( figures from Scotland Government website ) unlike England and Wales , the latest figures are for 2022 and they rose from lowest in 2020 due to covid( 50.00) to 77.000 in the year, , so 1500 average per week , 94 % were found guilty , the total for this year is expected to rise to 100.000 , TVL are currently advertising vacancies for more Enforcement Officers ,

14:00 we told the BBC/Capita we no longer needed a TV licence 3 years ago and still get a letter a month, sometimes more often. They changed to "The Legal Occupier" after a year. I use them as firelighters.

Be careful with emails from solicitors during conveyancing. There have been many instances of solicitors' email accounts being hacked/spoofed and telling clients that the solicitor has new bank account details and directing the client to send deposit/completion monies to that new account. If there is even the faintest doubt about authenticity ALWAYS double check by phoning the solicitor direct before parting with any money.

If I do hear from them again while living at this property then there will be a charge of £xxx.xx to reply and if they agree with that charge then all they need to do is send a letter after 2 years.
By withdrawing the applied right of access they can no longer call at your property by doing so they would be committing trespass and if they do so again it’s committing aggravated trespass which can carry a prison sentence

Wish they would and I think it would help saying what live TV is. Not just blurting out the TV stations. For example if a program Has an advertised start time then it is live including plus one which also advertise a start time.
Since cancelling my tv licence 5 months ago only thing I miss is watching the live sports on tv but I can still listen to the sports on the radio instead for free as it’s a lot cheaper than having SkySports and BTsport subscriptions, it would be better if the BBC went subscription only then the tv licence wouldn’t be needed to watch the non BBC tv channels as those that want to watch the BBC they can pay the subscription fee and leave us alone for those that don’t want to watch the BBC, it’s a disgrace that people have to pay a tv licence to watch the other channels as they been broadcast live on tv even if they don’t watch the BBC

It's clearly obvious millions of people have cancelled their TV license; there are about 150,000 houses built every year in the UK with the population increasing by slightly more than that...that will have more than covered the "freeze" in prices therefore there must be far in excess of this cancelling/not paying given how sharply they've been cutting costs.

I canceled my licence two years ago. A couple of weeks ago I received a ‘no licence required’ letter which I ignored, just got another saying they need to hear from me by 17/5/23 or the address will be treated as unlicensed (surely they wouldn’t have to send a letter in the first place because they KNOW I don’t have a licence🤔🤔🤔) and they may have to open an investigation and schedule a visit (I’m waiting for a similar letter from the DVLA asking me if I need a driving licence)😂😂😂. The letter is addressed to me, not the occupier, they want to know my address, telephone number and email address…do I, a.) completely ignore it again b.) respond but, apart from address and name, give a false email and telephone number (why would they want these they know where I live) c.) respond as b.) above but with a false name as well d.) just fess up all my correct details and just hope they’ll not bother me for another two years …any advice would be welcome😂😂😂

Today I was at my brother's flat in Braintree to see how he was getting on and the TVL turned up like flies to 💩 demanding to come in as they can hear the TV on? So I went to the door said to the guy, "sorry sir just moved in and replied to your letter that was already sitting here before moved in, so your records is out of date, if you like to know who I am then go check your with your office" I had already seen this guy in Saffron Walden a little while ago with a drone looking into my friend's place, also in a friend's place in Laindon, I've had to check my car and everything as it feels like they have apple tag me or something as it seems this guy is following me everywhere I go? Can these ‘enforcement officers’ working for TV Licensing, get a Court Order to enter the premises, purely on the say-so of a third party? In other words, you have cancelled the license and truly don’t watch live TV or use the iPlayer, but someone (anonymously or otherwise) contacts them to say you do.
No , and they probably wouldn’t try , they would visit and try to find any evidence , if they did would be a summons to court , They rarely go for warrants , less than 100 a year and most warrants are for frequent flyers who have been summoned probably more than once , Third party hearsay evidence whilst considered is at best unreliable ,

