Harassment on the other hand is.
In Law, what they are doing is NOT harassment. People need to educate themselves as this is what gets them in to trouble. Look how many cases those freemen of the land ever won - absolutely none!
@@Bond2025You can legally claim harassment after removing their implied right of access to your property.
After an occasion where they come to the door after you've removed their right of access to the property, you can go to court with a lawyer present and have them go through the motions.
The protection from harassment act 1997 section 1a and 1b states that a person should not act in a manner that amounts to harassment, and that they know or ought to know is harassment.
There is an exception to this where they can claim they were doing it to detect or prevent a crime, however, if they have no access to the property, it isn't a reasonable exception under subsection 3c.
I'm not a lawyer, but I suspect that's how a court case would end up looking like.
You will never get them for harassment because it’s covered in the legal act they do all this.

Why wouldn’t the police officer arrest you for that crime

Cancelled my DD in June this year. Had at least 5 letters in the post, each one getting more threatening. And an "enforcement officer" knocked on my door a couple of weeks ago and hand posted a red and white letter ( no name or house number) more or less accusing me of lying that I wasn't following the ..no licence rules. But I am❓
Have to admit....it's worrying me. But I'm not funding their nonesense. 👍

They'll get tired of trying to intimidate you that way in the end.... and take all of Jon (CJC)'s advice on what to do if you open the door to someone and find it's them. Two very short words... "No thanks" and slam the door closed. Repeat, repeat, repeat.

With the amount of investigations I've had opened on me, I'm surprised the TV licensing people have time to deal with anyone else.

I've lost count of the number of threatening letters I've received I could paper my Walls countless times with them. I will never pay the TV tax and if they are that bothered stop transmitting into my Home!
The letters serve as a nice reminder of how much money you are saving by not having a TV licence; I've saved over £1k.

‘The legal owner’
Not having had a licence ‘ever’… for over 35 years I have received these letters over the years to which I have never ever responded or communicated with them in any shape or form.
[they have no idea who is living at my address or even if it is occupied or not]
They started off being addressed to the legal owner because they don’t know who I am, then suddenly after a few years my name appeared on the envelope as if they had somehow found out I am,
I ignored them as usual… then after several months they reverted back to being addressed to the legal owner again,
Then another couple of years later they again came with the envelopes addressed to me by my name, [again into the bin they went] and then again after a few months they reverted back to being addressed to the legal owner [and so the cycle continued for quite a few years]
I eventually worked out that they must be periodically checking the electoral role with the local council to see who is registered to vote and living at my address, then after failing to get a response my address would go back into the pile of unknown occupants until the next time they check the council register again.
Interestingly they haven’t put my real name on their letters for the last 15 years or so, now it is always addressed to ‘the legal owner’
It makes me think that the more you ignore them the further under their radar you become.
The number of trees they kill to make these letters and the carbon footprint it then takes to deliver said letters is criminal

Nothing less than bullying and thuggery, what a disgusting way to treat people. We should crowd fund a legal challenge in court and sue them.
They claim to 'go easy' on the over 75s and at one time even stated they wouldn't prosecute over 75s, but if you're an over 75 'legal occupier' you'll be getting the same threatening letters, designed to intimidate and mislead, as everybody else.

I'm almost 80, and pay the licence fee simply because I don't want my nervous wife worrying about it, and because she does watch live TV (obsessively.) I hardly watch TV at all.
Allowing the licence to lapse as I simply didn't have the money at the time (neither my energy supplier nor local council having consciences either) I was soon receiving threatening letters by name. So - not just thieves and vagabonds, but liars too.

