You know what, I'd do that, if it's a shop and Joe's a plumber, I'd order pipe, fittings, maybe a boiler and just walk out with them, they've committed fraud anyway, in fact I'd use the mini to pick the stuff up,ha,ha.
Put it on the company books, use it as a courtesy car or runabout and depreciate it as heavily as your accountant will let you over the next year to offset your business taxes. Hopefully by then the finance will have been paid and 🤞you’ll be able to offload it. Good luck.
He wouldnt win in small claims. The original buyer is still paying the finance. What judge is going to find in favour of the dealer who basically messed up his deal?
Agreed, using it as a service loaner or similar would be the least miserable solution. I would definitely run it by your attorney to ensure you’re not opening yourself to any sort of liability. $1900L is not that bad of a lesson in the big picture. I’m sure no one will forget to clear liens in the future! Peace my friend, DrRick
Discovered your channel today, absolutely love it and your honest, straightforward content is refreshing and helpful. Hope you get the Mini Van issue resolved soon, it’s a cool car (van), must be a future classic.
Stick some company signage on the side windows and use it to pick up parts or just as a PR vehicle to runaround. Still be worth the PX you paid in a year.
not sure if you7 can insure a car on your name with finance still outstanding (albeit being paid) on another persons name. in the event of a crash there would be a headache between the various companies on the legality of driving it knowing it's financed up on someone else's name. who do they pay out etc?.
As I see it, it Close Bros’ problem. The car was on hire purchase in which case it is Close Bros property until the finance is paid off. Close Bros need to take action against the plumbing company who have, as I understand it, illegally sold the vehicle. Get back onto Close Bros mate. I am sure you cannot sell a car on HP - even if you are continuing to make payments. Surely your legal people can advise on this. I would imagine this is a common problem. Good luck with it Joe.
You're a business, that has a use for a van. To go through all the scenarios you mentioned, the time scale would be close to 12 months anyway. Keep, use it, then revisit in 11 months.
Jo, To keep this basic and uncomplicated. 'Knowingly selling a car with outstanding finance to a buyer without informing them is fraud' so this is a police matter as they did not tell the last owner there was still finance owing, or that it had been paid off. Chris
Ouch! Need to get those internal processes sorted maybe to have a checklist for buying cars or PX that has to have the vehicle check behind it maybe? Gutted for you & thanks for sharing the good and the bad news! 👍
Sometimes things don’t go the way we planned and you can either spend a load of time worrying about it or just put it down to experience, which in this case is probably the best thing to do. At least it’s a car you can drive for the next 12 months and even if you then sell it at a loss you’ve had good use out of it, which will then no doubt balance things out. It’s not necessarily the mistakes we make but what we do, so we don’t make them again that’s important.
Hi Joe I would definitely keep it for the next 12 months as a company or courtesy car. It looks a nice little mini Around Preston where I live there's a lot sign written for advertising there businesses so that could be an option also. Could you not diversify it into your 0:16 plumber business as a van?. All the best Shaun
Sticker it up as a Berrow motors vehicle as advertising , use it as a business runabout and maybe use it as a customer courtesy vehicle , oh , and let Sophie collect hay bales with it ?
Use it as a shop van going for parts and such like stick a sign on it put it on the books let the accountant sort it out regards tax. As soon as it is clear either sell it or keep it as a shop van.
Keep hold for the 12 months you mentioned , use as a mobile detailing/valet unit and offer 1 free home visit valet (usable within 6 months) if it earns it keep then hang onto it , if not flog it after 12 months , worth a go .
When did the plate change happen? If recent could the outstanding finance not have shown yet when you did your check? I'm suspicious that the plumbing firm may have needed some cash quick.
Hey Joe, thanks for the mug and air freshener mate and also the keyring you added as extra! Top man, will have my brews in the new mug watching the weekly’s on a Sunday morning.
