I noticed this immediately, on twitter there was one guy who was saying "remember projared? you should let the other side say their side before coming to conclusions" except they did let the completionist say their side, it was in the actual video. Turns out the guy was just a hater of this channel and wasn't afraid to state it. so he was biassed. Even projared is a hypocrite. "let both side say their story" except he didn't even watch the accusations side, because he would have seen the completionists side then too. Of all the people you'd think he'd know.

Ill be honest, most of them are on (formerly known as) Twitter and I think its mostly just kneejerk reactions, like usual on Twitter. It makes sense on an emotional level.
Many people would have that if a "drama" channel covered their favorite creator or friend who they had no reason to believe was a bad guy, and briefly read over the headlines on the even and it just said stuff like "found documents on the internet about improperly disclosed paper work".
Its easy enough to assume that this is some Keemstar guy.
Obviously this is not the case, but fake cancellations and outrage are so prominent on the internet its easy to assume as much.

I think he's known from day one. If you found out you were sitting on all the money you thought had gone to these charities. Wouldn't you at least adjust your language to say something like "oh sure we work with charities, yup we're always looking for the best charity to donate to in the future!" 'Lie' is a strong term. Dudes mom died of the disease and made a charity trying to 'cure' it. Having worked in non profits it reeks of good intentioned but naive individual completely ignorant of how difficult these kinds of projects are.
If he was doing this maliciously there's a million ways he could have cloaked the spending and simply pocketed the money. The fact there is no evidence he ever did this absolves him of malicious intent if you ask me. You'd have to really hate this guy to make yourself believe it was some kind of ultra long term con.
I want a professional investigation done because I have a hunch Jirards family was either misleading him to give themselves a yearly income OR they wanted to have so much money they would have the power to indicate how the money is spent.
I'm willing to wait for a professional investigation because although I have immense respect for guys like Mutahar, Coffezilla, Karl etc. People forget their jobs are not to definitively prove guilt or innocence, it is their job to use their platform and passion to point a finger at a house on fire and say, 'ain't it messed up there's smoke coming out of that house and nobodies doing anything about it?
Either results wouldn't surprise me in the least and it also wouldn't surprise me if they do find some evidence of criminal negligence or mismanagement on Jirards fault. The real tragedy is the the internet doing what it always does and obsessing over drama instead of helping the victims.

It’s sad to see that so many people missed the point. The problem is not that the money is being held, the problem is that jirard isn’t telling everyone that it is. The problem is that jirard is telling people that the money is being donated to these organizations when they are actually just holding the money. The problem is that despite acknowledging that this is a problem, he still held indieland 2023 and told people that they were donating the money to these organizations. It’s also sad that people will immediately disregard anything as drama if it’s between two UA-camrs, and if the UA-camr being called in to question is popular, they immediately assume that it’s just to gain fame.

In fact that story, whether truth or lie, has absolutely no bearing on the issue at hand - is the money that was donated still sitting there? And why has it not been properly donated as was the public expectation throughout all of the fundraising? Sure it is possible that the money has been embezzled and used for personal expenses, but if that is the case then it won't be that hard to bring it to light with a criminal investigation. We live in an era where every dollar you collect and spend can be traced electronically. If they did misappropriate the money for personal use then it will come to light because that shit is going to be hard to hide. You might be able to cover up a bit of fraud, but that much fraud will show with even a cursory audit.

My theory is that he personally (or by the charity, but that should have shown up in the filings) donated something to them. This would allow him to skate by on a technicality "well I donated 25$ way back when my mom got sick" or whatnot.
I dearly hope that the issue is simply that the family couldn't agree which charity to donate to, and Jirard just went "welp, I'mma peace out and keep plugging away, you lot decide what to do with it."
As time passes without any statements, though, the suspicion starts to grow that maybe someone did embezzle the money. Maybe taking a small amount to start with, to compensate them for the work they did for the charity. Then they used it for a trip, which might even be related - "hey, we're visiting X and checking in on charity Y, that makes it OK to have the charity pay for it right?" Then the brakes come off, the spending snowballs and now they can't pay back what they've taken.
Jirard finds out (hopefully after the videos turn up the heat on him to check in on the foundation), but doesn't want to throw a family member under the bus on social media and definitely doesn't want the justice system involved because it might mean jail time and/or the person(s) in question losing their jobs.
That's the story that my brain came up with to explain why Jirard hasn't explained it, and has tried to deflect without being directly at fault for the money not being donated to some charity. Now, could he have been embezzling himself? Sure, that's possible, although I think it's unlikely. Had he wanted to grab it, there are ways - make another company/foundation, preferably in another country, donate the money from Open Hand to the second one because "finally we found someone worth working with", have the second company donate the money to Jirard and then either just hang around, doing nothing or shutting it down.
TL;DR: I think there's an issue with some of the family blocking donations, perhaps because they do want the money to go to the specific condition that the mother had, or because they've embezzled it. I think Jirard knew or suspected this was the case, but didn't know for sure until a certain point in time (maybe late 2022, maybe just now). I think Jirard doesn't want to make public what happened, either because it looks bad, or because it will have really bad consequences for someone in his family.