I actually do feel better after listening to you go through the letters with us. Mine have got more intimidating as time goes on even though I'm following the rules. Even got an unannounced goon knocking, who then posted a warning for good measure, with his "enforcement officer" number on it. I ignored his attempts to get me to answer the door. I object to being called a liar by the biggest lying corporation in the UK.
I just save them up and use them for starting my wood burning stove in winter 😊

I've been watching you on my 40 inch Panasonic TV, but I haven't had a TV licence for 3 years. Only got 9 threatening letters and a visit from a goon before they backed off. I did phone them to tell them, and they basically repeated the same crap from that letter to me over the phone. I always thought sending threatening letters through the post was a criminal offence anyway. Seems that the TV Licencing Stazi can get away with it.
What you do with these litters you put in them in file 13 ) the bin and don't open the door just totally ignore them. ❤
What they are doing by sending letters is not a criminal offence. Your interpretation of the Law in England and Wales is WRONG. This is a mistake many people make, it's similar to people that shout, "I'll sue you" when a person says or does something they do not like!
If you do not want letters, remove any way of posting them through your door.
To clear up a legal point, sending a letter with real threats could be an offence, but advertising services and informing you of company procedures is not.
I really think we should band together and sue the BBC for harassment. As no other company sends letters like this and would not be allowed to. Could you imagine if Netflix sent these type of letters. Come on BBC start doing the right thing and behave in a proper manner.

As an Australian a TV license is nuts. At most we fund our governments TV channel via our taxes. (and I don't even watch it these days) and the privately owned stations make their money from advertising.
I see a lot of these videos and the one thing I never see is the posters telling people to challenge the law in parliament. To get off their backsides and protest. Write to their MP's etc.

The Malicious Communications Act 1988 is a British Act of Parliament that makes it illegal in England and Wales to "send or deliver letters or other articles for the purpose of causing distress or anxiety".
I know, right. Seems they're exempt, as even the police will agree that's exactly what their letters are, and on top of that, blackmail. Until the moment they find out it's the BBC and then they're suddenly no longer interested.

The BBC are the elite, they do what they want.
The airwaves are (or should be) free. They have no right to charge you for such a naturally existing thing, it is like charging you for using oxygen. They are the ones actually using the airwaves, therefore they are the people who should be, if anyone, doing the paying. This is just another example of government exceeding their powers for criminal gain, just like using traffic cops for revenue collection.

The BBC are the architects of their own demise. I remember when they were the gold standard of broadcasting.
I had number 8 today. A red envelope made from some plastic-coated paper with a gel seal, on the front it said they visited me today but none of the boxes on the back saying date & time were filled in, funnily enough it was amongst loads of junk mail in my solo post box screwed to my front locked gate. So, the postman delivered it. 😂

I have 2 indoor paper bins to save on my increasingly failing legs. One in the kitchen, one right next to the front door. Saves time.
My son calls once a fortnight to empty them into the outside recycling bin and wheel it out. Just as well I have a son - neither the council or any other 'caring' body seem to give a bwgger.

@@jackwaycombe If you have mobility issues, your local council or Housing association or the bin collection service itself can arrange for you to have an 'Assisted Pickup'. This means they will collect your bin from anywhere on the street side of your home. It's not ideal but it might help you out.

They only have power if you communicate with them, get yourself a video doorbell and check it every time someone is at the door - if it is a tvl salesperson, don't answer the door.

Personally (at almost 80 and virtually housebound) I think it should be an available aid to the disabled - not necessarily 100% free but at least made affordable.

Not if you're the BBC, report them to the police and the police will say that you are the criminal(despite doing nothing wrong) and the BBC are the victim because you haven't paid for a licence, regardless if you don't need one.

I have had about 20 threatening letters in the 2 years I have lived here, as I do not and never will need a TV licence I just put RTS on the front along with a "do not harass me again" before either popping it in a post box or the recycle bin lol

Students have just come back to sheffield and I have had to deliver a TV licensing letter to every student accommodation, if I see any student as I deliver them I then inform them about the rules and law about not needing a TV licence.
If I can get the message to a few of the students then hopefully they can all spread the message between them and not be tricked into believing they have to have a TV licence.
As well as the students I can't stress how many TV licence letters I'm delivering to other households, it's now very surprising how many people like my self as a postman have stopped paying this corrupt BBC.