Joe, st1t happens, could be worse Looks like a good runner and shame that its gonna lose value so may as well use it as a courtesy car while it sorts itself out and learning point for the future Keep up with the honest and transparent videos - so refreshing and always insightful 👏
Ask Close Brothers to convert the hire purchase agreement the plumbing company has into a loan to the plumbing company as they have breached the terms of the agreement ie sold the vehicle. But if that doesn’t work providing they are paying the agreement id just keep it as a courtesy car.
Another good honest video. You always come across as a really genuine guy. - I'm a bit confused, though, as to why you took the car in P/EX when you knew at the time (because you checked it) that it had finance on it? Why didn't you just the seller 'sorry. we can't accept this as P/EX.' Am I missing something?
My understanding from working in HP finance is that if you buy a gar from a garage it cannot be repossessed as you are protected. However if you buy the same vehicle off an individual the bank can take it back.
What happens if you drive it and have crash. insurance? Will pay the finance off before you get sorted, and you still will have an insurance clame against your policy. The depth holder will owe nothing! Anyway, good luck with your choices. It's nice to see honest trader for a change
Had a similar experience and contacted the MD of the company (via LinkedIn). Someone who owns the company would be interested in the fact that they are paying for something they dont own anymore. The person at the top would definitely want to know and do something about it
It’s probably a one man band and the boss/owner knows very well the situation. I agree this very small company had short term cash problems and wanted instant money to pay off a debt but wants to keep his credit rating intact. You have created the current problem and I agree with others on here you have to take a hit, use the van for your company hack until the finance is paid up then out it for whatever you can get.
I’m surprised it hadn’t sold as Clubvans seem to attract a premium because they are a car derived van and so can be quite tax efficient particularly if you don’t want to drive an actual van. Any that I have kept an eye on locally usually disappear quickly. I wonder if the reason why the plumbing business are paying the finance is they don’t want a black mark on their credit history but perhaps needed the cash at the time? I think a previous comment suggesting messaging the MD via LinkedIn is a good one…. Be a shame if they got all their credit/banking facilities called into question over a couple of grand of outstanding finance 🤔. Good luck sorting it and thanks for the awesome videos.
Pretty sure their existing banking suppliers would like to know what they do with property that's not theirs whilst breaching their finance agreements... Could imagine it'll be quite hard for them to future finance...
I love your videos this one in particular is a must watch. You deserve to be a successful second hand car dealer and a successful social Media influencer. Keep these videos coming wish you well. Your no Arthur Daley thank goodness. 😜
Small claims court is a pain in the "you know what", good luck with that one. Put it down to one of those things, and use it until the finance is complete would be the sensible option perhaps.
Use it for the next 12 months has the "Lunch" van - everyone takes it turns to taking the luch time orders - and picking parts up would be a good one too. Then after the 12 months just lob it over to BCA - problem sorted.
Agree with some of the other comments - its a rare thing - get Quicksign to brand the whole car in 'Berrow Motors' signage and use it for a year. I'll be sure to give you a wave when ever i see it :)
These Mini Vans are pretty scarce, I think cool (what do I know?) and should be a future classic. I saw it several months ago on your site though and thought it massively over priced. Pretty sure you could not take the plumbing co to small claims as you do/did not have any sort of agreement or contract with them. It's a smart looking car. I'd quite like it.
Is it on HP ? If so, when the plumbing company sold it & didn’t close off the finance, the agreement should have been terminated by Close as the t&c’s have been broken … Close should be chasing the plumbing company for settlement.
Perhaps. But as the original party is still paying the monthlies'. I doubt Close really care that much; although they should now be doing an update on the plumbers credit rating. Disposal of property still subject to finance is a serious breach of their T&C's, and certainly worthy of a note on their credit file for sure...
You’ve said before you have a plumbing company. Is the van any use to that as an asset for a year, or is there an apprentice coming through who’d take it off you in the future? Failing that, raffle it with a ‘reserve’ amount of tickets to guarantee covering all costs. Or drive it through the window of the plumbers merchants. If you can’t have the money, neither can they.
