place. these laws are complete bs from people who dont understand what its like to ride with traffic on an e-bike. being able to get up to 35 or 40 can be very useful at times. Im glad to see that specialized is presenting this as an option to users rather forcing them to downgrade the hardware that they paid for.
When they say you can pedal to 28 mph, do they specify if you can have a cadence sensor? That is basically a pedal activated throttle so it should be disallowed I would imagine.
To be clear, this part isn't a "new" law - it's already part of the 3 class system that California and the other 35 states with the 3 class e-bike definitions have. California just clarified that yes, they really meant it the way it was originally written. Nothing in the 3 class system allows you to have both a throttle and 28mph pedal assist on the same bike, as the definition of class 3 explicitly states that the motor completely stops providing assistance when the rider stops pedaling, regardless of what speed you're going at. (before someone mentions it, yes, California did add the 3.7mph walk assist and start assist bit to the most recent law, so, you can still have those, and they aren't considered to be throttles)

Mark it comes down to your basic needs and your goals while riding a bike . If it’s peddling mostly 6:17 or throttle as needed / in places where this is allowed nothing to see here . Option 2 riding a E-Bike Throttle only no pedals or nearly impossible to pedal the bike , your probably leaning towards riding a motorcycle and not a bicycle. I can see your dilemma with your bike and goals , you enjoy cruising around but have no interest in riding a 400-800 pound gas powered motorcycle. Bottom line there will have to be a category for your bike with a clear understanding on how and where to ride it .

It can be dangerous to limit power. Heavy riders may not get to 20 mph. I know - I weigh 210 lbs. It does matter. Lets govern Cybertrucks to 200 hp. It would not move. Same physics. My Jetson bolt is held to 15.5 mph. I reach 12 mph stock. I made tire changes and go 14.5. It stll wont reach max speed. No firmware for me. I ride safely.

I weigh 280#, so I have never taken a bike to it's theoretical max. If i was still on my old class 3 folder, I would have been penalized as I could only sustain 26mph on level ground while the battery was freshly charged. If limited to 20, then I can deduce that I'd be lucky to reach 17 or 18mph only when in a similar battery state. Now, I'm going rogue with my unclassed bike. I'm not sure how long i can keep to the potentially hazardous limits being forced on us, and I can't get myself to change my controller settings because I know too well how speed and safety can positively go hand-in-hand.

Fast pedal bikes are under 20 pounds and the riders are highly skilled and lightweight to train and reach those speeds. Any tubby lard can just jump on a 150 pound E-Moped and be at 450 pounds system weight 30+ miles an hour. You not being able to see the difference is why stricter laws are needed, hopefully culminating in licensing + insurance for E-Moped riders.
@ Why is that a problem? He's not wrong. If you want e-bikes to continue being allowed usage on the same trails, bike lanes and paths as regular bikes then restrictions are needed. It's worked in Europe and as a result there's little to know tension between e-bike riders and human powered. Not to mention the fact that many spandex wearing roadies also have an e-bike in their quiver for commuting purposes.

Unfortunately there's a very strong community undercurrent that are against ebikes full stop, there always was an undercurrent against cyclists, but ebikes they have an easy platform to demand very restrictive laws, politicians cater to the popular opinion.

The globe haul doesn't actually come with a throttle, it is an aftermarket addition, unless something has changed since I've looked at them. I prefer pedaling, but on a cargo bike I would want a throttle option, but not sacrifice the higher end pedaling speed. It's a stupid law and I hope it lives and dies in California. I'm good with the 3 classes, (not CA's interpretation), and think there should be a class 4 that follows speed limits in urban areas. I could rant on about cleaner air, noise pollution, healthy activity, TRAFFIC, all things lawmakers aren't even looking at. It's about safety, right? If that's so, why are automobiles still legal? Not against cars, just compare them to all other ways of transport for injuries or death. Safety isn't the issue. I'll stop here Mark, I should probably start a book.
In CA. I don't agree with the change. If I'm being forced to downgrade, then I want my throttle and a refund for the difference. I paid x amount for a level of performance, so losing it BLOWS. As I own an unclassed ebike (Aniioki A8 Dual Motor), I'm lucky that it's physical design looks more like a folder, and not an e-moto. So, staying under the radar is possible (especially since I ride within traffic laws). I'm going to miss regularly using the available higher speeds (and I'll see how I cope with it), but the primary reason I bought the beast was for the range and uphill climbing power. Yet, I loth the idea of going into the controller and limiting her, because there is real safety in having immediate access to performance (including higher cruising speed as i deal with city traffic). So, time will also tell when i might reduce her capabilities via the controller.

Cadence sensor is just a foot throttle. The updates should also keep class 3 if the owner removes the throttle.

My ebikes’ throttle just broke so I’m just going to remove it since I live in California but am not limiting my top speed on my class 3 e-bike.

As you know, parts of Florida are even stricter. Key Biscayne has banned e-bikes altogether. Sucks for the Seniors who live there and own one.

@@Alan-l3i7d If you convert it to E Bike it's a Moped now and should have those things, and should be driven in the street with the other mopeds. If you are scared of the street grow a set, it's not anyone elses problem.

The way to do this is by system weight. Any bike over 40 pounds follows moped rules, simple.

20 is 5 MPH faster than an ebike should go on throttle.
The globe haul doesn't actually come with a throttle, it is an aftermarket addition, unless something has changed since I've looked at them. I prefer pedaling, but on a cargo bike I would want a throttle option, but not sacrifice the higher end pedaling speed. It's a stupid law and I hope it lives and dies in California.
I'm good with the 3 classes, (not CA's interpretation), and think there should be a class 4 that follows speed limits in urban areas. I could rant on about cleaner air, noise pollution, healthy activity, TRAFFIC, all things lawmakers aren't even looking at. It's about safety, right? If that's so, why are automobiles still legal? Not against cars, just compare them to all other ways of transport for injuries or death. Safety isn't the issue.

In CA. I don't agree with the change. If I'm being forced to downgrade, then I want my throttle and a refund for the difference. I paid x amount for a level of performance, so losing it BLOWS.
As I own an unclassed ebike (Aniioki A8 Dual Motor), I'm lucky that it's physical design looks more like a folder, and not an e-moto. So, staying under the radar is possible (especially since I ride within traffic laws).
I'm going to miss regularly using the available higher speeds (and I'll see how I cope with it), but the primary reason I bought the beast was for the range and uphill climbing power. Yet, I loth the idea of going into the controller and limiting her, because there is real safety in having immediate access to performance (including higher cruising speed as i deal with city traffic). So, time will also tell when i might reduce her capabilities via the controller.
I think what an ebike looks like should have nothing to do with how laws are made.

I'm just saying, living and riding in Los Angeles and Orange Counties, that officials, and public perception, are hyper-focused on e-motos... which isn't fair to the many riders who aren't part of the problem. For now, riding on a platform that doesn't resemble an e-moto draws less unwanted attention... but as we continue forward that can change on a dime.
Bah... I'd just stick to keeping my bike being capable of 35 mph and having 3000 watts of power. I don't live in California but the laws are silly and too restrictive. the legal difference should be having an working pedal assist system or not having any pedals to determine if an ebike is legal or not. basically throttle optional or only throttle should be the legal definer