I don't contract with the BBC for that, no licence for years. Buying a licence would cause me to act as pseudo trustee - big mistake, I'll remain the beneficiary.
I`ve moved address recently. I cancelled my tv licence while I was at my last address. After a while they sent me those letters addressed to `the legal occupier` despite them knowing who I was. The last few letters were also from the 'Cambridge Enforcement Division' (I`m in Norfolk). I guess this fictional base covers counties in an 80 mile radius. I hate the “guilty until proven innocent " tone of these letters. Not to mention the sheer waste of public money printing and mailing them out.
@chillyjoncarne, many might not know this, but in Gibraltar (UK), residents receive BBC channels (and iplayer) as part of their basic broadband Internet package, no tv license, no extra cost... I could help you investigate this for making everyone even more aware of how much of a scam the TV licensing is!
What is offered for the viewing of BBC channels outside iPlayer? Is it a set top box of some sort? To clarify your vague statement, is it a set top box, a box that plugs directly in to the TV or is it a branded TV package that includes BBC channels as part of the cost? It is important to be accurate and not mislead us all.
If you are referring to a Internet customer having access to BBCi player and others - everyone has this at no extra cost in the UK, as part of the package. The BBC refuses to block iPlayer to people that will not enter their licence number, but don't be caught out on Televisions connected to the Internet if you are asked to "sign-in" or "sign-up" to services and have to put your post code, house number and name for example.

hi. I don't have a shotgun license. Oddly i have never got a letter asking me why. Now i would have thought that owning an unlicensed shotgun would be much more important than owning an unlicensed television. (i don't have a shotgun BTW). and I don't have an explosive license, still no letter / visit. so i can only deduce that the assumption is i am a criminal and his is an accusation of criminal activity. if i ever get a visit or a letter. Just thronging that out there for discussion.

Stalking or harassment offences can be found in sections 2, 2A, 4 and 4A of the Protection from Harassment Act 1997 (PHA 1997) and section 42A (1) Criminal Justice and Police Act 2001.
I agree they are scummy letters, but there is no way you can get a prosecution. If you think you can then you should make a video of it.
The Police, the IOPC, Trading Standards, OFCOM, Action Fraud etc etc, will ignore you or back the BBC. Ignoring the BBC and their meaningless gibberish letters is the only policy. Trust me, they can to jack. They are impotent

However, I used a police website to report each one. I put the reference number on the letter. You need to name the harrasser and she's the head of revenue collection at the beeb.
When I had five, I sent a cease and desist letter to the BBC, ordering them to remove my address under the right to be forgotten.
There's a video online with a goon using the argument, if you let me in to see, we can remove your address.
Town Police Clauses Act 1847 Section 28 is also useful. I chucked that into, along with the withdrawal of implied right of access. Sent to the BBC, and Capita were copied in to as the BBC's agents.
End result, not a single letter.

There have been prosecutions against TVL for mistakes that Capita have made. For example harassment of individuals over unpaid licence fees for deceased relatives. Unless someone knows, I don't think they have ever been prosecuted because of the standard letters.

I wonder how many door to door salesmen quit due to insults (which shouldn't happen, but must) they get as more and more people know how to deal with them. I am sure the turnover of door to door salesmen is quite high

I withdrew their right of implied access 4 years ago when one of the goons knocked and have not had a visit since but I have had dozens of these letters stating they may be visiting and under investigation since which goes straight in the bin. I am now considering in collecting them as evidence of harassment.

I just received one when I returned home after work earlier and it is exactly the same but with my name on it. I will be getting a visit from someone from Dundee which is a two hour drive south from where I live.
I get the letter twice a month, they go straight in the bin. Not had a visit and don't care if I do because there's nothing they can do. It does my head in how many people take this seriously.