I am surprised your lawyers didn’t have the answer. Ask the guy who sold to you to assign the contract breach and loss to you, then threaten the plumbing company for fraudulent contract breach. If you sell a vehicle representing that the loan will be paid off immediately after sale and then you don’t do it the loss suffered by the new owner is recoverable in contract law. I think it is maybe too late to demand the rescission of the contract but you have 6 years from the default to peruse an action.
But it's not currently in default in terms of payments, but is in terms of breach since selling it on without settlement is I'm sure would be a breach of the finance agreement/contract... Like others have said, if the payments are being made, then the finance house has no incentive to kick off, so they won't.... Rubbish situation really.. Joe really needs to tighten up his procedures as this is a silly mistake to make...
Use it for a year, like your attitude of it happens to the best of us and get in with it. I personally like it would do me good for my detailing stay up. Good luck with what ever you decide
Hi joe , I'm not in the car trade. I think your only option to soften the financial blow is to use it with a bit of company livery on until they have paid it off. But then again, wtf do I know. Great channel. Thanks for your regular vids😊 Mark
I’d get some Berrow Motors or Shifting Metal sign writing on the van in old 60s style writing. A bit of free advertising while you’re picking up parts. Make a bit of fun out of it.
Your man Jason is a liability , reduce car prices at weekly review , works with scraps of paper - are you surprised this was missed , it’s not your mistakes that are costing your business . Accountability drives Perfomance achivement .
Can you convert it into a five seater and add rear windows? It can add value to the car. We can legally do that in Turkiye and change the vehicle type on the register docs.
Hi great videos, tough situation, anyone who gives you grief over this either is'nt in the trade or are lying we have all done this stuff it happens, keep it use it register it and right it back as an asset for a year.
Use it as a courtesy car. It would be a nice touch. Rather than get the usual ropey BMW with a million miles on, they would get a nice Mini to run around in
That's a strange one . Because I had a car on finance through moneybarn . And I accidentally signed it over to my step son on the V5C a week later he gets a letter from moneybarn, alerting him to the fact that he was in possession of a car still under financial interest with them and was he aware .
Out of curiosity, how long do cars stay on the forecourt? I ask because in early 2022 I bought a Nissan Note (don't judge me) from a local garage. At the time, the garage owner steered me towards an 18 plate Nissan Juke but I needed something with more luggage space as I was transporting my daughters to their universities. Anyhow, I happen to pass that garage regularly and that Juke is still sitting on the forecourt nearly three years later - I look out for it every time I drive by. It even stays in the same prominent spot closest to the road. Surely that means it's overpriced? Would they not want to shift their stock quicker? It can't be good for a car to sit around for that long. I think it was £12k back in the day and now sports a £10k tag, but surely something that hangs around for a while gets marked down to move it on... or something??
Sadly this shows the flaws in the on-like vehicle check sites. No way should the vehicle been sold without the lien transferred or paid off. In the USA states, we have a separate title document from the registration (like your V5) that has to state any lien holders. The lien holder has the original of the title document until the loan is paid off and they stamp it paid before it goes to owner.
I've bought finance repos and dvla seizures, the original lender can clear it on hpi, maybe close could give you a clean bill and persue the plumbers. Id be getting it sorted, in a year or if they stop paying it'll be worth a lot less.
Shame about the Minivan. The risk of keeping it for the next 12 months as a general runabout and maybe a courtesy car is that if the original company decided they're no longer going to pay the finance as they don't have the van, then you'll be left with an even bigger headache. My best advice would be to sort the finance, and raffle it off to recoup some of your losses. I think you'd be surprised by how many people will buy tickets, I certainly would. This van is useful as a dog carrier, or someone setting up as a parcel delivery courier.
Keep it for a year lesson learned Genuine mistakes happen but we all know the “ plumbing company “ or a man without a mini van is never going to pay it off Smart we van as well
Ooo, that’s an interesting one..! If you use it, the value goes down, if you don’t use it, the price goes down. If you sell it, you will need to pay it off, you looses money, if you use it and right it off, they get paid. Fortunately, it’s a relatively small about of money, in the great scheme of things. But at £160.00 per month, it’s not going away anytime soon.