I work nights, sleep by day I purchase my favourite series, mainly CSI Los Angeles. Why do I still feel like a criminal?
It took my partner 3 years to get me to cancel the TV licence. I eventually did. We've been licence free for 2 years and never looked back. I did ring them and got a £52 refund. They do keep sending letters saying they are going to come and visit or I need to ring them to let them know I still don't need a licence. Do you have to keep informing them?? I know what to do. The "other methods available" is likely to mean an application for a warrant and, if TV Licensing can convince a magistrate that WOIRA may have been used to cover TV licence evasion, they are likely to get one. The solution to that, is to report each letter as harrasment, write the crime reference number and date on the letter and file it. When you get to, say 5 letters, you send a cease and desist letter to the BBC, with the crime reference number and the dates listed. Then you do the WOIRA. So to use the WOIRA to get the warrant they have to make a full disclosure. If they don't reveal the crime reports, the cease and desist, then in my view they are guilty of contempt of court. That would really screw them
@@Nickle314 First, someone in authority would have to agree with you that the letters amount to "harassment". A crime reference number is only given in the case of a suspected crime. Given that these letters have been sent for years, clearly without successful legal challenge, that is very unlikely, so "cease and desist" letters etc. would be a waste of time, effort and and money. A full disclosure that WOIRA has been used to deny access may be the only reason a magistrate needs to issue a warrant. I would not advise anybody to follow your advice.
@@anonnemo2504 First, the reference number. Report via a police website, you get the reference number. No one involved. Second, its victim lead. Read the rules, the victim gets to decide, not the police. Home office counting rules are your start point. The question, how do you get a search warrant. You have to lay evidence before the magistrate. Leaving off major evidence such as a cease and desist letter, WOIRA letter. Being selective in what you use, is contempt of court. Gets lawyers into major problems. You can also check the Bar Council or solicitor's regulatory body. PS, as they say, its not my first rodeo on baristers. I've had two disbarrred.

I would assume that people who are doing the WOIRA thing, would be doing so in the hope that TVL fall foul of the law by not adhering to the WOIRA as it is intended. Thus making more of a case for the removal of Capita as the 'heavies' for TVL enforcement. Show that they're not doing the job legally sort of thing. Because let's face it, if a massive majority of people did do the WOIRA it would cause no end of problems for the enforcement agency/s. No intention of doing it myself. We need a survey of people fined etc about TV license fees to find out how they were caught or what evidence was provided.
Good Idea to research this. It's apparent many fess up when they're innocent as it's not worth the cost of contesting the non recordable offence.

Live is usually defined as scheduled , watched at the time broadcast , plus one channel’s are classed as live ,
Since cancelling my tv licence 5 months ago only thing I miss is watching the live sports on tv but I can still listen to the sports on the radio instead for free as it’s a lot cheaper than having SkySports and BTsport subscriptions, it would be better if the BBC went subscription only then the tv licence wouldn’t be needed to watch the non BBC tv channels as those that want to watch the BBC they can pay the subscription fee and leave us alone for those that don’t want to watch the BBC, it’s a disgrace that people have to pay a tv licence to watch the other channels as they been broadcast live on tv even if they don’t watch the BBC

It's clearly obvious millions of people have cancelled their TV license; there are about 150,000 houses built every year in the UK with the population increasing by slightly more than that...that will have more than covered the "freeze" in prices therefore there must be far in excess of this cancelling/not paying given how sharply they've been cutting costs.