If I no longer have a licence and don't need one, can I request they remove my name from their database under a GDPR ruling? Everything else appears to be blamed on that piece of legislation. I appreciate they making keep the address but name?
The real pity is that the intimidation only works one way. Equity would be being able to do the same to them. A letter with words such as “We know where your office is. We know you drive to work. Please ensure your brake pipes are still intact before you drive home. Also, make sure you buy a fire extinguisher on your home” would be reasonable. Best advice if one of the pond life pitches up that you tell them you are removing their implied right of access to your property. Thereafter, any trespass becomes aggravated trespass which is a criminal matter.
Cheers again. I offically told them I no longer required a licence about 4 years ago now got an email back from them confirming I no longer needed one. Since then every single month I've had at least one of these threatening letters come through the mail. So It's pretty pointless even telling them. I mean some of the letters have even said in bright red captal letters all across it saying 'FINAL DEMAND' so everyone can see what mail I'm getting. I've collected them all without opening one. maybe have 40/50 now I'm going to package them up in a box complete with a pile of steaming fresh shite and send them all back to them..F***ing idiots drive me mad

I always remove anything with personal details on it, and shred it. ID theft is one of the biggest forms of crime these days.

A statement is misleading if it creates a false impression, even if the statement is true. It may be misleading because of something contained in the statement or because something is omitted from the statement. Even if it is literally true, it may be misleading because it is uninformative, unclear or deceptive.
The police, OFCOM, Trading Standards, etc. Will back the BBC and ignore you.
It depends on how a person chooses to interpret it. You need to prove the other person intended to mislead, or whether you interpret your lack of understanding as that. Imagine having to read through a list of all the things that could ever be omitted from a statement as they did not apply, it would take years, that is why the agreements and contracts only have the information required in them. It makes it easier to understand.
A statement is not misleading because you either choose to, or genuinely don't understand the wording. You can ask for help to have it explained to you.
They've been investigating my dad for fifteen years now, and still haven't knocked on the door. Not that it will do them any good - Dad died, fifteen and a half years ago.

My son had a similar experience with a flat he rented from a commercial agency in what had been a large house.
The original owner still received regular demands for a TV licence, despite the fact he'd been dead for a decade!

My question is why are they allowed to send these intimidating letters ? If my business sent letters like there's I would have been prosecuted by now so why and how do they get away with it? Ile tell you why, it's because they are in cahoots with the go ver ment that's the reason why

Very nasty, why are they allowed Criminal penalties to force people to pay. It is about time that was stopped.
I cancelled mine over a year ago and have never had a visit or a letter. Just do it. Its not illegal not to have one. If you live in a small Suffolk village like I do they are never gonna be bothered to come all this way.
I'm in Suffolk I've never seen one and haven't had a licence for probably best part of 5 years.
I cancelled my TV license several years ago, got a refund for the time I'd paid for. Yet, they still insist on send "The Legal Occupier" letters, even though they have my name.
It appears they are getting more desperate month after month.
I'd love to see how many cancellations TVL are getting per day.
The letters go in a cycle, I have more than 100. It's gibberish, all of them
i like actually calling them after getting said letter and discussing the exemption status. When they ask for my name, i tell them they can continue to refer to me as The Resident or The Legal Occupant, since for the last 5+ years thats all they refer to me as. Another thing to do is put their letters back in the return envelope and DONT stamp it. The company will then be charged the postal fee to receive the blank unfilled letter.
I suggest searching for "Town Police Clauses Act 1847 Section 28"
It doesn't work like that. They're under no obligation to accept and pay for unstamped mail. And if it's legitimate return to sender mail then there's no charge, the original postage covers that.
The post office don't deliver them
I suggest adding in large writting, Check Enclosed. Then seal with selotape. Don't include the letter etc.

I did this with a lot of unsolicited mail for some years.
It was our postie who told me the RM put the unstamped stuff into separate sacks for returns that are routinely declined en masse.
He assured me it was easier to simply drop the stuff into a bin. Which I now do - into a small bin right next to my front door.