Perhaps if your checks show finance outstanding on potential part exchanges then do not accept it as an exchange until it shows as cleared. All cars eventually sell, it may lose future sales but then you will not end up with a headache as this is. I know gate, horse, bolted.
The standard is for the buying dealer to directly settle the loan as part of the exchange, this way they 'know' the agreement has been settled... Most people don't have the funds to settle early, thus rely on the dealer doing the deal to also settle their finance as part of the transaction...
Tugboat would probably like the space in the back, with the guard in place, you could use it for work and dog walks, and when finance is settled, sell it on.
Just bill the company, after 30 days county court action, you can do it on line so it's not really a hassle, it's an open and shut case. Pay the finance off and sell the mini, even if it's mthly payments you'll probably get the money, tbh sounds like the plumbers want to keep their good financial standing as they're paying the loan.
How can they take the plumbing company to court when they never had a contract with them? Also they took this in part-ex knowing it had outstanding finance.
@QuattroUK2011 pay the finance off, send the plumbing company a bill for that figure, send a reminder, send a letter before action, then do a county court claim on line, plumbers probably won't want an unpaid ccj against them, just because berrow have made a mistake doesn't alter the fact that it's basically fraud on the part of the plumbers, it's all fairly straightforward, money claim on line, only takes a few minutes. Tbh I'd be over there in person as soon as it came to light.
@@roystonvehicles9129 as I said before they took the car in part ex KNOWING it had outstanding finance... I don't think they have a leg to stand on. Not sure on the fraud part but if it is fraud then they didn't comit it against Berrow so they have no claim against them... the original person who got the car off them maybe.
@@roystonvehicles9129 I get that my friend... I am only playing advocate for a court scenario :) Your suggestion will certainly prompt the plumbing company to pay off the finance or chase the finance company if they have already paid.
The accountant aka sister might say use it as a company vehicle and write it off under depreciation....or....or...advertise YOUR plumbing business on it ?😂😂😂❤... and send tthem a pic...🤪🤪🤨... or ...or...cut it down the middle put it your wall with the slogan we only own half of this car 🤣🤣🤣🤣🤣🤣🤣...cheers ❤ the content Joe keep up the award level vlogs.. ...👌🤘👍
We had this when we had our garage, we hpi checked A P38 RR vouge V8 at the time the value was arout £8000', it was awaiting a new becm and keys that took about 4months,we sold it immediately to a police officer and he had it checked and came back finance outstanding, can you believe we bought it from a finance company repossession 😂
Holy Cow! What was the original owner for?!!! delevring Moet Champagne, and Beluga Caviar with some Pate Fois Gras? LOL! Look up the Krug Champagne Rolls Royce delivery 'van' :-)
It’s actually a cool little van , stick it up at a big silly price £6500 and use the van for your business , in the meantime keep trying the plumbing company- you never know and if someone randomly wants it the settlement might be cheaper and just sell it and take a smaller hit - it’s not fair but you didn’t do the due diligence on it either .
settle the finance and then try to re-coup through small claims money claims route, to be honest it's very easy to submit your claim, but and you will need to pay for the court fees in advance £115.
What claim? They knew it had outstanding finance when they took it in part exchange... there is no claim to answer it's just a costly mistake... sometimes you need to accept you screwed up.
raffle it Joe and make the tickets cheaper. Great wee van that with a great spec. Pay off the finance with the profits and get some or hopefully all of your money back. Id enter that comp.
When the time is right put it up for comp', I'll roll a dice on this! Will be a good wagon for one of my twins, she has a dog called Pip who would love to be in hauled around in the back of that MINI.
Keep it and run it down over the 12 months as a courtesy car as other people are saying and then get rid of it. Human error but something which can be done to resolve this is also to do it as a rental...👍🌞. Best of luck with it Joe and the gang.
