NIKAH - Literally the act of sexual intercourse, nikah is the term by which marriage is referred to in the Qur'an. Islamic law defines nikah as a civil contract whose main function is to render sexual relations between a man and woman licit.

Nikah halala is one of the most bizarre and revolting aspects of Islamic law. Nikah means sexual penetration, and halala means to make something halal, or permissible. This type of Nikah is based on Quran, Surah Al-Baqarah, verse 230 and Hadith Sahih Bukhari, volume 7, book 72, number 715.

So if a husband divorces his wife ˹three times˺, then it is not lawful for him to remarry her until after she has married another man and then is divorced. Then it is permissible for them to reunite, as long as they feel they are able to maintain the limits of Allah. These are the limits set by Allah, which He makes clear for people of knowledge.

"Narrated Ikrima: 'Rifaa divorced his wife whereupon Abdur-Rahman married her. Aisha said that the lady came wearing a green veil and complained to her (Aisha) and showed her a green spot on her skin caused by beating. It was the habit of ladies to support each other, so when Allah's messenger came, Aisha said, "I have not seen any woman suffering as much as the believing women. Look! Her skin is greener than her clothes! When Abdur-Rahman heard that his wife had gone to the prophet, he came with his two sons from another wife. She said, "By Allah! I have done no wrong to him, but he is impotent and is as useless to me as this," holding and showing the fringe of her garment. Abdur-Rahman said, "By Allah, O Allah's messenger! She has told a lie. I am very strong and can satisfy her, but she is disobedient and wants to go back to Rifaa." Allah's messenger said to her, "If that is your intention, then know that it is unlawful for you to remarry Rifaa unless Abdur-Rahman has had sexual intercourse with you." The prophet saw two boys with Abdur-Rahman and asked (him), "Are these your sons?" On that Abdur-Rahman said, "Yes." The prophet said, "You claim what you claim (that he is impotent)? But by Allah, these boys resemble him as a crow resembles a crow.""

Narrated Aisha, Ummul Mu'minin: The Messenger of Allah (ﷺ) was asked about a man who divorced his wife three times, and she married another who entered upon her, but divorced her before having intercourse with her, whether she was lawful for the former husband. She said: The Prophet (ﷺ) replied: She is not lawful for the first (husband) until she tastes the honey of the other husband and he tastes her honey.

There was an incident from Aligarh Muslim University in India where a young guy told his father like muslim professor that he has divorced his wife by saying talaq talaq talaq and he was too afraid and ashamed to perform halaala as they wanted to get back together.
The old professor offered himself and told his young student that he will perform nikah halaala. Also, since he was so close the the male student he assured him that no one will know about this.
The young man was happy. He thought he will not have to get ashamed in front of the society and he will get his beloved wife back as well. So he agreed.
Then the old muslim professor got married to the young beautiful wife of his young student.
Next day, the student went to the professor to ask him to complete the talaq formalities so that the young man and the young woman can get back together, but the old professor refused and said "NO, now this young pretty girl is my wife and i will never divorce her as long as i am alive".
The End
She still has a solution. She can dump the old horny ass professor by leaving Islam. That way she will not be subject to the Islamic civil code of marriage in India. The problem with Muslims is that they are always extremely terrified of Allah who can put them on the Hell-fire after death. By leaving Islam she can get freedom from the fear of Hell-fire.

(This much is true, and was also the case in Europe: five centuries after Muhammad’s marriage to Aisha, 33-year-old King John of England married 12-year-old Isabella of Angoulême.) Interestingly, of the many criticisms of Muhammad made at the time by his opponents, none focused on Aisha’s age at marriage.
According to this perspective, Aisha may have been young, but she was not younger than was the norm at the time. Other Muslims doubt the very idea that Aisha was six at the time of marriage, referring to historians who have questioned the reliability of Aisha’s age as given in the saying. In a society without a birth registry and where people did not celebrate birthdays, most people estimated their own age and that of others. Aisha would have been no different. What’s more, Aisha had already been engaged to someone else before she married Muhammad, suggesting she had already been mature enough by the standards of her society to consider marriage for a while. It seems difficult to reconcile this with her being six.

The Islamic calendar is shorter than the regular calendar. It means that she was younger than six years old.

This can be further understood from the verse; “And test the orphans until they reach the age of nikah (marriage), and if you find in them rushdh (maturity of intellect) release their property to them.”(4:6). It may be noted here that the Quran makes intellectual maturity (which always falls beyond the age of puberty) the basis to arrive at the age of marriage. This is also in conformity with the Quranic description of marriage as emotional bonding between two mutually compatible persons through which they seek “to dwell in tranquility” (see 7:189 and 30:21) in the companionship of each other which is not possible if either of the spouses is mentally undeveloped.
This hadith cannot be true for several reasons. First, the Prophet could not have gone against the Quran to marry a physically and intellectually immature child. Secondly, the age of Hazrat Aisha can be easily calculated from the age of her elder sister Hazrat Asma who was 10 years older than Hazrat Aisha. Waliuddin Muhammad Abdullah Al-Khateeb al Amri Tabrizi the famous author of Mishkath, in his biography of narrators (Asma ur Rijal), writes that Hazrat Asma died in the year 73 Hijri at the age of 100, ten or twelve days after the martyrdom of her son Abdullah Ibn Zubair. It is common knowledge that the Islamic calendar starts from the year of the Hijrah or the Prophet’s migration from Mecca to Medina.
Therefore, by deducting 73, the year of Hazrat Asma’s death, from 100, her age at that time, we can easily conclude that she was 27 years old during Hijra.
This puts the age of Hazrat Aisha at 17 during the same period. As all biographers of the Prophet agree that he consummated his marriage with Hazrat Aisha in the year 2 Hijri it can be conclusively said that she was 19 at that time and not nine as alleged in the aforementioned hadiths.

This is because of the belief of Muslim theologians (particularly the Salafi ideologues, commonly known as the Wahabis) that hadiths have an overriding effect on the Quran. One such preacher Abu Ammar Yasir Qadhi has the temerity to write in his book, An Introduction to the Sciences of the Quran, that the Sunnah of the prophet can abrogate the Quran.
The truth is that the Quran being the locus classicus of Islam, no authority can supersede it. Even the Prophet was commanded to judge by it (4:105, 5:49, 6:50, and 7:203). Furthermore, as the Quran claims to be a guide for all periods, it supports the notion that any law formulated on the basis of its framework has to evolve from time to time.