It made me laugh when you said about them, not giving the full information on the letter… It sounds like when they’re reporting on a specific topic and they give their biased opinion rather than all the facts. Maybe that’s what BBC stands for “Bullying Biased Corporation”
They did actually put my name on a letter one time, then it went back to "legal occupier". Strange.
i still remember when i was in uni and my gf at the time had moved into her uni accommodation. and the tv license scum literally just sent these threatening letters to every occupant in the dorms, repeatedly. i think she got one every couple of months.
I was shocked that my gf was so intimidated by them that she asked if we should just pay it.... so these threats must work on so many people, people who don't even have a tv. we literally didn't have a tv in the room and she was so worried about it she was willing to just give them money.
I told her not to worry about it, because they literally don't have the right to come in to your room, even if someone was stupid enough to let them into the "apartment", since each apartment had 4 rooms. your room has a lock that automatically locks when the door closes, and you have the right to refuse entry, and the right to threaten a restraining order should anyone even ever show up and try to con their way in. So i told her to never open the door unless its someone she knows, even if i was there.
I didn't think about it at the time but i should have asked around with the other students and make sure they all know their rights, maybe even have checked with building security that they wouldn't let any tv license employees into the building.
The amount of letters ive received over & over just like, the one you're holding.
By now im expecting an Army of goons to show up.
Never the less as you state its to scare and intimidate , but also (i think, it's to get the occupier to call and divulge one personal info for them then to strengthen further action against you be it an actual visit.
I wonder how much of the TV licence payers money is wasted sending all these letters out?
Off topic, I know. But I do wonder how far that applies to so many 'charities' too...

@@MikeEves sadly I have a wife who demands the ability to watch her beloved F1 live, and until there is another way of doing so, we are stuck paying the licence fee. The annoying part is that she doesn't watch any of it on the BBC, so they get the money, for her to watch it elsewhere!!
Don't know how reliable, but I've seen media reports of Crapitas earning from 20 to 60 million a year from the BBC.
That's a shedload of licence payers' money before they've watched a minute of TV...

Anyone else find the letters go round in circles if you leave them long enough?
Start off all friendly "hello, looks like you may have forgotten to renew your tv licence". Then firmer "there's no record of a TV licence, get licenced now". Then threatening "if you don't get licenced we will be opening an investigation". Then finally, intimidating "an enforcement visit has been scheduled". Then they start again at the beginning "hello, we've noticed your property's not licenced".
8 years I've been unlicensed and under investigation (their investigation must be exceedingly thorough! 😂). Never had a visit but keep holding out hope I might one day so I can slam a door in a Crapita's face!

I,m 3 years into no license and 10 months ago they finally gave up sending me the monthly letters, oh I do miss um 😩😩😩😩😩😩
@@bryangreen9672 don't worry, I'm sure their is just a glitch in their computer and you'll be getting those letters again soon enough, wasting paper killing trees, like with the banks endless letters for loans. They should be locked up for killing those trees alone.

The amount of money they would save in not sending out constant letters, they could scrap the licence altogether.
Apparently, they pay TVL about £2-3 hundred million. Thats would leave them a bit short on the £3.7billion they get each year.
I heard on BBC that they are warning Uni students to get TV licences but not telling them how they may be exempt. A bit sneaky.

So, just for info - in Austria they cancelled the GiS what was basically the equivalent of the TV Licencing people and it has basically become a tax you have to pay to the government.
The ORF - Austrians version of the BBC basically went to the government; and they had to bail them out.
However, now the ORF is state owned and the state is scrutinising every expense, so it's not really a win for them either. The downsite, EVERY household has to pay, it doesn't matter if you watch or not.

I had that same letter last week. I moved address in 2016 and have been "The legal occupier" ever since. I get a threat letter every month, Never had a door knock.(would be a polite "No thanks") Roughly 150 * 7 saved :)
I believe that once you are "the legal occupier" they cannot get a search warrant.
I cancelled my licence on the TV licensing website and I still get letters addressed to the legal occupier.
Just tell 'em you are the illegal occupier!
Cancelled loicence approx 7 years back. Bloke on phone was great tbf. He said to simply ignore any mail. I have kept them all( about 40)and just need another 6 or seven to finish off wall papering the outside lavvy.
Moved into a new place a year ago, thank you very much for making me wake up to the bollocks they wish you to pay for, government state owned monopolies are something I expect in North Korea, not the UK.
They are "investigating" this legal occupier for years, they are even slower than a Government inquiry...STILL not even had a visit...
If you tell them you have a computer or phone or tv they will use that to get a warrant to come and check your equipment it’s best to say nothing
These threatening aggressive letters should be classed under law as harassment and malpractice