Definitely keep it for a year as a courtesy car OR put it on car sharing platform like Turo and rent it out for a year and let the car/van earn its keep or depreciation for the year.
The law on this should be simple in a way that the car cannot be sold whilst finance is outstanding or if an owner flogs a car that has outstanding finance, they are liable to the finance company and not the new owner.
It was always the case if you had a car on finance you could not sell it until it was officially fully paid off and until then it is the property of the finance company.a guy I once knew sold his car knowing it was on finance and the company chased him for the money
In your situation I would keep hold of it and use it until someone somewhere stops paying for it and deal with it when or if that happens. If you get 12 months down the line and someone else has paid it off and you've got a year out of it then send it to auction.
It is a no brainer. keep it as a company car until the finance is paid off. No other sensible option and it is a useful and cute car for your guys to use.

Perfect solution, also could hire it out to anyone who needs a one or two day van use
Might as well use it, Joe. No point in giving yourself a load of grief in the small claims court.

Company van 👍
Use it ,I was in business for 30 years and the small claims court is a waste of time and money
That van is rare, stick your advertising on it and get it driven about until finance is cleared off or do a spot the van comp around the country 😊
I agree, take it to local shows to help promote your business even a mini camper van conversion.
Slap some Berrow Motors / shifting meatal signage on it and that can be a shop van
Trotters Global Trading?
"Trotters Global Trading"?
@mbak7801 exactly what i was thinking. Wraping would be awsome

The police won’t even respond aside from a crime reference number. They’re too busy arresting people for comments on X for thought crime.

Not a good one maybe you could convert it into a camper for dwarfs lol
But it's not currently in default in terms of payments, but is in terms of breach since selling it on without settlement is I'm sure would be a breach of the finance agreement/contract... Like others have said, if the payments are being made, then the finance house has no incentive to kick off, so they won't.... Rubbish situation really.. Joe really needs to tighten up his procedures as this is a silly mistake to make...
Use it for a year, like your attitude of it happens to the best of us and get in with it. I personally like it would do me good for my detailing stay up. Good luck with what ever you decide
If they can't be bothered to stop the payments, and you've told them, there's not much else you can do. Just use it as the garage runaround.
If it only has 12 months on the finance to run, and you are not paying for it, run it around to pick up any spares you need and pick up your lunches
Problem is when will the person decide to stop paying
Hi joe , I'm not in the car trade. I think your only option to soften the financial blow is to use it with a bit of company livery on until they have paid it off. But then again, wtf do I know.
Great channel. Thanks for your regular vids😊
Mark
I’d get some Berrow Motors or Shifting Metal sign writing on the van in old 60s style writing. A bit of free advertising while you’re picking up parts. Make a bit of fun out of it.
Go and knock on the Plumbers Company door without telling them be brave and get it sorted, you will better for it.😎
They close the door in his face. What does he do then? Duh.
@@Mike7O7Okeep coming back every day to the house to the business keep leaving reviews
I doubt he has the time for that. @@KeyBrosUK
@@Mike7O7O Then visit every day until they do at least they will know he means to resolve the problem and is not a soft touch.
I’d get Berrow Motors sign writing on the van in a 60s style and keep it as a workhorse picking up parts and stuff. A bit of free advertising.
Rather than get the usual ropey BMW with a million miles on, they would get a nice Mini to run around in
The easiest and most sensible thing to do would be to use it as a runaround for service/courtesy and write the cost back in the books month on month.
Joe like many have commented use it whack some Berrow motors signage on it and use it to collect vehicle parts, business run around and dog van.
That's a strange one .
Because I had a car on finance through moneybarn .
And I accidentally signed it over to my step son on the V5C a week later he gets a letter from moneybarn, alerting him to the fact that he was in possession of a car still under financial interest with them and was he aware .
Courtesy car, parts, advertising van for you. Get a nice wrap on it; they can really stand out with the right wrap.