I canceled my licence two years ago. A couple of weeks ago I received a ‘no licence required’ letter which I ignored, just got another saying they need to hear from me by 17/5/23 or the address will be treated as unlicensed (surely they wouldn’t have to send a letter in the first place because they KNOW I don’t have a licence🤔🤔🤔)
and they may have to open an investigation and schedule a visit (I’m waiting for a similar letter from the DVLA asking me if I need a driving licence)😂😂😂. The letter is addressed to me, not the occupier, they want to know my address, telephone number and email address…do I,
a.) completely ignore it again
b.) respond but, apart from address and name, give a false email and telephone number (why would they want these they know where I live)
c.) respond as b.) above but with a false name as well
d.) just fess up all my correct details and just hope they’ll not bother me for another two years

Today I was at my brother's flat in Braintree to see how he was getting on and the TVL turned up like flies to 💩 demanding to come in as they can hear the TV on? So I went to the door said to the guy, "sorry sir just moved in and replied to your letter that was already sitting here before moved in, so your records is out of date, if you like to know who I am then go check your with your office" I had already seen this guy in Saffron Walden a little while ago with a drone looking into my friend's place, also in a friend's place in Laindon, I've had to check my car and everything as it feels like they have apple tag me or something as it seems this guy is following me everywhere I go? Can these ‘enforcement officers’ working for TV Licensing, get a Court Order to enter the premises, purely on the say-so of a third party? In other words, you have cancelled the license and truly don’t watch live TV or use the iPlayer, but someone (anonymously or otherwise) contacts them to say you do.
No , and they probably wouldn’t try , they would visit and try to find any evidence , if they did would be a summons to court , They rarely go for warrants , less than 100 a year and most warrants are for frequent flyers who have been summoned probably more than once , Third party hearsay evidence whilst considered is at best unreliable ,

It took my partner 3 years to get me to cancel the TV licence. I eventually did.
We've been licence free for 2 years and never looked back. I did ring them and got a £52 refund.
They do keep sending letters saying they are going to come and visit or I need to ring them to let them know I still don't need a licence. Do you have to keep informing them??

The "other methods available" is likely to mean an application for a warrant and, if TV Licensing can convince a magistrate that WOIRA may have been used to cover TV licence evasion, they are likely to get one. I'd be very surprised if the Black Belt Barrister thought WOIRA a good idea, by the way. Thanks for the video and all the best with the house move, CJ.
The solution to that, is to report each letter as harrasment, write the crime reference number and date on the letter and file it.
When you get to, say 5 letters, you send a cease and desist letter to the BBC, with the crime reference number and the dates listed.
Then you do the WOIRA.
So to use the WOIRA to get the warrant they have to make a full disclosure. If they don't reveal the crime reports, the cease and desist, then in my view they are guilty of contempt of court. That would really screw them
@@Nickle314 First, someone in authority would have to agree with you that the letters amount to "harassment". A crime reference number is only given in the case of a suspected crime. Given that these letters have been sent for years, clearly without successful legal challenge, that is very unlikely, so "cease and desist" letters etc. would be a waste of time, effort and and money.
A full disclosure that WOIRA has been used to deny access may be the only reason a magistrate needs to issue a warrant.
I would not advise anybody to follow your advice.

First, the reference number. Report via a police website, you get the reference number. No one involved.
Second, its victim lead. Read the rules, the victim gets to decide, not the police. Home office counting rules are your start point.
The question, how do you get a search warrant. You have to lay evidence before the magistrate. Leaving off major evidence such as a cease and desist letter, WOIRA letter. Being selective in what you use, is contempt of court. Gets lawyers into major problems. You can also check the Bar Council or solicitor's regulatory body. PS, as they say, its not my first rodeo on baristers. I've had two disbarrred.

That's what i would class you as Jon that's working class, i even said as much as i was watching the video before you said. None of this upper middle class rubbish, i too consider myself working class.
I would assume that people who are doing the WOIRA thing, would be doing so in the hope that TVL fall foul of the law by not adhering to the WOIRA as it is intended. Thus making more of a case for the removal of Capita as the 'heavies' for TVL enforcement. Show that they're not doing the job legally sort of thing.
Because let's face it, if a massive majority of people did do the WOIRA it would cause no end of problems for the enforcement agency/s.
