I’m just confused about what’s gonna happen if this lawsuit isn’t dismissed. Like it’s gonna go to discovery. The people behind that documentary channel are probably gonna be asked to testify, and what are they gonna say? “Oh yeah, the only reason we cancelled this deal worth thousands of dollars is because we watched some TikToks and episodes from a UA-cam podcast about what happened.” They’re gonna be like “we saw what she did and heard what she said and chose not to associate with her anymore because we don’t like what she did and said.” I highly doubt they’d testify in favor of Janet and LTM.

I feel like that's really hard. I spoke to a lawyer in IN. She said the number of lawyers that can pass the bar each year is a set number. It prevents too much competition from other lawyers. but then you see some of the yahoos and I agree, HOW!

She went to a bottom 25% law school. People online have said that the school is little more than a diploma mill in that it teaches to pass the bar rather than actually giving you the rounded knowledge that you need. Add to that Janet is a sole practitioner because the firms that she interviewed at were going to start her as a first year and she thought that all of her years being a paralegal (and a patent agent) should have had her higher (she also said that they said it wouldn't be fair to the people who have worked their way up through the intern program for her to just jump them). So she is someone with a big ego and thinks that she knows more than she knows. Sounds like Ben is similar ilk though he did work as an assistant attorney general for 3 years (according to his LinkedIn) so you would think that he would have had the rough edges removed during that time especially as after leaving there he worked as an associate for 9 months before going out on his own (for 1 year now). Or maybe he is too much like Janet and couldn't play well with others and that is why he was an associate for such a short amount of time.

You know how much listening to that would hurt? It would be like a giant vacuum was sucking out my IQ and my will to live.
Someone pointed out what sounds like the Discord alert going off in the background of one of the *wellness check calls. I would love to see that transcript because it sounds like one of them is taking a moment to give info and then the alert goes off, indicating that maybe they were communicating that way while making the calls, but I also want this dismissed. If CK brought something against them for the calls I wonder if that'd come out but realistically that probably wouldn't be worth the hassle for KC.

That would be cool but cellphone records just mean a log of who called who. They don’t include a recording of the phone call or a transcript unless one of the parties on the phone call recorded it themselves. That would be terrifying if you could just go back and pull up any phone conversation that happened between anyone. Text messages and emails though, that’s a different story.

In terms of the perjury claims - in one DCMA claim against the DWKT podcast, Janet claimed to youtube, under threat of perjury, that the DWKT podcast used about an hour of "demps" content. Janet made a mistake, they didn't mention demps in that episode, nor did they use an hour of her content. Janet perjured herself to youtube.
There was a thing there: they said that FB was right to shut Kittie’s account down. But Janet said that YT was not a court and therefore could not make a decision to shut down Mort’s video. Interesting.

I have no doubt that if the Defendant's lawyer was submitting legal work of this poor quality, the judge would not take kindly to it. So why are the plaintiffs getting special treatment???
there are processes that have to be followed from a due process standpoint. if we want this thing to be dismissed with the girlies getting their fees awarded, and we want that to stick, the court HAS TO be methodical about this.

In order to get that kind of dismissal, the courts need to give Janet every opportunity to fix this so that if the courts rule it’s bogus, Janet can’t say “well you were being unfair and didn’t give me enough chances to fix it!” Can’t give any appearance of being unfair to Janet and Company otherwise they’ll save that to try again on appeal. At least, that’s what I think. Again, not a lawyer.

This has been eating at me since this case was first filed. Since Janet and Lauren are co-plaintiffs now, and part of their filing discusses what would otherwise be privileged communications (IE: Lauren hired Braun to file DMCAs, why they both made wellness check calls, etc); at what point does any and all 'Lawyer/Client" communications related to this case become fair game to the defendants?
it will probably be something addressed in a specific hearing on the topic should any claims survive the initial Motions to Dismiss. it will definitely come up in a discovery dispute that will result in a motion to compel or motion for protective order.