Looks like a perfect mobile dog basket. My father has a Skoda Fabia estate for the dogs & an Octavia VRS for not smelling smelling like a dog
Dirty dog owners.
Close are being paid. The plumber obviously wants to avoid a criminal conviction. So Close have no motivation to do anything.
@Mike7O7O yes bud
Just use it as a courtesy car or something within the business coz any other option is a headache & when the finance is settled reassess.
Great video thanks for the honesty nice one ❤
Shame about the Minivan. The risk of keeping it for the next 12 months as a general runabout and maybe a courtesy car is that if the original company decided they're no longer going to pay the finance as they don't have the van, then you'll be left with an even bigger headache. My best advice would be to sort the finance, and raffle it off to recoup some of your losses. I think you'd be surprised by how many people will buy tickets, I certainly would. This van is useful as a dog carrier, or someone setting up as a parcel delivery courier.
Keep it for a year lesson learned
Genuine mistakes happen but we all know the “ plumbing company “ or a man without a mini van is never going to pay it off
Smart we van as well
Ooo, that’s an interesting one..!
I love the little Clubvan too...
Sit on it IMO, won't depreciate much further in the next year and you can use it in the mean time.
@QuattroUK2011 only making a comment bud, it makes no odds to me, if you look it up, selling a car that's still on finance is a fraudulent act.
@@roystonvehicles9129 I get that my friend... I am only playing advocate for a court scenario :)
Your suggestion will certainly prompt the plumbing company to pay off the finance or chase the finance company if they have already paid.
Sell it privately via a mate - any issues later on ,if worried can always buy it back.
Use it Joe, looks like a handy van for the dog's as well.
I'd sticker it up with silver or white Berrow Motors graphics and run it yourself tbh or use it as advertising.
settle the finance and then try to re-coup through small claims money claims route, to be honest it's very easy to submit your claim, but and you will need to pay for the court fees in advance £115.
They have no contractural relationship with the finance holder, they would have to hit the part ex customer
@@DashDriver-z1r the part-ex customer has no case to answer.
What claim? They knew it had outstanding finance when they took it in part exchange... there is no claim to answer it's just a costly mistake... sometimes you need to accept you screwed up.
Use it to get value from it as a loaner couresy car / assist the business until you can shift it, its a blancing act between usefulness / loss
raffle it Joe and make the tickets cheaper. Great wee van that with a great spec. Pay off the finance with the profits and get some or hopefully all of your money back. Id enter that comp.
Company Car for Toby 😊 Media Van. Wouldn't let it stress you though everyone makes mistakes we are all human.
Great consumer information but I have no idea what I'd do. Any idea how long it will take them to pay if off? If you're lucky
it won't be too long
Brand it up and use as a merch van at 2025 car shows?
Definitely keep it for a year as a courtesy car OR put it on car sharing platform like Turo and rent it out for a year and let the car/van earn its keep or depreciation for the year.
Surely it would make a fantastic mobile valeting van for the lads to expand their offerings and another revenue stream for Berrow Motors.
They did this before and stopped
What a great channel, would absolutely buy a used car from this guy 10/10
I think the only thing you can do is use it as a customer service vehicle or runaround until it’s lien free and consider it a lesson learned.
Yes but the plumbing company are still paying the finance so why should the finance company care?
In your situation I would keep hold of it and use it until someone somewhere stops paying for it and deal with it when or if that happens. If you get 12 months down the line and someone else has paid it off and you've got a year out of it then send it to auction.
Keep it running and use it to drop off and pick up. Weston wheels will be a regular trip
It is a no brainer. keep it as a company car until the finance is paid off. No other sensible option and it is a useful and cute car for your guys to use.
Id have a go at the van on a raffle too. Especially if you chavved ut up a bit with some jcw bits
Hi Joe,
As you say, shit happens. I'd keep it and use it as a shop vehicle until the finance is cleared and then sell it.... or Raffle it 🙂