All those organizations would need to prove in civil court is that people donated under the belief or due to being told that the money donated (or a portion of it) was to go to their organization.
The people who donated could also take it to civil court for the same reason and they would probably see more success in doing this than banking on one of these organizations taking them to court. Unfortunately, a large part will just stick their heels in the sand, and rationalize their initial decision as they don't want to come across as inconsistent.

Like muta said in his early video this could be a case of charity fraud if the balance confirmations and balances have a severe variance.
Unfortunately I don't think audits for NGOs are legally forced in the state of California. If they were we probably won't have this situation.
We have several standards for NGOs under the FASB relating contributions revenue recognition and the disclosures regarding related party transactions so as an auditor we simply just check for those (depending on the engagement type tbh).
If you wanna knock yourself out in the mountains of information, go for it, nothing ventured nothing learned.
Another VERY BIG RED FLAG is how indie land served as a SPE for open hand foundation and some expenses of indie land were paid by OHF, rings a very nostalgic bell *ahem* enron.
Tax wise when filing with expenses you have to be elaborate on the nature of expense.
Governance and ethics wise: the board members are required to question everything based on the stewardship relationship they have with donators.

This situation is exactly how charities get "scammed". A trusted member of the org collects the money, but instead of making the donations, just squirrels it away somewhere (usually only a small amount at a time) and then makes off with the whole stash after a few years. It happens again and again when people don't have a trustworthy accountant or take a look at their charitable organization. So yes, this IS on Jirard for not looking into this sooner or doing anything with it. If I was a company like say.....For lack of a smaller one coming to mind, Razer. I'm prepared to drop 10,000$ and dedicate a portion of all item sales during that stream to his charity. If someone came up to me and said he had been "waiting to find the right charity" while collecting almost a million dollars? I would immediately back out. And the sad part is - I wouldn't be surprised if some potential sponsors did.
That to me is the true failure - this lack of oversight is probably costing an otherwise noble endeavor even more resources because they lack the means to steward these donations properly and with correct documentation.

To everyone who is running to the Completionist's defense, I only ask you this: If Jirard is not guilty of anything, then why is he acting guilty as shit?!
All Mutahar and Karl did is ask him one simple question: "Why didn't your donate the money like you said you did?"
What Jirard and the foundation did was _immediately_ start covering their asses in dubious lawyerspeak and Jirard spewing complete and self-contradictory bullshit in that call they had. Then right after this he tried to _fraudulently_ get the videos removed, and when that failed he just completely clammed up. Not a peep from Jirard or his -mafi- organization ever since. No statement, no "hey guys, we are working on a response" or even "Hey we are donating all this money to [charity]", nothing.
The question right now is: Did he or did he not know where the money was for a DECDADE? IF he did not, that's gross negligence _at best_ . If he DID know, it's plain fraud.
He was constantly soliciting charitable donations using his dead mother's suffering and constantly namedropping organizations he apparently never worked with and _demonstrably_ never gave a single cent to. That's fraud. Even if the money is still there (which is _very_ doubtful at this point) that means the foundation did absolutely *nothing* for ten years. So what did all those tens of thousands of dollars of "administrative costs" go to? Clearly not towards facilitating dementia research, so...what?
Mutahar and Karl didn't accuse anyone of anything, they just pointed some very relevant questions, to which we do not have _any_ answers so far. So anyone questioning their motives I suggest to ask Jirard to answer for these before casting the first stone. You know, due diligence n stuff...

Let's take a more measured look at this situation.
It's easy to jump to conclusions when someone reacts defensively, but being defensive isn't necessarily a sign of guilt. People can respond in all sorts of ways under pressure, especially when their reputation is at stake. It doesn't automatically mean they're guilty of something.
Regarding the lawyerspeak and contradictory statements, it's pretty standard for individuals and organizations to be cautious in their communication when legal matters are involved. It might come off as evasive, but often it's about being careful not to say anything that could be misinterpreted or used against them in a legal context.
The silence from Jirard and his organization can be frustrating for those looking for answers, but it's not uncommon for people to withhold comment while they're figuring out the best way to respond. It doesn’t prove anything by itself.
The accusations about misusing charitable donations are serious, and if there's truth to them, that's definitely concerning. However, it's important to remember that these are still accusations at this stage. Without concrete evidence, it's unfair to treat them as facts.
In terms of administrative costs, it's valid to question where the money has gone, especially if it's a significant amount. Transparency in financial matters is crucial for any organization, particularly a charitable one.
While Mutahar and Karl have raised some important questions, it's crucial to approach the situation with a mindset of seeking the truth, rather than jumping to conclusions. It's always better to wait for more information before forming a definitive opinion on the matter.

If the IRS takes notice of this, Jirard is likely finished.
I'm willing to bet the Nintendo eshop stuff where he spent like 22K was taken directly from this account. It's just a large enough amount that I doubt he had it lying around anywhere else. Cause he's been aware of it since 2022.
The eshop video is from the beginning of 2023.
The thought process was likely that Jirard would just top it back up over time & pretend it was never spent. That's still fraud but I can see the 'mean no harm' idea. But I doubt he's topped it back up yet.
Basically, they caught him in time.
If he didn't record that in his tax filings, that's fraud & he will be charged. An audit looms over him.
I don't think you understand how seriously the IRS takes this stuff. It's their job to make sure the government ain't being lied to. And they're often good at it.
